♪. elizabeth: okay. welcome to the show. you're watching the fox business network. court watchers had to wait nearly five hours to hear from judge barrett as democrats fought with republicans against her nomination. senator lindsey graham says she will be seated by october 27th. many asking, was today's hearing about judge barrett or president trump? this was the first of four-days of hearing. the gop fighting to stop it from gets nasty as the kavanaugh or bork hearings. welcome a former clerk to judge amy coney barrett. she is amanda rauh-before. ri. thanks for joining us. are you sure, are you worried it will turn nasty? >> you know, i sure hope not. i guess, i'm curious as the next person to see what the next few days of hearings will bring. i think the highlight today of course is hearing from judge barrett herself and she, after, you know, sitting through several hours of opening

statements exercised the same kind of poise and grace that i know that she will continue to exercise. i guess we're just going to have to see. elizabeth: so judge barrett would secure, seating would secure the conservative tilt on the top judicial body for a generation. is she going to stop the democratic legislation? will she step obamacare? they talked about it 140 times. will she weigh in on abortion, gun control, that is what they were talking about. judge barrett said she will not legislate from the bench. what do you think? >> we heard a lot today about policy, that is the key word, policy and policy for our elected officials that is their job and as judge barrett said today in her speech as she said many times before that is not the role of a judge. a judge is there toe apply the

law as written and judge barrett as she has shown on her time on the court of appeals and she will do if confirmed to the supreme court will continue to be a fair and independent judge. she is going to approach each case with an open mind. she will listen to the arguments on both sides. at the end of the day she will faithfully apply the law and fairly apply the law and uphold our constitution. elizabeth: so we know that she's, you know, weighed in on a case prior to this just in line with justice scalia who i think she interned before on obamacare, right? she essentially said, the question whether the individual mandate is constitutional. people, you know, those on the left are worried about her catholic background as it comes to abortion. what do you think about that? >> well, a couple of things. first, judge barrett has been

clear multiple times that her private preferences, her policy views, on any issue in any case have no bearing on the way she ultimately is going to decide a case. she shared that in common with her mentor justice scalia, who she spoke of today, spoken fondly on many occasions. that is what it comes down to. she is a judge who faithfully applies the law and she is going to do that in every case in front of her on the supreme court. elizabeth: so she can split away her background, her religious background from ajudicating cases, is that the point? >> yes, exactly. and that is exactly what she talked about. we heard her speak about that today, how judges have to put aside their policy preferences no matter what they may be because it is their task under the constitution is to apply the law as it is written. it is the job of congress and the job of our policymakers to

make those laws but it is not the job of the judge. elizabeth: okay. we hear what you're saying. we warned about this. we reported on this a few weeks ago and it is happening now. democrat senator chuck schumer says that the democrats will try to stonewall her nomination by basically trying to block what is called a quorum on this panel, meaning a quorum of votes to push, to get her nomination through. the problem with that, republicans are in power. they can do, you know, push nomination through with different procedures. i'm bringing that up because this is indicative of what is happening on the democrat side of the aisle. senator kamala harris was front and center today. this is unprecedented. she is the running mate on the democraticket that election is three weeks away. you know, so what they're talking about is a big story right now is joe biden is basically not answering own whether or not he would endorse packing the court. we're going to show a sound bite on joe biden for just a minute. i want to point out kamala

has chosen a fantastic nominee. we heard from her in her statement today, talking about her qualifications for the supreme court, her background, her formation, i think the focus in the coming days should be on her qualifications for that position. elizabeth: i hear what you're saying. the question is, is the democrat gameplan if biden should win and democrats take control of the senate. they want the green new deal. they want "medicare for all." they have a tax hike agenda. pack the court, eliminate the filibuster so they can do whatever they want with a majority. more democrat seats, add more democrat votes by making d.c. and puerto rico states. your former boss is saying listen, i will go in there to do my job. i will not legislate and from the bench and do it in the

♪. elizabeth: welcome back. you're watch being the fox business network. we're coming into the bottom of the hour. joining me now, back with us, house oversight ranking republican. he is congressman james comer. always great to have you back on, congressman. what is the next shoe to drop in the declassification of documents? the president is saying more, quote, breathtaking documents about the abuses of the obama administration in the trump russia and flynn probes what do you think will be happening next? >> well it appears that next john ratcliffe is going to make public the handwritten notes from cia director brennan which apparently shows that president obama had knowledge of this

whole investigation and that it was potentially a hoax. it also shows at that the cia director thought that maybe hillary clinton's campaign was colluding with russia to spread disinformation. so this is pretty damning evidence, if true about obama and biden's involvement in this from the start because remember, they have always said that they didn't know anything about it. also we've heard that brennan asked james comey and peter strzok to investigate hillary's involvement with russia. none of the documents that we've been able to find ever showed where comey and struck did in fact investigate clinton's role in any potential collusion with russia. elizabeth: we don't know, yeah, we don't know if that was a referral for an investigation or head's up memo saying to james comey and peter strzok from the cia director saying this is what is going on. this is the intelligence we have out of russia.

