out in front of cameras. you don't want him taking tough questions, on a debate stage there is nobody toe protect him. it is him and donald trump for 90 minutes, bright lights, no teleprompters, no note cards. his wife can't help him answer questions or protect him from the questions. there are no handlers to protect him. really becomes the grittiest part of the campaign. there is no vetting of joe biden whatsoever during the campaign. no traditional campaigning going on. so the american people deserve debates. elizabeth: okay. you know, it comes as former vice president joe biden has had a notable physical absence on the campaign trail. critics are saying you know, he has been accused of not taking questions from reporters, doing scripted interviews. voters deserve to hear about his tax policies, economic policies, his foreign policies. that is it what is going on. is this a replay of what happened in 2012 where the obama

campaign kept biden off the campaign trail? now he is running for president? >> yeah. this is a different issue. he is running for president. and look, they want him to not have to answer questions. they're playing what we call in sports the prevent defense. they're trying to prevent him from making errors, playing error-free baseball trying to keep us off of our game. that is not going to work. this issue, this campaign, will come down to big issues. it will come down whether you want more taxes or lower taxes? it will be whether you want border security or open borders? it will be whether you want law and order or anarchy in the street. the american people are going to choose donald trump and reelect president trump. his record is there. joe biden is grasping desperate left-wing policies. they will lose because of it, liz. elizabeth: okay. biden is sparking concern again with a remark contrasting african-american and latino diversity. let's watch this.

insensitive comments that he makes. elizabeth: all right. this new mistake comes as fall out grows on joe biden first saying in june he is constantly tested for cognitive issues. but then said just this week he is not getting tested. it happened in an interview with cbs newser roll barnett. he compared barnett's question whether someone used cocaine. >> have you taken a cognitive test? >> no, i haven't taken the test. why the hell would i take a test? come on, man! that is like saying before you to the on this program you take a test where you're taking cocaine or not, what do you think, huh? are you a junkie? i'm so forward looking to have an opportunity to sit with the president or stand with the president in debates. there will be plenty of time. by the way, as i joke with him, you know, i shouldn't say, i will say something i, i probably shouldn't say. anyway, i am, i am very willing

from bush to obama. we did not have a peaceful transition of power from obama to trump. the reason why is is because vice president biden, president trump, and national security advisor susan rice began to pick up this, this strategy to go after the trump administration and the trump administration officials during the time where they should have been handing over files to say, hey, coordinate, let's coordinate this policy. let's have a peaceful transition. but instead they act like general flynn was doing secret phone calls with the russians. he was the incoming national security advisor. of course he is talking to the russian ambassador. just so happens when he is talking to the russian ambassador, the russians are concerned about a u.n. vote. what does general flynn say? we have one government at a time. let's escalate this situation. general flynn did exactly what you want him to do on a phone

call with the russians when he is the incoming national security advisor during the presidential transition. what is shameful is that susan rice and joe biden who were all about trying to undo this peaceful transition what they decided to do, and all of their team was create this crazy idea that somehow we were colluding with the russians. that the trump transition team was colluding with the russians. they were coordinating, trying to take over the greatest country in the world through a peaceful transition of power with the current administration who undercut them. it is outrageous. elizabeth: so it was president obama, joe biden, susan rice, meeting in the oval office the day after the fbi decided to drop the case and the probe into

general flynn. you know, all of this was basically based on, you know what was going on with the steele dossier paid for by the democrats. hillary clinton wanted to use the steele opposition research to contest the 2016 election if she lost. somehow that got into its way into the fbi used for fisa wiretaps. your take on former ambassador susan rice a candidate for obama running mate? was the obama team in your estimation only focused on stopping russian meddling? >> look, susan rice's career can be summed up by spying and lying. she was somebody who created an email to herself at 12:15 on the inauguration day. president trump had just become president. she was sitting in the white house and she emailed herself thinking that she was going to make some sort of email for the records to say, we did everything by the book. but what she failed to recognize

is that she was sitting in that chair and emailed at 12:15 when president trump had just taken the oath at noon. so her email to herself was actually written during the trump presidency. this is what the record shows. these are what the facts show. it is outrageous reporters haven't reported this, even though they have seen this. i also ask you this, elizabeth. why in january of 2016 weeks before president trump takes over as president and weeks before the inauguration did vice president joe biden request an unmasking of the russian flynn phone call? all of this is phone. he knew exactly who that was before even asked for the unmasking but he did it anyway. then it was leaked to the media. this is really a problem when your government weaponizes the

let welcome republican ben klein from virginia. on house judiciary. great to see you, sir. great to be back. elizabeth: what is going on with this exchange, sir? great to see you again. >> it appears miss yates was engaging in a little bit of cya. she called out jim comey for calling rogue. that is quite a statement coming from here, when you had comey who was going about things, furthering this investigation, going to interview michael flynn against the recommendations of others. sally yates saying she would not have approved that interview if comey had come to her beforehand. elizabeth: yeah. i mean, sally yates seemed to admit flynn was investigated because of policy differences with incoming trump administration but she couldn't provide any evidence of a crime flynn had committed in talking to the russian ambassador.

