funds for the military budget and raising taxes to awe bollish private -- abolish private health insurance. the trump campaign responding just moments ago to biden's choice writing in a statement that not long ago kamala harris called joe biden a racist and is asked for an apology she never received. clearly, phony kamala will abandon her own morals as well as try to bury her record as a prosecutor in order to appease the anti-police extremists controlling the democrat party. in her failed attempt at running for president, kamala harris gleefully embraced the left's radical manifesto calling for trillions of dollars in new taxes and backing bernie sanders' government takeover of health care. she is proof that joe biden is an empty shell being filled with the extreme agenda of the radicals on the left. president trump is scheduled to hold a news conference later

this hour where we expect he will be asked about today's announcement. and turning to the day's developments, over the past couple of months president trump has condemned the radical left can and their disdain for the rule of law. the left tightening its grip on some of the country's largest democrat-run cities. activists in chicago surrounded a police station, they demanded the release of more than a hundred looters and vandals. one black lives matter organizer defended widespread looting weekend with as a form of reparations. reports today also reare vealing cook county -- revealing cook county state attorney kim fox has dropped felony charges against more than 25,000 defendants over three years. in seattle the radical dem-controlled city council there slashing the police department's budget and its

staff despite a string of recent violence and riots. the lack of respect for police prompting an early less ugh e nation -- resignation of seattle's first female black police chief, carmen best. and portland's new district attorney working to undermine law and order, his name is mike submit, and he's announce -- mike schmidt, and he's announced new policies from groups like antifa and black lives mart. the violation in democrat-run cities also coming close to the white house yesterday. the secret service shot a man near the north lawn, and he was charged today with a assault on a police officer. myron berryman was shot after screaming and running towards secret service, taking something out of his clothing and crouching down into a shooter's stance. the incident broke up president trump's news conference yesterday in the white house

briefing room. the president remained composed and level-headed, dismissing later the possibility that he might be shaken in any way. president trump, eager to get back to talking about the country's historic economic recovery under his leadership. and the dow jones industrials and s&p today after the close up nearly 50%, the nasdaq up about 57% since their bear market lows earlier this year, a sure sign of the v-shaped recovery the president and his administration are promising to deliver for the american people. investors spooked today for a while after the big ten and pac-12 conferences announced they are canceling college sports in the fall. markets fell from intraday highs when they made those announcements that had been reached after news of russia approving a china virus vaccine. questions remain about the safety and the quality of that

vaccine as it has only undergone preliminary early testing. joining us to talk all of this up is white house press secretary cawly mcenaney, and it is great to have you with us. let's start with all of the -- it's great to see you. let's start with all of the violence that is hitting democrat-run cities all across the country that the president and the administration have had to contend with. your thoughts on what the administration's response will be in the days ahead as the violence continues. >> sure. so first let me note just how appalling the status quo is. you had in chicago the derelict mayor breaking up a beach party as her city was being looted. her city two nights in a rowing being looted. over in seattle, as you know, slashing the budget for the have had. seattle, of course, known for the c.h.o.p. zone where two

young men lost their lives, and police couldn't even reach them. their police department is one of the most diverse in the nation known for hiring a number of black men and women who have been hailed as a real model for how to do things. this would mean they cut that police department by 100 officers. it's appalling as murders skyrocket in these democrat cities. what we're doing here at the administration, we put in place operation legend. we're limited what we can do in our federal policy, but we've deployeded extra fbi personnel and federal agents, and so far they're arrested 250, charged 250, and they'll continue to be hard at work in assisting these hoping police departments. lou: well, and speaking of arrests and the number of cities that seem to be hell bent on cutting their police departments, in chicago we learned that state's attorney kim fox has dropped over 25,000 felony charges in three years in that role.

