attempted to challenge the activity the poll workers jumped in front of the volunteers to block their views so they could not see what they were doing. it became a little bit dangerous, one major hub for counting ballots in detroit covered up the windows again with large pieces of cardboard so they wanted to protect and block the counting area, they did not want anybody to see the counting, these were legal observers that were supposed to be there. in detroit there were hours of unexplained delay in delivering many of the votes for counting. the final batch did not arrive until 4:00 a.m. and even though the polls close at 8:00 o'clock, they brought it in the batches came in, nobody knew where they came from. we've also been denied access to observe critical places in georgia and multiple swing states counting, was halted for hours and hours on election night with results withheld from

major democrat run locations only to appear later and they certainly appeared and they all had the name biden or just about all, almost all they all had the name biden on them which is a little strange. i challenge joe and every democrat to clarify that they only want legal votes because they talk about votes and i think they should use the word legal votes, we want every legal vote counted, we want to open this in transparency, no secret count rooms, no mystery ballots, no illegal votes being cast after election day, you election day and the laws are very strong on that, you've election day and they don't want votes cast after election day and they want the process to be an honest one, so important. we want an honest election, we want an honest count and we want is people working back there because it's a very important

job, that's the way this country is going to win, that's the way the united states will win and we think we will win the election very easily, we think there is going to be a lot of litigation because we have so much evidence, so much proof and it's going to end up perhaps at the highest court in the land, we will see but we think there will be a lot of litigation because we cannot have an election like this. i tell you i have been talking about this for many months with all of you and i said very strongly that mail-in ballots will end up being a disaster, small elections were a disaster, small easy to handle elections were disastrous, this is a large-scale and it's getting worse and worse every day. were hearing stories that are horror stories, absolute horror stories and we cannot let that happen to the united states of america. it's not a question of who wins, republican, democrat, joe, myself. we cannot let that happen to our country, we cannot be disgraced

stop the radical dems from stealing this important election, perhaps the most important in the country's history. he also focused on the forces that were arrayed against him, not for the first time in his presidency by any means but for the selection talking about big tech, social media, the corporate establishment, the national left-wing media, the radical dems of course. it was an expression of some frustration but also handled with great style and he was in point of fact very constrained, not reserved but constrained as he addressed those issues and expressed his disappointment, his frustration at the level of corruption that we are watching into many of our states into many of our cities were both have been in fact nullified by

nothing shy of a kangaroo operation, this is what you find in third world countries. i'll just tell you very quickly, we had a state court order the state appellate court requiring the city of philadelphia to let poll watchers in to watch these ballots being open, the city election dismissed that, the sheriff of the county and here in philadelphia said he would not enforce the law so we were left with no remedy other than to file an immediate injunction today in federal court so we can have people watching and the people are opening these ballots and counting them in philadelphia. lou: not only in philadelphia are poll watchers not allowed to watch but not to see or hear the process that is going on and some cases not even to be admitted to the counting centers. and as you say in defiance, harmeet dhillon co-chair of the

lawyers for trump saying pointblank, their contempt of court, yet there is no action being taken despite all if you will irregularities at the very least that are being observed. by the way the american public sees what's happening as well, there will be a very difficult time recovery from what is only thing transparent about the selection has been the corruption, the political corruption and so many jurisdictions, do you believe the courts will in point of fact move to correct these irregularities and to deal with the corruption that is so blatant. >> i hope we can get remedy from the federal court but here's where we are, every second third counting additional ballots with no observers in the city philadelphia they're not telling

us the gonna finish counting and philadelphia by 11:00 o'clock tonight, right around the corner we had a court order in place effective since 9:30 a.m., they dismissed it, there is no enforcement recognize him, we asked the sheriff, he said no, we asked the election office, they said no, if they can do this to the president of the united states and defy a court order, what is the next court order they don't have to listen to, does that mean a restraining order for somebody else, does that mean a bench worked, the fact that there's complete lawlessness in the city of pittsburgh should scare every single american right now that a duly elected judge with authority does not have the authority to do exactly what she said she would do, they completely defined her with no recourse whatsoever. lou: as you well know and not permitting observers into the county areas and centers particular in philadelphia, they are violating federal regulations of law and not permitting observers. and the attorney general of the

