klobuchar led off the day's venomous assault. >> this isn't a rush to justice, this is a rush to put in a justice. we are dealing with a president who doesn't think truth matters, and he has allies in congress who in the past defended our democracy but are now doing his bidding. yes, judge, i think this hearing is a sham. >> more than 9 million americans have already voted, and millions more will vote while this ill legitimate committee process is underway by replacing justice ruth bader ginsburg with someone who will undo her legacy, president trump is attempting to roll back americans' lives for decades to come. lou: the democrats, the party of hate. the radical dems made no arguments today against judge barrett's credentials, her

character and capacity, but they did define the confirmation hearing as a litmus test for the future of obamacare. it's a topic that law professor jonathan turley says is entirely inappropriate for the senators to even discuss. >> the assumption being made, sort of brought through with all these pictures, is that this future justice is going to end health care for all these individuals. that's just not likely. and, but more importantly, the arguments on the merits of the aca, in my view, are really inappropriate for a confirmation hearing. lou: and the radical dems, do they care about propriety? of course not. they will make this hearing just as they did in the hearing for justice brett kavanaugh, all about the politics of hate and the democrats' love of the politics of personal destruction.

republicans, on the other hand, focusing on judge barrett's qualifications and her character. senator ted cruz today used his time to call out that glaring difference between the two political parties. >> to every democrat who's spoken, we've heard virtually not a single word about judge barrett. we've heard a lot of attacks of president trump. we understand our democratic colleagues are not supporters of the president, but we've heard very little about the nominee who is here and whose confirmation we're considering. and i think part of the reason for that is that on any measure, judge barrett's credentials are um peck bl. impeccable. lou: impeccable, but the democrats, they refuse to concede that, and instead they go on against the president of the united states. for more on the day's hearing and what judge amy coney barrett had to say and is looking

forward to, we turn to hillary vaughn in washington. hillary. >> reporter: lou, senate democrats used the majority of their opening remarks to talk more about the president than the nominee seated in front of them, so judge amy coney barrett used her opening remarks to tune out the partisan back and forth and, instead, talk about her legal philosophy. >> it was the content of justice scalia's reasoning that shaped me. his judicial philosophy was straightforward. a judge must apply the law as it is written, not as she wishes it were. >> reporter: two years ago democrats attacked judge amy coney barrett's faith during her 2017 appeals court confirmation hearing when the top democrat on the judicial committee, senator dianne feinstein, told barrett, quote: the dogma lives loudly within you. but that got blowback from both sides, and democrats say they are not going there this time.

when it comes to the fate of obamacare, they do want to go there. senator object. nut anyone i tries to attribute to you a policy position and hold you to that, you're not a policymaker, you're a judge. >> reporter: senate democrats have criticized the timing of this hearing just three weeks out if election day and called it court packing, but senate republicans rejected that claim today. >> we're focusing on jamming through judge barrett. i think this constitutes court packing -- >> and anybody who uses that, the language that implies filling legitimate vacancies is actually just another form of court packing, that's playing the american people for fools. >> reporter: tomorrow senators will begin questioning barrett,

and then thursday outside witnesses will testify. senate judiciary chairman graham has promised to get a floor vote on judge barrett by october 22nd, but some democrats are already calling for a potential justice barrett to recuse herself from any case reviewing the outcome of the election. lou? lou: hillary vaughn, thank you very much. i seldom agree with senator sasse, but the fools were in plain sight today and behaving as such in that committee hearing. president trumped today weighing in on the confirmation hearing. president trump tweeted some advice for republicans on the senate judiciary committee. president trump said in part, quote: the republicans are giving the democrats a great deal of time, which is not map map -- mandated to make their self-serving statements relative

to our great new supreme court justice. president trump is now on his way to florida for his first campaign rally since recovering from the china virus. white house physician dr. sean conley said this weekend president trump is, quote, no longer considered a transmission risk to others, end quote. president trump has a busy week of campaigning planned. he is in florida tonight before holding another big rally tomorrow in pennsylvania. then it's on to iowa wednesday and north carolina thursday. that's right, four stops for the newly-recovered and highly energized president in four days. in other words, president trump is back. the dems' nominee, joe biden, however, quite a different story. he made his own campaign stop today in toledo, ohio, and there biden appeared at times confused and dazed, often yelling and even mucking up what

left-wing rioters and looters and thugs stormed the streets. a story that the corporate left-wing national media refuses to report on in these final days of the election. and they have really not done very well for the past six months, have they? antifa and black lives matter rioters declared a, quote, indigenous peoples day of rage ahead of columbus day. the militant crowd used chains to topple statues of abraham lincoln and teddy roosevelt. president trump predicted this when they were taking down i statues of confederate generals. the looters and rioters also destroyed the entrance to the oregon historical society. they smashed several storefronts all across the city. and there are growing questions this evening about a man who shot and killed a trump supporter in denver this weekend. just who is he? police say the shooter was a

