reportedly met with judge amy coney barrett at the white house. welcome back to the show, house judiciary ranking republican jim jordan is with us. your thoughts on all of this, congressman. good to see you. >> great to see you, liz of the great to know we have the votes in the senate. i think amy coney barrett would be a tremendous selection and tremendous asset to the supreme court. one that will follow the constitution. one who will respect the first amendment, second amendment, bill of rights. do what conservative judges are supposed to do. i think she would be great. looks like we're moving in the right direction but the democrats, the democrats and they're threatening the american people and looking to do all the things you said in your opening statement. that is just, they want to change the rules. they want to do all kinds of crazy things, because as you said they're not winning elections. i don't think they are going to win on november 3rd either. elizabeth: so what news, what are you guys planning? because they're talking about things like getting rid of the electoral college, packing the court. >> yeah. elizabeth: they're talking about

a constitutional crisis but they're taking action to undercut american institutions. is there something afoot here? what do you think will happen? >> just a few minutes ago, liz we introduced a resolution, filed a resolution in the house, every single republican on the house judiciary committee was on the resolution condemning the democrats plan to pack the court. so the democrats can't win elections. the republicans control the senate. we control the white house. the president following the law, submitting a nominee to the senate. the senate will move forward with that nomination just like the constitution says. so the democrats said if we do that, we win back power we'll change the rules. we'll add six new people to the court. the court has been at nine for 151 years this is ridiculous. i think the american people understand that. we got a resolution we filed a few minutes ago. elizabeth: what teeth does the resolution have? >> it is just a resolution but, you know, we are 42 days away from an election. so it is important to have the

document. i think every single republican in the house will probably sign on to this. every single republican on the judiciary committee already has. this is that kind of document it helps create the debate, make the argument even bigger for the country to understand what the democrats are trying to do. understand this, liz, the democrats are trying to win the election after the election. you saw what happened yesterday in wisconsin. a federal judge said you can count ballots six days after the election n michigan, they said you can count ballots 14 days after the election. in pennsylvania you can count ballots three days after the election, even if you can distinguish the postmark on the envelope, postmark date. they try to win the election after the election. trying to change the rules on the court and whole bunch of things as you mentioned earlier. elizabeth: i hear you. i hear exactly what you're saying. i don't know if voters are ready for election week as it has been said. democrats, get back to the nomination. democrats are mad this is

republican hypocrisy after republicans stalled a vote on obama's vote merrick garland. senator cruz pointed outlaw makers in both parties switched positions exactly the opposite what they're saying now. chuck schumer says the gop has no right to fill the vacancy. four years ago, chuck schumer, barack obama, biden, ruth bader ginsburg said proceed with the scotus vote in the 2016 election year even though ruth bader ginsburg was her fervent wish a new president would do it. what they're saying back then versus now. republicans are flipping their position. your take on that? >> i don't think republicans are because republicans control both the senate and the white house. that wasn't the case in 2016. republicans controlled the senate. obviously at the time it was democrats with president obama in the white house. this is a different situation. frankly the historic norm is if both parties, excuse me, same party controls the senate and white house, then you move forward with the nominee in

election year. you do that. that has been the norm. when there is, when it is split, when you got one party in the white house, another one in the senate it typically doesn't get through. so this is a big difference when you control -- the american people elected president trump to put conservatives on the court. they elected a senate to make sure we got conservatives on the court. that is exactly what's happening. elizabeth: yeah. i mean we're just showing comments from barack obama, joe biden, words to the effect what you're saying. it is also really interesting, congressman, house speaker nancy pelosi is accused abuse of power telling "new york times" that democrats can impeach president trump every day of the week. president time firing back i'm probably only president threatened with impeachment for mom nominating. you can't get impeached for anything. high crimes and misdemeanors. i want reaction to senator tim kaine. senator tim kaine is firing back

getting rid of the electoral college, impeach the president, leading to this simple question, instead of tearing up the system in order to get your way, isn't this really about the importance of winning elections in the first place with policies that voters want? welcome for his reaction fox news contributor jason chaffetz. great to have you back on, jason. what is the reaction to everything that is going on? >> thanks, liz. i think it is absolutely laughable that the democrats and those in the media are claiming a constitutional crisis when they can't point to anything that the senate or the president is doing that would be unconstitutional. clearly the president can appoint somebody. donald trump and republicans didn't ask for justice ginsburg to pass away. it just happened. and so he has the duty under the constitution to appoint that person and the senate under the advice and consent portion of the constitution can take this up whenever they want. they can vote it down. they can vote for it.

