[closing bell rings] scott, david, thanks so much. the big jobs report for october is tomorrow. stay tuned. i will see you friday. connell: we have five states to go at this point. investors are betting on gridlock in our nation's capitol. they seem to be perfectly fine with that scenario. i'm connell mcshane reporting to you from harrisburg, pennsylvania which has become quite active city. we'll talk about that here on "after the bell." but we begin with the closing numbers. stocks surging on wall street fourth day in a row. despite what presidential candidate occupies the white house come january. dow up 540 points which is about 2%. here is where we stand in the race. five states on the board yet to

be officially called by the fox news decision desk. those five are pennsylvania where i am, georgia, nevada, north carolina, also alaska has not been called. the trump campaign is mounting a number of legal challenges in these states. the biden campaign calling the legal challenges meritless. we'll get into both sides on that. look for a moment at current vote tally in pennsylvania, as counting continues throughout the day, the margin between president trump and vice president biden has continued to narrow. president trump's leads with well over half a million votes, just over 100,000 votes as mail-in votes continue to be tallied in places like philadelphia. here in harrisburg, we had protesters out on the streets on the steps of the state capital. a number are still there behind me right now. they have been chanting things, stop the steal, stop the fraud. we'll talk about those challenges, the legal challenges on the merits from the trump campaign but also keep an eye on the other story, the vote tally

here in pennsylvania, 20 electoral votes on the line. the margin is much, much smaller than it was. a lot coming up. first the top stories. we have fox business team coverage. jackie deangelis, susan li back at the new york newsroom, blake burman at the white house. hillary vaughn is wilmington, delaware covering the biden campaign. edward lawrence is in washington, watching the fed. let's get to everybody. blake, we start with you. reporter: connell, with he heard from the trump campaign on a couple different occasions on conference calls. they say when all said and done, when all the votes are tallied up they believe, this is their belief they will win pennsylvania. they will win arizona, by the end. week they say they will get to over 270 electoral college votes. listen here to the campaign manager bill stepien from earlier this afternoon talking about the president and his chances. listen. >> he is alive and he is well. we believe, he believes and we believe that if we count all

legally-cast ballots the president will win. we are confident in that fact. we are confident in our pathway to 270. we're confident in our math to get us there. reporter: as the vote counting still continues in several crucial states, president trump tweeted out the following earlier this morning, saying quote, stop the count. the trump campaign connell, was asked, what exactly us did the president mean by that? >> what we should not be doing is treating ballots that are coming in late with no postmarks, or ballots that are magically being found under very questionable circumstances, those should all be set aside and dealt with separately. reporter: you mentioned lawsuits, potential litigation. add nevada to the list where the trump campaign will file

lawsuits. connell, give you a quick look right now. phoenix, arizona, there is a trump campaign event that is about to take place there. i think we have that shot f not, there you go, republican party of arizona, expecting the trump campaign to talk about arizona in the upcoming moments. we will see what potentially comes from that. connell? connell: we will. we'll monitor that, blake and just to be clear, everybody knows this, the reason 264 on our board the fox news decision desk has called arizona already for vice president biden. i know the trump campaign seems to think they still have a chance there. but the fox news decision desk standing by that call. blake, thank you. get to the other side joe biden is cautiously optimistic how we're told they're couching things in the biden campaign today. hillary vaughn live in wilmington, delaware. hillary? reporter: there are signs today biden is business as usual. he is in downtown wilmington at the queen theater. he has been there for several hours getting a briefing with

his running mate, senator kamala harris on covid and the economy. the campaign said these are the briefings a part of their normal routine since march. the return to normal routine is a sign biden is very comfortable and confident with where he stands. he just stopped short yesterday of giving a victory speech. he says he believes the winner will be once all votes are counted. the campaign is slamming the lawsuits that the trump campaign filed in states like pennsylvania saying they believe the president is trying to delay and distract because he is losing. >> he sees the same data we do and knows he is losing. donald trump continues to push a flailing strategy designed to prevent peoples votes from being counted. what we're seeing on the legal suits they are meritless, and nothing more than an attempt to distract and delay what is now inevitable. reporter: but the biden campaign

