"the evening edit" starts right now. ♪. elizabeth: okay. welcome to the show, you're watching the fox business network. let's go right at it with tim murtagh, trump 2020 communications director. tim, great to see you again. the president has been on a grueling travel schedule. you guys are in five states that he won four years ago, including michigan, florida, wisconsin. are you guys worried about these states. >> no, we feel good about those states. we get asked that question a lot. take a step back and think about this. if the president wins the states he won in 2016 he gets reelected, it is as simple as that he has been to states hillary clinton won. he has been to new hampshire in

recent days. was in minnesota in recent days. was in nevada, we think those are states we can add to the president's column. we start we believe with a floor of 306 electoral votes. that is what we won last time. we can only build on that. he is barnstorming states, wants to drive upturnout in the state. we have senate races in those states he wants to help n we feel very good where we are. i note that joe biden decided to make his closing argument in western pennsylvania with leading anti-activist lady gaga. here i am with a person who wants to kill the jobs in the fracking industry. if that is his closing message we'll take it from the trump perspective. elizabeth: that is interesting. president and joe biden barnstorming to the four corners of pennsylvania. this is democrats firewall. the vyings president is doing what the president doing there. the pittsburgh post gazette

backs president trump that is the first republican endorsement since 1972 for that paper. it us not about the national polls. it is about the battlegrounds. it is about the electoral college. he will need to win pennsylvania and florida. with those two states in his pocket he can afford to lose michigan and wisconsin. is that how you see it? >> well, we don't intend to lose any of those but you're right, the president intends to win florida. he will hold on to georgia, win north carolina, pennsylvania, was always going to be very important and again michigan and wisconsin. were in the president's camp in 2016. we believe he will win there again. we're well beyond the point where polls mean anything. we're looking at real vote totals coming in through the early vote period and joe biden has not hit his marks. the leads that he built up at the beginning of the early vote period have dissipated. in some states the president has gone ahead in early voting. in the other states the biden lead is so small we know that the president's election day turnout tomorrow is going to be

enormous and it is going to swamp joe biden's lead. president is going to be reelected. he will be doing it by the huge election day turnout we know is coming tomorrow. elizabeth: yeah. we've been reading through the footnotes of these polls and we're trying to figure out how the polls are potentially underestimating how significant the shy, silent trump voter is. they don't want to be identified because they have been harassed. they have been screamed at. the "real clear politics" average of 10 polls for the battleground states, biden is up more than three points in michigan, pennsylvania, wisconsin. that same "real clear politics" average showed hillary clinton winning all three of those states in 2016 when trump won them. we continue to question as critics are too, what is going on with the polls. charles cook of the cook report said hidden shy voter for biden is the college educated suburban woman. that is who he thinks is the biden silent voter. what do you think? >> well, i mean, i guess, we don't like to call them a shy

trump voter. the better way to describe it would be take a hike trump voter. our people will not report to pollsters. these are polls paid for by media companies who have been trying to destroy and defeat the president for four years. why anybody puts stock in polls paid for by the same media outlets is beyond us. our folks don't answer poll questions. they don't want to talk to pollsters. the polls don't take into massive number of newly registered republicans in states. over 200,000 republicans in pennsylvania and that, north carolina. those don't register in polls. they have not figured out a way to measure those things. they don't know what is going on the ground. we've seen the data for better part of the year. we know where the president stands. he is going to be reelected. elizabeth: i want to show "the new york times" map. how long the vote will take and what share of votes expected to be counted november 4th. that is a map all over the map. we have this odd tweet, it has

been called odd by critics from pennsylvania attorney general joshua shapiro. all the votes added up in pennsylvania, trump will lose. that is why he is working overtime to subtract as many votes as possible from the process. that is the attorney general of pennsylvania tweeting that out. really when it comes down to, when voters peel back the curtain. we have indictments, leaks, indictments, leaks, turnover, pandemic, protests but when voters pull the curtain they ask themselves who has earned my vote? what have you done for me? trump is hammering away on jobs and taxes in pennsylvania. tim, we're seeing pennsylvania had 380,000, 380-k fewer jobs now versus last year. the number of small businesses in the keystone state cut by 1/5 since last year. people on social media, they don't like the protests how they led to shooting and looting. they don't like the pandemic is doing nationwide shutdowns but when voters go in pull the lever

