[applause] our goal now is to ensure the integrity for the good of this nation. maria: the president went on to say yesterday process deserves look from the highest court. >> this is a very big moment. this is a major fraud in our nation. we want the law to be used in a proper manner. so we'll be going to the u.s. supreme court. >> joe biden also speaking to his supporters over the outcome of election. watch. >> take a little longer as i've said all along it is not my place or donald trump's place to declare who is won this election. that's a decision of the american people. but i'm optimistic about this outcome.

maria: so here is where we are, six states are still too close to call. one of the ones we're watching this morning pennsylvania, which has now stopped the ballot counting process until later this morning. markets this morning are lower. take a look at futures indicating we will see weakness at start of trading taking a hit after the overnight speech showing strength on nasdaq whether decline on the dow industrial down and nasdaq is up 292 points, and s&p higher by 18. it is a huge departure from election day markets. best election day performance since 2008. dow industrials up 555 point 2% and nasdaq up 203% and s&p high or by 58, one and three quarters percent. cac up 21 and dax index up 44 in asia mostly higher as well. we have a pretty good tone in the asian markets from the moment the markets opened last night as you can see the worst performer hong kong down a fraction and japan up one and three quarters percent on nikkei average now top stories we're watching this morning. president trump declaring and speaking from the white house hours ago the president hinted white house would push the supreme court to rule over the disputed ballots. warning that, quote, it is a very sad group of people trying to disenfranchise voters and the country. biden campaign releasing statement just after that saying in part donald trump does not decide the outcome of the election. joe biden does not decide the outcome of this election. the american people decide the outcome of this election. and the democratic process must and will continue until its conclusion. joe biden leads electoral

college vote 238 to 213 but, of course, we are waiting for tee race results in pennsylvania, north carolina, georgia, michigan, and wisconsin. let's turn to house and senate races they have another bounce of power change there is. fox news can confirm the democrats will remain in control of the house. picking up five seats in the process, republicans will likely remain in control of the senate. majority leader mitch mcconnell winning his race along with south carolina lindsey graham. two tight races, democrats meanwhile pick up one seat from former governor defeating senator cory gardner. >> election night protest breaking out throughout the country meanwhile demonstrator seen clashing with police outside of the white house last night. at least one person was arrested and then there was a similar scene playing out in portland oregon city there has been the scene of ongoing unrest and it did not stop last night. several dozen protesters took

streets of los angeles. some of which went head-to-head with police who were in riot gear flangs. president trump and joe biden making their messengers clear overnight addressing supporters with key swing states still up in ambulance ed lawrence in d.c. this morning with the very latest update. ed good morning to you. >> good morning maria here we go again we're looking at pennsylvania also looking at new york and upper midwest michigan, and wisconsin for president donald trump looking at how this shakes out between he and forger vice president joe biden now fox news data is showing that the former vice president joe biden is underperforming from 2016 in large cities in wisconsin and michigan. have to see how rest of the ballots, though, shake out there's a lot to be counted in two areas now pennsylvania and north carolina extended their ballots to have them registered at least by friday. they'll be counting friday a very big day that's going happen here in the nation. now we know that the majorities of the ballots coming in from

register democrats those are majorities of the mail-in ballots which is why republicans went for a huge push for an election day turnout. the president relying on marathon campaign rallying one after another to try to get that vote out. now early this morning still the president still fighting. listen. >> this is a fraud on the american public. this is an embarrassment to our country. we remember getting ready to win this election, frankly, we did win this election. [applause] >> within the last hour, the biden campaign released a statement saying this, quote, the president's statement tonight about trying to shut down counting of duly cast ballots outrageous unprecedented incent. last night you started to hear some nervousness from the biden campaign about battle grounds states of pennsylvania, ohio, texas, and florida. here's the campaign manager. listen. >> we don't need to win them and

