your city go down to the ruins. do something for us. elizabeth: let's welcome former nypd commissioner bernie kerik to the show. your reaction to that? >> liz, back in the '90s, before 1994, mothers were putting their babies to bed in bathtubs, afraid of the random gunfire and afraid of the murder rate. we were averaging 2200 murders a year. that is happening in minneapolis i predicted it would get far worse when they started calling defunding for the police. when the cops started walking off the job. you want a safe and secure environment to live in. you want a peaceful environment to live in. the only way to do that is have the police there in full force. you diminish the police and diminish the safety and security of the community. they were stupid, these people were idiots to even go down that

road. elizabeth: your thoughts on a.g. barr reportedly saying that democrats now demanding quote, biden or no peace, they want mob rule. director, fbi director wray seemed to downplay antifa as ideology. your thoughts on that? >> i would agree with the attorney general. i would also agree with the attorney general that we should be pursuing charges against these people, whether it is the black lynches matter or antifa group, whoever is responsible for the rioting, the arson, the violence. pursuing charges, federal charges at the most extreme extent of the law because that is the only time you will get accountability. these local municipalities, they have these bail reform laws where you're locking somebody up. they're out of jail three to six hours, maybe eight. they're back on the streets. they're doing the same thing tomorrow. you know what?

that has got to stop. hold them accountable for real. the only way you get that done right now is through federal charges. elizabeth: you know 200 people already have been hit with federal charges. what's your thoughts about the doj considering civil or criminal charges against leaders of portland for letting riots get out of control for months on end? >> you know what, liz? this was basic management. this was basic management. you have a job to do. you're sworn to uphold the constitution of the united states and, that oath of office entails for a mayor, a chief of police, a city councilmember, that entails you making sure your community is safe and secure. if you were intentionally violated that oath, i think the civil rights division should come after you. you know, there are people that died. there are people that lost their livelihoods. people that were attacked viciously attacked. somebody has to be held

accountable. and if the mayor, and the city council and the governors were doing their job, that stuff would not have happened. elizabeth: yeah, the doj is denying they were going to charge the mayor of seattle but you know, 16 republican senators want new legislation that would hit hard those who attack cops. they're talking federal penalties of 10 years in prison or life for attempted murder. show the weapons rioters used against cops in places like portland. we're talking lasers strong enough to burn paper. you can see the weapons there. speaker pell lows today is condemning the riots. after nearly four months of riots. watch democrats say for sometime now that these were peaceful protests and the media saying that, downplaying violence. watch this. >> mostly a protests. it is not, it is not generally speaking unruly. >> peaceful protest. >> peaceful protest. >> peaceful protesters. >> destroying property which can

violent, whether it is throwing a rock, a molotov cocktail, an attack on a cop, whatever the case may be, the brutalization of some innocent people, that turns violent and once it does, then the peaceful protest is over. people have to get dispersed or they have to get arrested. that is the way you handle it. elizabeth: you know, what would you say to people out there who have not had that happen in their own communities but are critical of those who are pushing back up against the, you know, critical of those who say don't defund the police? >> you know, i say take a ride through, you know, southern manhattan. take a right through new york city and look at what it looks like today. take a ride through minneapolis. really looks like, it looks like the aftermath of beirut in the '70s. it doesn't even look like a city in america. that is what happens when you

the vice president said 119 million covid-19 vaccines doses by then. are the vaccines ready? there is a risk of serious side-effects. what is going on here? >> the president took the unprecedented step of launching operation warp speed which was a partnership between the health and human services and department of the defense and as well as private sector. we allocated billions of dollars so that private sector companies in partnership with those entities could work to manufacture vaccines simultaneously and also work on being ready to mass distribute them. so when we do reach a vaccine we'll be ready to go. so the vice president is absolutely right. we're very confident that by the end of the year we could have as many as 100 million doses of a vaccine on the market for americans to take. and i would know we've got several vaccines already in phase three clinical trials, which is a very promising number and we think we could be somewhere within the coming months we could have a vaccine on the market.

