tonight. we have this breaking news. dni ratcliff sent almost 1000 pages of documents to the justice department in response to a request from u.s. attorney john durham this is opening a new front in the durham probe of the fbi botched trump-russia probe. in is a criminal probe. does this mean indictments are coming? how the top of government under obama knew. president obama, susan rice, james comey, the fbi, the cia, they allegedly knew about hillary clinton's alleged plan to manufacture a trump-russia collusion scandal to link trump to hacking hillary clinton emails. this is according to newly declassified documents. plus former cia director john brennan trying to downplay his own newly declassified handwritten notes written in real time revealing john brennan told obama, susan rice, james comey about hillary's plan eventually pushing fbi to go after it, going after trump.

you tonight. let's get right to hillary vaughn at the scene of the vice-president deng debate in salt lakeit good to see you. reporter: liz, good to be with you. vice president mike pence and senator kamala harris did walk-throughs through the debate hall ahead of tonight's debate. this is the one vp debate and the chance to call out their opponents a platforms in person. even though harris is fiery former prosecutor and pence is a calculated former governor, they have different debate styles. both campaigns want the focus not on personality but instead on policy. nine topics ten minutes each. they are not releasing them ahead of time both candidates are going in blind. the trump team strategy is to hold harris accountable for her progressive past. the harris team wants to go after pence on how he handled the coronavirus while head of

the coronavirus task force. both pence and harris are next in line to the presidency but also because a lot of voters in both bases were turned off from the first presidential debate and tonight both harris and pence have a chance to try to win back those voters that may be tuning in tonight. liz? elizabeth: hillary, we already have nearly six million people voting. a lot is on the line this is the one and only vice-presidential debate. there are nine different topics, do we know what the topics are? reporter: no, they're not releasing them ahead of time but of course both campaigns are preparing that coronavirus is going to be a topic discussed. there are topics that both candidates want to bring up used to attack their opponent. vice president mike pence wants to bring up the economy and the fact that harris would repeal trump's tax cuts on day one in

see them though prior to the election. elizabeth: okay. here's the other thing. so we don't, you think there could be indictments. we don't know what the documents show. we don't know yet what they show but we do have that story, robert, that we covered last night, we're staying on it, dni ratcliff declassifying former cia chief john brennan's handwritten notes in his own words in real time, that he told barack obama, james comey, susan rice, that russian intelligence had information in july 2016 right when the fbi trump-russia probe startedh about hillary clinton alleged plan to link trump to russia hacking of her emails to distract from her own email scandal. when you saw the story, by the way this fits with the timeline of hillary clinton campaign and democratic national committee financing the steele dossier in 2016. if you saw this, why didn't they tell congress about this? why didn't they blow the whistle on hillary doing this? >> i can't figure it out for the

life of me other than the obvious which there was political diversion going on to advance the interests of the democratic party. i guess the second thing my reaction to it, why did it take the dni director john ratcliffe to do this when this could have been done, seems to me months ago during the trump administration through the existing leadership, among others the fbi if the intelligence community wouldn't release it, how come the fbi didn't disclose this? elizabeth: yeah. that's the question, what is going on with the stonewalling here? you know, christopher steele did testify in a british court that hillary clinton was going to use his information to fight against the 2016 election if she lost. one of steele's sources is suspected by the fbi, was investigated by the fbi being a russian spy. so there could be russian disinformation in there. disinformation to accuse trump of cove lewding with russia and spy on carter page. when you saw that information did you expect to see that?

>> well, no but i, on the other hand it is consistent with the other facts that we know, reached all the way into the higher reaches of the obama administration and on their way out the door, they certainly used this as an effort again to do damage to the incoming administration. so, you know, now it stretches all the way back into, not even the campaign, donald trump's 2016 campaign but it stretches all the way back into hillary clinton's campaign and efforts to try to do damage to the political opposition which apparently were efforts that were blessed by the obama administration. i mean that's, that's, that should be front page news and a big story. i would hope that there would be questions about it even tonight in tonight's vice-presidential debate and on into the rest of the election campaign. the american people ought to

