plan. texas congressman brian babin joins us tonight. i'm elizabeth macdonald. the even egg edit starts right now. elizabeth: welcome to the show. you're watching the fox business network. a major manhunt still underway after two los angeles county sheriffs deputies were shot in the head as they sat in their patrol saturday night in compton, california. 100,000-dollar reward leading to the arrest of the gunman, seen on surveillance video seen shooting the officers. 31-year-old mother of a 6-year-old child and 24-year-old man. they were both shot multiple times. they were sworn into duty months ago. reports look like they will be able to recover. doctors are calling this quote a double miracle. the wounded female deputy was able to radio for help. she is being called a hero. she was shot through the jaw.

she applied a tourniquet to the male deputy's wounds. the sheriff's office had to demand rioters stop blocking doors to the emergency room at the hospital where the deputies were. they were shouting quote, "we hope they die." welcome former nypd lieutenant darren porcher to the show. your reaction to the reports? >> thanks for having me on, elizabeth this is a unfortunate traumatic incident what happened in l.a. county. we have two heroes sitly, speaking sitting in their police vehicles. i see extreme parallels inn what happened to 2014 with the shootings of lew and ramos in connection with a crazed gunman, took arbitrary action shooting, killing officers here in new york. this madman tried to commit the same action this was an attempted assassination an assassination or shooting of a police officer is an attack on all of society because police

officers represent the social contract in protecting citizens of los angeles. elizabeth: lieutenant, you're reaction to the surveillance video of the shooting. talk to us about who they could be looking for, who law enforcement could be looking for? is it an adult? is this speculation or could be a teenager or minor? this is speculation. no information what he sorry on this but video appears to show the shooter is not tall enough. his head does not clear the top of the window of the police car. could they be looking for a teenager too? >> that is very difficult to make that assessment. often times law enforcement captures of images of individuals on a crime, based on height, weight of individual difficult to make the assessment could this be someone of south american descent. could it be an american, teenager, et cetera. we want to capture the video and

leapfrog from one video to the next video. what police will do, they will connect with other videos in that same area to attempt to assess possible vehicle that that individual entered, the escape route that they used, et cetera. so it is very difficult to make the assessment now. it is multifaceted in connection with who it could have been in the wake of the violent protests that have been occurring, it can be a multitude of different people or actors that would have been responsible for this. elizabeth: you know, president trump is in california meeting with officials over the wildfires there all of that is going on in california too as this is happening. law enforcement have repeatedly warned that antifa and anarchists targeted cops across the country. we know that the fbi is warning police nationwide that antifa and other violent rioters are planning arrests even after the election, weeks after. both president trump and joe biden were visibly angry today.

both condemned the shooting. president trump culling calling for a fast trail with the possibility of the death penalty. your response to those reports? >> i commend both vice-presidential hopeful biden and president trump speaking out against this act of vitriol. this is the time that we need to unify as both parties against people that committees horrific acts against law enforcement. but in connection with who it is, it is very difficult to assess this is lone wolf attack or this is an organized surgical strike from one of these groups such as antifa or black lives matter. the truth of the matter, this is a problem, many criminals feel as though they can act with impunity in the wake of riots that have been plaguing the nation. unfortunately the left has been driving the sentiment for this vitriol that is committing to riots and unrest in a lot of the

major cities throughout the united states. elizabeth: we're in dangerous ground right now. you know, the criticism has been leaders need to step up to come together to stop this. your reaction to the city manager of lynn wood, california, posting on instagram saying quote, the chickens have come home to roost after they were ambushed. naacp national president said there is no such thing as blue lives. there is no statement from black lives matter leaders condemning the shootings. your response, outrage over the protesters trying to block the hospital emergency room doors? >> my reaction to that these are complete lunatics and they have no place in our society. we need to understand what police officers do and police officers are basically the glue that mend as level of, a saneness to our society in connection with enforcing the laws that are on the books. in addition to that, there is another video where as you have a group of people that are