state of pennsylvania has said the joe biden is going to win irrespective of the vote if he does not yet have the lead but it's clear that a lot of forces are at work that would lead to that if we continue to see more counting of votes that are illegal. >> that's exactly right, what we have said, count all the legal votes, not the boats that came in after tuesday night at 8:00 o'clock, count all the legal votes, give us the opportunity to have our election watchers there as these ballots are being counted, this should be open and honest transparency, whether you vote for donald trump or joe biden, i hope the joe biden campaign to join us and allow us to get in there and watch what's going on. if you want transparency, why wouldn't you join us.

georgia has swung to 3600 votes, that again the atlanta journal-constitution reporting just now, president trump in the past half-hour holding a news conference in the white house briefing room where he had a lot to say about the polls that showed him behind joe biden by 10%, some 17%, they proved to be outrageously and absurdly wrong, here's what he had to say about voter suppression polls. >> all the officials overseen, the counting of pennsylvania and other key states are part of a corrupt democrat machine that you written about for a long time, you written about the corrupt democrat machine, i went to school there and i know a lot about it, hasn't changed, long time ago, i think it's gotten worse, pennsylvania democrats have allowed ballots in the state to be received three days after the election and we think

much more than that in their counting those without even postmarks or any identification whatsoever. lou: this is a historic election, it's also likely to be considered an infamous election perhaps the greatest disservice to a free democratic republics reputation in our history, attorney general bill barr has not been seen in public in two weeks, he last appeared at an event in indianapolis that on october 22. since then the attorney general has been silent about the dems efforts to for donald trump in his reelection bid in their efforts to outright steel and election. but moments ago justice department spokeswoman issued

joining me now former congressman, former chairman of the house oversight committee, great jason chaffetz, great to have you with us. i want to start with the president's press conference and statements tonight, your reaction to what he said, his demeanor? >> he was very calm, cool, collected. he was very reserved, i love the way he articulated, one at a time, what's happening in this country, how many records did he achieve, how many milestones did he achieve in the selection and were looking at these handful of states for shenanigans going on that are unparallel, they have been coming after donald trump for five years, these polls were very wrong, misleading and done with the purpose but then the president talks about all the games, there's no income net

republican house number that lost a race. and yet the president, the? 's about suddenly the tens of thousands, if not hundreds of thousands of ballots suddenly showing up in maps for democrats, that does not make a lot of sense. there was going to be a big blue wave and they were gonna knock at the senators but that did not materialize either, the two republicans lost senate seats but the democrat lost this in alabama so there is no big blue wave and i think what donald trump in his campaign need to continue to do is document the evidence, present that, it's very nervy for the fbi to suggest that everything that comes in they pursue, that is a bunch of hogwash, impersonal examples about that and they need to talk to ric grenell and people in nevada where they have 3000 examples of people who are dead who cast the ballot, you

want to get some fbi agents, go find those 3000 dead people and how they actually voted, that's where the fbi should be spending their time. lou: this fbi as you well know and everyone watching this broadcast nose does not have a distinguished record when it comes to either fighting crime or investigating evil and evildoers in this country unless they happen to be republican and then they will exert every possible energy to persecute them, a number of people i'm sure come to everyone's mind among paul manafort, roger stone who ran a foul of the deep state and they paid one hell of a price for it. >> i said dead people i erroneously said that i believe these are people that moved out of the state but went ahead and took a valid and voted in that

state, nevertheless the term campaign in nevada has a lot of evidence that's where the fbi should be spending their time. lou: my favorite example is a man who was supposed to be 120 years old had voted but it turns out he had died some years ago, thereby not being able to achieve the record for longest lived american, the president talking about the suppression polls in the left-wing media going into this there is no question that the big corporate media comcast, nbc, at&t, cnn, walt disney, then you realize you're talking about abc news, their polling was outrageous, most of them had joe biden leading this president by ten percentage points.