government documents said comey said flynn's phone call with the russian ambassador appears legit. flynn was trying to neuter, neuter obama administration sanctions on russia. general flynn's phone call, the documents show he was saying don't escalate. don't escalate those sanctions. we need you on isis. that is the issue too. the brookings institution sir, finds trump administration has beener on russia than obama administration with five actions. >> absolutely true. through the use of sanctions has been tough on russia. the investigation into michael flynn, they knew that flynn was coming in as intelligence chief and he was going to see exactly what they were up to in the fisa warrant process. yates testified that she would not have approved the fisa warrant applications had she known what she knew now. it goes to show that they were

perjury trap. comey said the phone call with the russian ambassador appeared legit. when the fbi wanted to drop the case against general flynn. comey said we'll use the chaos, we'll use the chaos of incoming trump administration to basically go after flynn. also the opposition research, steele dossier paid for by democrats. that seemed to be not addressed by sally yates yesterday. your reaction? >> comey has admitted as much, that he did go rogue. he wanted to use the chaos in between administrations to try to get general flynn in that interview. you have peter strzok's notes. are we trying to get him to tell the truth? are we trying to trap him and charge him? the notes that were taken reveal exactly what their strategy was with general flynn. they knew he was going to find out exactly what abuses were committed with the fisa process and the steele dossier and he was going to hold them to

♪. elizabeth: to the big debate and the fight over mail-in ballots for the 2020 race. look at this, more than 84,000 new york city democrats had their mail-in ballot for the presidential primary tossed out, disqualified. why? they either arrived late, lacked postmarks or lacked signatures. this is according to "the new york post." that shows how problematic mail-in ballots r. as democrats pushed them for the 2020 race. now senator chuck schumer and house speaker nancy pelosi told the administration that the new covid-19 relief bill this friday, tomorrow, must preserve funding for the post office to handle mail-in ballots nationwide and remove new rules they say slow down the mail. let's welcome fox news contributor jason chaffetz. jason, great to have you on here. are we headed for a constitutional crisis with the election? no joke, could the election get lost in the mail? >> look, there are a lot of reasons why mail-in balloting doesn't work. it is totally different than

absentee ballots. that is very different but the post office is not to blame necessarily for that's 84,000 votes. when you don't have signatures, when you don't put a stamp on a letter, and, if you put it in the mail too late, i mean there is only so much the post office can do. i think authenticating the vote should be the driving force for both parties but it is not for the democrats. donald trump has rightly pointed out that mail-in balloting en masse is ripe for fraud. it is absolutely ripe for fraud. you send out millions of ballots. you don't know where they are, you don't have the same mechanisms in place to authenticate the vote which should be the mantra. elizabeth: yeah. you know, there have been more than 1100 criminal cases involving voter fraud in absentee ballots and mail-in ballots over the last few decades. the democrats say post office policies, that will stop, that stop postal workers from working

overtime, instruct them to leave mail at post offices if they're running late that is causing delays in mail delivery. what you're saying it goes beyond that. we seen entire mayoral results tossed out in indiana and illinois because of problems with mail-in ballots. you see what is going on, sir? media narrative going on that mail-in ballots are okay. that they're pristine. that they're good to use, when you're saying and critics are saying no, there are big problems there. what do you think? >> think about it. you take literally millions of ballots, you throw them out into the wind. then you just see what comes back. that is not authenticating the vote. i think there are a lot of other creative ways to do it. some sort of authentication. blockchain technology. voting in person is a good thing. showing identification is a good thing. cleaning up the voter rolls is a good thing. you just want to make sure that everybody has a chance to vote

that is supposed to vote. that those that are fictitious or dead, or voting more than once are called out in this process, but just look at the microcosm of new york. like you said, liz, 84,000 were disqualified. and so, were those bogus? were they just mistakes? i don't think so. there seems to be something there that could be very, very fraudulent, and done en masse on a national election is a problem. elizabeth: it is reportedly 1/5 of the votes collected here in new york in that vote. you know, here's the question, can the post office handle nationwide automatic mail-in ballots for all 50 states? because the american postal workers union now warning they were already delays across the country in mail delivery. house oversight democrats want a new hearing to make sure the post office can handle this. we're seeing that the house democrat campaign chief is saying hey, get ready.