what will you do for me? we have former senator phil gramm saying in an op-ed biden plans to raise taxes and regulations three times as much as president obama did. president obama's gdp growth was at an 80-year low, 2%. what will you do for me, that what voters are going to say? >> if you read through the pittsburgh post endorsement of president trump the very clear case. the president is the one who stood up to china. the president is the one who created world's best economy once and already doing it a second time. he has strengthened our trade deals. he championed the energy industry and will protect and grow the fracking jobs that are there. he put america first in all of his decisions. on the other side joe biden who was a supporter of nafta. has always put china ahead of american workers interests. he got them into the world trade organization that cost 3 1/2 million jobs. people in pennsylvania know what nafta did to the manufacturing industry. people in pennsylvania know that

joe biden will ban fracking and kill 600,000 jobs. when you go into the voting booth in pennsylvania the question will be on many voters mind, who do you trust to get the economy pack to where it was pre-pandemic? that answer is today as it has been since the beginning of this race, donald j. trump is the clear answer on the economy and it is not even close. if the economy is your central issue, you will vote for president trump. there is no question about that. we know that president trump has the votes still in the tank, even more than joe biden's lead is through the early voting period. the biden campaign knows that. they know how many votes they have left in the tank. they know how many votes we have left in the tank. we have more than they do. the president is going to win pennsylvania and he is going to be reelected. elizabeth: interesting. we'll watch the demographics. we'll watch all of the splits in the vote. you know, we'll follow as we said that college suburban woman, that charles cook says is going for biden. we don't know.

♪. elizabeth: okay. let's welcome congressman mark green of homeland security. kong grand, great to have you back on. will we know the winner tomorrow night? what do you think are we going to know the winner tomorrow night? >> certainly not. even in philadelphia the courts said they have until friday, or pennsylvania they have friday.

other states have these delayed counts. no, we definitely won't know the answer tomorrow. elizabeth: so, also this is like 300 lawsuits now. there was 230 last week. now the number of lawsuits has grown over the election. it is filed in dozens of states. so how long will this go on if we don't know the winner by tomorrow night? >> well, what we'll see are court cases. then you will see appeals that may wind up as high as the supreme court. that is going to take several weeks. but frequently, as in the case with the bush-gore race and hanging chad from long ago, you know, the supreme court, the state supreme courts, they will move pretty quickly on these. i don't know that it will drag into january but there is certainly that possibility. elizabeth: january? i mean, that is, that is unheard of for the united states. >> yes. elizabeth: voters and people out there would say we don't want

this for our country. we don't want to have this going into january because the more you have that, uncertainty, the more potential street action and riots you have, right? >> absolutely. the longer this is held out or, longer it takes to certainly will create more instability. then the decision when it comes later, there is more anxiousness and all of that so yeah, that is a concern. i think the courts will be very responsive but there there wille appeals. several of these will probably go all the way to the supreme court. elizabeth: yeah, president trump said yesterday, as soon as the election is over he will go in with the lawyers. he is preparing for a tough legal battle. he is disputing a report that he would declare himself as winner if he was in the lead. talk about the supreme court. is the conservative wing of the supreme court, is that a factor? >> we're excited about judge amy coney barrett and her addition to the court. she will go by the law and what the law says and the

constitutionality of the law. a lot of the issues have been judged, unelected bureaucrats making decisions because of covid at the last minute to subvert the laws of each state. i think that's wrong. i think we need to execute the law as it is written. if we do that the supreme court will come alongside that. it is where the laws are subverted, particularly by non-legislative -- legislators make the law. so when some bureaucrat or an executive order changes the voting process, contrary to the laws of the state, well that creates a big problem. elizabeth: talk to us more about that. so what exactly is the issue? >> well the issue is, you know, you take, for example, the court ruling in texas, in houston and drive-in ballots. these were decisions that were made at the last minute on how to execute the, sort of voting process during the covid

