now. ♪. elizabeth: okay. welcome to the show. you're watching the fox business network. let's welcome back house judiciary representative. he is republican kelly armstrong. kelly always great to have you on. let's dig into this. senate homeland security working to confirm hunter emails, twitter, facebook are they practically asking to have their business models blown up? they have immunity from lawsuits. they're supposed to be neutral platforms. not curators of acceptable ten. what is going on here. >> it is clearly they pick a side to this election. they are moving forward. to hacked or private information, throughout the entire investigation farce, collusion, hoax, whatever you want to call it they had no problem sharing any and everything going on but now when it directly relates to candidate biden's presidential reelect, they immediately -- there is no other way to spin this.

they pick ad side and helping one side win. elizabeth: the second batch of new bombshell emails talks about hunter biden allegedly pursuing a deal with a chinese energy company worth potentially $30 million over three years. that company allegedly went bankrupt. the person he was talking to at the chinese company. by the way robert biden is hunter biden's real name. the top official since disappeared from that chinese company. he talked about quote, introductions and december that would be interesting for me and my family. your reaction to this email? >> you can look at the two emails too from may of 14 and april of 15. we have to see if these are true or not but they fit into the timeline and pattern of everything that went on with burisma. always, always remember that hunter biden was working for these companies with no experience whatsoever in the oil and gas industry or any of that. of course he was pedaling influence. so now the question becomes, was he successful with that?

what did, i mean what did the vice president actually do for his son or didn't? regardless, you can't censor "the new york post." you can't censor "the federalist" f you start doing those things, we need to take a really hard look what we're doing, or what we're allowing these companies to get away. i like what the energy and commerce committee did today, we want a complete revamp of 230. it is obvious they're pushing one agenda versus the other. elizabeth: we're seeing a turnstile between these social media giants, facebook and twitter. worker turnstile. workers going back and forth between them and the democrat party. you know, predominantly we know that they are, a lot of democrat workers work there. another hunter biden email. let's stay on this new thing about what's going on with this chinese energy company. they set up holding company. hunter biden likes this deal allegedly. he gets half or 50% stake in it.

then that holding company funds that global shopping spree for his uncle james and aunt sarah biden worth more than $100,000. airline tickets, hotels, restaurants. when you look what the emails are saying, by the way "the new york times" is saying implication this is russian military intelligence or russian disinformation. no one is disputing the content of the emails. when you look at the content of it, what is striking here, congressman, why is joe biden getting involved in the prosecution of a local ukraine prosecutor? why is the vice president of the united states getting involved in that? >> that would be a really great question to ask and answer. hopefully somebody will ask him during a town hall. that is exactly right. you can't, you can, they can't prove it, they can't disprove it but take the narrative that is most effective to one side over the other and do it immediately. if that is not electioneering i don't know what is and we have to call it what it is at this

point. they are running, i mean they are not running down the veracity of one side or the other. they are just picking one side. that is exactly what they're doing moving forward less than 20 days to an election. we all should be concerned about that. elizabeth: again this is about hunter biden allegedly trying to sell influence with his father overseas with burisma officials, emails to hunter biden, you know saying can you help us out here? hunter saying what's going on? hunter talking to his business partner on the board, devin archer. get a 7-eleven cell phone. we'll work with another firm to do deep dive information searches, not to connect it to us. we don't know the provenance of basically that computer hard drive found at the repair shop. that is going to be an issue. what is also an issue too, the biden's campaign defense of this. they are saying biden's official calendar at the time shows no such meetings on the firm

schedule with any ukraine businessmen at hunter biden's request. there is hours and hours of holes in that day. the days in question. by the way, president obama's white house meeting in january 2017 was not on the schedule either. >> that is absolutely right that is exactly to ask questions and worthy to report on and worthy to continue investigationing. i spent 10 years as as a criminl defense attorney, it wasn't on my calendar is not an answer. there needs to be serious investigation and serious critiquing and serious conversation about all of this. elizabeth: hunter biden keeps referring to his father as my guy when talking to burisma officials. you are going to be in touch with my guy. he is referring loosely about his father, the vice president here. you know, hunter biden already