they get total discretion. that is what the constitution allows them to do. so no action is even action, as was the case four years ago. but for them to vote on a nominee from the president, wholly constitutional. it is only the democrats want to try to rewrite the constitution on the fly. elizabeth: okay. here is the other thing that is happening. we got breaking news. the president moments ago says he will make his announcement of who the nominee is on 5:00 p.m. on saturday. later that night he will attend a rally. your reaction to the republicans now saying voters can expect the same heated supreme court nomination hearings like brett kavanaugh, samuel aheat to, clarence thomas and robert bork, is that what is going to happen? >> the democrats are flailing and flipping out. they have already written their press releases. they already feigned their exasperation but they don't know who the president will nominate.

i will give donald trump credit, he should be winning awards for his openness and transparency putting out a list of those that he would select from. it is something by the way that joe biden said he was going to do and hasn't done and should do but nevertheless, the president foreshadowed who he might pick. that is why he can accelerate this process and put out a nominee within a week because he is already you know, looked at that list over years in order to get to that place. so the president is doing the right thing. saturday is the right time to do it. after justice ginsburg has laid in the supreme court there but the president is doing the right thing. i'm sure he will make a great selection. elizabeth: republicans are saying democrats appear to be, they're getting egged on by democrat pundits in the media saying things like, pack the court if biden wins, when even ruth bader ginsburg said packing the court was wrong to do. we're seeing that happening at msnbc, cnn, across the board.

your reaction to that? >> it is an act of desperation. i think democrats know they're in trouble in this election. i think donald trump will be reelected. the only way the democrats can actually succeed is to rewrite the constitution, rewrite the rules, do things never done before in this country. for nancy pelosi, for instance to suggest that they could, they could impeach the president at anytime, that is not what the constitution says. and so they're misleading the people. elizabeth: that abuse of power. we got breaking news. >> yeah. president trump: going to pittsburgh. we have a very big crowd as always. we have a very, very big crowd. we are doing actually, i think it is a lot hotter than it was even four years ago. people like the job we're doing and i think we're going to have a very successful day. do you have any questions,

deaths. if you look at alternatives you could have 2 1/2 million deaths or somebody thereabouts. you could have a number substantially more. with all of that being said we shouldn't have had anybody. you saw my united nations speech. china should have stopped it at their border. they never should have let this spread all over the world. it's a terrible thing. had we not closed our country down and reopened and now we're doing well in reopening. the stock market is up. all of those things, but i think it's a horrible thing but if we had not done it right, you could have two million, 2 1/2 million or three million. but it's a horrible thing. should have never ever, ever happened. china let this happen. and just remember that. reporter: [inaudible]. another 200,000 death milestone? president trump: i know this, the original numbers were around 200,000, if you do it right. if you did a good job and if the

judges, justices. so i think you're going to be very impressed when you see all of them, they're all great. these are all very talented people. i think you will be very impressed by the person chosen. that is -- thank you. elizabeth: okay. let's bring back jason chaffetz. i'm so sorry we had to cut in there with the president speaking just now. congressman, this is something that we were talking about last night. the president just noting you can't have a deadlocked 4-4 court. with mail-in ballots you could have a disputed election. that is why you need a nine-seat court. your reaction to what the president said? >> the president is wholly right. democrats foreshadowed, they would challenge any election result where their person didn't come out on top. hillary clinton went out on publicly, advised joe biden, no matter what happens, don't

accept the results. seeing what happened with bush and gore, you need a nine person court in order to rule. that is imperative. i think it is the driving reason, one of the driving reasons why you should not only have the nomination but the vote on that justice prior to the election. elizabeth: i don't want to impose upon you congressman to assume whether you are a betting man, if you were to bet who would be the pick do you think? >> i think amy coney barrett is probably the leader at this point. very talented number of justices. i heard and seen more about her. she has a compelling life story. she served injustice scalia. i think which is very appealing. trained at notre dame. i just think she would be a wonderful choice and i think, i think the president is most likely, if i had to guess, going to pick her. elizabeth: oak. jason chaffetz, thanks so much

for joining us, appreciate it. come back soon. >> thanks, liz. elizabeth: okay. we're going to roll on to another big story. attorney general william barr in milwaukee today revealing new details of the success of operation legend. this was launched in july. it is about the deployment of federal agents to nine states to fight violent crimes. so far look at the results. more than 3500 arrests. about 200 for homicides. agents have seized 1000 firearms and kilos of powerful drugs like fentanyl and methaphetamine. welcome former acting attorney general matthew whitaker. great to have you on, sir. a.g. barr said they seized enough doses of fentanyl to kill five million people. your take? >> it is stunning. i'm glad to be with you tonight, liz. let's remember why operation legend was established t was for legend taliferro a four-year-old killed while sleeping in his bed