spectators to when the officers are shot, they are embracing this with laughter. it really begs the question of the societal norm or pendulum switching to the extreme left. this seismic shift needs to be stopped. we have too many people feel they can act with impunity. elizabeth: lieutenant, the media is talking a lot about a study that says 93% of the demonstrations have been peaceful. that does not discuss the fact that they're, that 570 riots, they have been violent riots. nearly 600 violent riots have ripped through the nation in 220 towns and cities across the country since may. dozens now dead. businesses and communities burned, torched to the ground. nearly 7800 black lives matter demonstrations in all 50 states. so when they talk about studies saying most of them are peaceful and mask the truth underneath that, that nearly 600 riots have

been violent. more voters than ever consider black lives matter demonstrations in three cities, new york, portland and kenosha to be riots, not protests, what is reaction to the "fox news poll" and other data we gave you? >> i believe the riots plaguing society need to be stopped. there needs to be some level of a moratorium. i also blame social media. when we look to a couple of weeks ago the miracle mile up in chicago, this was a concerted effort on social media to have people conjoin to go riot in the miracle milocation in chicago. this is happening quite frequently. social media is a platform. social media outlets yet to put a moratorium on this. a lot of this is amplified as peaceful protests. i demet i cannily oppose that. i live in new york city, i have seen the damage, chaos plaguing

potential bias against trump is that what you're saying. >> in addition to that we have an investigation that has been looking at everything mueller's team has been doing or did. it makes it a little difficult now when you go back, if they don't have a record that is even there to go back to look at the decisions they were making. this is only for the firms part of when the mueller team was first stood up. i hope everybody understands that. thank god for "judicial watch" and tom fitton and his group that was able to get these because doj has been actually blocking these from getting out. it makes it a little hard to do an investigation, when, one, we don't get the information and two, when you finally do get the information there is no information there because they wiped their phones. let's be clear here, liz. so people understand, they may claim that it is an accident and claim well they were just following the rules, no. i don't know one person in, i run into a lot of people, and if somebody has ever done this, let

me know, but 10 times you would have had to reset your, we had to go through put the wrong password in. 10 times. one of my staff actually very knowledgeable about this, actually walked me through the process how complicated it would be to have this accident, have this accident on 30 phones. it is just preposterous. it didn't happen. elizabeth: congressman, senate finance chair chuck grassley wants answers from the justice department and the fbi whether this was a widespread intentional effort. senator ron johnson, chair of homeland security, doj horowitz to investigate. i think you're saying these phones were wiped after peter strzok and lisa page were found to have been sending bias anti-trump text messages, that what you're saying? because reports are coming in, the government documents show a gap in text messages for peter strzok and lisa page, what they were texting each other between

december 15, 2016, through may 2017 a lot was going on then. the flynn case was falling apart. the flynn perjury trap was being discussed behind scenes at fbi. >> right. elizabeth: the fbi's trump russia case was falling apart. a lot was going on in the interim, appears no text messages between strzok and page for that time period. >> you also have to remember, nearly all the people that were selected to be on mueller's team were close clinton confidantes. how that happened we probably will never get the answer. i'm not sure mueller is even capable of answering that because when he was here in congress a little over year ago he didn't know what was in his own report. so when i look at that group of lawyers that was put together and you now, we can also piece together, this is just, this is an important fact that can't be lost on people, they knew there was no evidence of trump colouing colluding with russia. they also knew the people that

had written the dossier had connections to russia and worked for russia and a lot of the sources probably had been compromised. all those lawyers knew that the fbi knew that at the time. the lawyers that came on the mueller team knew that at the time. i say when mueller walked in the door on day one he knew they had no evidence. they started running an obstruction of justice trap. i will tell you, i hope a lot of these lawyers come forward because the way that they treated lawyers that were representing a lot of people whose lives were ruined, innocent americans lives were ruined by these people, and there was so much misconduct there, whether it is the flynn case or others, now you can't even go back and look at federal records? i guess they learned from hillary clinton, their former boss you can destroy a hard drive get away with it. they have done this and will get away with it. >> strzok and pages phones were wiped clean and set back to factory settings. they were important members of the investigation of hillary

