"washington times" opinion editor charles hurt, let's take the story on first, charles. who won the vice-presidential debate? who got the undecided voters. by the way, good to see you. >> good to see you, elizabeth. you know in as much as there are any undecided voters out there that are tuning in at this point which i'm sort of highly skeptical of because people seemed to be so set right now and have been for a while i would think that if you landed on planet earth from mars and just watched the debate you would have seen kamala harris, she was defensive and a bit, a bit snappy at times and didn't have a terrific command of the facts i don't think and you would have seen a guy like mike pence who had, i thought handled himself beautifully. he had perfect command of the facts and of course you know, had a winning message i think and i quite frankly, i hope that

president trump can look at that debate and realize that you know, these debates are not rallies. they're very important, great opportunities to make your case for why you are the person to be, who needs to be in charge of the economy. you're the person who needs to be in charge of our health care for the next four years. elizabeth: president trump doesn't want to do a virtual debate october 15th. here is what he is saying. he is saying things, joe biden could be in a room with cue cards, staff, you know, teleprompters an earpiece. remember the george w. bush debate he was accused of having a wire in his back. so there is -- >> that's right. >> take out the names trump and biden. it is about fairness here. there is a reason why we haven't had a virtual debate in 60 years since the kennedy nixon debate which was effectively virtual debate. people will be accused about

cheating. we'll waste airtime talking about cheating instead of policy solutions to fix the country. i think that is what the debate is. >> i think the entire thing becomes about process and when we're arguing about process that is never a winning message for anybody involved. certainly not anybody who wants us to make some progress here. you know, a regular, whether it is town hall-style debate or an in person mano y mano debate on a stage with a moderator, however that is, donald trump won the 2016 election based on the issues. he can win this election based on the issues and, anytime we're talking about debate rules, you know, obviously the moderators, we have seen have been, moderator last night, for example, the number of questions, the tough questions that she had for mike pence, the softball questions she had for kamala harris, it is so obvious.

kite frankly i think viewers sort filter that in but if we're talking about things like that, donald trump and mike pence are failing to win on the issues. they can win on the issues. talk about the issues. that is the only way they're going to win. elizabeth: it has been talked about how about no moderators. don't have any moderators, right? that is issue too. >> fine. that would be great. elizabeth: up to speed, what is going on, the trump campaign offered to move the debate back a week to october 22nd. move the third debate to october 29th. joe biden is doing abc town hall the need of what was supposed to be the second debate october 15th. nancy pelosi will say talking to democrats tomorrow about invoking the 25th amendment. get the viewer up to speed what the doctors are saying about the president's condition. he has been fever free. he doesn't show symptoms. he doesn't need oxygen and basically does have antibodies. no indication he is immune to future infections. that is where it is at.

nancy pelosi on the 25th amendment. your take on that? >> here's the crazy thing about this, elizabeth. if the polls are all correct and joe biden is winning by 10 points or 20 points, if democrats have this election in the bag the way they're claiming that they do, why are they being so desperate right now? why is nancy pelosi out there talking about wanting to invoke the 25th amendment? it really does sort of have me second-guessing whether they really are so confident they have this thing in the bag. either way, we have an election in three weeks. it tells me that she is banking far more on trying to stir the pot and whip up all of this trump derangement nonsense. that is what she cares about. she didn't care about governing. she doesn't even care about wing the election. she just wants to score points with their rabid base who hate trump. the blind hatred of trump. that is really, really bad place

for us as a country to be in, and even worse place for democrats to be in. elizabeth: you know trump wants to do rallies. he is saying he wants to do rallies as soon as next moaned. you know, trump supporters have told us they said, quote listen, we don't like the crazy things he says. we don't like his personal attacks. what they do like he is trying to get things done, fix the country, work, he is working to fix the country. they like his actions. that is it what they're talking about when it comes to president trump. >> right. elizabeth: it's clear that certain individuals in the media and on the democrat side don't see that. if you're a fair-minded, rational logical person you would be fair seeing that and understand what is going on in the country. now you have things like nancy pelosi saying invoking the 25th amendment. move on what is going on the polls. i want your take, real clear politics average up 9.7%. in "real clear politics" average

of 14 polls. we see different battleground state polls shifting and moving. now we got nearly six million people voting. that is more than 70 times when it was in the last election cycle. who is swinging the vote now? there is a lot of talk about the pandemic moms or the soccer moms and they want to feel safe and they're concerned about the chaos in d.c. is that what is going on? what do you think? >> i do think that there is this, this sort of, i call it the make it stop election where they're are a lot of people, i'm trying to think, because obviously you know i think trump is doing a terrific job and four more years. he have doesn't need to make the case to me. i followed all of it i know he earned another four more years. i try to think about it from other peoples perspective there are intelligent logical people out there, who love america who want all the insanity to stop. elizabeth: yeah. >> joe biden is trying to make the case you vote for me, you're