elizabeth: yeah. let's stalk talk about that. eight potential vaccines in late-stage trials. moderna, astrazeneca. they will know by november whether the vaccine is working. president trump got hammered hard on contradicting the cdc. talk about that fight. >> i talked to the cdc and dr. redfield's team. they understand, acknowledging later that 100 million doses should be ready by the end. year. it is larger distribution to 250 million americans that could come later probably the second quarter of 2021. $100 million is incredibly significant. it will really allow americans to get back to order snarery life to get back into the public space. that is an incredible number. on top of that we also got therapeutics on the market and we're seeing test positivity rates for the virus go down dramatically. either way this is an excellent track that we're on.

elizabeth: your reaction to a.g. barr getting pushback for saying quote, other than slavery, which was a different kind of restraint, coronavirus lockdowns were the greatest intrusion on civil liberties in american history. he is getting pushback on that. your reaction to it? >> yeah. a.g. barr is talking about what we're seeing in some democrat-run states particularly pennsylvania where they're denying americans the right to do things like run their businesses, practice their livelihoods, to have a paycheck for their families. that is a huge infringement on the civil liberties t goes against the constitutional rights to freely assemble to practice what they need to do earn for themselves. it's a huge concern. this president early in the pandemic took the unprecedented step of doing a lockdown. for a period of time to stop the spread of the virus. but we quickly reopened our country. we did so safely, to stop the spread. we're in a position now where our country is open, our economy is getting back to work because

of the stuff this president took and we encourage democrat governors and mayors to do the same. open their cities. the american people are smart. we've been living safely with this virus now for months. we know how to avoid it. wear your mask, wash your hands. practice -- elizabeth: still up, right but it is up to 200,000 people dead. people are really scared out there. you can understand that, right? >> absolutely. absolutely. it is heartbreaking we lost that number of lives at this point but we're working day in, day out to achieve a vaccine so we could be in a place where we're fully reopened by early next year. in addition toe people who are scared and who may have the virus now we have therapeutics we didn't have in march and april. we have them now to treat you. the likelihood of getting seriously ill with this virus is the lowest it has been since it come to our shores. that is directly a testament to this president's leadership. elizabeth: alyssa, your take on

comedian chris rock, chris rock now getting in on the action. chris rock blasting house speaker nancy pelosi saying quote, democrats you let the pandemic come in during impeachment. democrats were not focused on the pandemic earlier this year. they were focused on impeachment. democrats did not talk about contract tracing, testing, did not talk about doing travel bans. they were opposed to that. saying go out and congregate. joe biden had a rally with a lot of people through march. there is this hypocrisy here, the data, the red states were getting hit really hard even though they had the covid shutdowns. they had a lot of covid shutdown rules. the question, don't politicize this. stop making this political. it is american lives that are at risk. what is your reaction? >> i think this is absolutely right. this president never viewed it as red or blue. he is looking out for the whole country. whether ppe we're distributing or remdesivir or different

this is a crime? because disagreement no longer is enough. political disagreement and political debate. now you have to call your adversary a criminal and instead of beating them politically, you try to put them in jail. so we're becoming sort of like a eastern european country. the obama administration, you know, had some of the people who were mueller's office writing their briefs in the supreme court. they're not crowing so much after they get whooped in the supreme court. elizabeth: that was attorney general william barr giving a speech a tough speech at hillsdale college. let's bring in michael flynn attorney sidney powell for her reaction. great to have you on. what is your reaction to a.g. barr here? >> he is exactly right. justice scalia called them headline grabbing prosecutors. i talked about this phenomenon since 2013. exposing corruption in the

department of justice. they make it about themselves instead of seeking justice and seeking the truth. it is absolutely appalling. elizabeth: that happened with your case, right, with general michael flynn. people keep saying they stopping their thinking, general michael flynn pled guilty twice. how does what a.g. barr talking about with the case you're working on with general michael flynn? >> multiple ways. they coerced general anyone into a plea of guilty by threatening to indict his son. they put enormous pressure on him timewise. he didn't get all the information he was entitled either from his own lawyers, much less from special counsel. abused the system at every turn to make up a crime against him that the fbi did itself. and they had no basis to interview him whatsoever. it is one rule-breaking episode after the other from the beginning of the quote, investigation, through the district court's decision, through the court of appeals opinion.

