elizabeth: okay. let's show the email the "new york post" is reporting t shows an advisor to the ukraine company buries marks an advisor to the board emailing hunter biden in april 2015, thanking hunter for inviting him to washington, giving an opportunity to meet your father. it also goes, there is even more emails like this about that. again biden campaign is denying it. twitter and facebook suppressing now this information. there is also an email in 2014 from the same burisma executive, use your influence, hunter, stop politically motivated actions. that is 2014. eight months late joe biden threatens ukraine withholding a billion dollar loan guarranty for ukraine. the prosecutor looking maybe into the burisma board where hunter sat on, that prosecutor was looking at corruption at burisma. this doesn't look good. do you think they dig into it at

election, abortion. reaction to day three? >> good to be with you, liz. what i saw after day one, appears they caucusing talked to their benefactors, clearly got the message they were being too nice to judge barrett and tried to come back today and score some toughness points. it is amazing not only how well-qualified that judge amy coney barrett is, also just unflappable she is. she knows statutes and laws and reasoning of her own opinions off the top of her head but she is also just so impressive in how she has balanced her life. you see that how evidence how well-behaved her children are sitting behind her. you can tell how everybody has everything together. she is not only well-qualified to be on the supreme court and a great person. democrats can't stand that. elizabeth: she did it without

notes. senator kamala harris and democrats trying to delegitimatize judge barrett to talk about her personal views. she said i can't discuss personal views, that is the "biden rule" with ruth bader ginsburg. i can't talk about policy. senator harris and democrats don't want to talk about how they want to undercut the supreme court via court packing. the democrats would really hurt the supreme court with that. it would hurt the supreme court with this bloated seesaw in court that would be unable to check the power of other branches. that is what the democrats want to do, sir. >> no doubt, liz. this court packing is a terrible idea. the fact that both joe biden and kamala harris won't reject it out of hand just demonstrates how radical the agenda is. the simple answer on all these things like the affordable care act and some other policy issues, it is congress' job to reflect the will of the people. the courts as john roberts famously said, call balls and

strikes, officiate what is constitutional, what is legal, how to interpret statutes if congress doesn't write good statutes and surprisingly often don't write good statutes, do the job of judges. the lefts always want the judges to be activist or legislate from the bench and that is not the the tradition of judging. >> senator grassley and senator graham giving reality check to democrats like senator hirono, there are 70 times the republicans tried to do away with obamacare since it was enacted. this is the issue with obamacare as senator graham said. it is democrat push for socialized government-run single-payer health care which is government rationing. it was passed in the dead of night on christmas eve on straight line party democrat vote. all democrats, no republican. overhauled a fifth of the u.s. economy. something of that should have more buy in than that. senator grassley democrats want to distract from the fact that

they're blowing up a covid relief bill that would protect preexisting conditions. needs to be a reality check on exactly what democrats are saying right now turning the hearing for senator, excuse me, judge barrett into a referendum on obamacare. >> that is exactly what it appeared. there were arguments made somehow americans lives would be worse off if obamacare is overturned. now i was in the department of justice when the decision to appeal that series, that case out of texas and ultimately to the supreme court and issue of severability so i know this issue very well. i don't think anybody should expect that the supreme court as it is currently constituted even adding judge amy coney barrett as the ninth justice will necessarily overturn it and throw out the obamacare on the theory that it is not severable once the tax is taken to zero. this is again, congress has the ability to work in a bipartisan manner to construct good

administration or republicans is laughable. i can't think of an out let that has been more tough on the trump administration and more anti-trump but pelosi cannot handle any tough questions. she is not used to it. i mean if a republican handled him or herself that kind of way on air it would make big news, people would be calling it inappropriate, it would be all over the place but she can get away with this kind of behavior because she is a democrat but what this really highlights, liz, is that for the democrats, for pelosi, these stimulus talks, really have little to do with actually helping the american people. otherwise pelosi would put aside politics and work with trump. this is all about politics and optics. pelosi does not want trump getting credit for a stimulus and she wants nothing to do with a deal that doesn't funnel taxpayer cash to blue states and blue cities that have been wildly mismanaged for years long before covid this is about politics. people are starting to realize that.