security official. we don't know how the outbreak happened at the white house. charles hurt, great to have you on. come back soon. okay. great to see you. elizabeth: thanks. turning to a shocking and disturbing story the fbi charging 13 people including people linked to militia with a plot to abduct michigan governor gretchen whitmer with a storm the state capital and basically start a civil war. fox's garrett tenney with more. reporter: liz, federal prosecutors say this group was actively planning and preparing for the operation which they planned to carry out before the election. according to the criminal complaint, the six suspects who have ties to a militia group were planning to kidnap michigan governor gretchen whitaker and take her to secret location for a quote, trial. they have been training for

combat drills, gathering materials for explosives around conducts surveilance of the area to better plan their attack largely organized by suspects adam fox and barry croft. >> fox and croft in particular according to the complaint discussed detonating explosives devices to divert police from the area of the home. and fox even inspected the you know side of a michigan highway bridge for places to seat an explosives. reporter: in one encrypted conversation obtained by the fbi the suspects allegedly described governor whitmer's strict restrictions in the pandemic as uncontrolled power with no checks and balance they said quote must come to an end. this afternoon whitmer thanked law enforcement for stopping the failed plat and suggested president trump is partly responsible. >> when our leaders speak their words matter. they carry weight. when our leaders meet with and

what do you think? >> i think there are two-ways to measure a debate, one is substance and the second one is optics. first to the optics, what you saw with i saw all night long was one candidate smirking, laughing, shaking her head incredulously, being disrespectful, her tone of voice being condescending. the other side, the candidate behaving like a complete gentleman. optics, winner is pence. when it comes to substance, i will say something here, if the trump campaign wins in november, i think you're going to say last night was the turning point in the campaign. why do i say that? because on issue after issue after issue on substance the vice president nailed the biden-harris, ticket, whether it was on taxes with a massive tax

increase coming, whether it was on fracking, whether it was on abortion and finally on packing the courts. i think everyone who watched saw the disingenuousness of a campaign that simply will not tell the american people what they're going to do. we just heard today by the way, joe biden saying he will not tell people until after the election whether or not he will destroy the supreme court. i love it. elizabeth: okay. interesting. so here's, also, what else happened. kamala harris opened hard on covid-19 but the question was, what would biden-harris do differently on cove cover. pence firing back, biden, you're copycatting the trump plan. brought up biden's plagiarism. >> mr. vice president, i'm speaking. >> you're continued undermining of confidence in a vaccine is just urn acceptable. the reality talk about failure

♪. elizabeth: let's welcome back to the show former independent counsel ken starr. okay, ken, i want to break it down for the viewer and i want your reaction to this. the justice department released newly declassified fbi documents to general flynn's lawyer sidney powell. the documents are devastating. it is showing fbi, top lawyers at the fbi, it is handwritten notes from the fbi's top lawyers vindicating a.g. barr's decision to toss out the case against general flynn. let's show the viewer what the fbi lawyers are saying at the time they're trying to go after flynn. that, quote, no reasonable prosecutor would charge flynn under the logan act. it would be quote an uphill battle. that general flynn's call with the russian ambassador was quote, not out of the ordinary t was similar to other presidential transition teams what they did. it would be the first time to try to use the logan act like this, devastating stuff.

what was your take when you saw it? >> my take was poor general flynn and what a travesty of our justice system. you know, usually in investigations you get a mixture of evidence and you then make a judgment call. here the evidence, liz, is so overwhelmingly in favor of general flynn. that the professionals, the honest professionals in the fbi of whom there are many, indeed most, said no prosecution. i love that term, no reasonable prosecution. that means only unreasonable prosecutions and politically motivated prosecutions would be undertaken. so this is a complete affirmation of the vindication of general flynn. the prosecution shouldn't have been brought by the special counsel. elizabeth: so, the timeline here is these fbi lawyers wrote these handwritten notes the day after peter strzok and joe piaknk

interviewed general flown at the white house. they say it is unreasonable for obama and biden to go after michael flynn via the logan act. you remember biden was the one brought up the idea. the theory that flynn is in covert relationship with russia it is not proven out with the interview with flynn and what the documents show. so basically pushing back saying you know what? obama and biden and his team are being unreasonable. that they're being unfair, right? is that how you -- this is how we're reading the documents what the fbi lawyers are saying? >> i think there is no other reasonable interpretation of these documents. and first, let's just remind our viewers, that the logan act had not been used by the justice department in well over a century. it has profound first amendment concerns but i think it has fundamental separation of powers