know this before they cast their votes and they ought to know specifically what was going on in the dirty tricks that were being played in order to undermine donald trump's candidacy, thereafter his presidency. elizabeth: you know there is, the mueller probe found that the trump campaign did welcome help from the russians but didn't collude with russia to hack into emails. so that's always been a sticking point what is going on here. how do you square that with what is being found in these documents? >> this is far worse. this is using the intelligence community for political purposes. i have mean this is institutional political dirty tricks being played in order to affect the political process. it's one thing to be welcoming help from russians. it is quite another to being, take advantage of the intelligence community and use the intelligence community to do

damage against an opposition candidacy and an opposition party. elizabeth: okay. obama's former cia director john brennan, his notes are heading to senate homeland security if they haven't already arrived there. john brennan is downplaying his own declassified notes on quote, hillary stirring up a truth russia scandal. brennan says there is nothing illegal to hillary doing this and blind to what russians are talking about. watch john brennan here. watch. >> these are my notes from the 2016 period when i briefed president obama and the rest of the national security council team about what the russians were up to. i was giving examples of the type of access that u.s. intelligence community had to russia, russian information and what the russians were talking about and alleging. now if in fact what the russians were alleging that hillary was trying to highlight the reported connections between trump and

russians, if in fact that was accurate and that is a big if, there is nothing at all illegal about that and so john ratcliffe and others are trying to portray this as potentially unlawful activity that deserves follow-up investigation by the fbi. no. it was a campaign activity but again i was giving examples to the president and others of the types of access we had. i was blind to whether it referred to one candidate or the other. i was blind to whether it referred to one party or the other. elizabeth: okay. here's the problem. it was serious enough for john brennan to brief the president of the united states about what hillary was doing. that is the first problem with problem with what john brennan said. the second problem there was russian disinformation in the steele dossier that the fbi investigated. why did the fbi or cia investigate what hillary was doing with this russian disinformation? >> oh, that is one question and an appropriate one to ask and the other is that those in the intelligence community and in through the fbi who were then

which would coast america $93 trillion. i hope she lays out for the american people very clearly the two administrations if kamala harris and biden would be elected and where the trump administration is on these big issues for the american people. elizabeth: vice president pence will have the parents of cale law cale law mueller. she was held and raped, tortured repeatedly by isis leader al baghdadi. she was killed by isis. you're a former airborne infantry officer. what do you think will happen with this invitation of these guests? >> what a great symbolic representation of what the trump administration has done for our military. for peace throughout the middle east. for bringing justice, for people like that and her parents of the

atrocities from terrorists that have been committed bense americans and people that are just, went there to be peaceful servants, to other human beings and what happened to them. so what a great showing on behalf of the vice president and the trump administration, the things they have accomplished, bringing these terrorist organizations and these terrorists to justice for the atrocities they have occurred across our country and the world. elizabeth: you know i think the critics have been saying that they're tired of the debates talked about like a boxing match. this is about solutions. it is about fixes for the country. and who is going to be administering those fixes. so maybe the question should be for kamala harris who would a president biden appoint to his cabinet? would you put elizabeth warren or bernie sanders in his cabinet? who would he nominate to the supreme court? would we get the answers out of kamala harris? likely not.

great to be with you. elizabeth: good to see you. abuse of power is your book. reaction to dni ratcliff sending over nearly 1000 pages of documents to u.s. attorney john durham probe of the trump-russia probe? then we have sidney powell saying president, don't just authorize classification for the intelligence agencies, order them to do it. what was your reaction when you first heard those stories? >> listen, great interview with sidney. she is absolutely right. there has been a lot of stonewalling going back many years. i actually remember two years ago in september of 2018 president trump started pressuring these people in the intelligence community to start releasing these documents. unfortunately it has been one stonewalling effort after another. they have really been pushing back on him very aggressively. it is terrific that we now have dni ratcliff really pushing hard. obviously taking significant

steps forward in terms of actually disclosing the truth. and, of a particularly important next step it is great that mr. durham is receiving these documents because there are so many people who have not been held accountable as of yet. elizabeth: you know, so we had john brennan now downplaying his own handwritten notes which was basically a briefing of president barack obama, susan rice and james comey about hillary clinton's plan. heard it via russian intelligence she would try to link trump to the hacking of democrat emails. he is downplaying that. then he has james comey before senate judiciary last week saying he didn't remember the cia sending a memo to him and peter struck about hillary's plan. let's listen to james comey here. >> you don't remember getting a investigatory lead from the intelligence community? , 2016, u.s. intelligence