pandemic. you can't just change state laws by executive orders and, at the last minute and expect the voter to know exactly how they're supposed to do it. that's the problem. and then the judges rule to support not the law but this bureaucratic decision at the last minute. so that creates the concern that i think you will see presented to the courts again and again. elizabeth: you know, yeah, i hear you. pennsylvania and wisconsin, other states they can't begin counting the ballots until election day. that is an issue too. you have the pennsylvania attorney general josh shapiro tweeting out if all the votes are added up in pennsylvania trump is going to lose. so you can see at the ag level, you know, it is getting really politicized. your final word, sir? >> you know that position, that particular individual in that position is incredibly political and incredibly biased. so i would ask the american, you

♪. elizabeth: welcome back. you're watching the fox business network. we're now coming into the bottom of the hour. joining me now is former deputy independent counsel and fox news contributor, he is sol wisenberg back with us. okay, sol, let's break this down. reports coming in that the fbi is questioning hunter biden's former business partner tony bobulinski. tony bobulinski sauce this should be the focus. the alleged 10% cut for joe biden on a multimillion-dollar deal with china's energy conglomerate cefc. the big guy, bobulinski says joe biden. bobulinski says the five million dollars that the chinese wired to hunter biden via off off-balance sheet shell companies. the question is, did joe biden get the money. we don't see that yet.

tony bobulinski is saying focus on that. why? >> who knows, why. he is mad he didn't get his money and it is a hot topic right now. i don't think we have nearly enough evidence to say what the fbi is focusing on and why and i think for sure it looks like they have been, let's put it this way, hunter biden has been in their orbit for quite a while. i mean, my gosh his former business partner has been convicted and that conviction has been recently upheld. so again, it is a big story. it is a story that should being covered by the mainstream media and it isn't. but we just don't know enough to know if that should be, if that should be the focus. elizabeth: okay. so joe biden is named as a possible witness in the bond fraud case involving allegedly involving devin archer. joe biden is actually named in court records as a possible witness in that. that i think that is what you're referring to.

we have the fbi investigating hunter biden's laptop for money laundering. hunter biden began sending large wire transfers out of the pot of money he got from china over to james and sarah biden to their bank account and a lot of these wires involved shell companies. the treasury department and banks are flagging them for potential criminal financial activity. we don't know if there is money laundering involved here but treasury analysis, sol, the aim was to send large amounts of money into the u.s., to these bank accounts to purchase, quote, luxury goods and properties. the amount flowing through the hudson west shell was $902 million. that is according to one report. this is, sounds like if you take out the names, this is classic money laundering stuff. >> well, there are all kinds of things like i said that hunter biden could conceivably being investigated for. obviously he is involved in influence peddling. there is potential violations of

the foreign corrupt practices act. there is potential violations of fara, foreign registrations act. he is apparently worried about that. there is no question that is suspicious activity which is why a sars report, a suspicious activity report, was filed by a bank. now there is a difference between that and being indicted and convicted. i actually was not really talking about him being listed as a witness, hunter and joy. that is a complete, that means virtually nothing. that happens in the federal criminal trial when certain names of famous people might be listed. they asked the potential jurors about that. is there anybody who has, you know, here are some people who might testify. does anybody have a bias or a problem about that? so that is a complete nothing part of the story but the other part, the hunter biden part, that is all extremely disturbing. and by the way, and the fbi should be investigating it and