that's a true luxury we don't need to win any of the four big states in order to still get to 270 electoral votes. >> we know that texas, ohio, and florida falling for president trump on the senate side as you said it looks like republicans will retain control of the u.s. senate. very close races still oustanding in michigan, and in maine we're talking about susan collins very close margin. but she is up just slightly in that on the house side as you said, the house is going to stay democrat. there were some seats that were flipped about six but again democrats retain control by about five. back to you maria. maria: all right ed thank you so much. ed lawrence with very latest we're keeping a close eyes on wisconsin this morning joining me right now is real clear politics cofounder president bevin and dagen mcdowell republican strike that jigs and founder ceo joseph great to see everybody this morning. late night early morning.

kick it off what's your reaction? >> what an election which is still going on. i mean, look, you know there was a lot of talk about the blue wave right this was going to be the blue wave and certainly the national polls and a lot of battleground state polls were giving some indication that didn't turn out to be true, in fact, republicans overperformed in the senate. they overperformed in the house actually picked up seats in the house. drurp won florida by, you know, twice as much three times as much actually than he won in 2016 and now we're down to situation where, you know, he's got ab 680,000 vote lead in pennsylvania. which is pretty substantial. there's still over a million democratic votes shouldn't say democratic votes but mail-in ballots that remain to be counted. those are going to -- going to lean heavily towards joe biden. but still that's an awful steep climb i think trump campaign

feels pretty good about where they are in pennsylvania. so it will come down to michigan, you know or wisconsin and i think we're going to be in recount territory i think it is going to be messy a real fight to play out over next coming days. >> it is a dog fight prior to real clear mr. speakers average had joe biden up by 7 points of impact as we get more and more results is this looking like a repeat of 2016 which would you expect we have definitive answers in michigan, in wisconsin? >> well, they're going to be counting their mail-in ballots going to take a couple of days pennsylvania says they'll be done by friday so i would hope that we would have something by then. people are saying that, you know, wisconsin, michigan could be, you know, counted and declared as early as, you know, this morning. maybe by the end of today just depends on how this shakes out it looks like joe biden picked up a bunch of votes overnight in wisconsin. and is taking a very slim lead

there. so we'll have to wait to see it is going to be -- it is going to be a dicey few days as both get counted nip and tuck a lot of states trump is looking pretty good in michigan. his campaign is looking pretty good feeling pretty good about where they stand right there but again a lot of votes to be counted in that state including some in and around detroit area lean heavily towards joe biden. maria: dagen mcdowell. >> tom also talking about the senate because again with president trump and a lot of these senators, it is very difficult to unseat incumbent lindsey graham winning reelection. mitch mcconnell winning reelection despite just tens of millions of dollars flowing into those states for their democratic opponents. talk about the money spent or the money wasted and also how the republicans will likely keep control of the senate and that really gives a big balance and a check to the house and

potentially the white house if it moves if it winds up in joe biden's hands. >> yeah. you know hundreds of millions of dollars spent in kentucky, in south carolina, in texas, all for not. for the democrats, right? look the big race i think, this is a thing donald trump basically turned out the vote. it turned out the vote in north carolina and got thom tillis over finish line turned out vote in iowa got joni over finish line there. you know, he turned out the vote and got steve gaines over the finish line in massachusetts. it is going to be a very, very ironic situation if republicans keep control of the senate. and actually pick up seats in the house based on what donald trump did in the final days of this campaign and then if he does not prevail at the tom of the tiblght if donald trump loses, you know there will be a lot of republicans who will owe him a great deal of thanks because he really did get massive turnout across this