this is what hillary is doing, is thinking of doing is linking for the president to the hack of democrat emails by russian military agents. you know, we're hearing, so you're saying that you're hearing that cia, former cia director john brennan's notes will show him talking about a collusion between hillary and russia. because we're hearing a foot tall binder with hundreds and hundreds of pages. we know dni ratcliff gave nearly 1000 pages of material to u.s. attorney john durham about his investigation. what do you hear about the brennan notes, what can you tell us again? >> we're hearing that he wanted comey and strzok to investigate any potential role hillary had. that has never come out before. that has been the frustrating thing. so many documents were classified and they were redacted but now we've found

apparently with ratcliff, he is trying to be very transparent which is what the american public wants and deserves is transparency here because, remember this is what the democrats tried to overthrow a president of the united states through impeachment and we've learned since it was a complete sham and now we're learning that potentially clinton could have been involved in some role with russia. so there is a lot of, there are a lot of questions to be answered and looks like we have some new evidence here. elizabeth: so it is two threads with hillary clinton, her campaign. in other words the democrat emails get hacked, you know, she has got her own private email server scandal going on. they go on go fronts. that is, try to link trump with the hack of the democrat emails and try to smear trump with the steele dossier. we're finding that democrat lawyers from the affiliated with the democrat national committee actually met with top officials at the fbi in the fall of 2016

talking with them about the steele dossier before the fisa wiretaps were, you know, gotten by the fbi, based in part on the use of the steele dossier. so we're finding that too, that dnc lawyers met with the fbi in the fall of 2016. possibly to talk about the steele dossier. we don't know. we're drilling into the bottom of that. i want to take a listen to former acting dni ric grenell on this. here he is talking about what happened behind the scenes at the obama administration. let's listen to this? >> comey is accused of seeing those warnings. brennan is accused seeing those warnings. susan rice is accused of seeing those warnings. barack obama and joe biden are accused of seeing the warnings and the information that this was a russian collusion hoax. we now know that insiders in the government at the cia, at doj, at the fbi, they knew that this was a russian collusion hoax.

toss out the flynn case for fbi abuses. who exactly said keep it open? because former fbi director james comey testified in congress in 2017, he told congress yes, i ordered the flynn case shut in december 2016, early january 2017. so who kept it open? >> so look, mr. comey doesn't have a ton of credibility in this area. what we have now documentarywise is a paper trail that shows the case was going to be shut down, peter strzok, our famous agent here, reached out to the people that would shut it down, they said no, no, the seventh floor wants it open. i don't think for a minute that he was in collusion with comey, which is the seventh floor. doesn't mean the absence of political players but the fbi chose to keep that case alive. and i think that rests at the very top. elizabeth: let's listen to former independent counsel saul

your only purpose is to catch somebody in what you think is a lie. it is very clear when you look at the timeline, when you look at everything, that that's what was going on. and you mentioned something else i think is very important. there is now evidence that has come out in recent weeks that they were really ready to drop the case on flynn in early november. the question is, who kept it open from early november until january 4th? that is something we still don't know the answer to. elizabeth: so november, november they wanted to shut the flynn case. who is keeping it open? william barnett, the former fbi agent said they were keeping it open, the flynn case open as kind of a place holder to keep going after trump. what do you think happened? >> it is a circumstantial case right now but sometimes circumstances are pretty darn damning. look, there were so many actions that were completely in bad

faith by the fbi when it comes to general flynn. i don't know if general flynn is an angel or a saint or sinner, all points in between. it doesn't really matter. the conduct of the fbi is truly outrageous, keeping the case open, doing an ambush interview, avoiding white house counsel and avoiding the attorney general that comey did to sally yates' expense and even having discovery violations during the case. start to finish, everything about the case raises the red flags about the use of investigative resources to go after somebody connected to the trump administration. elizabeth: yeah. at one point james comey testified, you know, we did take advantage of the chaos of the incoming trump administration. one of his former assistants actually quoted james comey saying you know what? we're going to do this. screw it. here is the other thing. susan rice's memo five days before peter strzok and joe pientka sit down with michael
