jacob blake. the damage came from riots. jacob blake is a black man. he was shot in the back. kenosha's democrat mayor, quote, the national guard has been extremely helpful keeping order in the city. i want your thoughts on homeland security probing who was paying these rioters? 2/3 of those arrested came from 44 cities outside of kenosha? >> that is correct and they are right to begin this. we have asked back when the rioting started, there were some of us that said we need to be looking into who is paying for this because those -- leaders for the riots, they were well-organized, they had earpieces and equipment and backpacks. they were coming in from various areas. they were getting equipment or bricks, pallets of bricks, batons, things of that nature, dropped into city centers and, you knew someone was

coordinating this. that meant somebody had to be splitting the bill. it is right to be looking into who is paying for this because, it is costing cities like kenosha and portland and so many others thousands of dollars in order to pay for the added law enforcement and protection that is necessary when you have this type lawlessness on your city streets. elizabeth: yeah the question, should they be charged with racketeering and conspiracy because it happened again in portland yesterday. 100 straight days of riots. rioters showed up, hundreds of them at the condo building where democrat mayor ted wheeler lives. they used baseball bats to smash into his apartment building. though didn't get into his residence, it was down on a first floor. demanding his resignation. the mayor of portland doubles as the police commissioner too, he is mayor and police

commissioner. he ordered no police to show up, basically de-escalate this. is he taking political approach to letting riots get out of hand? >> here is what i think has happened. the democratic party did not condemn these actions and they let it go on. now they have been emboldened these revolutionaries and anarchists that have taken to the city streets. they have lost control. they have lost control of the situations. they have lost control of the messaging around this. and you have to realize everyone of these cities are blue cities. these are democratic cities. and these are problems and things that i think have been escalating for quite a period of time. it didn't just start today or yesterday. this is something that has been bubbling under the surface. indeed, you know, when you go back and look at some of the

words and choices of words that were said after donald trump was elected president. we had democrats that never accepted that he won that election. and there were calls to impeach 45, to shout at members of congress. that is what they asked for. this is what is happening now but it is also happening to some of these democratic leaders such as the mayor of portland. elizabeth: homeland secured is saying to portland, either stop the riots or we'll send federal officials in. biden is getting criticized not condemning attacks on police officers. let's show weapons used to attack police officers. let's show the viewer that. basically not that they're left-wing rioters, that they're antifa. criminal justice reformed a very cat alice johnson, she was reportedly accosted after the gop convention. she is about 65. she was granted clemency by the

♪. elizabeth: welcome back. coming in the bottom of the hour let's get you up to speed what happened with the justice department and fbi today. they announced they are moving faster and harder to stop fbi abuses of the fisa court, things like committing perjury, knowingly misleading the fisa court when it comes to using fisa court wiretaps meant for terrorists on political campaigns.

we found 200 errors in fisa court applications according to reviews in government documents. that is what we're finding at "the evening edit." we'll stay on that story for you as the durham report is coming out maybe september 4th. we're staying on the story. more on federal appeals court rejecting effort by general michael flynn's team to get his criminal case dismissed. the justice department decided to throw out flynn's case because the flynn was a victim of a wrongful prosecution. the fbi agents found flynn did not mislead those agents. here is what is going on, district court, d.c. court of appeals judge blasted the court causing inquisition into flynn by u.s. judge emmet sullivan. accuses general flynn out proof of quote treason. with me now former independent counsel and former counsel to president trump. back with us, ken starr. always great to have you on. we love your insights. what were your thoughts when you heard this? >> i wasn't surprised but i was

really disappointed. this was kind of a long pass right into coverage, namely to try to get this unprecedented kind of relief. it is unusual to get this kind of relief from the court. having said this is unprecedented set of circumstances poor general flynn has been facing. i'm very disappointed in the majority. i wish every american, liz, would read judge karen henderson's opinion and as well as judge naomi rau's dissenting opinion. read the majority opinion which does not have an author. that tells you something right there, doesn't it. no one said i'm the author of the majority opinion. elizabeth: you know, judge emmet sullivan just made a ruling today, procedural one, the plain case looks like it is in abeyance. won't be decided until after the election. he is victim of unlawful prosecution. he withdrew the guilty plea that he lied to federal investigators

after declassified documents showed misconduct in the fbi under the obama administration. they tried to coerce flynn into jury trap. they tried to get him to lie after fbi agents said he didn't mislead us when we first interviewed. judge rao said the case should be tossed because of irregularities by the fbi and judge emmet sullivan? >> i completely agree with this. they took a fresh review with united states attorney. he was unanimously confirmed to the united states senate to his post. he comes from the outside, he find this is prosecution, i'm using the term evil. it is so wrong. it is morally and legally wrong. it never should have been brought. so yes, it should be dismissed but here's the key in our separation of powers system, liz, as you know. this is the justice department's call. some thing judges are called to do. what judge sullivan is doing way outside of the boundary line, the court of appeals be should

not be countenancing this. the only silver lining, is, it will be decided with reasonable dispatch. i don't think it will be a slow walk to the election before judge sullivan has to come to grips with this. elizabeth: all right. so the declassified government documents that we reviewed showed that flynn was railroaded. that he was set up and framed with false accusations after the fbi was going to drop the case, after james comey said, his phone call with the russian ambassador, quote, appeared legitimate. then president obama said to james comey, quote, get the right people on it. get them, in other words, the fbi agents led by peter strzok tried to get michael flynn to lie. tried to get him to lie, committing a lie to federal fbi investigators. they didn't read him his miranda rights. they turned a briefing into a criminal interview. he had no defense attorney present.