by the way, that's what we call kompromat. i wonder if the fbi started a counterintelligence investigation? because all this could be compromising material on the bidens. that was the standard they used to start one on president, presidential candidate trump. something tells me they aren't doing a counterintelligence investigation on former vice president biden. but hunter should be looked at. yes. elizabeth: interesting. >> we have very little, we have very little on joe biden except that his statement that he never discussed business with his sons is obviously looks like it's false. elizabeth: okay. so the idea about joe biden's name being in the court records, it just is an indication joe biden knew a lot more about what -- hunter biden's business dealings while denying it. i hear what you're saying about that but we're going to dig into this next. why the bidens were getting involved with cefc, the chinese energy conglomerate in the first place, right? because cefc was part of china's

big belt and road initiative for a global power. and so, chinese intelligence, "new york times" reported this, chinese intelligence knew the value of the biden family name and went after hunter biden to get them involved. so is that part of kompromat story that you're talking about? go ahead, take that on. >> absolutely. look, hunter biden is selling access. he is selling access to the biden name and all that, all that can get somebody, can get a foreign entity that is seeking influence. it is something unfortunately done on both sides of the aisle by career politicians. you know, there have been books recently written about it. and it is a very bad feature of american political life that should be altered. again, but when people throw around the name the bidens, i am not a fan of joe biden at all but when you throw around the names like the biden and you start talking about criminal

activity, there is nothing so far to indicate that joe biden is involved in any criminal activity. and hunter biden has not been indicted yet. elizabeth: that is exactly right. >> he is being investigated it looks like and he should be investigated. >> the question is the fbi had that laptop for a very long time. there is questions now, what exactly is going on, what is the status of that. so you know, again you and i talked about this, sol, it is devilishly hard to make a case with anything when you involve 16 plus shell companies and more doing these wire transfers, being used to skirt the foreign registration act or the fcpa. so you know, that's the issue too. they purposely set up shells to circumvent and do an end-run around a bunch of u.s. laws. your final word, sol? >> well the fbi is capable of investigating shell corporations and going through those. they're not always really very good at looking into laptops

hirers of lobbiests in washington, d.c., you start to see this come together. include another component of this. while vice president biden was vice president biden he was, he had access to the pdp, the presidential daily briefings, the security briefings. it is not as if he was not aware, would not be aware of who the players were in china. so the question should be asked about intelligence. the question should even be asked about john brennan, any role he might have played. elizabeth: right. >> but fast forward to what this is. it is about the money. hunter biden had nothing to offer in the form of skillsets. you're right on the shell companies. it is all about the big guy, joe biden. elizabeth: all right. conservative columnist andrew mccarthy says cefc was part of china's debt trap diplomacy where china loans foreign governments billions of dollars for things like infrastructure and then manipulates them to do

its bidding. you wonder why the bidens were getting involved in that. we're looking at senate homeland security and senate finance documents. cefc was storing china's oil reserve. hunter biden was helping china buy a back in russia's state backed oil company rosneft. they were working in places like louisiana. hunter talks about the cefc top guy, he is my partner. he is the richest man in the world. he is blanking spy chief of china. he goes missing. the other guy, patrick ho gets arrested for money laundering and bribes. pa patrick ho was trying to make cefc the middleman to help out iran, to help iran circumvent u.s. sanctions. that is patrick ho. the patrick ho hires hunter biden to help him with legal assistance when he is arrested. that guy goes to jail for money laundering and bribes in uganda

when you see cities preparing for possible violence, they're asking where is the america of january 2020? how do you get back to that, herschel? >> way you get back to it, get the democratic leaders and leaders, put restrictions on the people that destroy a building, breaking the law, they need to get prison time and i guarranty you they will do, they don't destroy those cities. right now you have to have people that will have law and order. you cannot go back into what we used to do and not have a chance to vote because you don't like the voting. put law and order on them. i think it will be better. elizabeth: you know, do you wonder how this is all going to hit the vote. the frustration of you know, regular folks out there, we don't want this anymore. we're tired of it. reports are coming in that antifa is planning to fight with trump supporters. they fought in beverly hills, orlando, new york, chicago, other major cities. one thing that seems at a