it looks like they could slash the prosecutor's office budgets as well. your reaction. >> what a complete and utter insult to the men and women, the young children, some toddlers who have lost their lives in the streets because of this lawlessness. and you have a prosecutor dropping charges which sends a signal to every criminal across chicago that their actions will not received a adequate relate ily abuse, that they will not be hell to the standard of justice in a court of law. it's disgusting and it does an absolute disservice to the younged toddlers, little boys and girls who lost their lives because of the derelict mayor, the prosecutor and people who clearly don't care about law and order in their streets. lou: the president, as the law and order president, has to, he has some difficult decisions ahead of him. withdrawing federal law enforcement officers and agents from porthand, the result has been over -- portland, the

result has been over the past over a week now a deck la la ration of a riot by the local police department every evening since they have withdrawn. how much more can the country put up with? >> yeah. so so those federal agents are there, and their only jurisdiction is to protect that courthouse. so what we've seen with these riots are they've been happening in places far away from the courthouse or at least not there in the immediate jurisdiction of the officers, and what we've seen are finally mayor wheeler -- who used to march alongside these rioters that he calledded peaceful protesters -- finally admitting that when you lock people in a building, 20 federal officers and civilians in a building, try to set the building on fire, you finally have the mayor after 73 days calling this attempted murder. it's unacceptable, and it's up to the mayor to control his streets. lou: well, it may be up to him, but those streets remain well out of his control or anyone else's.

firmly in control of the swamp. also breaking tonight, attorney general william barr has undisclosed reasons for dismissing the case against general michael flynn tied to other investigations. barr's acting solicitor general jeff wall today revealed during the hearing with the full d.c. appellate court on whether to force judge emmet sullivan to dismiss general flynn's case. flynn's attorney, sidney powell, told the court today, quote: general flynn is a defendant without a prosecutor. only the department of justice can decide the public interest and more idea factors -- myriad factors inherent in pursuing a prosecution. there are no circumstances now under which judge sullivan can continue on this case because his bias demands disqualification. joining us now siny powell -- sidney powell, attorney for general michael flynn and a former federal prosecutor, best selling author.

sid, it's great to see you. >> thanks, lou. lou: i just, just looking over some of the statements from the d.c. appellate court judges. you are up against, you're outnumbered, without question, and they're not even trying to disguise their political bias from the bench, are they? >> there was certainly a lot of questions, lou. i will have to leave it to individuals to listen to it, and i would encourage people really to listen to the arguments to understand how our court system is working or not working, as the case a may be. because the rule of law is what separates us from countries like colombia and venezuela and failed states. we have to have a functioning rule of law that holds everyone accountable in the same way and not break rules for somebody just because it's michael flynn who was prosecuted when there was no case to prosecute.

the government has now recognized that. the government moved to dismiss it back on may 7th, and we haven't been able to get the dismissal granted yet. and the court has no role in that -- lou: well, you have a politically -- is it unfair of me to say that it's pretty obvious to all of us who watch and follow and read about this case that judge emmet sullivan -- and i know at one time he was a here -- hero of yours, but he has behaved as a monster of the left in this case. it is despicable what he has done. it is a disgraces to the judiciary, and some of the judges on in this d.c. appellate court en banc at today's hearing, i'm amused by the fact that they can't speak plain english or plain american from the bench. but i think it couldn't be much plainer to hear what cornelia hill ard, the judge said to you today, and i'd like us to pulse that up as a a -- put that up as

a full screen, if you would, the quote. she said this: it's the core of any judge's job to assess cases and view the strongest arguments that can be made on both sides. your position, speaking to you, is, no, he can't hear both sides from the law, he has to drop the case like a hot potato without adversary closing argument. what in the heck kind of -- [inaudible] is that? >> well, i was certainly perplexed by that question because one of the requirements in our constitution that there be an actual case in controversy. there's no controversy between the defendant and the government anymore. they both agreed that the case should be dropped. and so since only the government can be required to prosecute something, i mean, it can't be required to prosecute something by the court, it can only do it if it chooses to do it, there's nothing left to litigate x.

that's why every single case in the country in which the government has ever moved to dismiss a criminal case at any stage of the case even after conviction and sentencing and on certiorari, the government gets that dismissal. all dismissals are granted. lou: how many irregular decisionses haves judge sullivan made at this point in the case that defy precedent and law? >> well, certainly his appointment of an amicus to stand in the stead of the government was highly regular, his solicitation of amicus briefs by anybody who wanted to file one in a criminal case was highly irregular. when the court told him by mandamus to the panel to grant dismissal, he didn't do that. he instead on his own, as if he were a party as if he's not, he filed a petition --