private security forward for pinkertons, a local news station had hired this many. but his name doesn't appear on any list of registered security guards in denver, which requires that. fox news correspondent alicia acuna has this report from denver. >> reporter: it was a violent weekend in at least a half a dozen big cities heading into the columbus day holiday. in denver, a man was shot and killed during dueling demonstrations between antifa and the patriot rally group. police are holding a 30-year-old under suspicion of first-tree murder. a local tv station says i it hired him as a private security guard to work with its crew to cover the events. officials say he was not licensed to be a security guard. >> there there didn't seem to bn altercation, there wasn't yelling, the victim didn't appear to be -- >> reporter: video shows the victim spraying the suspect with mace just before the fatal shot.

>> civics is the stuff we're all supposed to agree on regardless of policy view differences. civics is another way we talk about the rules of the road. civics 101 is the stuff like congress writes laws, the executive branch enforces laws, courts apply them. none of that stuff should be different if you're a republican or a democrat or a libertarian or a green party member. this is basic civics. civics is the stuff that all americans should agree on like religious liberty is essential. people should be able to fire the folks who write the laws, and we can't -- the voters can't fire the judges. judges should be impartial. this is just civics 101. politics is different. politics is the stuff that happens underneath civics.

civics is the overarching stuff we as americans agree on in common, politics is the stuff that we differ about. lou: sasse was giving less of a lecture to eighth graders than to his democratic colleagues on the injurity rich committee -- judiciary committee. but an important lesson on civics, nonetheless, for all of the radical dems in this country. breaking news, "the wall street journal" editorial board has called president trump's criticism of attorney general william barr misguided. they say in their editorial that the president should trust barr's decision not to indict anyone involved in obamagate before election day. effectively, "the journal" is telling president trump that he shouldn't concern himself with something so immaterial and irrelevant as his reelection and should take his cues from their august e editorial board

congressman jim jordan. he's the ranking member of the house judiciary committee and the house oversight committee. congressman, great to see you. we have never had -- >> good to be with you, lou. lou: -- in my experience, any candidate for president of the united states say that the people don't deserve to know his position on something that he himself has advocated. >> yeah. no kidding. and, frankly, lou, it doesn't matter whether joe biden's running for senate or president, he should tell you the answer to that question. more importantly, he should tell the american people the answer to that fundamental question, are you going to pack the court, are you going to put three new members, six new members, whatever they're going to do, are you going to do that. and by the simple fact that he won't answer it, sort of tellses us they're going to do that if, in fact, they would get power and control of our government. the good news is i i think president trump's going to win and i think, frankly, he's going

to win big. lou: and biden saying that the proceedings to put judge barrett on the supreme court as justice is an unconstitutional act. i mean, this man -- >> yeah. lou: -- making some of the wildest claims and deferring on some of the most important issues one could imagine. >> yeah. but that's a typical democrat. they always accuse us of doing what they're doing. frankly, this is the constitutional thing to do. the president nominates, the senate has advise and consent responsibilities, and they confirm the justice. i think she's going to get confirmed, but this is from joe biden. it shouldn't surprise us. this is the same joe biden who was part of the whole trump-russia hoax. this is the same joe biden who sat in the oval office with president obama, with jim comey, with susan rice on january 5, 2017, we've talked about this before, where they hatched a

plan to take out michael flynn because they couldn't have him being the new national security adviser to president trump and figuring out what they did to the president during the campaign and all throughout the last three and a half years. so, look, we've come to expect all kinds of ridiculous statements from joe biden. today was one of the most craziest when he said the american people, we the people, as our constitution starts, we the people don't deserve to have an answer to a fundamental question that's right in front of us, this whole supreme court situation, and packing the court like the democrats have said they want to do and he won't answer the question? that's another reason why i think he's going to lose and why president trump's going to win. lou: the president being defied by a number of agency heads in his government to be as transparent, to open up the government on the issue of obamagate. he has ordered them, ordered them to declassify those documents and put them before the american people unredacted. as of right now -- >> yeah.