♪. elizabeth: welcome back. we're coming into the bottom of the hour. u.s. attorney john durham may be on the verge of releasing an interim report in his criminal inquiry into the russia investigation. that is according to news reports. welcome former house oversight chair jason chaffetz back to the show. great to have you back on. what is your reaction to that? a.g. barr, senate judiciary chair lindsey graham indicated a significant development may be coming. what do you think? >> generally u.s. attorneys don't offer reports. inspect generals do such. there is pending news, something about to pop, those are generally charges. those are not going to be, hey, i have got this report, here is my 27 pages or 300 pages about what is going on. those are usually about indictments. so foreshadowing has been off the charts. you have two people who are in

the know, i don't think they would continue to foreshadow with such ferocity and such specificity without something really about to happen in the next week or two. elizabeth: what you do think it is? could it be perjury charges because the fbi officials were found to have misled the fisa court normally used for terror investigation and wiretapping terrorists. instead it was used on opposition time. they were found to misled the fisa court, knew as earlier as 2016 carter page was a source on russia and china that would explain his multiple contacts. he hid that information from the fisa court. they hid the information that was debunking the steele dossier that also helped to used to get fisa wiretaps. perjury charges possible here? >> possible perjury charges. you could have the court take some actions because they were misled. i don't know of any other court

be worried about. elizabeth: you wonder too, about how much is going to be made of the fbi officials using the steele dossier that christopher steele testified in a british court he was initially paid by democrats to come up with the anti-trump opposition research for hillary clinton to use in case she lost the election. still need to know which fbi agent was handed that document and how that dossier got inside of the fbi and was used to help get fisa wiretaps. we don't know, still haven't gotten to the bottom bottom that. what do you think? >> not only how the document got in there, peter strzok not only developing this information but also signing off on this information. he is wearing two hats at one time. newly-released documents. country, golf wolf of pennsylvania is certainly one of them, they have been acting like petty tyrants. they have been acting like monarchs. they have imposing completely unjust, unfair, in this case unlawful restrictions on the american people. they came they're doing it for our health. we all know better. they're doing it because of politics. they want to punish people. they're not afraid to use small business and even children as pawns. so they close schools. they forbid sports. they suspend our society in many ways, particularly when it comes to free enterprise and they're doing so because they believe that it will ultimately lead to donald trump losing the election. this judge, thankfully is standing up for our rights. i would also say this, liz, it is important americans rightly recoil at the whole idea there would be two sets of rules and we've seen that throughout these lockdown restrictions in states like pennsylvania. what i mean by that is, government leaders like governor wolf and governor pritzker in illinois and governor cuomo in

agencies, with no help whatsoever from congress, have been astounding. he built, built 300 plus miles of wall. he has done our, he has cut back a tremendously on amount on a lot of the asylum-seekers. he has worked with mexico. i think mexico is certainly to be commended. just think what we could have been doing had the democrats worked with the president. we could have a very, very, 100% secure border. but the fact that vice president biden says he is going to roll back all of this should give many americans a very strong chill up their spines because like you just said, with covid and riots and all of the things that we're experiencing today, to have thousands and thousands of illegals flooding across our borders again would just add that, exaggerate what is already happening there.

be further from the truth. because of their policies, open borders, they absolutely encourage, they encourage child trafficking, you know, all of the drug trade. all of the terrible things, child abuse, female abuse, sex abuse, coming across the border, many of them never even made it up here to begin with. these are all things being encouraged by these democrat policies. and we absolutely must not allow all of these, these great changes that the president made to be reversed because, all it is going to do is open our borders up. it is costing the american taxpayer $1.8 billion a year for our asylum-seekers and our refugee programs. we just simply cannot afford that, especially at this point in time. and, you know, i think the american people need to realize we don't want a sanctuary nation because they're pushing sanctuary cities over there on the democrat side with their