is commenting on a particular dispute in pennsylvania where the trump team is fighting to get their campaign representatives closer to monitor the actual ballots being counted. biden campaign official bill russo tweeted this. we don't care if your observers are 18 feet a you way or 15 feet away, or six feet away as long as election officials can do their jobs. connell, back to you. connell: we'll have more on the pennsylvania case as little bit later. hillary, thanks. "fox business alert." business news with uber. uber is out with the third quarter results after the bell. susan li watching that. what do we see? reporter: a smaller loss than anticipated when it comes to the profit line. they're losing 62 cents in the quarter where analysts were expecting something closer to 65 cents. this is a beat. on the sales front, revenue, slightly less than anticipated. i think this is university is hurting the stock. uber reporting sales of 3.13 billion. analysts looking for something

closer to 3.2 billion. commentary coming from the ceo dara extending delivery offerings to groceries and prescriptions. you see here, from the profitability standpoint since they have reiterated they will be profitable outside of expenses by next year, 2021, but gross bookings when it comes to ride-hailing giving us some color how things are operating. they're only down 6% in september. that is the 70% during the march, april period during the height of covid lockdowns. for geeinggraphy, first time they broke out the ride-hailing business, that the u.s. is the worst geography worldwide. they're still struggling on the west coast. new york is doing better than most across the u.s. finally when it comes to uber

eats is it making up for the loss in ride hailing? uber eats is powering ahead. they're up 191% from the july to september period. they made 1.13 billion there. so yeah, we're ordering a lot of food in these covid times. connell? connell: interesting. uber is selling off about 4 1/2% after the bell. susan li on uber. the washington, d.c., with the other big name making comments, edward lawrence joins us about the fed chair. reporter: i thought you were talking about me. federal reserve chairman jerome powell announcing interest rates will not rise anytime soon. the federal reserve will use all the tools it has until the economy is on the recovery. he said the downside risk for the economy predicted when the pandemic hit turned out not to be true and the economy recovered faster than expected. throughout the comments he talked about the need for more fiscal stimulus. >> this will take a whole of government approach including

health care policy and fiscal policy too. it is really is, if the want the economy back as quickly as possible to where we want it to be, then really it should be all of government working together. reporter: so without that whole government approach the fed chairman feels like the recovery will be slowed. senate majority leader mitch mcconnell says that the first priority when he gets back next week to the next covid package, they want to get that passed. he thinks it can be done before the end of the year. >> we need another rescue package. the senate goes back in session next monday. hopefully the partisan passions that prevented us doing another package will subside. reporter: roughly two trillion hollar price tag being offered before the election the given the democrats lost seats in the house it could be added pressure on house speaker nancy pelosi to

help businesses and people with the coronavirus more. they argue she was delaying to hurt the president with a weaker economy going into election day. also they have to pass a budget by december 11th in order to keep the government open. back to you. connell: edward lawrence. big name in his own right in washington, d.c. another one joins us right now steve moore, the freedomworkses economist. i know we're still trying to sort out this election, steve, sounds like what edward is reporting from jay powell and mitch mcconnell maybe we get some stimulus finally in the lame-duck session. i'm not sure if you would be a big fan of that or not. what do you think? >> hi, connell, i authority you were talking about me. connell: i know. >> good to be with you. i think it is really up in the air what happens to stimulus. i think if trump were to pull this out and win in arizona and win in pennsylvania, and then be reelected i think there is a high probability that the president would sit down with

pelosi and get a deal done. if he loses or this stretches on for a number of, more weeks, i don't think you can count on this happening. and let's say that trump is declared the loser sometime in the next week or two, i think republicans are likely to say, look, you know, let's wait, joe biden you own this. you want to have a two trillion dollar spending bill, go ahead. we'll not have it on our watch. investors are they want it badly. i don't think they can count on it. i'm talking to investors today they're get a little nervous about the senate t looked yesterday like it was a slam dunk that republican was hold the senate. you have the two seats in georgia that look, you know, possibly going to a runoff. the north carolina race looks pretty good but not a slam dunk. so there is a scenario when you, where you could have 50-50 in the senate. you have have a situation where