minimum, a lot of jurisdictions have laws against wearing masks at riots. why don't they enforce that? >> if you can remember this, remember joe biden saying antifa was an idea. that is a problem. seems like no one acknowledges antifa even exists. that they're are rioters doing anything that is creating this chaos. until we come to the understanding and the truth. this will continue to happen. until we come to the point that the governors and mayors can almost stand down and say, hey, we got to be leaders. being a leader will do things a lot of people will disagree with, but you have to be the right thing. the right thing putting people in jail for breaking the law. if tear up a building, hurt a police officer, do anything outside the law, arrested. don't come out of jail. spend time for three years. i guarranty they will think about whether they want to do that or not. elizabeth: you know, herschel, did you also put your finger on another problem? i think you said this too, that

how can you fix the problem if you can't name and identify the problem? is that an issue here too? >> there is a big issue there. no one is ever, ever, admitted that there are rioters out there that are breaking the law. everyone wants to continue use this word, peaceful protesters. with all dozens of businesses destroyed, people are being beat up. anytime -- you never notice a trump supporter is someone happy. they're happen, laughing having a good time. when you bring in a biden supporter, they're mad, they're mean, nasty, calling names. that is not right. it is totally not right. i think that needs to be acknowledged. until biden acknowledges it, why don't they ask biden to ask his people to stand down? ask his people do not tear these buildings up? go with whatever the voting is, go with that. left's get along, let's make this country better? elizabeth: we just saw, rather we showed the viewer footage of

a trump supporter with a flag getting swarmed by antifa rioters. and they almost killed him. they beat him up. we'll show it again. you know, herschel, we see this time and again. now police units doing tactical response preparation on election night? we hear the media out there saying this is a really sad time for our country. you know, but, what you are saying is, acknowledge the truth at the outset and stop it right from the beginning. is 24, is that the problem from the get-go with this? >> that is the total problem. and i think another problem is you already hearing some of the democratic people talking about voter suppression. you know, before, even voted, they have already now making an excuse why you got to be upset about something. i think that is a main, main problem. if you going to be a leader, be a leader. being a leader, you have to throw the laws down. you have to get people understand, this is the law.

that is tough words. >> 100%. she is absolutely right. she is pulling her punches on it. she has been saying it on the campaign trail four weeks. president trump was very popular with the media. i lived in new york. he was in the society pages and in the pages and cozy with politicians, cozy with entertainers. he was very popular with the media until he decided to take on the establishment. that is when they turned on him, ever since his campaign started the media has been attacking him, mocking his supporters, ridiculing him. over the last four years since he became the president it is always felt like the mainstream media and increasingly journalists and twitter, facebook, instagram has similarly been absolutely 100% arrayed against him whoever the democrat is. that is tough, not just against the democrats but against the media too. elizabeth: you know, in new yorkers who have followed the president, the president is

a new yorker, know that the president, then, big realtor, donald trump was using the term, quote, fake news since the 1970s. he used it against local tv reporters. he said it in an interview with mike wallace. he has been using the term fake news for a decade. he goes to washington, becomes president. the media takes umbrage against that. they think he is putting in a fascist state shutting down the press. you see narratives, that he is antisemitic, anti-muslim, a warmongerrer and a russian agent. vituperative attacks go against the president. when you hear all of that, you know the history of donald trump, how do you put all that together? >> i mean you can't. we see an establishment that is threatened by an iconoclast. what donald trump says for, whatever cozy rips you thought

you had with whisperers or you in the white house, you can't count on those at least not officially. like many successful people, he doesn't take kindly to criticism but that is to be expected. what the media absolutely did not expect him to take them on, hold them accountable. you know, elizabeth, what we've seen increasingly in american media. there is no accountability for calling election results wrong, polls wrong, russia wrong, ukraine wrong. china biden scandal wrong. there is no accountability for any of that. they laugh, sell their books and move on. so holding them accountable is what they're scared of more than anything else. i don't think the media loving joe biden as icon future of america, so much as they hate trump and would like to see him gone. the first lady said i don't like what my husband tweets all the time. she doesn't like what he says in the tweets and agrees with the