maria: uncertainty driving market this is morning investor focusing on 2020 presidential election, as results are coming in futures have been all over the map dow industrial this is morning down 77. nasdaq has been firm throughout the night today, and about it continues this morning up 270 points right now. 2 and a half percent and s&p higher by 13 and three quarters after stocks closing near high of the day before any of the results were in investors betting on more stimulus and, of course, clarity really leading this dow industrials up 554 points i still think that this market would not be trading this way if it weren't baked in that investors believe president trump gets a second term. dow industrials with a 555 point gain yesterday. nasdaq up 202, s&p higher by 58. yesterday, joining me right now is global advisor president dominic. thanks very much for being here. have the election that we're still crushing through. what's your reaction? >> i think you brought up one of the real critical points that is markets like clarity whether trump wins election or biden at the end of the day they want to know what the rules of the game are. they want to know what taxing structure will look like regulatory structure going to look like and i think what we're seeing right now at least with the futures are, is trump is known quantity and fact that the senate looks like it is going stay republican is huge. because about even if biden were to squeak in, they would angt as a buffer as a control on any wacko legislation that might come out of the democrats. >> yeah. i mean going into this as markets were rallying before the election, wall street firms were trying to put a face on a good fashion on stimulus, i mean, i can't believe that this market would rally because we're going to get massive spending programs should joe biden win the presidency. i would much --

i was siding with, you know, much more that investors were thinking maybe clarity we talk to pin point why markets have been up for two straight days in triple digits. but what do you think? do you think that markets could actually rally because we're going to see huge spending programs? >> if you look at the polling data you saw race that are rogue over last couple of days, i think investors in general starting to get a little bit of a sense that this might go other way. and then certainly a lot of people on wall street were trying to make this argument that if the democrats were to sweep that we would have this just this ginormous massive stimulus package out of the democratic side of the fence there. but there's no free lunch and such a -- spending measure would be accompany by a taxing measure to pay for it. so trying to play this as democratic sweep would be really positive i find that one really hard to believe. >> it is not positive. at all with the democratic sweep i totally agree. the october jobs report out meanwhile this friday let's talk

fundamental regardless of where this goes economists are compting 600,000 job added to economy last month for the month of october they're expecting unemployment rate to tick down. to 7.6.a six month in a row of the unemployment situation ticking down dominic. this is on top, of course, it have that 33.1% gdp number last week. what do you expect from the jobs number this friday, and what do you say about the back drop in terms of the economy right here? >> so what we're seeing literally on a weekly monthly basis is, obviously, with the gdp report, that the economy is in recovery mode. but what we're also seeing is that it is starts to slow down because ppp money run out for most part and major companies out there have said you know what, we can't hold on any longer. so you're seeing small business owners that are shutting doors you're seeing large companies going we're going to have to start laying people off so you have a seesaw starting to pick up steam and starting to grow

maria: welcome back battle ground state of pennsylvania still too close to call this morning joe biden saw a lead during early voting. but the trump campaign was relying on in person voters to show up in a big way on tuesday. they did graddy live in philadelphia with more on critical swing state of pennsylvania. graddy, good morning to you. >> good morning, maria we knew that keystone state could be key to this election, and we're still seeing that play out this morning. as you mentioned the president needed his supporters to e shough up in full force on election day to make up for those democrats spewing mail-in ballots that were received three teams more democrattings return mail-in ballots than republicans did and president did have a strong show of force among his supporters here in pennsylvania. yesterday, but there are still mail-in ballots being counted

and a lot of them we have live pictures poll workers still counting ballots here in pennsylvania and philadelphia right now across the state 1.1 million mail-in ballots have been could counted 1.4 million o be counted so there's a chance that the vice president or the former vice president catches up to president trump who as of right now has a sizable lead but there are also in fern votes that still have to be counted. yesterday the president came out he claimed victory he also indicated that he would dispute the results of this election. listen. this is a very big moment this is a major fraud in our nation. we want the law to be used in a proper manner. so we'll be going to the u.s. supreme court. >> ofng, this race still too close to call. question should point out what makes pennsylvania a little bit different than the other swing states that we're still paying attention to right now is that

mail-in ballots can still be received until november 6th if they are postmarked before election day. so if this is a close race, they could still be receiving ballots and counting those ball the los up until friday of this week if it all comes down to the keystone state this could be a long drawn out process with legal battles to ensue. maria. maria: oh yeah graddy we're expecting that. thank you so much. grady this morning if philadelphia. dagen jump in here with what's happening in pennsylvania we knew we wouldn't know and secretary of state said not finishing counting ballots until fred. >> we knew that but we'll point out that will the ballots received after election day are being segregated incase of a court fight. that we found that out a few days ago. so they were anticipating because of the decision to allow the counting and receipt of votes to last until friday.