it turned a fraction of that. and to think that the president, i cannot call precisely how we put it but he understands clearly and made it clear to all of us that there was a purpose, that's the word purpose behind those polls being so erroneous, this is not just an item for tabloid to save the pull is wrong, they were purposely wrong and they were suppression polls in every dm one of them is a result of a corrupt actor at some point in the process about polling operation. do you disagree? >> no the propaganda that they put up or claim to simultaneously being news organization but putting this garbage out there, very few were accurate, i think the des moines register hit it on the money talking about joni ernst and donald trump but you can name a handful of them but these others

were pounded, look at how they pounded on the president for essentially five years because before donald trump was elected they started coming after him, all the garbage and hoax but when it came to joe biden they barely asked him what the flavor of ice cream was and never held a biden and harris to the same accountability. now nonetheless we want to have a fair and open ballot process in the way corey lewandowski and the others are talking about pennsylvania and other places where you could not have pull watchers watch what is going on, what kind of banana republic are they running up there pennsylvania and this is how they're acting in philadelphia. lou: there's a similar banana republic going on in wayne county and detroit, a very similar operation going on down in holton county and atlanta as you know. there are a few of them that

seem to want to drop the standards of this country for free and fair elections because this does not approximate anything remarkably close to that. you touched on this, for the president to have held seats in the house and in fact gain republican seats in the selection to have sustained control of the senate is actually going against the history of such elections and the timing of this one as long as it does his first term in office. he also brought in more minorities in the republican party has ever brought in to serve on capitol hill and the senate and the house, more minorities, more women in 60 years, quite an achievement for the president and will see whether he gets credit in the final vote. jason chaffetz, i thank you very much, we have one of those hard out you know all too well. thank you for being with us.

believe, he believes and we believe that if we count all legally cast ballots, the president will win, we are confident in that fact and confident in our pathway with 270 and were confident in our mass to get us there. lou: so what is the path toward victory to the president, how does the win. at this hour this is the stay to play, fox news showing joe biden with the 264 - 214 electoral college vote lead in addition to alaska where the president leads by 54000 votes, the president must take pennsylvania, north carolina, and georgia, and either north carolina or nevada. he is ahead by 65000 votes in north carolina, he is leading biden by 58000 votes in georgia and joe biden has a very slim

3600 vote in nevada. and in georgia the atlanta journal-constitution is reporting a number significantly smaller than that, they are reporting showing that the president has his lead their dwindled to 3600 votes. the fox news decision desk called arizona for joe biden on election night, some say prematurely. but with around 440,000 votes still to be counted biden's lead is now 61000 in the trump campaign is confident that arizona will turn for the president. joining us now is jenna ellis, the attorney for the president. great to have you back with us. let me ask you, where you believe the trump campaign has the greatest opportunity to prevail amongst all of these battleground states, particular the ones who are having some

difficulty, will put it that way with transparency and dealing with a late vote? >> yes, it's a really important question in the pathway to 270 actually remains almost the same as it was on election night in the sense that we have multiple pathways to get there because people should remember that it does not matter what news outlet or organization actually called the states, what matters is when the state certified the election results and when the electoral college delegates actually count that vote. we have legal challenges to make sure that we preserve the integrity of the elections so those certifications accurately reflect how the voters in every legal vote is counted. so our pathway is for multiple options. lou: let me ask you a question, i think it has to be on the minds of many of our viewers across the country. that is, we understand of course

why you are leading the fight on legal efforts, lawsuits and so forth but it's also a question, why in the world aren't the local republicans, the state republican parties, their apparatus, why haven't they have been more aggressive in asserting prerogatives for transparency whether it's poll watching, why lawyers to make certain everything is working and why haven't they have been more aggressive and diligent in preventing if you will, the foundation for all the troubles that we are witnessing since election night. >> that's also a great question, it's the efforts on the ground have been really great and very significant, the trump victory in partnership with the local rnc chapters have been intending to make sure that they can prevent some of this upfront but