elizabeth: but there are other negative headlines. remember nancy pelosi showing off her freezer full of ice cream while tens of millions were losing their jobs? you remember when nancy pelosi shut down the media asking why she got a haircut at a salon that had to shut down to covid-19 restrictions. nancy pelosi blamed the salon owner saying that the salon owner should apologize. watch this. >> so i take responsibility for falling for a setup. i think that, this salon owes me an apology. elizabeth: okay. that salon owner, that salon owner then got, you know death threats. this is becoming almost ba rock with the way nancy is behaving ripping up the state of the union address and more. senate majority leader mitch mcconnell will schedule a procedural vote on slimmed down covid relief bill. why politicizing this? >> it is an effort to make

robert i hate to throw a curveball at you what did you think about the "new york post" story about hunter biden and burisma and joe biden knowing about it according to hunter's emails reportedly? what did you think of that story? >> i just heard the clip where the former vice president denied he had any contact with his son in connection to the business which i always found, my reaction at the time i heard it, i reacted that is rather unlikely. now there is prove in fact he did have, not only had contact but his son introduced him into the company. elizabeth: yeah. so this is ongoing story. we'll stay on it. the now you hear the justice department switching gears, to the next case. your reaction to the justice department ending unmasking probe without any charges of wrongdoing and no report? voters should be okay being kept in the dark 39 obama officials susan rice and obama, biden had

identity of trump campaign members and others exposed with intelligence reports? everybody should be okayed with that, names like general michael flynn being leaked to the media? >> there are number of different things this is the investigation conducted by the u.s. attorney in texas at the attorney general's direction. that is john bash. that is separate from the joan durham probe out of connecticut which relates to the fisa court and origins of the russia investigation. own the unmasking investigation, there was nothing wrong with individuals who received information to provide context of intercepts acquired for national security reasons to learn who the other parties were to the conversation. that in of itself is not illegal. now the fact that it was shared within an administration potentially for political purposes although not illegal would present some troubling questions. the way the rubber meets the road honestly whether or not any

crimes were committed in the disclosure of that information to the media but that is a very difficult thing to prove as you know. and it would require the cooperation of the media in order to give up sources in order to make that prosecution something that is always been very difficult to show. so i guess at the end of the day i'm not surprised. elizabeth: yeah. i hear you. feels like washington writes rules to protect itself while the privacy of regular citizens get slammed. this is why people don't serve, not to run for office or serve in campaigns. it just feels terrible. >> look you make a legitimate point you know. right, you make a legitimate point that you know really the public deserves the benefit after report with regard to findings, not my explanation what i think may be going on here. the problem is that that was not a special counsel investigation. that was just done at the direction of the attorney general and generally speaking as we learned through the comey saga, if you decline to file

charges, the department of justice policy ordinarily is that you do not comment with regard to the decision other than to announce a decision that you're not going to file charges. elizabeth: okay. now we hear from foia lawsuit that the justice department is not declassifying trump russia and flynn documents after the president requested that. that basically they need an actual order. we're going to stay on this story for a little bit now. i want to get to this point because it feeds into this. who exactly in the hillary clinton campaign came up with this disinformation plan to try to link trump to the hacking of russian emails? the mueller probe didn't find that. somehow that storyline was taken on. robby mook in july 2016 goes on cnn, starts to link trump to russian misfeasance here and then "the new york times"

what was the reaction when you first heard about it? >> this is not surprising but i will say this, liz. it proves that the wall is working. and we just need more infrastructure, more technology, more boots on the ground down there, continue building this wall. the cartels are quick to adapt and they have been stopped, you know, coming on, on land. so they're going under the land. this is what is happening. they're smuggling through tunnels and what is now called the nogales is the tunnel capital of the border. so my hats off to cpb and the border patrol and hsi and people that work down there. also i want to commend the mexican authorities. they're working with us now and we have, we have nabbed a lot of drugs. literally tons and tons of drugs. elizabeth: yeah. i mean this drainage, this new tunnel system, drilling u.s. border patrol and mexican authorities found tunnel after