lou: -- there is not a single substantive document that has been produced for the president and for the people. what is your judgment as to what is going on? >> well, look, any more documents we need to see -- let's be honest, lou, we already know the facts. with what came out last week with brennan, with brennan's notes? we know it was hillary clinton conjuring up this plan with the russians to create this false narrative about the trump campaign working with the russians to take heat off of her and the fact that she had destroyed 30,000 e-mails. so we know it was all fake. we know what i just talked about, what took place on january a 3, 2017, in the -- january 5, 2017, in the oval office. we know all this now. so, look, the facts are out there. the fundamental question now is, is there going to be enough evidence for the justice department to actually prosecute people, indict people and hold people accountable. and, look, you and i can't -- we can't make that determination. we can only bring out the facts. you been doing that on your

show, we've been trying to do that, a handful of us in the congress started three years ago, we've been trying to do it, but in the end, it's going to require the justice department to take action if, in fact, they feel they have what's sufficient to actually prosecute someone and hold them accountable. we're just going to have to wait and see. lou: my point, congressman, is we're three weeks from the presidential election. perhaps -- >> yeah. lou: -- the most important in the history of this republic because it may, indeed, determine whether this republic survives. and for the attorney general, the head of the cia, the dni who's done a terrific job in exposing and distributing to the pluck a handful of documents -- to the public a handful of documents, right now they're holding against the president's direct order to declassify and to distribute those, release them to the american people. the american people will, in effect, be going into that

election blind as to the actual documents and the facts right in front of the evidence -- >> yeah. lou: because the deep state is defying the president of the united states. that is a big deal. and not one single democrat has stood up with this president to say, yes, please, let's release these documents, let's expose -- >> right. lou: -- the criminals who tried to overthrow this president. and they have the dee herty to talk about -- temerity to talk about a peaceful transition. they have been fighting, they've made this a five-year transition as they tried to destroy him. >> yeah. and you know what they disliked so much about this president? this president kept his word. more than any politician i know, in my lifetime, president trump told the american people what he was going to do, and then he did it. he cut taxes, he reduced regulations. he had our economy going like crazy. he said he'd build the wall, he built the wall. he said he'd put the embassy in

jerusalem, he put the embassy in jerusalem. most importantly, in the context we find ourselves now, he told the american people the kind of individuals he'd put on the supreme court. he put out a lists, then he selected people from that list, judge gorsuch, judge kavanaugh. then he did it again a few weeks ago, he selected from that list, and we have amy coney barrett in froivet the senate right now, and she will be confirmed. this president has done what he said he would do more than any elected official that i know of, and that's what drives the democrats crazy. because they never do that. they say all kinds of things, or they won't even give you an answer. what a contrast. and i think that contrast is going to come through loud and clear over the next three weeks, and that's why the american people on election day are going to speak loudly for president trump, and he's going to win. lou: well, i think you're exactly right about all of that. i also think that there is a remarkable tale as well in the left-wing national media. this president is putting three justices on the u.s. supreme

♪ ♪ lou: michigan's radical dem governor, gretchen whit her, says michigan's election results won't be fully counted on election day, but don't worry your pretty head about that. whitmer also says election day is just an artificial deadline. she might as well have just said it's a number, just a number! a state judge in michigan has ruled that postmarked ballots may be counted by the state government up to 14 days after

>> well, it shows you they don't care about the vote. it's about power politics, and it's about coming up with a process that may or may not include counting votes that puts the candidate of their choice, the candidate of their choice into office. so, you know, the governor kind of exposed the fraud behind the mail-in ballot push. they don't want rules to apply. as you point out, they'll be counting ballots potentially until at least november 17th, and she's saying maybe beyond that. technically speaking, if they don't know who won by december 3th, michigan may not -- december 8ths, duane may not be able to participate in the system. california will be counting ballots 17 days after the election. i tell you, lou, it's one thing to count ballots that have come in -- let's say you had a lot of mail-in ballots, you got a bunch more than you would otherwise have, but they're all there on election day. and it takes a while to count

them, maybe a day or two to get all the numbers right. we are talking about counting ballots that arrive postmarked in some cases the left doesn't want even postmarks to matter after election day. if you count ballots that come in after election day, you're inviting fraud. and you're undermining confidence -- lou: so let me ask you this -- >> -- in the outcome of the election. lou: the conduct of the democrat party ising nothing new. they're not exactly a surprise organization. and their objectives should be a shock to no one. yet here we are from the most important election certainly of our lifetimes, and the republicans act like they've been caught absolutely flat-footed, had nod idea this was coming -- had no idea this was coming. there are already 9 million votes by mail-in ballot, and the republicans still don't seem to be reacting very vigorously.