officials forwarded an investigative referral of fbi, to fbi director james comey and assistant director of counterintelligence peter strzok regarding u.s. presidential candidate hillary clinton's approval of a plan concerning u.s. presidential candidate donald trump and russia hackers hampering u.s. elections as a means of distracting the public -- >> that doesn't ring bells with me. elizabeth: okay. let's back up. conservative columnist andrew mccarthy says that the cia was not, john brennan was not asking the fbi to investigate hillary on this. instead the cia's john brennan was pushing for the fbi to probe trump based on what hillary was alleging because remember senator harry reid got on the stick after john brennan talked to him in august of 2016 saying why don't aren't you doing anything about this? he called james comey, why

aren't you doing anything about this? in september 2016 basically they, the cia, brennan sent the memo over to him with hillary's plan, with the information. when you heard all of this, because you sent a letter to james comey i think in september 2016, right? >> yes, i absolutely did. and i knew at this time that the democrats were doing this. and the fact, for them to sort of downplay this now when me, as a private citizen had inside information as to all the wrongdoing and to try to say that they knew nothing is really ludicrous. elizabeth: white a minute, carter, how did you know that the democrats were doing this? >> i have worked with the intelligence community going back many decades and i had contacts with on the intelligence community and they gave me a head's up that the

democrats through a law firm and through a network of contacts both in the united states and in, and in london were working to put together thisser. >> campaign against supporters of then candidate trump. so if i as just a average citizen and someone with ties to the intelligence community was able to find it it's obvious particularly now with this new evidence that these other individuals had a lot more knowledge than they're leading on to, disclosing as of yet. elizabeth: what was the date when you first heard this? >> it was sometime in september of 2016. i don't remember the exact date but my letter that you mentioned to mr. comey was sent on sunday night, september 25th, 2016.

and i laid it all out. i explained all of the lies that were being pushed by the democrats and also explained that i was, that i had worked or alluded to the fact that i had worked for both the cia and the fbi in the past. so which was another topic of conversation at senate judiciary last week. so unfortunately there are just so many unanswered questions. i think these documents which are now being released are going to be a huge step forward. i am very disappointed, unfortunately like we talked about last week, i was very excited that mr. mccabe was originally scheduled to testify this week and through some bogus excuse he pulled the plug on that. so it is another example of the two standards of justice where those of us who are average individuals outside of the swamp are dragged through the mud and all these big washington insiders all circle the wagons

and they work together to cover up these terrible events that were pushed forward. elizabeth: okay. senate homeland security, senator ron johnson, they're subpoenaing stefan halper who was an fbi informant who spied on you and tape-recorded your conversations as well as others in the trump campaign. what do you want to hear out of stefan halper? >> there are so many unanswered questions for him as well. again, he, there is been some initial clues that have come out. unfortunately i trusted him. when my life was being put at risk he was one of the few people who was an open ear. little did i know it was part of the obama-biden administration plot in conjunction with the democrat party to push forward this totally false narrative. and he was working as an operative against myself as a way of damaging the candidacy of

3 1/2 years. he doesn't have to read policy books to know how to answer questions tonight. he has done it. he helped the american people. elizabeth: but how did you play kamala harris. >> i will not talk about the details. elizabeth: how did you play kamala harris? >> i know kamala. we were ags together. she is a very smart. she is former prosecutor. i'm a former prosecutor. we have a lot in common in that area. that is about all. elizabeth: okay. you're a straight-shooter and you're you know, you're tough and you stand up and again you tell it like it is. i want your reaction to voter fraud in this new report, evidence of it by the public interest legal foundation. they built an enormous database, data from 42 states. look at the results, 350,000 dead people registered to vote in 41 states. over 144 likely instances of potential voter fraud in 2016

and 2008. -- 144,000. -- people voted in 2018. your thoughts on this? >> liz, it is horrendous. that is what the president, we've always been so concerned about. north carolina leads the nation in deceased people voting. they recently found also in pennsylvania in a ditch ballots in a ditch. in wisconsin i believe they found military ballots which is despicable, cast aside because our great men and women in the military mostly support our president of course. so, yeah, i call it "whack-a-mole." it is every state. it is constant. the campaign is constantly having to defend against this. people out there need to be vigilant. you need to watch for it. you need to look around to see what is going on. poll watchers will be out there but people need to get out and vote in person. early vote. there will be plenty of early voting.