lou: and it's been heard. >> yes. that's what we were in court for today. lou: and that's insane. it's not only unprecedented and not part of procedure, it's just crazy. and good for them, i mean, they've got 70% of the judges on the bank, as it were, judging the -- [laughter] i don't know what the hell they're judging, to be honest with you. the political winds, i suppose, and their preferences. we have now a judiciary that is showing itself to be rotten in political corruption, just as rotten as the former officialdom of the fbi and the justice department. the american people right now are about to become physically ill looking at what was once a judicial system that was the finest in all the world. an fbi that was storied in bravery and achievement, and it is rotten. and it may be rotten to the core for all we know. and now we have special, special

investigators assigned, john durham, to investigate the origins of obamagate, and it looks like that's going to be a whitewash of the highest order. we not only lost our integrity, we have lost our guts. i am deeply concerned about the tate of -- the state of our judiciary, the state of the justice department and the fbi. i believe most americans feel much the way i do. your thoughts. >> i'm very concerned too, lou. i have always held our judiciary in the highest regard, i still do, i still want to, and i understand that sometimes they ask questions to test both sides that don't reflect what they think at all. but it's very important that they put politics out of this and decide the case as if it were john doe as opposed to creating a michael flynn exception to the rule of law that doesn't apply to anyone else. they wouldn't want it applied to

someone in their own family if they were in this situation. this has taken four years of the life of a dedicated american patriot who has just done everything humanly possible to serve his country. and it was started by an investigation that was corrupt from the beginning. they had no basis to investigate, and then they made up the false statements against him, and now the government's finally admitted the wrongs and wants to set it right, and we can't get the district judge to issue the order of dismissal when every case in the country the dismissal has to be grant canned. it's always granted because no court can make the government prosecute a case. to it's beyond with frustrating, to saw the least, that we're till here -- lou: it's -- >> -- three months later trying to get a case dismissed that can't be prosecuted and should never have been prosecuted in the first place. lou: well, there's something wrong as well with the highest court in the land, in my opinion. i don't know what the law calls for, i don't know the properer

intelligence community has found a way to provide the committee, the house intelligence committee, access to all of the documents it has requested for the investigation including raw intelligence. i find it interesting that the fbi and justice are taking a different approach. joining us now is congressman devin nuñes, ranking member of the house intelligence committee. congressman, great to have you with us. finish this is, this is -- well, first, i want to start where i left off with sidney powell. this is a rotten judiciary, politically corrupt as any agency or department within the federal government, it appears to me. i would love to have your reaction to what we have seen in part in these statements from the d.c. court of appeals regarding the hearing today, an uns precedented hearing, by the

way in law or in practice. >> yeah. thank you, lou, thanks for having me on. first of all, we shouldn't be here today, yen flynn should not be here. we've talked about out many times on your show. but you brought up something, i was able to hear you in the last session isment as i was preparing to come on the show. you bring up something very important and that is the judiciary e system of government, that third branch, that holy grail. it slowly has become corrupted. the democrats seem to put on judges that are purely political, that clear ily make political decisions. the republicans seem to put on, you know, outside of very rare cases, i think you'd have to go back to justice scalia are, perhaps justice thomas, we put on people that seem to be afraid of the mainstream media. to whether it's, you know, whether it's this decision with flynn, if you look at the recent, some of the recent supreme court cases, if you look at some of the bush appointees and even some of trump's

appointees, we continue to see we're putting on -- i'm glad that we're putting on and the senate has put on hundreds of judges, a record of judges, but that only matters if they're not weak judges because clearly what's happened here is the judicial system has become completely politicized from top to bottom, and that doesn't include the challenges that we have with the department of justice and the fbi that you're very well aware of. lou: yeah. it is, it is deeply troubling to see mob rule in the streets, to see the number of democrat-run cities in this country that are given over to street violence, to vandalism, looting, and it is pure, raw thuggery and an effort to intimidate not only local officials, but to intimidate all of government and citizens across this country. and it's going without response, and it's deeply troubling.