the vice president in this case kamala harris would be the tiebreaker. that has some folks on wall street a little jittery. connell: we keep saying that the market is up. so funny trying to assign reasons by the way for market rallies. we're not the best at that over the years sometimes. we don't always get that right. but when the market is up 540 points on the dow, the bet is on gridlock. sounds like you might be saying investor are making short term bet on a big stimulus because the dems take everything and start spending like crazy, no? >> let me be very clear about this because i want toby crystal clear. i think the odds are low that democrats will get the 50 votes but it's a possibility. i think this time yesterday everybody thought republicans were already over 50. so in terms of the stimulus, i would say this, there will be another stimulus plan but i don't think you can count on that happening anytime in the next few weeks. connell: where is the economy, steve in your view?

no matter who ends up on top whether joe biden or president trump, jay powell talked about, i think the way he phrased it, growth has moderated, right? it slowed down a little bit. where are we right now. that is what the new president will be dealing with whoever is inaugurated in january? >> i think it its strong. i really do. obviously the blockbuster gdp report i think is one of the things that really narrowed this race. trump had been down four or five points in the polls. he narrowed that over the last weekend because of the strong economy. we got another good report on unemployment this morning, connell with another, you know, several hundred thousand people leaving the unemployment rolls in terms of the unemployment insurance. so i think the economy is pretty fundamentally strong right now. that is why we were saying i'm not a big fan of another stimulus bill because i'm not so sure we're going to need it but, connell, ask me that question tomorrow because obviously we get the big jobs report for the month of october tomorrow

morning at 8:30. connell: yes. almost forget about all these things with the election going on. final question is election related, if you don't mind, steve, i'm trying to avoid as many hypotheticals as i can this week -- >> there are so many. connell: i know. there are, legal challenges and everything else, at the moment our fox map has it at 264 for vice president biden, one more state gets called, that is 270. if that happens the president continues to fight it out in court and this thing drags on even though biden looks to be across the threshold is there an economic impact to all that if it still looks in any way uncertain to people? >> first of all you know we're mad at fox news, you know that, connell. we think we're going to win arizona. we really feel confident about that. connell: i heard that. arnon mishkin was on with us yesterday, i asked him the same question. he is adamant they got this right. sticking by the call in arizona. but go ahead.

>> i lived through bush v. gore in 2000. we all did, i remember, the markets don't like it when it is a shaky situation uncertain. i think all americans hope we get this resolved in the next three or four days, there is a clear picture of a winner. i certainly hope that is donald j. trump. trump feels strongly there is, i don't have a attitude about this one way or the other, they do think there has been some election fraud in some of these states like pennsylvania and michigan. i do think given how close the race is, that is worth investigating even if it takes another week or so. connell: always good to see you. steve moore out of washington. thanks a lot. >> thank you. connell: we heard while steve and i were speaking, vice president biden plans to speak in a few moments in wilmington, delaware. when the remarks begin we'll take you there live. we have not heard from either candidate on camera. millions of ballot counting

continues. we're awaiting results in five of them. you add it up, 60 electoral votes out there. we have the possibility of recounts in 3:00 states including wisconsin. a state that conducted presidential recounts in three other races. but must certify the election results by the 1st of december. there are a lot at moving parts. we'll talk with an attorney that worked on the recount in florida 20 years ago, bush v. gore. stick around here from pennsylvania.

connell: we have a "fox business alert" now as the "after the bell" earnings are in from news corp. jackie deangelis following that. how did they do, jackie? reporter: good afternoon to you, connell t was beat on both fronts earnings per share and revenue. adjusted earnings eight cents. expectation was not for a profit or loss. it was flat. this is better than expected on revenues. 2.12 billion. that was also higher than expected. remember news corp is the parent of "the wall street journal" i want to switch gears and talk about peloton for a second because this was a blowout quarter by all accounts. earnings per share, 20 cents. it was a nine cent beat there. revenues, 7.5, pardon me,