humanly take. step back and think. is there something there shows there is unqualified, that hidden racist she is being accused of in some quarters, part of a cult? this is not the type of data moves the knead dell on the merits but any fig leaf might be used. elizabeth: senator democrat richard blumenthal saying the nomination should be delayed. he says the new disclosures are dynamite. break down what the judge barrett is basically accused of concealing. that she met with the notre dame's women's legal forum. student scholarship symposium. student religious society. round table on the constitution. religion in the public square and an anti-abortion group. that will stall the nomination, what democrats say. what do you think? >> to me, if you step back and

actually watch how she conducted herself over these hearings, they lose a the who have steam in terms of suggesting that she is a terrible person or unqualified judge. i came at it from a perspective really wanted to hear her, how to conduct herself because she is academic. maybe i value experience on the bench a lot as an actual practitioner. i was thinking three years on the bench isn't a whole lot. she has encyclopeaic recall of cases. great mentality. great definition of originalism. she basically overshadowed all the questions through the this thing. thee is tremendous. elizabeth: using no notes. using no notes. that was impressive. >> correct. >> jim, there was emotional, really power if you recall powerful testimony from laura woke. she was the first blind woman to be a supreme court clerk. she told how judge barrett came to rescue with a problem with her computer threatened to shut

down her work and what she was doing. let's listen to work. >> she listened with deep attention as i explained my situation, giving me the freedom to let down my guard and come apart. as a disabled person i am accustomed to acting if i have everything under control when it reality the world feels like it is spinning out in front of me, but in front of judge barrett i was able to let the mask slip, indeed to disappear completely. i poured out all my concerns, not just about technology and my worries about failing classes but all the burdens i currently carried as a disabled woman navigating a brand new environment. when i finished, judge barrett leaned forward and looked at me intently, laura, she said, with the same measured conviction we've seen displayed throughout her entire nomination process. this is no longer your problem. it is my problem. elizabeth: this is really strong stuff. this really pulls at the heart.

it shows her compassion. it shows her kindness, right? and so it shows her heart. so you know, this is what, when we watch these supreme court hearings, we got to remember these are human beings we're talking about right? when we see the fighting going on, people being upset on both sides of the aisle, we're all human beings. justice barrett shows her humanity there, right? >> yeah. i mean look, they had a lot of witnesses today that were characterized at least on tv as expert witnesses. some may be experts in their field more really character testimony. the ones that were positive were pretty compelling like the one you just heard. the ones negative, imagine sitting there and hearing your name and being told you're a racist, explaining that to your two haitian adopted children or you're hell-bent destroying the rights of women. it is a god awful process.

it is a nice reminder when it comes to character this particular candidate has it. she has a tremendous record in terms of personal things that make you reassured she will make you a great judge. elizabeth: jim, were you, democrats led by senator amy klobuchar did have this one question about justice barrett, if she is seated becomes justice barrett, she would get to weigh in on a potential 2020 contested election case. the judge said she would need to hear arguments whether the president can postpone the election. the constitution does not give the president authority unilaterally to do that. the constitution is about the congress setting the election schedule. what was your election when you heard that furor? >> i think she has been perfectly within the judicial cannons of not tilting her hat in one direction or another when it comes to any sort of controversy that might come before the supreme court. so you heard endless senators try to spin it into, i'm not asking for a pre-position, i

want your personal feelings. tried to get away from the judicial cannons involved here. she won't bite on it. i don't think there is a misunderstanding when that she understands the constitutional limitations regarding an election. i think she is -- elizabeth: she is doing the "biden rule." like they did with ruth bader ginsburg. don't talk about your personal views. jim trusty. you're always great. thank you for coming on. >> see you, liz. elizabeth: next up, house oversate ranking republican james comer. staying on the firestorm about twitter and facebook, suppressing the blockbuster "new york post" story and hunter biden's disturbing emails allegedly selling an influence overseas with the father. are they asking to have business models blown up. is this new election interference? do they have that much power? what about the turnstile of workers between these tech giants and the democrat party.

