"the evening edit" starts right now. ♪. elizabeth: okay. joining me now is former u.s. attorney brett tolman. let's go at it. georgia ordering a recount. joe biden's lead is 14,000. ballots counted in arizona and nevada. they're reanalyzing the ballots. we're seeing still there is a lot of talk now, more cases of voter fraud coming in. what do you think is going on? >> well you know, look the leland the legal landscape is incredibly difficult. it's a high standard to get a temporary restraining order but the recounts are as a result how close the races have become and i'm starting to think that may be where a lot of the surprise comes if there is a surprise and

that is in the hand recount, for example in georgia. they may be successful in pennsylvania as well. so liz, i think, you know, you've been on top of this issue and i think, many of us are looking at it saying it seems like an uphill battle but it is gaining some momentum. elizabeth: in arizona i think joe biden's lead is 0.7. if it slips below 0.5, there will be a recount in arizona. so we've seen, we've been doing the math and talking to, and looking at the vote count. the trump team would have to overturn 275,000 votes over spread across pennsylvania and where the counts are going on. that would effectively finding 75,000, each of those votes are individually fraudulent, 57,000 dead people. that is the issue. that is at stake? is that how you see it? >> yeah it is. they have to see something, for

example, you heard the story about individuals filling out ballots and being observed and one person came forward in arizona and saw multiple ballots being filled out. they would have to find a cache of those where it is very apparent that this is one person who is filling out multiple ballots. the dates could be, the location where it is at. there could be many factors, they have to find a cache a significant amount of those in each of those states. unless a recount comes back and they're able to sort through some of these, these issues that seem to be highlights on the individual cases. elizabeth: you know sure ain't over. it is not over. by the way the democrats are quiet now. they're pretty much silent even though they have been complaining about the electoral college and wanting to get rid of since hillary lost. the electoral college is a big factor. they're not complaining about it now as it seems to have gone potentially in their favor. we don't know yet. this is not over.

senator lindsey graham says he will investigate voter fraud allegations at senate judiciary. we want to listen to what laura ingraham played on her show about a poll worker saying yeah, she saw shenanigans going on. sheave said she was scared. she felt threatened. watch this. >> i went out to go for a walk on my break and i probably had a 150, 175-foot stretch where i was walking the biden van was parked along this stretch and i was walking to it, so about 150 feet i was walking i could see these people hand over what appeared to be white envelopes, just hand over on to this table. as i got closer the envelopes were being torn open. there were two men or two people dropping the envelopes and two people ripping them open and turning facing the van and drawing on them, marking them.

elizabeth: this individual released a sworn affidavit to the trump campaign. it has been submitted to the justice department. you know, this as we move forward we could see more store i ares like this. your final word, brett? >> liz, you're right. it hit me close to home. i have two friends who went up. looked up, they found that their names in states that they lived in previously, both instances somebody had voted for them. they hadn't done it. is it widespread? i don't know. very unusual for me to have a couple of people that i know something, you know, like that has happened. so i think democrats are starting to be a little bit worried. >> what state were they voting in? where did that happen? >> florida. elizabeth: both in florida. >> yes. elizabeth: wow, a heck of a story. hit close to home to you, brett. two friends, where two people voted for them instead you know, basically using their ballots. >> they went online.

time when my father and his comrades returned from vietnam. in his case after a second tour where he was grievously wounded. and they were not welcomed. he returned after recovering from his wounds to the 82nd airborne division. the army's most decorated combat unit, and wasn't even allowed to wear his uniform off post. those were dark times. america can never go back to those times. we have to remember that a very small percentage of our population carries our freedom on their shoulders and this day, this veterans day, is about those 41 million who have done that since the first shots were fired at lexington in april of 1775. elizabeth: you know so i had an uncle who served in the vietnam war. members of my family have fought in every practically every war going back to the civil war on my step grandfather's side.