757.9 million. it was up 232%. remember, this is a company that had a loss a year ago of a $1.29. despite the expensive bikes, the fact the people need subscription service to participate this, is a covid trade that worked out for a company. paid digital subscriptions up 382%. so over 510,000 total members were added during the quarter. that grew to over 3.6 million. really strong showing for peloton. connell: all right. jackie. thank you. vice president biden has come tout speak in wilmington, delaware. >> 242,000 deaths due to covid. our hearts go out to each and every family that lost a loved one to this terrible disease. in america the vote is sacred. it is how people of this nation express their will and it is the will of the voters, no one, not anythings, that chooses the president of the united states

[horns honking] connell: live from wilmington, delaware, vice president biden addressing supporters, a small amount of media had come out. that is first remarks we heard on camera from the former vice president. he talked about each ballot counted. something following in the state of pennsylvania as well, getting many ballots through the system. i was watching the count here in pennsylvania, we brought it up at the top of the show, a lot of attention given to the legal battles in the state. one of the other things to look out for the actual vote count itself. moments ago the county in pennsylvania dropped under 100,000 in terms of margins between president trump and vice president biden. we'll keep eye on it. more on the state as the u.s. enters new terrain with the virus as vice president biden reported, more than 200,000 new coronavirus cases in a single day. first time of the pandemic we've

♪. connell: back here in pennsylvania, not the only state where the trump campaign is mounting legal challenges. jonathan hunt joins us now from las vegas with an update on things in nevada. jonathan? reporter: connell, two storylines here out of nevada today. first and very quickly the numbers. at this point yesterday former vice president joe biden was leading president trump by around 8,000 votes. today that is up to 12,000. we're told by the nevada secretary of state there are something like 190,000 total remaining ballots to be counted and 90% of those come from here in clark county where the biden

campaign thinks that he is strongest. so they are optimistic. less reason for optimism it seems for the trump campaign, which may be why they filed this lawsuit or are filing they say this lawsuit today which claims that thousands of dead people have voted and those votes are being counted, which claims that thousands of non-nevada residents have voted and those votes are being counted. but they offered scant evidence for those claims and the county registrar here in clark county at least says they have seen no evidence of fraud. here is both sides. listen. >> we firmly believe that there are many voters in this group of mail-in people that are not proper voters. >> the trump campaign is alleging that counting of improper votes here in clark county. what is your response to that? >> my response is that we are not aware of any improper ballots that are being processed

reporter: we gave the trump campaign officials the assembled media plenty of chances today to offer evidence to back up their claims. they declined to do so. it may be that they are saving that evidence for the judge they have said they are filing that lawsuit today but as far as we are aware according to the court, it has not yet been filed. connell? connell: all right. jonathan, thank you. jonathan hunt with the update there from nevada of the as we bring things back to here where we are in pennsylvania, we said at the top of the show, the trump campaign filing a number of lawsuits here. it is all happening as the state continues to count the mail-in ballots. two track story here as well. the vote count itself where the trump lead is shrinking. my colleague bryan llenas is here in harrisburg from fox news. joins me in front of the state capital here this afternoon. first what is the latest on the legal front? reporter: the latest the trump campaign filed a lawsuit in federal court to try to stop

counting in philadelphia in its entirety. the reason why they want to stop the count, they say republican poll watchers are not being allowed access inside of the convention center where they are counting 92,000 mail-in ballots. initially republicans came here. they had a victory in the court here in pennsylvania. they were temporarily able to halt the counting claiming their pole watchers were not allowed to get close you have to view the ballot counting process. that is federal lawsuit. this is one of many issues they're bringing up here. the republicans improper vote by mail. precanvasing in montgomery counties. pole poll observer pack ses. they're throwing everything but the kitchen sink from legal perspective to halt the count. connell: as they do that the count continues. the lead for the president seems

to be shrinking. any sense where they stand? reporter: the lead for the president is 100,000, a him less. connell: a little less. reporter: there are 340,000 mail-in ballots are left. most of those ballots are philadelphia county and other counties that are heavily democratic. he has been winning, 70% of the mail-in ballots going to biden in the state thus far. connell: right. reporter: even in red counties. connell: not just philadelphia. what is going on in allegheny county in pittsburgh? reporter: there are 35,000 ballots counting in allegheny county. they stopped the county because of 29,000 of those ballots were incorrect ballots that were sent out. so they need some time to sort these ballots out. it was a, dates back to a federal court case, about a week ago. they're going to start their count friday after 5:00. connell: about 30,000 whatever it is. we may still know the bulk of