it was just a briefing. your reaction to all of that. >> totally irregular, totally improper, and james comey is completely to blame. this again should not have happened. the very idea now we know thanks to declassification that the president of the united states, president obama, was himself while he was supposedly saying go by the book, all that, he was interested in an investigation of michael flynn. the president should have been cooperating with the incoming trump administration. instead they were engaging in very questionable irregular behavior. shame on that outgoing administration. elizabeth: sir what do you think of the judge emmet sullivan on this case? you know has expressed bias against general flynn. should this case be removed from judge sullivan? >> it should have been. when i went back to see what he, judge sullivan had said at that

initial sentencing, that had been scheduled, of course it has never come about, it is extraordinary what he said. he accuse general flynn, this patriot, of treason. and he was saying the most disgusting things about a patriot. how dare he do that? so i think he went outside of the bounds. one of the judges in dissent just nailed it very well and just talking about, how can there be an appearance of impartiality which is what judges are called upon to do? yes, they can have strong feelings but they have to do their very best at a moral and professional level to be impartial, and equally important, to give the appearance of impartiality. judge sullivan, who i know, who has had a very distinguished record has just gone off the rails on this and he should, he should step aside on his own but the court of appeals, i think basically said, hurry up and

what is your reaction to all of this? >> keep in mind, adam schiff from california selectively leaked and lied, the reason he does this because he has always gotten away with it. he gets away with it in two different ways. a, his media only reports on what he claims is the wrongdoing of republicans. then beyond that, he hasn't been charged with a crime. so this is right out of the playbook. it doesn't matter what they do. it just matters what sensation they can cause by claiming republicans are committing a crime. i hope these referrals that dni ratcliff is talking about actually gets done because it hurts the republican base when these things don't wind up with actual charges. elizabeth: okay. dni ratcliff says he has cases of illegal leaks by members about congress. he has launched criminal reports on illegal leaks. there are investigations

underway. former republican congressman jason chaffetz says to your point democrat adam schiff should be prosecuted. lose security clearance for leaking to the media. here is what dni ratcliff says, he is saying he wants to stop what happened a month ago. he gave a briefing with all members of congress. within minutes they leaked to media sensitive classified information, creating a false narrative that russia is still a threat to help trump. when intelligence officials say china is the bigger national security threat. your reaction? >> that is exactly their gameplan. they, first of all, they want to delegitimatize the coming victory of trump. so they're already claiming once again that russia is involved. when they make that incendiary false comment, they are committing a crime in the process and they get away with that. so their best defense an offense. doesn't matter if we're economisting a crime, because we think the trump campaign is in

that hit my district. i've been traveling all over, the last few days, the president was even down here. we told him when he was in orange, texas, fossil fool exploration, oil and gas industry, including fracking was absolutely necessary and joe biden, it is classic doublespeak and when he says you know, he was for it before he was against it, i can tell you it is going to cost the american, texas and other oil producing states millions of jobs. it is going to keep us from being energy independent and quite frankly, this is something i shudder to think that he would do this. let me say one other thing, because his bureaucrats that he will bring into his administration, he doesn't have to ban fracking. this he can do it through the bureaucracy. they will make permitting process so burdensome you will never get a permit to frack and that will be the end of it. elizabeth: yeah, that is a good point. congressman, president trump

created half a million factory jobs in the country. there is generational highs, generational highs in the onshoring of jobs moving here from overseas. joe biden is talking about shovel-ready jobs when obama joked that wasn't true. we didn't create, quote, shovel-ready jobs in the 2009, 900 billion-dollar stimulus. biden is now saying he managed. even president barack obama himself admitted that the shovel-ready jobs did not exist. the $900 billion went for things like "cash for clunkers," bankrupt energy companies. they were trapped at social, at the state and local level, trapped in, you know, at administrative level. the money didn't get out in the u.s. economy. we have seen that under the reagan administration. the question, what are joe biden's job policies because obama made him the jobs czar at one point in 2014. said go study federal job training programs. joe biden studied it. came back said, they don't work.

you know, what are joe biden's job policies? >> we really don't know. i mean he is all over the board. i have a ton of manufacturing jobs as i said just a second ago. we've got more petrochemical refining plants and facilities in my district than anyone else in this country. and shovel-ready jobs we found out was a myth. and if this was biden's and obama's idea of a success for that stimulus package which was nearly a trillion dollars, then i shudder to think what a real success would look like. so all i can say i hope the american people realize that only thing that will save our jobs, our economy, make america safe again, is reelecting the president already in there. he is doing a fantastic job. elizabeth: yeah. okay. president obama needs to talk