we know that happened. but i just want to shine a big light on what we saw in this very fine country where we live. we had almost two-thirds of eligible voters come out and vote. i think that's highest percentage since 1908 maybe. and president trump really hammering the campaign trail in the final days garnered more votes so far as we know than the did four years ago so turnout was incredible and people stepped up and i think you watch these market there's solace in knowing that republicans will likely maintain control of the senate as you were talking about because one of the most important things for corporations and the people who work for them they don't want their taxes to go up. higher taxes on corporations, it just simply means less money to hire people less money to rehire people, and less money to give folks raises. you don't want that in a pandemic as we're trying to

election day performance since 2008. dow industrials up 555 points yesterday better than 2%. nasdaq up 203 and s&p 500 up 59 points. european markets this morning look like this. as you will see we do have a firmer tone although it is very much fractional situation here. flat up one and a half and cac up two points and dax is lower by 32. in asia overnight markets mostly higher as you can see here. and here too you've got really fractional moves up 7%. taking place last night get to cheryl casone with details there. cheryl. >> some potential tossups maria that's right let's first start with arizona democrat mark kelly defeated gop senator martha mcsally that was arizona special senate elections. this gives his party a big pickup in fight to retake the senate majority although the senate at this point likely is going to stay gop controlled. this is a rapid shift for

arizona in the political spectrum suddenly they've got two democratic senators after going years without electing one fox news called arizona for joe biden overnight this makes him by the way, first democratic presidential candidate to win in that state since 1996. as for fox news voter analysis in arizona, younger voters really came out for joe biden in particular if you look at the 18-29 demographic 62% went for joe biden also sydney mccain voice strong this that race also looking at that one let's move on to north carolina, this is again one of the most critical senate races in the country north carolina senator thom till lis first term republican whether he succeeds determines whether his party keeps majority and looks to be head and kind of a tight race right now as you can see on your screen had a strong challenge from cunningham over state senator army reserve officer again that small town rural vote according to fox news

voter analysis really came in and also the president had strong support in the state. 55% saying that the president was a strong threerd that helps on republican ticket. also north carolina govan white cooper saying let the process work out in that state did declare victory now to south carolina republican senate lindsey graham winning reelection after a contentious race although democratic candidate jaime harrison jot raised by enough not enough to flip the senate race 200 million spent on this one remember gam led that high profile confirmation hearing for judge amy coney barrett to the supreme court. harris hit him on reversal for confirming a supreme court nominee in the presidential election year. so again, this balance of power maria and senate key to watch, obviously, as we try to move forward to get stimulus move forward and by the way, we can't confirm fox news confirms that democrats will remain in control of the house of representatives.

you think something can still happen and if so, how long do you expect this to last this unrest and uncomfortable feelings in our big cities? >> well it's always a possibility. one thing that law enforcement did was this control training was focused on confirmation of judge barrett that was the dry run, so to speak, for potential outbreaks that could unsigh in connection with the election and what police department are doing are using washington, d.c. portland and los angeles as a lit test for potential outbreaks of violence in relation to election. that being said, i think it is too early to call but a lot of businesses have been proactsive in terms of boarding up locations as we see in wal-mart. they remove firearms from the display counters so more of a wait and see approach but generally speaking when we look at this being a close election we're more unlikely to see