concerns because general flynn in having his conversations with the russian ambassador was doing his duty back in december. he was doing exactly what he should been doing. he wasn't free-lancing. he didn't go rogue the way the fbi leadership under jim comey went rogue. this is part of the tragedy and really the unfairness, the fundamental unfairness to general flynn here. those who were acting professionally in the fbi, including lawyers said, don't go there but yet we have even vice president biden flagging the possibility of the logan act that here is a private citizen engaging in foreign policy. in other words going rogue. and that is simply very unfair, profoundly unfair allegation to even entertain much less to seriously pursue. elizabeth: i want to just give some more information to the viewer what was said in these handwritten notes by the fbi's

lawyer, the day after anyone was interviewed at the white house. the fbi theory that flynn is in a quote, covert relationship with russia, no, probably not based on facts to date and the interview. also there were predication issues with even bringing the case to begin with. according to the fbi's lawyers, fbi lawyers, ken, they're saying how can you charge flynn with lying to fbi investigators when you would not even prosecute the underlying crime? so that is ag barr's position. >> i agree with that. lying to the fbi is a very bad thing and you shouldn't do it and so a hard-nosed prosecutor may say, you know, i will go after it anyway, perhaps get an indictment but that was not this case. we're not talking about general flynn somehow not sharing the fact, which he knew there were in fact conversations with the

russian ambassador. so it just again proves that the problem and it was a fundamental moral problem as well as a lack of professionalism problem in jim comey's fbi beginning with jim comey and his senior leadership, i were concluding of course peter strzok whose hands are over so many very diabolical things at the fbi leadership did during the transition, during the campaign and so forth. so i wish, here's wish. i wish director wray would give a blockbuster speech condemning the jim comey fbi once and for all but we may not get it but here is what we do have, the horowitz inspector general report determining that very bad things were done about it fbi and this is just another affirmation of it. but this time going to the very top into the oval office. elizabeth: yeah. so you know, listen, the critics have said you know, michael flynn should have registered as a lobbiest when he was working

with the government in turkey. got that. he shouldn't have lied to vice president pence about the phone call. got that. but what happened after that, was the fbi case was falling apart against michael flynn. the oval office meeting with obama, susan rice, james comey, sally yates, joe biden, talking about what we do next. obama says put the right people on it. they keep the flynn case over even at the agents said shut it. then you have the white house interview turns into a criminal interview without telling michael flynn. they talked about not reading his miranda rights. not having a defense lawyer for flynn at that interview he is then alleged to misled the fbi officials and lied to them? is this how we want our government to be run? is this what america is all about? >> it better not be. so i think we have honest cops, i wish chris wray would speak out more. but at least we have no reason to question his integrity.

the fbi has to be characterized by integrity. there is another dimension of it. in addition to what was happening at the time we also know exculpatory material, that is evidence that was very important to general flynn's defense, was not being turned over to him. so even later the special counsel's office compounded these errors. elizabeth: yeah. so that's due process and 14th amendment problems. ken thanks for joining us. ken starr, thank you for your insights. good to have you back. >> my pleasure. elizabeth: sure. next up former federal prosecutor jim trusty, he is taking on this story, why the media and democrats push trying to undercut and discredit newly declassified government information alleging that hillary clinton had a disinformation plan to link trump with the hack of democrat emails by russia. why their push will fail.

july 22nd, 2016, the democrat emails, the hacked emails are published. russia hacked them. the hillary clinton campaign fires back. they're fighting back. they generate the now debunked steele dossier that might have, likely had russian disinformation on it. they financed it. the hrc campaign and dnc financed the steele dossier. now watch the clinton campaign laying the groundwork in july 24th, they're going on the media, campaign official robby mook, while the dnc hack was in the news, he goes on tv to try to link trump to russian hack of democrat emails. watch this. >> experts are telling us that russian state actors broke into the dnc, stole these emails and other experts are now saying that they are, russians are releasing these emails for the purpose of actually helping donald trump. i don't think it is coincidental that these emails were released on the eve of our convention here. that is disturbing.

i think we need to be concerned about that. we need to be concerned we also saw last week at the republican convention, that trump and his allies made changes to the republican platform to make it more pro-russian. elizabeth: here's the problem. cnn should have said right there what is your proof trump is connected to the hack? so you see that right there from the get-go it is starting. that same day, "the new york times" reported trump being too close to russia? that that was quote emerging as a theme as mrs. clinton's campaign. you see what the clinton campaign was doing, laying the groundwork immediately in the media and they're now pushing back not pushing back saying to show us the proof. >> you're right calling it a theme. they went with the russia bogeyman at trump's expense when really they were using russian false information to tarnish him and distract from the problem she was facing. the politics about it are really