the county here by maybe tonight, right? reporter: secretary boockvar says overwhelmingly majority of mail-in ballots will be counted by the end of the day. they thought it would be tomorrow. a lot of eyes on pennsylvania today. the mail-in ballots swinging pretty hard towards biden. that lead for the president continues to dwindle. connell: smaller and smaller throughout the day plus legal challenges. a good summary, a lot to follow in pennsylvania. we're joined by tom spencer to talk about the legal side, more detail. democracy president and florida recount attorney in bush v. gore days 20 years ago. tom thanks for coming in. bryan went through pennsylvania and john through nevada. is there anything that you heard from the campaign officials that might stick? is there anything that should be concerning? what do you make what happened in the last couple of days in terms of what has been filed and what has been threatened? >> this is a typical situation

involving election litigation. there are a lot of allegations. there is a lot of information coming in to the legal team. a lot of forensic people in the field. a lot of investigators, looking at records and then looking at what happened. and the formulation of the legal issues to be presented to the court. and ultimately obviously it will be a court to decide if they win. it is a heavy burden in an election litigation. then whether or not it gets to the supreme court of the united states is another issue. but there are some very, especially in pennsylvania, there are some very substantial issues. connell: what's the biggest issue in pennsylvania? what would you look at most closely in this state? >> the issue is the constitutionality of what the supreme court of pennsylvania did in taking on legislative responsibilities and changing the election rules, just before

the election with respect to the date of the election, extending the date of the election, with mail-in ballots for postmarks and ballots which, really don't even require postmarks by the supreme court decision. so the question there, presented to the supreme court of the united states will be, did the supreme court of pennsylvania have the right under our u.s. constitution to make those changes or is that exclusively within the province of the legislature. connell: right. those postmarks, postmarks when a postmark can't be read, that seems to be one of the questions that will be interesting to see how that one is -- is ruled on. can i ask you one other legal strategic question if you don't mind. >> sure. connell: this goes back to 20 years ago. when there were questions about, close races in a number of states but the concentration on the legal side was in one state,

in florida, with the hanging chads an everything else. >> right. connell: would that be only way to successfully contest a election, hypothetical, put all resources in one state as opposed to filing all the lawsuits all over the map? what is the best way to go about it? >> the republican party has enough resources to put excellent legal teams in each of those states that are going to be contested and develop strategies and legal theories with respect to each of them. so they're doing exactly the right thing. and it just, a question of patience and time and effort and there will be a winner and a loser. connell: the timing of that, right, is december when you have to certify the electors. is the goal i guess from, if you're representing the challenger, the president, to get a case to the united states

supreme court by then to try to latch on to one of these cases in one much the other courts to drive it all the way up there? is that essentially what you're trying to do you think? >> absolutely. it is a sprint. they have to have the case determined, finally by december the 8th. connell: right. that is the big date. because we have to certify those electors and move forward. as we did in the year 2000 as you well know. >> right. connell: tom, good to have someone with your experience, insight to explain it all as we follow real time. another thing we're following general motors, that stock price surging. truck sales delivered a huge third quarter beat for gm. the interim chief financial officer said the company sales and u.s. and china are recovering faster than people expected. gm is benefiting from robust customer demand for new vehicles and services. a lot more to come. stick around. we'll be right back

bringing up the possibility ballots came in after the 7:00 p.m. election day deadline were counted. a judge decided, a judge ruled there was no evidence to suggest that that occurred or that election officials did anything that did not follow the letter of the law. now earlier this afternoon fulton county election workers applauded the conclusion of their marathon session processing more than 145,000 mail-in absentee ballots. statewide, more than 47,000 ballots remained to be processed as of 2:40 this afternoon according to the georgia secretary of state's office. >> fast fast is great, we appreciate fast. we more appreciate accuracy. accuracy will be bedrock people will believe outcomes of these elections be it on the winning side or the losing side. reporter: most of the outstanding ballots are in chatham county which leans democrat.