in kansas city. it was clearly in the summer, an increase in violent crime in some of our major cities and the president, along with the attorney general were not going to stand by to lose our cities. so they plussed and surged resources, money, agents together with deputizing task force officers to address this. and you're seeing the results of some of that effort now. obviously this federal surge of resources is not going to be a forever solution. we need to get these cities and their police departments to continue to press the advantage that the federal attention is giving them in order to, you know, take these bad actors off the streets. take the guns away. fentanyl is a deadly killer, to take that many doses, lethal doses off the street is a big win. we'll have to continue to combat the opioid crisis in america while we deal with all these other issues in our cities. elizabeth: i like your reaction to the labeling of new york city, portland, seattle, and doj

as anarchist jurisdictions. elected officials like mayor de blasio in new york pushing back saying this is all politics. saying shootings have nearly tripled in new york over a year ago. manhattan, queens, bronx, brooklyn d.a., are not prosecuting crimes related to the unrest and more. so your take what is going on here. your reaction? >> yeah, my reaction is, you're seeing in these cities that have been deemed anarchists jurisdictions you're seeing political failure and de blasio is a prime example of that political failure where the police are not supported. the police are being defunded and, you're getting the results of that which is increases of crime. the question i would have, i think that bill barr is also asking because the president asked. that is, because what is our investment in these cities, if they're unwilling to invest themselves in lowering crime and keeping citizens safe. legend deserved to be safe in

his own bed. every child in every city deserves an ability to play safely in their front yard. i think ultimately these jurisdictions, portland, seattle, and new york need to get their act together, need to fund the police at adequate levels but address their rising crime problem. i don't know why the american taxpayers should foot the bill when they're unwilling to do it themselves. elizabeth: you know, so we've had democrats playing the down the violence and protests. portland mayor, also the mayor of seattle, washington, the governor of washington, publicly rejected federal help. your take on that? >> yeah. well there is no doubt that the federal government can offer resources whether it is additional federal agents from the dea, atf, fbi, u.s. marshals or the national guard, for example. in these cities unwilling to accept that help, you know, they really are hurting their police officers who are the front line

and trying to defend these cities from complete anarchy and chaos. you know, it has become kind of a meme where people describe it as mostly peaceful, fiery protests. be honest, what we've seen in places like kenosha and chicago, cities we mentioned i think is complete deterioration in public safety. the only way you will get that back is with more law enforcement, not less. elizabeth: how do you think this is going to play with voters? we've been reporting this too. of course the facts are out there about what happened with the democrat national convention where democrats we, not mentioned, talked about the violent protests by that time. numerous people were killed. that was noted at the democrat convention. how will that play with voters? >> there is no doubt that donald trump is the law and order president. i think this helps him because he is paying attention to these cities that request federal help like kenosha. the feds came in with the first

china accountable for their actions. elizabeth: now let's welcome back to the show white house trade advisor peter navarro. great to have you back on. how can the u.n. hold china accountable here? >> clearly by first calculating the costs. i would say that we're probably going to lose a full year of gross domestic product to the chinese communist party after you take into account the value of the lives lost, the amount of economic stimulus that we're having to pour into the economy and the lost jobs and gdp growth. it is enormous. the hashtag ccp lied, americans died i think says it all. what i think the president sending a clear signal today, we need to find out more about the origins of the ccp virus and we

need to calculate those costs and, essentially give china a bill. it is interesting liz, last week a chinese scientist, dr. yan, who had been working in hong kong, was pulled in to investigate the virus by the chinese government itself wound up having to flee that country and last week made the claim, i don't know if it is true or not but she made the claim that that virus not only came from the lab but it had been genetically engineered by the chinese communist party. these are the kind of things that we need as a world to know. i think it was instructive that the first reaction of the chinese communist party and government was to say that we were lying. this gets tiresome, it really does. are you a "new york post" reader by the way, liz?

did you see the cover today of your local paper? it had. elizabeth: no, go ahead, tell me. >> it had a police officer in new york city who was a chinese spy, who basically had used the nypd to spy on people who god forbid were any part of the tibetan dalai lama corruption or whatever. come on, it is like, fbi director wray i think says that every 12 hours they open up a new case on chinese spying on americans. when, when, liz is enough enough with the chinese communist party? all they do is lie, cheat and steal and kill americans. today president trump sent a strong signal. i think it is also true, liz, we haven't heard from the democratic party. we haven't heard from joe biden.