♪. >> yesterday the "new york post" broke a story alleging serious corruption of joe biden and hunter biden concerning ukraine. the allegations in the "new york post" story, if true, indicate that vice president biden lied when said he had never discussed his son's business dealings. that story, once the "new york post" broke it, was blocked by twitter and facebook. this is election interference. the senate judiciary committee wants to know what the hell is going on. elizabeth: okay. that is texas north ted cruz announcing the judiciary committee will vote on a subpoena to bring in twitter ceo jack dorsey at a hearing last friday. jack dorsey said he wasn't happy the way it was handled at twitter. we have house oversight ranking republican james comer.

the criticism is this another hearing. is this mistaking activity for achievement, they have hearing after hearing, stern lectures a lot of finger wagging nothing changes? >> no. this is an emergency issue here. we're inside of three weeks of an election. the democrats, if you will remember, they tried to impeach president trump over a phone call with ukraine. what we've learned from this "new york post" story if true is that, that joe biden was doing a quid pro quo with his son in exchange for his son getting a sweetheart deal with a ukrainian energy company. this is newsworthy. yet for whatever reason twitter and facebook have censored this news story from the fourth largest newspaper in the united states. we need to have a hearing -- elizabeth: i hear what you're saying. right, but are the laws governing facebook and twitter going to change? are they, is their immunity shield from lawsuits going to

get lifted or changed in any way? >> well that is what we need to hear about. i want to be, i want them to be transparent with the american public. what do you base your decision on? which stories you censor? seems like any negative story about biden down the stretch is censored but anything is fair game with president trump. you know the kavanaugh hearing, all that stuff that brett kavanaugh went through during the supreme court, that is pretty much been proven to be false but yet they never censored any of that. so there is a double standard taking place here, probably election interference. again, that is one of the issues that the democrats talked about for two years trying to prove wrongdoing with trump and russia, when in fact you have got facebook and twitter censoring interfering in an election to help joe biden. -- elizabeth: hang on. i hear what you're saying. i want to jump in here. >> okay.

elizabeth: just, the biden campaign is saying that joe biden was going after that ukraine prosecutor because he wasn't doing enough to stop corruption. so the debate is why is joe biden a vice president of the united states getting involved with a local ukraine prosecutor? the issue about election interference is that really provable? i'm just playing devil's advocate what twitter was doing, what facebook was doing? we pretty much hear what you're saying, the other side of the aisle would say, the other side of the argument would say, this is their business, their private sector business. they're allowed to show and post whatever they want. it is issue with the immunity shield. are they neutral arbiters or are they censoring? that is what section of the law you're talking about, is congress really going to change isn't people by know exactly what you're talking about. they get it. the question is the next step. is it going to be another grandstanding hearing or are you

going to change the law? >> well we herd today, the fcc chairman finally came out and said he will reevaluate the federal policy with respect to how these social media companies can dictate what goes on their platform and what they, what they can censor. i agree with you. i'm a conservative republican. i'm all about getting government off the back of the private sector. so many americans get their news from social media now. we have clearly got a bias here with twitter an facebook, and what they're censoring with respect to grow biden versus what they're doing with donald trump and we need to know who these people are that make the decisions with twitter and facebook and what they use to bays their decisions on. and i think that that is something that the democrats should allow us to do in the house oversight committee because we've had so many hearings about trump's involvement with phone call with ukraine. we've had some hearings about

potential wrongdoing, with trump campaign and russia. but here we've got a factual story from the fourth largest newspaper in america, liberal newspaper, that has come out and, you clearly has evidence that joe biden's lied to the american public about the role that he played with his son hunter and yet they're not doing anything about it. they're sitting there silent. so i think you're seeing a hypocrisy from the hands of the democrats and i think we can do something about it. we just need to prove that facebook and twitter have clearly shown bias with respect to the election. this is election interference. it's a big deal. elizabeth: all right. we're going to watch this debate. congressman, always great to have you on. we love mixing it up with you. great to have you on, congressman. >> thank you, elizabeth. will do. elizabeth: sure. up next republican strategist ford o'connell takes on the biden campaign. we're staying on the story. what are the holes in the biden's campaign defense of what