they fought for the union army. my mother never knew his father. he passed away when she was one years old. he was gassed in world war i. he suffered from that. he died afterward. this day hits so many people personally. in such an emotional way because it is really what built our country is the sacrifice of families like yours, the people that you work with and it is, basically it's a reminder to show how much people care, right? how much they care about the country. >> yes. elizabeth: final word, secretary. >> absolutely. to reflect on the sacrifices of others. one thing i will conclude this. this points to something that the president has said. we need to keep americans enthused about their history. because if we don't, if we don't keep them engaged in what made this country great, then we risk losing those sacrifices of those 41 million. this is a day of deep reflection. not on the reflection those who

elizabeth: welcome back to the show congressman greg stuebe of house judiciary. okay, here is the story for you, senate finance chair, senator chuck grassley, he is not giving up on this. he is asking the justice department to assess, whether hunter biden, his brother joe biden, james, biden should have registered with the work for a chinese conglomerate backed by the chinese government, a big part of china's belt and road push for domination around the world in various markets.

do you think the bidens should have done that? >> absolutely they should have done that and i commend the senator questioning it, calling for a special counsel investigation. i agree, there absolutely should be a special counsel investigation. if we have a special counsel investigation for 18 months basingthe document on the trump campaign that was completely false, we have a whole bunch of evidence of a lot of evidence of wrongdoing on behalf of the biden family, hunter, his brother, all the they were doing in these different foreign governments. the american people know deserve to what influence they are getting from the chinese communist party and if the chinese communist party are paying hunter and other biden family members. the special counsel should have the authority to subpoena those documents and get to the bottom of those financial documents to show the american people what was really going on. elizabeth: senator grassley is saying that this chinese

conglomerate was be chinese energy conglomerate was moving to influence u.s. policy and public opinion. this is the same charge against michael flynn, that he didn't register under fara with his work at turkey. that is how his investigation got started at fbi, by peter strzok by the way. cefc, hunter biden to circumvent the fara registration allegedly sets up a shell corporation to get money wired into his accounts. it was five million dollars starting in august of 2017, congressman. you know the issue too is, how close were the bidens to cefc because hunter biden was paid a million bucks to represent an executive at cefc charged with money laundering and bribery. that is the allegation that tony bobulinski text messages. this guy, patrick ho charged

with that. first phone call he makes after being arrested is to james biden. "the new york times" reported that. chuck grassley is holding on to this. he will not let this go. what do you think? >> absolutely he shouldn't let this go. if you look at the text messages and these emails that were recovered from hunter biden's laptop there was communication between him and the chinese communist party actors trying to set up meets with people like kamala harris and people in the government of the united states. so the chinese communist party, they can facilitate those meetings and engage those individuals in our government. absolutely i commend senator grassley and continuing this investigation. the senate needs to investigate this. they're absolutely should be a special counsel appointed to investigate all of these dealings. i can tell you that the american people want to know the truth. they want to know the facts. there is a lot of evidence out there right now that shows there was a lot of, of bad acting going on on behalf of hunter biden and the biden family.

elizabeth: what is the house going to do about it? >> the found northly thing in the house, if we don't have a gavel, there is slim chance we take majority in the house. if democrats and nancy pelosi have the gavel in the house. we can do nothing in the committees of the house. we're only ranking members of the committees. we can't subpoena documents. during the whole impeachment sham were number calling individuals to testify. the democrats wouldn't let the individuals come because they control the chamber. so hopefully at some point we'll have control of the chamber. we can investigate. we will rely on others in the senate like lindsey graham to do the investigations to call upon a.g. barr to appoint a special counsel to do the investigations because we have no power in the house to do it. elizabeth: where does this end up over in the senate? what do you think happens? >> i hope it doesn't end up where we still are today with things like the durham investigation and other things that are going on. the american people, everywhere i go in my district people ask me when is the outcome of these