of course even with the trump campaign and rnc international lawyers trying to get involved, and matters what the court actually determines. remember the supreme court with chief justice roberts leading the way declined to hear the case in pennsylvania and north carolina prior to the election day. pennsylvania, we could've prevented -. lou: absolutely. does that suggest that the court may refuse to deal with what are obvious irregularities and corruption of the electoral process? >> i don't think so and here's why, justice alito wrote an excellent dissent that said we are going to have to do with this at some point. now the issue is called outright which means under the law is a legal term meaning there is. lou: we don't care about the legal terms jenna. >> it basically means that now there is a right challenge, case and controversy and when we go

there they wanted them 60 - 70 feet away or 100 feet outside away to observe people inside the building. and we won a case, big case and we have others happening, a lot of litigation even beyond our litigation. a tremendous amount of litigation generally because of how unfair this process was, i am predicted that i've been talking about mail-in voting, it's really destroyed our system, it's a corrupt system and it makes people corrupt even if they aren't. lou: joining us tonight by phone, republican national committee chair ronna mcdaniel, thank you for talking with us, these are tough times and i know you got all sorts of things going on. where are you tonight? >> tonight i'm in michigan, we have been pursuing the irregularities we have seen of the state which are profound, as part of the reason why you've

seen don james announced he will not be conceding the race because of what we have seen on the ground. the president is correct, we need to pursue all of these irregularities and we've been organizing to go to all the battleground states fundraising and getting ready to deploy to make sure we pursue election integrity and we fight for our voters that they do not get disenfranchised. lou: the democrats, nancy pelosi, hillary clinton told joe biden not to concede no matter what. as if they had an understanding what this is going to come down to. are you saying to the president, do not, no matter how these things go, if they were to tip one way or the other, are you telling him not to concede no matter what? >> i think we need to let the process play out. one, every state. lou: as a matter of principle if

you're in a fight for the integrity of the election, you're in a fight for this country and it's free and fair elections, are you telling the president he should not concede until all avenues have been exhausted? >> exactly. arizona is not counted yet and we feel like the calls that were made were incorrect and not balance out with a margin that we feel the president will overtake arizona. georgia were sending staff there to make sure we can count ballots. detroit we filed lawsuits in michigan and wisconsin working hand-in-hand with the trump campaign. but 100% we have to make sure were at every campus in every state for the counties to make sure there's no irregularities and secondly we need to pursue the regularities we are finding. what we are saying as were deploying lawyers we are getting affidavits from people on the

ground who saw the irregularities so we can prove and show the evidence of what we seen across the country in the bottle around states. lou: watching what's happening in philadelphia, i don't think there's anyone in the country, democrat or republican or independent who would argue with the statement that there are a tremendous of irregularities that rise to the level of abject corruption. stealing people from watching the official poll watchers being denied entry let alone access and once in not being permitted to be close enough to the ballot counting to see whether there are problems or nefarious actions taking place. what is it going to take to get the courts to act? >> first of all where are the democrats. they talk about voter suppression and disenfranchisement, we have poll workers who have been kicked out

of polling locations unable to verify and certify the fairness of the selection. this is causing uncertainty and we are going to fight this in detroit last night just doesn't look like john james and president trump are going to win or tuesday night they kicked everyone out i had and attorney say she's lost her faith in the democracy based on what happened on tuesday night in detroit and no transparency. lou: why the hell would they leave? >> why would they leave? >> because they brought police and. lou: did somebody have a gun? >> this is a problem we have, to be fair the fact that we had these people there and have this on video it's going to be part of the evidence that we are submitting as they pursue the irregularities that were seen across the country. lou: were watching irregularities, that's a popular