is going on here with this whole controversy. more on what exactly biden's official calendar, that is what the biden campaign is citing as their defense about meetings with any representatives from ukraine energy company that paid hunter biden a lot of money to serve on its board. what does the calendar show? that is next. president trump: you don't have a kid who gets thrown out of the military, hasn't had a job a long time. his father becomes the vice president. now this kid is going into every country walking away with millions of dollars from every country, with no talents, no skill, no expertise and the press doesn't want to cover it because they're corrupt. ♪ ♪

official of biden campaign trying to cite twitter's censorship of the "new york post" story and pulling the entire "new york post" story proving that the "new york post" is false. is that proof of that? >> no, absolutely false. here is the deal, the biden campaign is in crisis mode. all you have to do is listen to their actions and words. they're not denying the meeting between joe biden and a burisma executive is actually occurred. all they're saying it was not on the official calendar. in messaging we call that a non-denial denial. saying something that sounds good but has no relevance whether the underlying meeting occurred. they're not denying the authenticity of the emails, text messages, pictures and videos on the laptop. they have nowhere to go. they are just tying to run out the clock over the next 20 days. elizabeth: i hear what you're saying. it is, critics keep saying it is patently crazy to block and

unplug the "new york post" entire twitter account. that is censorship. they didn't do that, they disseminated the steele dossier, russia collusion disinformation for months and months. what is the provenance of trump's tax returns. twitter keeps saying this is, this is a hack. the computer hard drive is a hack. we don't know. it is not a hack. it is a copy after hard drive that was found. that is not a hack. facebook is saying we have to fact check a scoop. how do you fact check this scoop? if you're going to fact check anything, why censor it? we hear what you're saying. no one is disputing the content of the hunter biden emails. they're trying to basically talk about joe biden's role in this by citing quo biden's official, stay on the word official calendars. when you look into his official calendars at that time, there is hours and hours of empty space where joe biden could conceivably have met with burisma executives or anybody else. >> yeah.

that is exactly right, emac. i agree with you here. twitter and facebook are making this up as they go along of the reason is honestly they're picking winners and losers here. they don't want a story possibly damaging to joe biden, particularly when it comes from a reputable source like the "new york post" which has the fourth largest circulation in this country. it is subject itself to its on libel laws. to that point the biden campaign is not telling you that these meetings didn't occur. frankly i think it sends a terrible message. yes, hunter biden is selling influence to his father in matters of foreign policy but it sends a terrible message to the world because it says under a biden presidency the u.s. foreign policy could be bought. all you have to do is call up hunter biden. that is horrible! elizabeth: yeah. america for sale. that is a terrible, you know it's a terrible story. this story has legs. it is not going away. by the "new york post" doesn't

rejected the 1.8 trillion-dollar offer the white house had? now senator mcconnell is saying no to that. media and democrats are saying nancy, you're wrong, is this a turning point for her? >> well it should be a turning point, liz. nancy pelosi is a textbook example of term limits. the woman has been in office for over 30 years, liz. she is standing in the way of providing relief and help to americans who are suffering right now through no fault of their own but you know what? she despises president trump so much that she is willing to do that. she is harming americans who need relief. and so clearly nancy pelosi should be put on notice, i don't know why they keep voting this woman back in. if you look at the streets of san francisco, her district, they are absolutely deplorable with homelessness, high taxes, regulations. it is just absolutely ridiculous.