get a vote by mail game going because dozens of races will be determined by mail-in ballots. again, you see the same in the media. that this is not a problem with mail-in ballots. we saw net florida in 2008. mail in votes were rejected twice the rate as those who showed up to vote. "new york times" reported that in 2012. >> well, look, the postal union has endorsed joe biden. so i think republicans have a, you know, a real question mark about postal union people actually being handed these ballots. i think that is a legitimate question. i don't think that is pushing it too far. and there is just been fraught with problems. every single step of the way. it is very different, like i said before. very different than absentee ballots where you actually go, you ask for a ballot. you show identification, do all those types of things, but absent any of those things, even in some states like nevada now,

contributor deneen borelli. welcome back. deneen. what is your reaction when you heard that. >> to me that is common sense. they want law and order. they want to be safe and secure in their own neighborhoods. you have big cities like portland, chicago, new york. they're held hostage in their own homes, liz and you have the left that is constantly pushing to defund the police, disband the police. minneapolis council members for example, voted 12-0 to defund and disband their police department. meanwhile, some of those same members have private security at $4500 a day on taxpayer dime. so how hypocritical is that? they don't care about their constituents. they only care about themselves. elizabeth: yeah. independent journalist michael tracy went on tucker carlson, says "the new york times," "washington post," is not reporting on the devastation left behind by riots in major cities.

that is being ignored. it really affects and harm communities of color for decades to come. joe biden is now saying he is dialing his back on position of redirecting police funding. he is saying now, claiming that he wants to give more money to police for social workers. this idea, deneen. i want your reaction to whether or not biden should not debate president trump? cnn's brian stelter the pressure on joe biden to not debate donald trump is fueled by right-wing media. cnn's own joe lockhart, former clinton press secretary, analyst at cnn, wrote an op-ed for cnn saying don't debate. he appeared on cnn talking about that. democrat mayor. this as gang violence, shootings, murders, homicides hit historic highs in cities like new york. now this, nearly a dozen members or close associates of ms-13 gang were arrested this week for the sex trafficking and sexual exploitation and physical abuse of 13-year-old girl in northern virginia, maryland. the gang allegedly beat her 26 times with a baseball bat as part of a gang initiation and they sex trafficked her. they have major presence in long island and new york city. let's bring in former i.c.e. acting director tom homan. think could kick-start the new york economy. now he is deploying police there to stop them when our violence is taken over the streets of new york city. >> first what de blasio is doing, he already ruined the city. he is sanctuary city.

he and city council will not detain a ms-13 gang member that i.c.e. puts detainer on. so that i.c.e. can pick them up. they will release them in the community to reef open fend. but he will detain law-abiding u.s. citizens based on what criteria, no one knows. interrogate them, where are you going, where are you coming from? you have to self-quarantine. it's a poor plan. it is idiotic he would go there. to take the law enforcement officers off the streets when the crime rate is already skyrocketing in new york, to put them on this boondoggle stops. it is ridiculous roadblocks and checkpoints are legal if you're enforcing the law. this is not the law. this is an executive order. i think it can be beat if someone takes it to court. elizabeth: it is interesting you say that. let me back up. protecting citizens from covid-19 is important but we've got a mayor who is, fair enough to say, he has a tough

relationship with the nypd. he also wants civilian members of the nypd to volunteer for the duty cracking down on tourists when we have ms-13 gang members as initiation using baseball bats to attack people. basically using machetes as part of the initiation to attack people. the justice department, sir, says ms-13 is attacking first immigrant communities here in the u.s. immigrants from central america that they suffer more at the hands of ms-13 than other individuals. so it is basically minorities are getting hit by ms-13 and the mayor is doing what about that? >> you're absolutely right. that is my biggest argument i made for the last three years. when you knowingly release a criminal alien back in the community he is going to reef offend reoffend the community he lives.

you put immigrant community at greater risk of crimes. that is where the victims of crime first were. if mayor de blasio put more resources on roadblocks, take the 22 man protect sieve detail of nypd officers, because he defunded nypd a billion dollars. taking security and safety from new york communities. lead by example, mayor de blasio. defund your protection detail first. put them on the roadblock details. lead by example. if you are going to defund the police, defund your protective detail first. that is the right thing to do but he will never do it. elizabeth: you know, sir, it is textbook that if you have a pandemic there is going to be problems that ensue after a pandemic. you are going to have issues with your local businesses. if you have drug cartels exploiting the u.s. southern border which you have told us about frequently they're exploiting the chaos in u.s. cities suffering from under a pandemic you will have drug gangs pouring into cities here in the u.s. it is happening now.

so isn't there a lack of perspective and focus here on the part of democrat mayors like bill de blasio? >> absolutely. and that is a great question. the data itself, drug smuggling increased on southern border. there is demand taking advantage of the pandemic. this is serious thing the country is dealing with. you have to keep your eye on the ball, to continue to protect your communities. the pandemic is serious but securing your communities, making sure there is law enforcement out there, making sure a system of consequences and deterrents is important or you're going to lose control of the entire city. i think the mayors need to pay attention to the communities, to covid again is very serious. but sew is crime. you can't ignore one in support of the other. elizabeth: tom homan. always great to have you on the show, sir. thank you so much. thank you for your service to our country. great to see you. tom homan there.