people that are frikin' voting for you depend on you to take care of us. where are you? show your face to us! do something! don't just sit there to let the city go down to the ruins! elizabeth: well that is what is happening, right? >> it is so sad, liz. the people pushing this defund the police nonsense are so out of touch with the people who are truly vulnerable to crime. not just that. a lot of the people pushing this defund the police notion are just total hypocrites. for example this week an official in portland who is a big advocate of defund the police, says that most 911 calls are unnecessary, she called 911 herself when her lyft driver canceled her ride. this is another example of liberal hypocrisy. these people want open borders, yet they lived in walled in

gated communities. they want no school choice but send their own kids to private schools in limos and they want to defund the police. of course most of the people pushing for this can afford to live in safe neighborhoods. many of them including celebrities have their own armed security. that is so sad. they're not prioritizing underserved families being hurt by the poor policy. elizabeth: minority communities as you pointed out. >> exactly. elizabeth: this is why there is burgeoning growing civil war with the far left versus democrats because the moderates are saying your defund the police push is slamming voters nationwide in districts that we are now losing. but, so, do you, do you agree with that? i mean we keep hearing that but the progressive left is saying no, we are in the right. continue to defund. now joe biden may be calling for a national commission to study what is it going on with the police departments. i think maybe the studies should be look what is happening in the aftermath of these decisions.

elizabeth: okay, with me now is former california republican gubernatorial candidate john cox. john, so this, you and i have been talking about this, and now it is coming to pass, a new report from the pentagon showing drug cartels are a threat not just to mexico's national security but to the u.s. border and u.s. cities and this new report says it is getting worse. what are your thoughts? >> it is and great to be with you again, liz. it has been a wild week. this report is extremely troubling. let's face it, this is not a right or left issue, conservative or liberal issue. this is about public safety which is the first role of government. let's face it. and the idea that these gangs and these cartels are now killing journalists in mexico. mexico is relatively ungoverned at this point in time.

we need to make sure the security is strong. i saw your last guest, the kind of extremism that seems to per say people on the left. the one thing i'm ken couraged about here, liz, is that last week, california voters rejected a lot of that extremism. they denied this move to end cash bail. they killed affirmative action, race baiting that goes on with that. they killed a big tax increase and i think they will rebel against this effort that to lesson border security. liz, i have a 15-year-old daughter, a beautiful young lady. there is a lot of human trafficking as well as drug trafficking that goes on the border here. i'm only 30 miles away from the mexican border. i want to make sure we have a wall. i want to make sure we support the border patrol. i want to make sure the wall has a big door in it so we have people we know can come into the country, can become americans

and contribute but border security is something we can't let fail. we have to do something about that. at the same time, we also do something about this sanctuary city movement which is the next thing to fall in california. elizabeth: you know people are pro-immigration. you know -- >> they are. elizabeth: you can be pro-immigration and pro-border security. being pro-immigration is not the same thing as border security. what we're seeing nearly a dozen journalists in mexico getting shot to death. three in the last few weeks as you mentioned. we see mexico's homicide per capita rate higher than the middle east. pentagon reports that the drug cartels in mexico, behind all the heroin, most of the cocaine, fentanyl coming into the u.s. they're using drones, tunnels, planes and boats. just last month the mexican army tracked a plane caring 57 kilograms of who heroin and going cain trying to break in.

as the border wall want up. as trump did 400 executive orders on border security. they have done all that. they try to bring drugs in via vegetables, medical supplies, home goods and trucks and more. >> right. elizabeth: we see it time and again, so i'm just not, you and i talk about it, john, just not seeing it on the radar screen in other media or washington. your thoughts? >> well it is threatening our young people. let's face it, liz, the war on drugs, putting people in jail for drugs is not the answer. we've got to get treatment. the extremists in sacramento want to give out free needles to people that live on the street. the aidea is to avoid hepatitis. the same time we are sending the wrong message. interduct the border. make sure drugs are not coming across. at the same time we have to attack the demand in this