♪ connell: we're back in harrisburg where we've been alerted to expect a news conference in 25 minutes from the pennsylvania secretary of state, cathy boockvar. she i will update us on the election in pennsylvania which bryan llenas said is tightening throughout the day. we have legal challenges we're dealing with. bill mcgurn joins us, fox news contributor. obviously not just pennsylvania. the count on the screen at 264-214. it may be a state doesn't matter in the electoral college if one of the others is called, what do you make of the state of things here? what do you expect over the next few weeks? >> i expect things to get messier. we made a lot of exemptions. we have different rules for this election, doing a lot of new things and we allowed a lot more

latitude. for example i believe votes in pennsylvania can count even if they're received by friday, so forth. some without postmarks. i think the more latitude, the more departure from the norm that you allow the more you're just inevitably inviting lawyers to come in to make these judgment calls. so i think this is very bad for the nation, not just in pennsylvania. it adds to the feeling on either side, i don't know who is going to win but i think whenever the winner is pronounced, it is worse for america if the losers feel not only that they lost but that an election was stolen for them. and again the more, kind of departures from the norm we have, the more likely that feeling, you know, likely is to happen from people. they go to bed one night. there is a lead. it is like a ballgame. someone scores seven runs in the top of the ninth. someone scores eight runs in the bottom of the ninth.

this has been going back and forth. so i do think it erodes confidence that our people know what they're doing when they know they're counting. we need as much transparency as we can. connell: understood and agreed. everybody would agree with those points on all fronts. one thing i would say, bill, we don't necessarily know anything nefarious has happened. >> right. connell: to the best of my knowledge have we been presented any evidence that anything nefarious happened. sometimes it is counting. the system could be better, the counting takes a while. it seems like what is happening in pennsylvania until we know differently. is that fair? how do you look at it? >> i agree with that, absolutely. we hear different things, different places. we have no evidence. i will say some things seem to be troubling and they should be investigated. when observers, you know the republicans say they're being denied access to the vote counting. that bothers me. that worries me. the supreme court decision upholding a today change in the

election rules, made by pennsylvania judges, not by the state legislature as the constitution demands that worries me. that will end up in court. that means it is contentious, whichever side prevails. connell: yeah, there is no doubt about that. that is what the horns beeping behind me are. the trump supporters have been out here throughout the day, bill, making their presence known. they're clearly upset about things but so far so food -- good in terms of being peaceful. bill mcgurn thanks for being there in pennsylvania and other states. >> thank you, connell. connell: we've seen some protest in other cities around the country demand that every vote be counted. the national guard sent to portland after widespread violence reported there. authorities in minneapolis. more than 100 election protests

♪. connell: one more state to update, that is wisconsin. i know we called wisconsin yesterday but there is now a legal war to watch there which is exactly what jeff flock is doing. what's the latest, jeff? reporter: connell, they're throwing both fair to say spaghetti as well as linguini against the wall hoping something sticks. recount being asked for and potential lawsuit alleging some sort of unspecified fraud. first to the recount. how would that take place? we know the president will get a recount if he wants one here. he says he does. it would take place at county boards of canvas, doing the canvasing certification of vote now. wouldn't happen until december 1st. we might not know anything until december 1st to do a

recount. they have to know votes are if within a percentage point of each other, the votes for candidates. the cost would be borne by the trump campaign. do recounts really work? in other words, do they switch votes around? they switch some votes around, in 2016, for example, the trump-clinton race went through a recount t turned up an additional 713 votes for hillary clinton and an additional 844 for the president. not much of a switch there. i show you again as we talk about fraud, potential fraud, the central count location we observed overnight, the trump administration, trump campaign has suggested that that count overnight of the mail-in ballots was somehow fraudulent because vice president biden got 120,000 votes out of it. president trump got 50,000 votes out of it. it was not anything that took place in the middle of the night in some nefarious fashion. it was pretty much the same percentages clinton and trump