and as you talk about the strength of justices on the supreme court or the strength and character and integrity of the d.c. appellate court, the swim caution factor -- intimidation factor large. we don't have to think back too far to recall what happened to justice kavanaugh in his confirmation hearing. >> right. lou: it was an outright bloodletting from which i don't think any of us would blame him for still not having quite recovered from it. >> well, and, lou -- [inaudible conversations] lou: i'm, go ahead. >> well, just on kavanaugh before we get to that, i mean, you would think after watching what judge kavanaugh, his family went through the, that these new trump judges at least would be out there saying, look, enough is enough. that there would be somebody, anyone out there of these new judges that would be saying this is it, i mean, let's leave general flynn alone. you can't just have a wild judge that's gone totally crazy that's trying to prosecute a case himself. by the way, that's exactly what

and rioting taking place in the democrat-controlled cities of new york, portland, chicago and seattle. the mayors and governors of these states and cities have an absolute duty to use all resources necessary to end the violence and all of the injury and death. new york city has an army of great police. i know them very well. expect law enforcement and the new york's finest are are as good as it gets, and they should be allowed to do their job. if they do their job, if they're allowed to do their job, the new york city problem will be solved,s and it will be solved quickly. they do it well. the mayor, bill de blasio, should immediately hire back all of the police who were fired without justification. they were fired. i guess that's part of defund the police by the democrats.

they should hire new york city's finest back. you have some incredible policemen doing specific jobs that nobody else can do, actually. when it comes to terrorism and other things. together the few of chicago -- the city of chicago expect tate of illinois have have 25,000 police officers, sheriffs and guardsmen available to quell any violence. they can do it very quickly, very easily if allowed to do their jobs. again, if allowed to do their jobs. their police, law enforcement is incredible, but they have to be allowed to do their jobs. the democrats or the radical left democrats who are both becoming one and the same if you look at election results, the democrats are being taken over by the radical left. the city of porthand expect state of -- portland and the state of oregon have 10,000 fine officers and guardsmen available. seattle, washington and washington state is have 10,000 available. is so seattle, the city of

seattle in washington state itself, they have great people. they have to be allowed to do their job. i'm urging them to deploy these resources to protect their citizens and to stop the violence can and all of the things that we a watch on television going on although a lot of the, unfortunately, fake news don't like to put it on because it shows that the democrats are doing a very bad job of law enforcement. they have to put it on. they have to be honest with the people of this country. but i'm offering all available federal support requested to stop the violence and arrest the criminals. we have to be asked by the governors or the mayors, and we'll be this very rapidly -- be there very rapidly. it's ready, willing and able. we're all ready, willing and able to go to these jurisdictions and take care of them. we'll do them very quickly. you saw what happened in minneapolis. they ripped the city apart when the national guard went in, it

ended immediately. it was immediate. and lasted. these acts of destruction are not isolated incidents, but demonstrate the pattern of violent, left-wing extremism that you get to see if you're watching the right news program. under any rational definition, the arson attack on the police precinct in portland would be considered an act of left-wing domestic terrorism. they really are anarchists. these are left-wing anarchists. they are an around cuss. and i'm directing the department of justice to stop these anarchists immediately can and to work with the city expect state to get -- and the state to get the job done. local authorities have the investigate and prosecute all of these crimes immediately. we'll work with you.

see ads attacking your president. it's very simple, it means drug prices are going to fall very s. -- are going to be falling very soon. i'm pleased to announce we have reached an agreement with moderna to manufacture and deliver 10 million doses -- 100 million doses of their coronavirus vaccine candidate. the federal government will own these vaccine doses. we're buying them. recently we also secured partnerships with johnson & johnson as well as sanofi and gsx to support the large scale manufacturing of their having seens. doing very well on those vaccines. tremendous programs in every single one of them, and we have many of them. and they're years ahead of schedule. this would have been if it were in the previous administration or new ecoof the previous administrations -- any of the previous administrations would have taken years. three vaccine candidates are are now in phase three trials already, the final stage of

clinical trials. this is the final stage. we are investing in the development and manufacture of the top six vaccine candidates to insure rapid delivery. the military is ready to go, they're ready to deliver a vaccine to americans as soon as one is fully approved by the fda, and we're moving very close to that approval. we're on track to rapidly produce 100 million doses as soon as the vaccine is approved and up to 500 million shortly thereafter. to we'll have 600 million doses. operation warp speed is the largest and most advanced operation of its kind anywhere in the world and anywhere in history. we've treated more than 86,000 americans with convalescent plasma. a recent maw owe clinic -- mayo clinic study found this treatment may produce results which are incredible. we look to a reduction in

so we've increased by 50%, more than, since just march. it has gained approximately 9,500 points since that same period, march, and has recovered nearly all of its value since the virus struck the our nation. new of that. america's economy is incredible. and its economic recovery is outpacing our peer nations. last quarter the european union's gdp declined, was nearly 40%. worse than the united states. so it's 40% worse than the united states. we built such a strong base that we're able to do things and sustain better than anybody in the world by far. france's gdp decline was nearly 80% worse than ours and spain experienced an economic contraction twice as severe as the united states. nation wide we continue to see improvements in our fight against the pandemic, very substantial improvements.