or in states where it's safe, like florida, to mail in your ballot. mail-in ballots are very different, liz, you know than mass mailout of ballots. in florida -- you can track it. >> barack obama, understood. understood. barack obama downplayed voter fraud even though he said it existing when was running in 2008. hillary clinton downplays. democrats downplay it. it appears there are hundreds of thousands of undetected dead registrants. deed people voting. people with multiple registrations in different states and voting twice across state lines. many using commercial addresses like casinos, gas stations restaurants, as their homes to vote out of it. this is not by any means a cleaned up system. your final word. >> no, it is not. it is horrendous. of course the democrats are downplaying it. because they're the ones who are doing it. that is why our campaign has been so vigilant in trying to

stop it around the country. you know we're blessed in florida. we have a great secretary of state. we have a great governor. our system shut down for a while in florida, so we extended it to register to vote. we play fair. some states don't. that is why we have to elect conservative governors that will have conservative secretaries of state because we've got to fight voter fraud. again it is non-step. it will be non-stop. that is why people need to go to the polls. people need to get out there to vote, to combat this. because, yeah, we'll be challenging this constantly until election day and hopefully not after. elizabeth: all right. pam bondi, great to have you back on. good to see you. we'll see how you're playing kamala harris helped vice president pence tonight will help him. kristin state is ahead. conservative columnist and author. we'll stay on the story and much more with kristin state next.

despite democrats and the media downplaying it. i don't know if you heard the report but found at least at least 15,000 dead people voted in 2016 and 2018. democrats keep downplaying that. what is your reaction? >> for the last four years the democrats tell us they care so much about the integrity of our elections and defended end lis investigations into supposed russian meddling. now that we have actual evidence of voter fraud we don't hear a peep from the media. this should be something concerns all americans regardless of party affiliation. you know, we should be protecting the ballot box from illegal activities, especially, liz, since so many of these critical swing states in 2016 were decided by a very slim march begin. fewer than 80,000 votes strung the 2016 election. so voter fraud could really have an impact especially in these states like north carolina,

michigan, wisconsin, minnesota, pennsylvania. this is really infuriating but unfortunately the mainstream media is not covering it and the democrats won't talk about it because typically the fraud benefits them and their party. elizabeth: you know in 20,161.8 million voter registrations were -- in 2018, 1.8 million people registrations were for dead people. doesn't mean they voted. nearly 44,000 voted more than once from the same address. in 2016, 38,000 did as well in 2018. the issue, florida, in 2000, the year 2000, bush versus gore, that was decided by just 53votes in florida. so this is an issue. >> that is exactly right. keep in mind this voter fraud that we now know happened in previous elections happened before we had mass mail-in voting. now we're doing this mass

mail-in voting where sometimes in some states you have ballots being mailed to addresses without people even requesting them. voter rolls are notorious for being inaccurate. it is no surprise this is happening, but donald trump and great news networks like fox business and fox news need to continue shining a spotlight on this, to that is the only way you really know your vote is safe, secure and counted. liz: is so also this: why are we all of a sudden launching this gigantic nationwide science project experiment of putting the election in the hands of what's a been said to be, unfortunately, one of the most dysfunctional agencies, and that's the u.s. postal service? remember the joke the check is in the mail? is it going to be the now the vote is in the mail? because there's been a lot of

delays and problems with the postal service. why do that now? >> it's a great question, liz. every time you get the federal government involved, things go wrong. and we cannot afford to have things go wrong with especially on a mass scale during the most important election of at least my lifetime. i mean, right now we are deciding the fate of the nation. we have two parties who want distinctly different things for the future generations of this country. we have one party who wants to do away with law and order, who wants top-down control over every aspect of american life and wants to abolish police, and then another party trying to defend our economic and personal freedoms and liberties. this is so critical, this election, and we cannot have it endangered by mass mail-in voting fraud. liz: kristin, the debate's coming up between vice president pence and kamala harris. what will you be looking for? final word? >> i think kamala harris is going to make covid and the