unrest as opposed to being a landslide. >> so what should people do darin, tell us how we should be reacting to people in the streets all day, i mean, there's a lot of unrest and certainly tension within our streets. >> well granted, this united states has been divided in a wake of the up and coming election which just subsequently happened. i think one of the things that we can do is we need to reengage that police and community relationship and understand that that cause ways essential for us to maintain a level of calm and peace. the police are going to do all that they can. but us as common citizens we needed to do best that we can in connection with staying vigilant and notifying professionals which law enforcement if question do, in fact, observe that service. but by and large i believe we're going get there this as american people because this is the best nation on earth. maria: all right let me bring in

joseph go ahead joseph. >> no absolutely. obviously, darin i think, you know, there's this notion somehow that streets will be filled with roving gangings of trump supporters and yet, obviously, you know question see there's no reason to be scrawling black lives matter on your build physician you were in fear of the conservatives are going to taken to streets in anger. you know talk to me a little bit about this false narrative that's been put forward when in reality we're seeing that if president trump was placed in office four years ago by flyover nation, that in great truth it was kind of drive through and drive around america that really went to the polls and earnest in the name of law and order in the name of justice when you talk about like some of the exit polls where, you know, close to 36%, 41%, 35% state by state when you see this precipitous rise in favor of trump and republican agenda for equality and justice in our streets.

>> well i think what's happening now is a lot of people when we look back at the death of george floyd back in june and may of this year. we saw a rise in violence that plagued the nation most specific to the larger cities. the democratically controlled cities to be specific. and we as a nation viewed that as a problem, and we now focused towards how can we present or come to a level of calm? anarchy and violence is something that we don't want and i think many have come to polls and voted from the perspective of look enough is enough. we now need to attack our nation to a better place and so many -- individuals will vote for trump because they see him as a person that will place moratorium on violence so when we look at the hispanic community or let's say the african-american community, you're gong see a big split in terms of how people vote and you're going to find more people are going to vote on the side of law and order than people think.

we certainly will not know about pennsylvania. but i've just point out something karl roe talked about on your show yesterday that the president and 2016 won 306 electoral college votes. so he can give up 36. only state that we know so far that joe biden took away from president trump this election year versus four year ago right now is arizona. so i believe correct me in my ear if i'm wrong that's 11 electoral college votes that would leave him only the ability to lose 26 additional electoral college votes still get to 270. that's something to watch. but i want to put up that map just want to point something out see the state of florida that's where mike bloomberg set fire to 100 million dollars. that's essentially what he did he set it on fire because that because president trump again won the state of florida he had a better showing with latino

cac up 20 and dax higher by 18 fractional moves as we await final results from five key battleground states this morning. including michigan, wisconsin, pennsylvania, north carolina, and georgia. for the presidential election, joining me right now is ubs global wealth management chief economist great to have you this morning thank very much for being here first give me your take on what you're seeing in terms of the economic back drop and oh, this uncertainty plays into that. >> so as we all know markets do not like uncertainty. and what we have seen is i think two areas of uncertainty coming through with this result. the first is uncertainty of potential contested election results. for when president remarks this morning, and sending is uncertainty about the senate which, of course, is extreme important economically. but markets now i think are settling down and perhaps

planting going back to assessing where we're going to be going with policy. and where that is a focus on fiscal stimulus is going to come through and how quickly fiscal stimulus can come through to support the u.s. economy as it continues to deal with the pandemic. >> yeah. we were talking about this yesterday, i mean, i'm hearing that we're not going to get anything significant the way we were talking about in the regular session to two and a half trillion dollars that maybe during the -- during the lame duck session you get something much smaller than that. is that enough to make a difference if it is a 700 billion dollar very targeted deal that the president releases just to help certain groups for example, like the airlines and individuals that are home looking for those checks? >> so this is where things really come down to, you know, what is critical in the pandemic. and we've been saying right from the start the virus doesn't matter economically what matters
