the united states. we will give tax credits to companies. reporter: all of this said it is joe biden who has been leading in the polls here in pennsylvania. we've been around the state talking to a number of voters here the last couple of nights ahead of the former vice president's speech tonight. we even stopped by his old neighborhood, drove by the old biden childhood home earlier today. he moved away when he was 11 years old. you speak to the biden supporters, they say they want change. it is trump supporters who will probably decide this election this time around in a state like pennsylvania, the ones who voted for him last time. some of those trump supporters do say they have soured in some ways on the president. however, many of those same people who are starting to turn on president trump when we speak to them in voter interviews they say they have not quite jumped on the biden bandwagon. the former vice president gets his biggest chance to make the case tonight at the convention.

♪. david: former fbi attorney kevin clinesmith will be sentenced september 10th for doctoring a document to justify surveillance of former trump campaign advisor carter page. the charge he faces a maximum of five years in prison but reports say it is unlikely he will serve that much, if any jail time. it is the first criminal case to come from u.s. attorney john durham's investigation into the origins of the trump-russia probe but many democrats still refuse to admit there was any wrongdoing under the obama administration. here is illinois senator dick durbin speaking to this point on fox news this morning. >> when it comes to spying on the trump campaign, here is what it boiled down to the intelligence agencies were in fact monitoring conversations of the russian ambassador to the united states and when that ambassador engaged with general kelly they picked up on the

source of wealth. all they do is take what other people have made and spread it out a little, right? >> well, absolutely f you don't have economy where private sector businesses are growing, hiring, creating jobs, creating that competition for workers that causes wages to go up like we had before the pandemic, then you end up with a terrible economy that obama left for president trump. the last year i believe, gdp was 1.6% under president obama. if the labor participation rate had been the same as he left office when he took office, unemployment with be 9%. they have got this fantasy vision that government can create jobs. that government can create private sector growth. and it can't. they don't have one program, not one program, not one policy that would incentivize private sector businesses to grow or create jobs. all of their plans are, you grow government, you increase taxes to pay for it, which again,

discourages growth. it doesn't encourage it. david: not only discourages growth. it sends people packing. individuals and companies pack their bags and they move. that is why we had the greatest job creation ever in this country under the first three years of trump because he lowered the tax rates and brought companies back from places like ireland that had lower rates. >> that is absolutely the case. we're seeing it now with cities across the united states. i read today that in san francisco, which has a very high tax rate, the number of homes for sale are up 200% from last year. people are leaving high-taxed, high violence areas in the united states like chicago. lou: like new york, like san francisco and moving to places like nashville or like dallas, texas or down to florida, where you have a friendlier business environment, a friendlier tax environment. if the national policy becomes like the policies in these democrat-controlled cities, a lot of people are going to leave

president trump: they're going to pay at the border, at the gate. cars going through. we may do a toll for money being sent back and forth. they will pay for it. david: interesting idea. president trump floating idea of adding a toll at the border crossings paying for the wall. as department of defense inspector general confirming that sending troops down to the border is in fact legal. joining me to discuss it at all, retired acting i.c.e. homeland director tom homan. so much to discuss. can a cross-border tax pay for the wall? >> it would help pay for the well but we got to remember country of mexico is paying a lot of that wall, sending troops from the southern border to the northern border. remain in mexico. all the people claiming asylum. mexico acree he had to all of

this, i.c.e. detention is 35% of where they were last year. take cost of detention and medical care which is around $3 billion, the country of mexico has that down half. i.c.e. already saved over a billion dollars, close to two billion dollars. if you add the court costs, immigration courts, medical expenses, social services mexico is already saving this country billions of dollar, one way they are paying for that wall. david: interesting, interesting. second, military deployments at the border. apparently they're a go now according to a new ruling, right? >> i think they should be. look, people need to understand border security is national security. they need to understand that, during that crisis last year where we had thousands of family units coming through. david: caravans. >> over half, yeah, they said over half of the border patrol agents were no longer on the line taking care of family groups, changing diapers, making formula. when half the border patrol is not on the line, the line is vulnerable to terrorism, drugs.

that humanitarian issue, quickly changed into a national security issue. so having the military on the border, i think addresses a national security concern. so i think it's a good idea. david: that is extraordinary. we've been dealing with these problems for years, for decades, really. this is a president who said he was going to deal with it. he has been dealing with it. this is a real, important, accomplishment. mean while, we still have these attacks on i.c.e. this must be killing you, tom. former acting i.c.e. director. meanwhile, this is portland. i believe this is the one we saw in portland where, an i.c.e. building was attacked. with he saw that group in bend oregon surrounded ice agents prevented them from getting really bad hombres. they eventually got them. what you do make of the attacks on i.c.e.? >> first of all, your comments on the president, i worked for six presidents from ronald reagan. no president has done more to secure our border than donald trump. that is a stone cold fact.

i worked for six of them. as far as the attacks on i.c.e., it's a shame. if these people study did, like the issue in oregon, they're stopping this bus, letting i.c.e. do their job for hours. they are criminals on the bus. i.c.e. is protecting their community, taking criminals off the streets in their community. they ought to be thanking us. if they want to effect change. you will not bully i.c.e. doing their job. you don't like what i.c.e. does. go protell capitol hill to change the law. david: bingo. >> i.c.e. is enforcing laws enacted by congress. david: exactly. we have only a minute to go. we have the story about bannon, steve bannon getting arrested for this build the wall campaign, apparently was a scheme that he was involved with, siphoning money from this. the president back in july wrote the following, i disagreed with doing this very small section of the wall in a tricky area by a private group which raised money by ads. it was only done to make me look bad.

perhaps now it doesn't even work. should have been built like the rest of the wall, 500 plus miles. do you agree with the president, this was something that even, if it hadn't been found out to be a scheme it was a bad idea? >> first of all, steve bannon is found wrong and proven he needs to be held accountable. they spent two years looking prototypes what they want for border barrier. the experts on the border patrol tests nine different prototypes. they came up with what they want. this private project wasn't nor is near what the border patrol already studied and tested and wanted. i agree with the president. it doesn't follow the format of what the border patrol really wanted and studied. david: tom homan. we did it. covered four subjects in three minutes. final comment. you guys in i.c.e. and border security deserve our support and respect in never way possible. i thank you for your service, tom. i got to move on. i have to say that before we