judicial watch is doing great work, but you're only one organization. the democrats are throwing hundreds of thousands of people at this effort to control the election, the balloting, the polls. as you say, the vote counting will certainly be interesting. how in the heck did we get to this position knowing for years what certainly you and i have known, that there's going to be a real contest here for power? >> well, you know, republicans have been late to the game here. at least they're litigating in an aggressive way, frankly, thanks to the president. and i'm not saying because i like the republican party, it's just that i don't want votes to be stolen. i don't want the elections to be rigged. what i'm more concerned about is the -- lou: too late. too late, partner. >> -- the justice department hasn't been anywhere on this. they haven't done much to clean up the rolls, they've done no intervention es in these

outrageousers to really, in my view, it's about voting fraud. there are people whose votes are going to be thrown out who otherwise could have been counted if they showed up and vote in person because they were being fraudulently induced to rely on something that's really unreliable in the end or less reliable, which is voting by mail. and so now you're going to have potentially millions of voters not have their votes counted, and the doj knew that was coming down the pike, and they did nothing to stop it. lou: well, we know this, the department of justice, deep state -- what would you call it -- cabal is, you know, they're not there for civil rights and voting rights. they're there to make certain of outcomes. and that is the deal. "the wall street journal" today saying the president was, they wished that he wouldn't be so critical of the attorney general barr because, you know, it's,

really it's a matter of principle, they're sure, on the part of barr to not have a report as he promised, to not have indictments and charges against those he described as nefarious. my word, encapsulating his language. you know, i don't know what to say. your thoughts about barr. is the president being too harsh wanting an attorney general to honor the people's right to know? is the president being too harsh in insisting that the people have the information with which to make a judgment before they go and cast their ballot? my god, the arrogance and the ignorance of the elites in this country whether republican or democrat is suffocating. >> yeah. trust the experts at the justice department. the president can't be president. that seems to be the suggestion, and it's from both the left and the right. they get nervous when the president makes the mistake of

thinking, oh, my gosh, i was put into office here to be president, maybe i should exercise the powers entrusted to me by the american people and not defer to nameless bureaucrats or people who supposedly work for me but who ignore the public interest. you know, this president came to town to clean up the swamp and drain the swamp. and they targeted him and tried to destroy him ever since. and there's been few people out there within his own administration, within congress who have defended the rule of law and him for being victimized here. and i'm just tired of it. and the justice -- lou: he is going -- >> -- has allowed this to go on with impunity, practically speaking. lou: well, in other words, you're not siding with "the wall street journal" editorial board. >> no, "the wall street journal" -- no, look, this is the typical approach from the washington establishment. lou: we don't have time for

♪ ♪ lou: the president back on the campaign trail in florida tonight for a rally. and out in arizona, three former astronauts endorsing senator martha mcsally over former astronaut mark kelly. astronauts tom stafford, charlie duke and jack l are uzma say kelly is much more radical in private than he claims in public, and the latest trafalgar poll from arizona has kelly leading mcsally by two points, within the margin of error.

tom fitton and i have both been named on the same day to presidential commissions. yeah, he was named to a commission on judges -- lou: we reported it. >> right, right. but to have us back to back is kind of interesting, i appreciate it. look, arizona's going to be really tough. arizona is becoming one of these -- [laughter] lou: no, no, i was just laughing. larry, that's funny. i wish i could say i planned that, but the idea of putting -- [laughter] government commissioners on the show back to back -- anyway, i'm not that smart. my producers are -- >> but -- [laughter] anyway, lou, i'm in d.c. this past weekend, and i was there at the invitation of candace owens' organization, pro-cop event, and i caught a red eye after my show, flew through atlanta, flew through washington, d.c., they rushed me off the plane, i gave a full-throated 10-minute speech

which you can see on youtube and on twitter, and then everybody went over to the white house where the president looked amazing. this man just recovered from covid-19. he's, what, 74 years old? it was absolutely amazing. and i hear he's got all sorts of campaign events planned, he kind of dumped on mike pence for not adding more on his schedule. this man is amazing. he doesn't sleep, and as one of your guests said, this man has promised -- this man has done what he promised to do. he supports choice in school. you know how adamantly i feel about that. he's cut taxes, he moved the embassy from tel aviv, and i remember a speech that john kerry gave when he was secretary of state for obama when he said don't even think about trying to do a deal with the arab states without involving the palestinians. whoops. [laughter] the man is amazing. got us out of the stupid climate accord deal, out of the iran

deal, put all these judges on the supreme court, add on the appellate and district court wenches. e -- benches. he has done this against ferocious opposition, as you well know. almost a third of the democratic delegation didn't show up for his inauguration. john lewis, among others, never i attended his state of the union speeches. there was an attempt to invoke the 25th amendment, a two and a half year investigation for -- oh, by the way, the man was impeached, and he's still going strong. this is amazing. and if america was fair, people who hate his guts ought to at least add mire his stamina, his willingness to get up every day in the morning despite the opposition and do what is best for the country. some margin of respect for that. lou: larry -- [laughter] by the way, you left out a few things. he will have named three justices and received four, four nominations for a nobel peace prize. larry, it was great listening to you -- [laughter]