word for what is corruption. irregularities in georgia, and north carolina, in michigan, wisconsin, nevada, did i mention pennsylvania, this is outrageous and the president reminded us all as he was talking calmly and directly to the country tonight, he reminded everybody he has been talking about the mail andn ballot as the surefire of electoral fraud. why in the world was anybody listening? >> we were we pursued over 40 at the rnc several going to the supreme court, we wanted states like iowa and states like wisconsin and now we have seen they kick our people out of the polling places, were seeing the irregularities, the ballots being found, we will pursue every single avenue, we saw democrats pursue a russian hoax with taxpayer dollars, we

attorney general william barr a criminal referral over 362 ballots that are fraudulent, that is all we know right now, we will bring more as the story develops. joining us now is harmeet dhillon, a member of the 2020 trump advisory council national cochairs of lawyers for trump. great to have you with us. let's start with criminal referrals. it's beginning, the action by the republicans, it's also to mean reassuring that the state republican party is taking action along with the national trump campaign, the republican national committee of which are in a port and part of the leadership. >> yes, this is great news, by the way each of the battleground states the state parties are playing a role. here i've seen the letter that

the state parties lawyers have sent in very good lawyers there and the allegation is this, it's based on documents, they can. the people who voted to the address change list which is on file with the state to cover how many people move out of the state, that is over 3600 people and none of those people are eligible to vote yet they did vote, not that they got a ballot, they actually voted. when you look at the registry of people who moved, that is underinclusive by 50%. the estimate is as many as 7000 or more may have voted illegally, we know over 3000 of them did. so that in such a close race in nevada could change the outcome of those electoral college votes. lou: the last time i looked it was around 10000 votes separating the president and joe biden. i don't know how current that is. but that's very close, a few hundred thousand votes, maybe

200,000 still to be counted. do you have better information than that? >> it is about 10000, slightly more than 10000 separating them right now so fighting over every vote is absolutely critical at this point. lou: let's also turn to, are we talking to ronna mcdaniel about all the parties involved in all the fights that are going on. give us a sense of what period of time do you think it will require to be dealing with the contempt issues as you raise as we talked earlier, the contempt issues in pennsylvania where they were defined a state judge in an appellate court and not permitting a poll watchers. >> earlier today they were not permitting them beyond 30-foot

tom fitton, he is joining us and i want to get your sense of the level of corruption that we are seeing of the irregularities in the absence of the department of justice and any significant or at least obvious role here. >> it is astonishing but nevertheless not surprising it was entirely predictable, we've been talking about on your program for months. i testified to congress about it that the vote by mail scheme was going to lead to chaos, federal law, three usc section one says the states shall select the electorate for president and vice president on tuesday, election day. it has not happened and no one has been in court to enforce that law. instead we have the campaign arguing for better seat to watch the three-car madi game in which there the mark. they're not going to win.

misconduct, something improper is going on. i take the position based on what the law says that you figure out who one on election day, we know the president one michigan on election day, we know he won wisconsin on election day, and pennsylvania and georgia and north carolina. we know, that result should be protected, instead it's been changed as a result of the county that goes on past the statutory deadline and if the courts don't come in and fix it, there is opportunities for congress in the end to decide whether or not they're going to bless this process that were seen in pennsylvania, a slow-motion overturning of the lawful election results. lou: harmeet dhillon was doing a terrific job fighting for this president and fighting for free and fair election, talking earlier about she hopes the supreme court will do its job,

are you hopeful that the supreme court which is already demure when it could have remove some of the ambiguity and vulnerability to corruption in pennsylvania, do you think they will have the guts and the principal to act this time? >> what are they going to be asked to do, are they going to be asked to do something that is going to restore the election results that i think is lawful here that the president actually one on election day at least according to the numbers that were being released by the states. lou: nothing less would be resorted. >> or because it's so out of bounds in terms of the processes that the state has to redo the presidential election, those are the options. anything short of that, they're just arguing over legal, right now the campaign is fighting to watch the fraud take place and
