undecided voters. he had the answers to the questions. it's a joke. it's not even a reality tv, it's so fake. where president trump goes in, he doesn't care who the moderator is and does a great job. elizabeth: well, he was criticized for giving a chaotic debate. i hear what you're saying about msnbc and cnn, what happened with the undecideds when they actually were for joe biden. let's first deal with president trump and then joe widen. gallup says 56% of voters say they and their family are better off than four years ago. they're feeling better than they did in 2012, 202004, even back to 1984. the president raised the suburban mom, you know, the soccer mom. he'll face questions over his covid-19 response, his debate performance, then he got the covid-19 virus and he balked at

a debate. do you agree with all of that? >> he's going to be focusing on policies. and i would not agree to a virtual debate east, because we know joe biden would be in his basement. we know, we all know that he uses teleprompters when he's in his basement. that's cheating in a debate. they have to be face to face. so i don't blame the president. and the president's going to take tough questions in a town hall. he takes any questions from anyone. the man holds press conferences constantly and answers all the questions from reporters who don't even like him. so he's out there, he's going to be talking about policy. i agree we that, and he's coming to an patient near you very soon with all these rallies he has planned. the president is 100 percent. talked to him twice a week ago. he's doing great, and he is back. elizabeth: the media like axios and including "the new york

times" are reporting things like shockingly little scrutiny of joe biden. the biden campaign has been calling a lid on biden events early. president obama is now stepping this to campaign for joe biden. is this issue? will abc ask biden at it town hall about e-mails basically from hunter biden that directly can contradict his claim that he never spoke to hunter about his ukraine business dealings? do you think abc's going to ask him about it? >> liz, they have to ask him about that, because all of these networks -- other than fox -- they have been reporting that this was a debunked theory with hunter biden and ukraine, it was debunked. and it's very personal to me because i'm the one that had to argue it at the impeachment hearing because adam schiff and nadler talked about it over 455 times in their brief, in their opening. so we had to address hunter biden. and president trump made a perfectly good phone call to ukraine, yet they tried to

impeach him over it. it put president trump and his family through hell, what they tried to do to him. think about being his kids. they tried to take him out of office when all the time the fbi was sitting on this information. so i'm furious about this. president trump did nothing wrong, and now we know -- elizabeth: okay. >> -- according to the post, if this is true, according to the post, joe biden said he had no conversations with hunter biden about his foreign business dealingses. we now know there is -- elizabeth: all right, so -- yeah. yeah, go ahead. >> there's an e-mail out there that says the executive from burisma, the corrupt board -- by all accounts, it's a corrupt board -- that hunter biden sat on, hunter biden set up a meeting with his father to see how his father could influence, influence is in the e-mail, influence things. eight months later approximately after that evil, shokin, the

ukraine company burisma, an adviser to the board e-mailing hunter biden in april 2015 thanking hunter for inviting him to washington and, quote, giving an opportunity for me to meet your father. you know, it also goes -- there's even more e-mails like this about this. the biden campaign is denying it, twitter and facebook suppressing this information. there was also an e-mail in 2014 from this same executive saying use your influence, hunter. stop politically-motivated action. that's 2014, and eight months later joe biden threatens ukraine with withholding a billion dollar loan guarantee for ukraine, and then, you know, the prosecutor maybe looking into the board where hunter sat on, that prosecutor was looking into burisma. do you think they're going to dig into it in the town hall? >> they need to, they have to. and to go to china for a minute, we know joe biden lieded about

that. we know now that a banker met with joe biden in a hotel the, met with joe biden in a e hotel, the vice president of the united states, and hunter biden ended up with millions of dollars of business from that banker's firm. now ukraine is even more important because they tried to impeach the president oh ukraine. -- over ukraine. elizabeth: i'm so sorry, pam. i've got so many questions of about that. because i don't get it. how can joe biden repeatly deny it when hunter biden is going on hundreds of flights with secret service protection overseas, when ric grenell, former dni, was saying he was using embassies around the world to do business dealings? how could joe biden not know anything about that? how could he say that? >> exactly. exactly. well, we know it's a lie about china because we know the meeting took place because jonathan li took a picture with joe biden. hunter was doing if business, and he introduced his dad, his