they have all broken every rule they can to make sure michael flynn is prosecuted. it is terrifying because this could happen to any american. elizabeth: yeah. they talked about a perjury trap for michael flynn, no miranda rights at his interview that wasn't even, he wasn't even told it was a criminal interview. it was a debriefing. the fbi officials behind the scenes admitted in government documents that there was no violation here. they didn't have a case against him. sidney, i like your reaction to senate judiciary chair lindsey graham getting pushback for republicans for not being aggressive enough. james comey has agreed to testify before a senate judiciary on september 30th. senate homeland security has 41 obama administration officials subpoenaed for abuses of power, you know to talk about that, testify about that. your take on this story? >> i think the senate judiciary committee should been much more aggressive than they have been

and it should have started over a year ago. there are multiple witnesses who need to be interviewed in public under oath for their role in setting up, framing and prosecuting general flynn. i think special counsel, mr. durham may also be looking at the former special counsel operation itself. we now know they destroyed the information on multiple cell phones, 27 i believe. and they also lawn dered and removed information from the their own files. i'm sure the flynn file material went missing through them and also the file on mr. wolf, the senate select committee on intelligence staffer who leaked the buzzfeed materials, the fisa application to buzzfeed. they were protecting senator warner and senator burr who had some sort of involvement in that episode. they have been filtering out a lot of inculpatory information to protect their friends. that all needs to be exposed

too. elizabeth: sidney, your take, let's stay on the mueller team accused of wiping dozens of government phones before they could be investigated for bias against trump and other issues. george papadopoulus got threatened by mueller team and fbi, switching cell phones and deactivating account. accused of obstruction of justice. peter strzok is not worried about the durham probe. years from now he will be seen as a patriot. his phone was wiped. so was lisa page's phone. they were wiped. there is a gap in their text messages between december 2016 around may 2017. a lot weren't on during that including general flynn's case. your reaction to that? >> i wrote an article in the "daily caller" as soon as that happened, saying mueller himself was obstructing justice as was mr. rosenstein who was responsible for lisa page's cell phone at the time. she turned it in to doj and strzok turned in his to the fbi

and mueller team. they were responsible for tee heating that information. that is obstruction of justice, far more egregious than what they have sent many people to prison for. elizabeth: why is it more egregious? >> they knew exactly what they were doing. they knew how wrong it was. george papadopoulus was not thinking about it, certainly not the way they were. but they knew there was incrimer to information on the cell phones of lisa page and peter strzok. there was significant exculpatory information on the cell phones of all those who saw fit to destroy them immediately as soon as they realized the strzok-page messages were being seized. elizabeth: the irony here, sidney, lisa page, peter strzok worked on the hillary clinton email case. that was about destruction ever federal records. your final word on that? >> yep. the same thing. one rule for them, another rule for everybody else. if it's a democrat or a special

now he is for it again. >> there is constitutional issue whether the federal government could issue a mandate. i wouldn't issue a mandate. i plead with, i carry my mask with me everywhere i go. i set an example. the question whether i can mandate over state lines that every single state has to comply. our legal team thinks i can do that based upon the degree to which there is a crisis in those states. and how bad things are for the country. and if we don't do it, what happens. but i would make the case. elizabeth: okay. your reaction, john? >> well you know, it is, joe biden is a career politician. he has never been in the private sector really. it is hard to bee believe he could run for the highest office in the land without having real life experience. as a businessman, liz, i want somebody that actually knows what is going on. this flip-flop on masks is just one example. i will give you another one.