not particularly deniable now in terms of how it played out, the motivation from the memo that was back in time when this was breaking, seems to have been accurate. what i think is more surprising, more disturbing than a political campaign doing these things or acolytes in the media accepting it, that the fbi knowingly embraced it. that is the issue. they're on notice from the intelligence referral is not just suspect, not just possibly political but intentionally false. so i think you have to connect the dots to the fbi part to think about john durham's probe, why are we getting information now? what does it show about the knowledge of peter strzok and james comey when they were specifically told false information coming from the hillary clinton campaign? elizabeth: you know, to your point a few days after clinton reportedly approved the disinformation plan obama's cia director john brennan tells obama, james comey, the fbi director then and susan rice and

it. what the department of justice traditionally had a 60-day moratorium on investigations into candidates that are running for office before the general election but in this case bill barr and the justice of department are correct, suspending that rule, changing it, so u.s. attorneys can look into voter fraud if they have evidence that it is occurring. elizabeth: you know in the year 2000 bush won florida by just 537 votes and then won the election. i don't know if people remember that. we're talking about winning elections with just 537 votes in the year 2000. you know, they're talking about misconduct by federal workers or workers at the u.s. postal service. you know the democrats say this is not an issue. we just had a case in new jersey was posted on social media of you know, basically mail-in ballots, nearly 100 of them were dumped and thrown out.

a 26-year-old postal worker has been arrested. that is just in new jersey alone, sir. >> yeah, liz. there will be examples all over the country because i think the american people are on guard in this case and whether it is the postal service doing their job and in these absentee ballots or places like california where every registered voter, even if they have been dead for 10 years are receiving bat lots in the mail. there potential for fraud. let's hope the american people are good and decent. all we've see is we need a few bad apples as you seen in the past. you can wreak havoc. a mayoral candidate in texas had 100 absentee ballots he requested fraud lently. there is examples here liz. i'm glad the deep of justice is on it. elizabeth: matthew, thanks for coming on. come back soon. >> always enjoy, liz.

♪. elizabeth: okay. back with us now is former i.c.e. acting direct tomorrow ronald vitello. great to see you again, ron. i.c.e. arrested -- god to see you too. never got the hang of that. i.c.e. arrested more than 1100 illegal aliens including those convicted of murder? why? because state of california let them free. how can sanctuary states let convicted murders go free? >> this is not good, it undermines law enforcement and endangers public safety and makes it hard to protect the homeland. the employees methodically plan and go out, risk are their own personal to find these people in the wild. traffic stops or homes or businesses. when california or the jurisdiction they're in, the county jail could turn those people over very quickly and safely and in the jail setting.

notice july and august. 5% of those arrested had criminal convictions. i.c.e. is saying los angeles releases back into society 100 criminal illegal immigrants every day? is that true? that's a lot. >> it's terrible. 95% of everybody they came in contact with either had a criminal conviction or an arrest for serious felony. this gives you a demonstration how dangerous this could be. let's think about this, 30% of those people will go out to reoffend. when you take those people into custody, they get, immigration hearing and get deported. those are preventable crimes. the third that will go on to reef offend, you can prevent that misery in these communities. elizabeth: so sanctuary cities are helping, aiding abetting these individuals to recommit crimes and victimizing innocent people, including as you point out in immigrant communities. go ahead. >> they're a safe harbor for gang-bangers and people that want to commit crimes. it puts pressure on the border.

it puts pressure on law enforcement t puts pressure on citizens that want to live in a safe society that believes in the rule of law and law and order. elizabeth: so can you ball park it for us? how many criminal illegal aliens have been released back into society after arrested by sanctuary states and other jurisdictions? >> tens of thousands. there are entire states like california. every jurisdiction is prohinted from cooperating with i.c.e. there big cities like chicago, new york, the largest cities in the states. they're all sanctuaries. they refuse to cooperate with i.c.e. authorities to help prevent crime and remove aliens in the country illegally and also gone on to commit another crime, forcing them to be arrested in that jurisdiction. so the police can take them off the street but then they don't want to take the additional step which costs them almost nothing to help i.c.e. get them out of the country. it makes no sense. elizabeth: what is that step? >> they honor the detainer that

i.c.e. files. elizabeth: what does, what does, tell me what does i.c.e. simply want? >> they want to be able to go to the jurisdictions that are holding people for crimes. they want to file a detainer. so when that person is ready to be released 48 hours before justice has been handed out whether they have been sentenced convicted and served their sentence or charges have been dropped you make a phone call to the i.c.e. officer. they send immigration agent over there who takes them into custody and moves them into deportation proceedings and removes them from the country t makes it safer for everybody. in moles of my career you could hand a detainer to a deputy on the side of the road, that the county calls you when the person's case is ajudicated. it makes it safer for everybody. elizabeth: ron vitello, thanks for your service to the country. thanks for coming back on the show. you will be back on soon. good to see you, ronald individual toll low. >> thank you. elizabeth: sure. i'm elizabeth macdonald. you've been watching