dad had a meeting with them. but again, the crew crane is much more important because they tried to impeach the president of the united states, put he and his family through ale over it. we all had to sit there and listen to these democrats call it a debunked theory that hunter biden had nothing to do with his father, his father knew nothing about his business dealings. and so if this new york post story is accurate, then joe biden lied, and joe biden has to answer to the american people. especially when all these other networks reported debunked theory. elizabeth: and, you know, then we have "the new york post" also reporting that the obama administration allowed a burisma-connected pr firm to sit in on a conference call with obama officials, you know, basically talking about ukraine. but the pr firm officials sitting in on obama administration conference calls. we're going to have to dig into that one tomorrow. >> that's right. elizabeth: so sorry, wish we had

your reaction to day three? >> yeah. it's good to be with you tonight, liz. what i saw after day one, it appears that thewh democrats caucused and talked to their e benefactors and, you know, they clearly got the message they were being too nice to judge barrett and tried to come back today and score some toughness points. and, you know, it's amazing not only how well qualified judge amy coney barrett is, but also just how unflappable she is. she knows statutes and laws and reasoning of her own opinions off the top of her head, but she is also just so impressive of in how she has balanced, you know, her life. and you see that by evidence into how well behaved her children are sitting behind her. you can just tell when somebody hastt everything together, and e clearly is not only so well qualified to be on the supreme court, but she is just a all-around great person, and the democrats just can't stand that. elizabeth: yeah. and she didn't have notes.

senator kamala harris and the democrats trying to delegitimize judge barrett for not talking about her personal views. she's saying i can't discuss personal views, that's the biden rule with ruth bader ginsburg. you know, senator harris and democrats don't want to talk about howri they want to underct and delegitimize the supreme court by court packing. it would hurt credibility to the supreme court told see this bloated seesaw in court that would be a needle to check the power of the other branches. that's what the democrats want to do, sir. >> no doubt, liz. this court packing is a terrible idea, and the fact that both joe biden and kamala harris won't reject it out of hand just demonstrates how radical their agenda. is the simple answer on all the things like the affordable cower act and other policy issues, it is the congress' job to reflect the will of the people. and the courts, as john roberts famously said, to call balls and

strikes, to officiate what's legal,l, how interpret commutes- how to interpret good statutes and to do the job of judging. and, you know, the left always wants judges to be activists and legislate from the bench, but that is just not the conservative tradition or the originalist tradition of judging. elizabeth: you know, and then senator brassily and senator graham giving a reality check to senator hirono who said, yeah, you know, there's been 70 times that the republicans have tried to do away with obamacare since it was enacted. this is the issue, as senator graham said, it's a democrat push for socialest government-run, single-payer health care. it was passedded in the dead of night on christmas eve on a a straight-line democratic vote. they overhauled a fifth of the u.s. economy. hasenator grassley said democras want the distract from the fact

that they're blowing up a covid relief bull that would protect pre-existing conditions. is so there needs to be a reality check on exactly what democrats are saying right now, turning the hearing for senator -- excuse me, judge barrett into a referendum on obamacare. >> and that's exactly what it appeared. there were, you know, arguments made that somehow americans' lives would be worse off if obamacare was overturned. now, i was in the department of justice when the decision to appeal that case out of texas and, ultimately, to the supreme wourt, and the issue of severability, so i know this issue very well. i don't think anybody should expect that the supreme court as it's currently e do you wanted even adding judge amy coney barrett will necessarily overturn it and throw out the obamacare on this theory that it's not severable once the tax was taken to zero. so, you know, i think the this is, again, congress has the ability if they would work in a bipartisan manner, to construct good legislation, to fix all of these lumbarrations that now -- limb talkingses that now somehow