since last week 87% of the counties in the united states report declining cases. think of that, 87% of the counties in the united states. they reported declining cases. mortality has declined by 7%, and hospitalizations are declining rapidly. states that were primary hot spots such as florida, texas and arizona have reduced cases by nearly 25%. but all americans must remain vigilant, practice good hygiene, socially distance, wear a mask whenever possible, whenever you are getting too close to poem. wear a mask and protect the elderly. always protect the elderly. since the end of july, the seven-day average for causes in the united states has fallen by nearly 20%. but the virus continues to

increase in nations across the globe. last week france and germany both recorded their highest daily number of new cases in three months. not that i want to bring that up, but might as well explain it to the media. the seven-day case average for germany has uncreased by 62% -- increased by 62% since last week, unfortunately. and that is truly unfortunate. it's increased 82% in france, 1 13% in spain and 30% in the united kingdom. those are big increases. cases are also rapidly increasing in the netherlands are, sweden, belgium, switzerland, slovakia, estonia and other european countries. and in our country they're going down. we will be seeing that even more rapidly as time goes by, a short time. even though america is the largest at-risk population including 1.5 million residents

of nursing homes, about five times that of other european countries, europe has experienced a nearly 40% higher excess or mortality rate than the united states. we also is have fewer deaths for capita, excluding the disastrous deaths from the new york tristate area which had a very, very hard time. and did better than our peer nations of western europe thanks to our excellent and high hi advanced medical care and skill, something that the news doesn't tell you. they don't like to tell you that. the united states has now conducted more than 66 million tests, far more than any other nation in the world. india, which has a population of 1.5 billion people, has done 24 million. so we're at 66 million. and think of it, india's at 24 million, and india's second.

the entire region of latin america comprising 33 countries, has conducted 25 million tests, yet latin america has more confirmed cases by far than the united states. as we seiche my reopen our schools and hopefully we can watch colleges play football. we want to get football in colleges. these are young, strong people. they won't have a big problem with the china virus. so we want to see college football start and, hopefully, a lot of great people are going to be out there. they're going to be out there playing football, and they'll be able to fight it off and, hopefully, it won't bother them one bit. most of them will never get it statistically. but we know we'll see more cases at some point, and we will eventually develop sufficient

immunity in addition to everything else that we're doing. so college football, get out there and play football. people want to see it. and stand for your american flag, stand for your national anthem because people are not happy when that doesn't happen. you look at nba and their poor ratings. i don't know, can't imagine why, but they didn't stand, they didn't show respect to our flag, they didn't show respect to our national anthem. and maybe that's having an impact. trust just not good. the nfl had its problems two years ago when that happened. i think went way down in their ratings and their fans, and they struggled back, and now all of a sudden they're pussinging themselves in the same position. stand for the flag and for the national anthem, and i think you're going to do fantastically well. a lot of people aren't going to watch if you don't. i'm one of them. that's why our strategy and attention are focused on

preventing the cases that are most likely to require discussing the opening of schools, hospitalizations produced, any death. we have to maintain vigilance over our elderly population. we've personned that more than any single event, scott. we have to be very vigilant all over, but we have to really protect our elderrerly population and especially our elderly population that has problems with heart, lung, any form of sickness, diabetes in particular. and we are at the same time in very good shape with respect to hospital room and hospital overcrowding. we're in great shape. on the nursing home front, protecting our nursing home residents is a critical focus of our strategy. healthhhs recently announced thy

will use the provider relief fund to deliver an additional $5 billion to further protect nursing homes and long-term capabilities as they continue to combat the china virus. we've delivered over 1,800 rapid point of care nursing ca quites to nursing homes, be we're in the process of delivering these to all 15,000 medicare and medicaid-certified nursing homes by the end of september. so they're going to have very, very rapid test. they won't have to wait around two, three, four days, and that number has come down substantially compared to what it was. you get accurate tests but it takes a period of time to send it, to check it and to send it back. now we're senting are, very rapid tests, 5 minutes to 15 minutes. we will care for america's