attack. your thoughts on the hispanic commune here? >> well they ought to look at the economics of what the president has done. you know there is a great article in "the wall street journal" on that point alone, liz. inequality went down significantly in 2019. black and latino employment was significantly higher. real actual incomes rose. listen, liz, i'm in the business world. i want results. i want things to be better and i'll tell you what. 2019 was much better for the latino community and for the black community. incomes rose, unemployment went down and peoples lives got measureably better. that can happen again. it will not happen again with the policies joe biden talks about. elizabeth: we should point out the united nations human rights council just slammed venezuela as communist dictatorship for crimes against humanitarian. bernie sanders supporting them and a lot of people in hollywood. john cox, you're great.

elizabeth: okay. 43 cops killed so far in the line of duty. hundreds more injured. they're using weapons like lasers to blind them in riots. your reaction to that? >> it's, i feel for the families and friends of these officers. i, it is just outrage -- outrageous how the violent mob has been able to take over these cities and states in some cases. we've seen the riots, looting, rioting going on for months in some cases this comes down to the failure of leadership. these are democrat-ran states and cities. we've had this violence and nonsense going on from the mob and over 100 cities across the country, liz. in some cases for months. so there needs to be accountability with these mobs, these criminals. but also to these elected officials. the basic duty for government is to protect the person and

plus, law enforcement, law enforcement in new york, hsi, i.c.e. and local and state law enforcement have very close working relationships with the rcmp. so the intelligence and working together between the two countries extraordinary. they're being very successful through their intelligence efforts to find where these drugs are being smuggled through the borders specifically in the state of new york. elizabeth: you know the feds seized nearly 40,000-pounds of marijuana across 16 ports of entry. a.g. barr said a dozen cities are seeing methaphetamine pouring in. ag barr specifically named and blamed two drug cartels pushing massive amounts of meth across the border into cities hit with lockdowns and riots. your reaction to that? >> partly agree. the cartels are moving a lot of drugs through the southern border and they own most of that business. on the northern border it is mostly organized crime. it is asian organized crime,

east indian organized crime and outlaw biker gains. buffalo has a transportation infrastructure that can handle the commercial traffic. a lot is coming through the port of entry. a lot of is coming through the st. lawrence seaway. i grew up half hour south of that. could be in canada from the nights in a boat minute 1/2. you can snowmobile across the river. you have the indian reservation, the st. regis reservation, they have been smuggling people there since i was a kid. the feds have little access to the reservation. it always has been a smuggling haven. it is getting more popular. because canada legalized marijuana. the amount of marijuana seizures into the united states has exploded. there is a need. east coast there is need for marijuana and drugs. canada is fulfilling need through organized crime syndicates. elizabeth: i want to switch to

the story, the reports about you know, an i.c.e. facility in georgia. the detainees there saying they were given unwanted hysterectomies by a doctor affiliated with the facility. your reaction to that headline? >> you know, it is just another attack on i.c.e. this is the left pushing a false narrative. the medical care given to aliens in i.c.e. custody is the highest quality medical care available. when i was i.c.e. director we spent $1.5 billion on people. i.c.e. professionals, doctors, nurses, pharmacists, they have saved many lives. a lot of diseases and sickness are found when they're in i.c.e. custody. so i don't believe this story. i'm not the i.c.e. director anymore. again i'm very skeptical about the story. they get highest quality medical care. before they get a hysterectomy they have to get approval by i.c.e. person in charge and detainee, has to okay in her language interpreted to her.

a certified medical doctor has to say this is necessary for your health. however i cannot do this without your per -- permission. elizabeth: same for privately run facility, same for privately run facility as it was in georgia? a outside doctor affiliated with a privately-run facility, go ahead, tom. >> exactly. thatis just just another caveat to i.c.e. medical attention. if i.c.e. doesn't have the capability or specialists to do this they will go to an outside physician of the they won't try to take on something, if that doctor, that nurse, in that facility doesn't feel they have the skillset to do that, i.c.e. will go to an outside physician or hospital have the work done at taxpayer expense. elizabeth: understood. so we still don't know the facts and details about this. congress is saying it will get to the bottom of it. we'll stay on the story. tom, thanks for your insights and perspective here. thanks so much for joining us. >> thanks for having me. i appreciate it. elizabeth: sure.