the trump administration or republicans is laughable. i can't think of an outlet that's been more aunt-trump. but pelosi just cannot handle any tough questions. she's not used to it. i mean, if a republican handled him or herself that kind of way on air, it would make big news, and people would be calling it inappropriate, it'd be all over the place. but she can get away with this kind of behavior because she's a democrat. what this really highlights, liz, iss that for the democrats or pelosi, these stimulus talks really have little to do with actually helpingng the american people. otherwise pelosi would put aside politics and work with trump. this is all about politics and optics. pelosit does not want trump getting credit for stimulus, and she wants nothing to do with a deal that doesn't funnel taxpayer cash to these blue states and b cities that have bn wildly mismanaged for years, long before covid. this is all about politics, and now people are starting to realize that.le

curveball at you, but what did you think about the story about hunter biden and burisma and joe biden knowing about it according to hunter's e-mails? >> well, i just heard the clip where the former vice president denied that he had any contact with his son in connection with the business whichit i always found to be, few reaction at the time when i heard it and i remember hearing it was that's rather unlikely. and now i apparently there's prf that, in r fact, he did have, nt only had contact, but his son introduced him into the company. elizabeth: yeah. so this is an ongoing story. we're going to stay on it. now you hear that the justice department is switching gears, switching to thewi next case, yr take, your reaction to the justice department ending its unmasking probe without finding of -- wrongdoing. so voters should be kept in the dark after 39 obama officials including susan rice and joe biden had the identities of

trump campaign members and others exposed, revealed in intelligence reports? everybody should be okay with nameser like general michael fln leaked to the media? >> there's a bunch of different things going on there. remember, this wasas the investigation conducted by the u.s. attorney in texas at the attorney general's direction which was john bash, and that's separate from the john durham probe out of connecticut which relates to the fisa court and the origins of the russia investigation. on the unmasking investigation, remember, there was nothing wrong with the individuals who received information in order to provide context of intercepts that were acquired for national security reasons to learn who the other parties were to the conversation. that in and off itself is not illegal. now, the fact that it was shared within an administration potentially for political purposes also, although not illegal, would present some troubling questions. the way the rubber meets the road, honestly, is whether or

not any crimes were committed in the disclosure of that information to the media. but that's a very difficult thing to prove, as you know. and it would require the cooperation ofof the media in order to give up sources, in order to make that prosecution something that's always been very difficult to show. so i guess at the end of the day i'm not surprised -- elizabeth: [inaudible] yeah, ied hear you. it just feels like washington writesri rules to protect itself while the privacy of regular gets slammed. this is why people choose not to run for office or serve in campaigns. it just feels terrible, you know finish. >> f look, you make a legitimate point. right, you make a legit it mate point that really the public deserves the benefit of report with regard tort findings and n, you know, my explanation as to what i think may be going on here. the problem is, is that that was not a special counsel investigation. that was just done att the direction of the attorney general. and generally speaking, as we learned through the comey saga,

if you decline to file challenge charges, you know, department of justice policy ordinarily is you do not comment with regard to the decision other than to announce a decision that you're noto going to file charges. elizabeth: okay. now we hear from a foia lawsuit that the justice department is not declassifying trump-russia and flynn documents after the president requested that, that basically they needed an actual order. we're going to stay on this story for a little bit now. i want to get to this point because it goes into this: who exactly in the hillary clinton campaign came up with this disinformation plan to try to link trump to the hacking of russian e-mails? the mueller probe didn't find that. somehow that storyline was taken on. robby mook, in july 2016, goes on cnn, starts to link trump to russian, you know, misfeasance here, and then new york times runs out a story saying this is

the new narrative out of the hillary clinton campaign. is so who came up with the plan, who leaked it, how did russia find out about it, the russians find out about it by hacking those democrat e-mails? it's a a mystery here. >> look, those are all good questions, and it shouldn't remain a mystery too much longer. if the president has declassified things and, i mean, let's -- we can just recognize reality, who's running the show here. if the president makes the decision to declassify, it get declassified. ththe bureaucracy can drag its feet, but ultimately the decisionqu maker is the preside. that's the first point. and the second point is, yes, e-mailth will presumably show wo from the clinton campaign or in the clinton orbit was responsible for feeding the so-called teach state with regard to a narrative that, obviously, we now, you know, have come to understand wasn't true andnd was done for politicl purposes to do damage to the trump campaign at its outset.