elizabeth: you know treasury secretary steve mnuchin says that you know, we may not see cove spread relief because nancy is trying to deny president trump a victory. there has been a lot of focus on president trump but not really enough on what nancy pelosi has been doing and saying. her rhett rec is such as, you know, remember the 25th amendment push to unseat the president? it was a commission that she was talking about in recent weeks. she was claiming, claiming, it was about future presidents. nobody believed that. now she is saying, she is pushing back on covid-19 relief because it doesn't have a plan to defeat the covid-19 virus. you know, there is no strict way to crush it. the cdc, the white house, the administration has been moving to try to stop what is going on with covid-19. her rhetoric doesn't hold up. >> no, you're absolutely right. i hope voters are paying attention. nancy pelosi needs to be reminded she works for us and her elitist, condescending

attitude since the president got into office has been off the charts. don't forget about how she was, wanted to impeach him and the investigations and, everything else, anything to push back against president trump and what he is trying to do which is look out for the forgotten men and women. nancy pelosi has been standing in the way from day one. elizabeth: why don't you be like tip o'neill or you know, the congressman of the past, just do deal making? president is wanting to make a deal. just do a deal. instead it has been a constant barrage of attacks. now we've got democrat congressman ro khanna of california and former democratic presidential candidate andrew yang, nancy, americans cannot wait until february for economic relief. take the deal now. we have obama administration official dan pfeiffer saying nancy do the deal wrong.

♪. elizabeth: okay, to an historic drug bust in southern california. let's welcome congressman mark green from homeland security. it is great to have you back on, congressman. this is how big it is. u.s. authorities are calling it the biggest domestic seizure of methaphetamine in u.s. drug enforcement history. it is so big it could quote, provide a dose of methaphetamine for every man, woman and child in both the united states and mexico. we're talking more than a ton of meth here. >> yeah. 2224-pounds. it is a huge thing. and a great, a great feather in the cap of those dea agents who did the investigation, raided those places just east of l.a. and found this meth. it is interesting, comes a few days after one of the largest, second largest border, you know, seizure of methaphetamine.

so these guys are all doing a fantastic job. and they risk their lives for our safety. this methaphetamine would kill and harm thousands of americans. it is amazing what they have done. elizabeth: yeah. it is quite a victory. i mean they were tracking this drug trafficking organization tied to the powerful sinaloa cart tele. it was so brazen the way it was being done with these stash houses throughout riverside county and also east of l.a. in those community there. that they were, handing drug, drugs inside of duffel bags in places like sam's club parking lots. >> yeah. elizabeth: locals in these communities, congressman, were saying they were really worried about stash houses and chemicals inside of these stash houses drug cartels was using because the stash houses could blow up because of chemicals in there. this is quite a victory. >> this is huge victory.

our dea agents and the border patrol folks who are on this watch, manning this post for our safety, they really deserve kudos for this one. they saved thousands of lives. elizabeth: how much does this set back the drug cartels? >> well, it is a lot of money. you know this one is estimated to be street value around $7 million. that is a huge hit. we obviously, you know, total haul last year coming across the border was about 800,000-pounds. so the in big scheme of things it is small but huge in terms of the lives saved and $7 million off their books i guess. elizabeth: you know, let's turn to another issue. we're seeing the fifth straight month of arrests of illegal aliens at the border, there was an uptick here. what is happening right now with illegal apprehensions and arrest

of illegal immigrants at the border? >> i think there is this perception because of covid, you know, we're not manning the border as well as we once did. if you look at 2020, you know the fiscal year of 2020, we basically cut those border crossings in half. president trump, the wall, the focus on cbp. all of that, cut the flow from 19 in half. now in the past few months, in september, there was a increase again. i think it is just people thinking that covid has got us not looking but that is not the case. our folks are on the job and doing a great job. elizabeth: all right. so let's all talk about this quickly, about the border wall. homeland security says it is adding an average 10 miles a week to the southwest border wall. they will complete 450 miles before the end of the year. do you think they can do it? >> absolutely this is so important, i'm an ex, i was an infantry officer before i became

a physician in the army. those walls can at utilize the t utilization of our personnel. they're critically important. he saw this during the campaign. he has delivered. 260 miles are in construction. another 120, roughly about that are in preconstruction phase. the president is delivering once again. elizabeth: joe biden and the democrats say they will take down the wall? >> of course. they're about a borderless country, because empowers them. they're about, president trump is about putting americans first and they are not. they're about empowering themselves and their southern border strategy has no other purpose but to empower themselves. elizabeth: all right. congressman, it is great to have you on. thank you so much for joining us. really appreciate it. >> thanks. >> okay. a special nolt for you.