their own country because they knew it was dangerous. they knew it had human-to-human transmission but they sent hundreds of thousands of chinese nationals across the world to seed and spread that virus insuring insuring the -- elizabeth: i want to get to this. republicans on house foreign affairs released their final report. they revealed damaging details after, their probe about how the chinese tried to hide the outbreak. they have punish ad whistle-blower who was a nurse. they forced u.s. companies operating in china to make ppe, protective equipment only for china. they forced and ordered their companies, chinese companies to start buying up critical supplies from around the world and threatened other countries economically if they spoke out against china. take that last part on, china threatening other countries economically, take that on? >> yes. first let me say that it is remarkable that had to be a minority report, right? that was from a democrat

this week or days before the first debate. this is a big story. your reaction? >> it's great. glad to finally hear it. think about this, liz, for the last year we dealt with president trump's very legitimate, very honest phone call with ukrainian president. what we never really talked about joe biden and hunter biden and skeletons they have in the closet from the ukraine. this is really now coming out. we're getting to see what we thought about corruption behind this all along. see if joe biden can answer a corruption issue where he was a part of where his son got $50,000 from a company he had only no business getting only because his name was biden and his dad was vice president. it will be good. i'm glad to see it. elizabeth: you're hooking it back to impeachment over ukraine. i mean, what you just said is kind of controversial and debatable. i want to understand both sides of the debate. i want to move forward on these allegations.

♪. elizabeth: welcome back to the show retired i.c.e. acting director tom homan. tom, here's what is going on. beaver county, pennsylvania, 16 people arrested in a human and drug trafficking operation. it involved also the use of hotels. so that is -- we understand of course that this has gone on before but it must be incredibly difficult to break up these

criminal gang rings with use of hotels. your reaction? >> well the good thing is all law enforcement, whether state, local, or the feds, fbi, i.c.e., i.c.e. has a huge human trafficking team that is looking for the stuff but it's at least, have the attention of law enforcement. law enforcement is hitting this across the country. it's a terrible crime. many of these women are smuggled into the united states illegally, forced into servitude or prostitution. hotels that perform these services, forced to perform these services. many of these women are identifycation and passports are held by the bad guy. they're not free to move. if they threaten to leave, they threaten to call i.c.e. because they're in the country illegally. 15 years ago in dallas, texas, liz, i ran an operation, we shut down dozen massage parlors. when we hit the massage parlors, they were working in

prostitution, paying smugglers their fees, they lived there, ate there, the smugglers had identification locked up in a safe. this is terrible crime they live with for the rest of their life. elizabeth: this state attorney in beaver county, it is so bad, if hotel taxes directed there should be redirected to law enforcement than tourism. what do you think of that idea? >> i think it's a great idea. the blue campaign, dhs, we're educating hotel owners what to look for, how to spot human trafficking. we meet with airline employees, what to look for with victims of trafficking on air flights across the country. we're trying to educate the public on what to look for, what signs to look for. if you see something, that doesn't look look right. call law enforcement authorities maybe we save some of these

women. last year, i.c.e., we prosecuted 2100 human traffickers. saved several hundred women. there are many more out there. it's a horrendous crime, it needs attention not just law enforcement, american people need to pay attention, be vigilant what they can see. elizabeth: good guys have success stories here. homeland security, move on to this. your reaction to the story about homeland security and utz marshall officers rescueing 90 missing children in four states, oklahoma, indiana, georgia, ohio, many abused by human traffickers. this is over the last month or so your take on that story? >> priority for law enforcement. child exploitation, like human trafficking, it's a crime of the decade. again i will brag on i.c.e. last year they rescued, liz, 1069 children from sexual predators. probably the most horrendous crime that exists in our

society. again law enforcement is concentrating on it. we're really good identifying victims and saving them but we need the help of the american people. again, be vigilant, you see something out of the ordinary call the police. there is literally tens of thousands of children out there missing and are being exploited. we have to attack this with all force. elizabeth: shoutout to the border guys and u.s. marshals. >> absolutely. elizabeth: homeland security for doing the right thing. they are the good guys, they are the heroes here in this story. human traffickers at the border, tom, you know this story, they're so intent getting illegals over the border and getting money off of illegal aliens that they're leaving these illegal aliens trapped at the top of the border walls. there is reports that there are a large number, dozens of rescues by border officials of illegals stuck at top of the border wall. dozens of people have been rescued. some fallen off, seriously injured. this is border story too, tom.