that really bothers me about this is why the fbi allowed itself to get involved in this. they're supposed to stand as a beacon against corruption, against misuses of power, and they've always been like that. from the day i walked in the academy, we talked about the importance of the r rule of law. this went beyond that. and the stairly part about it, to me, is it wasn't one rogue agent, it was several people that went along with this contrived idea that there was a russian conspiracy and interference. o it goes over right to the clinton investigation. how did that happen? you had to have a cabal of people that trounced on the constitution to allow this to happen, and i put it right at the feet a of james comey. elizabeth: by thehe way, the clinton disinformation plan allegations are in cia brennan's own handwritten notes. >> yes. elizabeth: our own fbi sources say james comey got with on that train right into the obama administration. he helped politicize it.

he set the tone culturally from the top down. in fact, doj i.g. found that what he did in terms of the culture was, quote, disastrous. uojuly 24th clinton campaign official robby4t mook, was in te news, goes on tv to allege trump was somehow linked to that russian hack. new york times runs out the story at the same time, and then you have the fbi trying to blushing the validity of steele dossier with stories about the steele dossier that christopher steele was leaking, was planting in the media and other government officials were planting. so we hear what you're saying. how did this all come down? how did it get off the rails, and r why is fbi directer christopher wray still stonewalling about this and the cia still stonewalling information about this? >> i don't know. they're doingng a disservice to the fb i, to the cia. we've got to -- we have to be pretty pure. we're not choir boys, but we need to be pure when it comes to the law.

sir, what was your reaction when you first heard about it? >>bo it's not surprising, but i will say this, liz, that it proves that the wall iss workin. and we just need more infrastructure, more technology, more boots on the ground down there and continue building this wall. the cartels are quick to adapt. daand they've been stopped, you know, coming on land, so they're going under the land. and this is what's happening. they're smuggling through tunnels and what's now called the no galless is the tunnel capital of the border. and so my hat's off to cbp and border patrolling and hsi, the people that work down there. and also i want to commend the mexican authorities. they're working with us, and we have, we have nabbed a lot of drugs, literally tons and tons of drugs. elizabeth: yeah. i mean, this drainage, this new tunnel system, they're drilling, you know, u.s. border patrol and mexican authorities found tunnel

after tunnel drilled into this drainage system. it's 15 feet the surface, it's atnow worth tens of millions of dollars to these cartels, so this is really intense stuff to try to shut this down too, right? >> there's no question about it. and, again, they're doing an outstanding job, and i'd like to commend not only our agencies, likeut cbp, but again, i want to thank mexico. because due to president trump's negotiating abilities, we now have the mexican authorities on ourn side. not only on our southern border, but also on their own southern border in mexico. and they are nabbing these drugs. just last friday there were 3100 pounds, a ton and a half, of meth, fentanyl and other hard drugs that contribute to 70,000 overdoses per year of american citizens. and this is why i think people need to wake up. this w border is an absolute

danger to our national security. and that's why this election coming up too, liz, is so very important when the democrats continue to say they're going to open the border up, and they're going to basically just let in millions of illegals. and we're -- you can see what the effectiveness of president trump and his administration and mihis agencies. and i'm very, very proud of that. elizabeth: you know, we've been reporting how the drug cartels, according to our sources, are talking advantage of the chaos with covid-19 shut downs in u.s. cities to start pouring in drugs into these cities. we're seeing record amounts of drugs, hard narcotics, seized at the southern border, record amounts of drugs seized at the northernru border too. looking at what happened in understood annapolis, 1.5 million -- indianapolis, 1.5 million lethal doses of fentanyl, authorities caught
