elizabeth: we'll go right at it. welcome you to the show. you're watching the fox business network. with me now former house oversight chair, jason chaffetz. ceos at twitter and facebook not conscriptioning in front of understand judiciary. we're digging into with senator cruz. jack dorsey admitting the censoring the hunter biden story from the "new york post" with no evidence. your take own this? >> the heads of the tech companies were inconsistent. the bias is undoubtal. it was in the hearing when they have such huge donors within these companies all going to the democratic side. but look, they were given special access, a special way to communicate by congress. it is being abused. congress needs to do something but as i think mike lee, senator mike lehigh lighted, this may very well end up being a federal trade commission issue because of the deceptive trade practices

that these companies are engaged with. that will ultimately do more to change the trajectory of these companies than just about anything else. elizabeth: will bring lawsuits on that front, the platform issue versus editorial content issue, acting like editors with protection on 230. with the fcc route that could bust them up, right or wrong, is that right? >> not only can bust them up. what they're claiming the consumer gets. you trade your personal information, your access, they monetize that but they don't deliver what they say. they are actually manipulating what you see and how you see it. if you go to follow a particular person, say a mike lee or a ted cruz, you may not actually get to see that content. and so that is deceptive and on its face and i think the ftc will be the clearest, easiest, most difficult route for the tech companies to deal with because they have been deceiving people and they view it all and the guise well it is a

algorithm. elizabeth: yeah. we're just a platform. we're just a town square when they're acting like editors making political choices and decisions on what is seen. you know, we've got senator josh hawley saying they're all talking to each other on facebook's task tool. we'll dig into that later. ostensibly they say we're not in cahoots with each other but you know we keep seeing that facebook and twitter employees talking honestly saying, yeah, we're talking to each other. we don't like what conservatives and the other size says. your final word on this story. we'll move on after this. >> it always seems to go against conservatives. hey, sorry, we improperly censored that hunter biden story. they do that after the election. it never goes the other direction. it always goes against republicans and conservatives. that is infuriating. >> they say it after the fact. now to the vote count.

oral arguments began on the trump campaign pennsylvania lawsuit. we're still not seeing evidence in court to overturn the biden victories and vote counts in pennsylvania, wisconsin, arizona, georgia. biden is leading trump by more than 100,000 votes there. the issue the president is using words like corruption, fraud or rigged, those are really serious charges, if they're true it undermines our democracy. if false they still undermine democracy. people say you can't throw around those words for political gain. so is, that is the issue. so where's put up or shut up stuff? where is the trump team's proof? are we going to see it? when will we see the so-called bombshells the vote was rigged via computer systems and the like? what do you think? >> well if you're going to actually have a court move in a direction or force a state to do one thing or the other you have to have solid evidence. there is a reason why you do the election in the first week of november, it take as good month

to six weeks for states to certify it. i don't blame the trump administration or donald trump personally at all for going and pushing and making sure that every valid, legal vote is counted. i think that is what we need. not just for this election, we need it for the future elections as well. he should exhaust those efforts but they need real evidence. elizabeth: we got breaking news just now in las vegas. the trump campaign lawyer announced his belief that president trump won nevada. the campaign along with state republicans will officially contest the race in a court filing in carson city. since the election, trump campaign, other plaintiffs they lost 20 court actions challenging the vote count. your reaction to the news coming out of nevada right now? >> hey if they have something, they want to announce they're going to challenge it in court, then have at it. i'm sure i would hope that the court would look at it very quickly. that the state of nevada would

be cooperative in their efforts in making sure that we have a good, clean, vote. but i haven't seen what that evidence i was. i heard the allegation but we have to actually see what the evidence is. elizabeth: the second week of december is when states really start to finalize the electoral counts. that deadline is coming up. move on to iran. president trump was reportedly talking to advisors about going after either with cyber strike or a missile strike iran's main nuclear site in natanz. reports he was talked out of that. iran's stockpile is 12 times stronger than it was under the iran deal. report u.s. troops coming out of iraq and afghanistan. senator mitch mcconnell, congressman adam kinzinger, they don't like that. reaction to these stories? >> donald trump has been working on this nearly four years as the president. i'm sure with his cabinet and senior advisors like robert

twitter did censor the "new york post" hunter biden story without substantial justification. welcome back to the show congressman kelly armstrong of house judiciary. you know, when you heard this, what was your first reaction? we hear the kind of wonky speak but them saying yeah, we did it. what were your thoughts when you heard that? >> two things, what i heard was we didn't want to run it so we need an excuse not to run it. when they said yeah, what is a mistake, what is left unsaid, daring congress what are you going to do about it? and we should do something about it. elizabeth: you wonder if you're going to get around to yanking their legal liability shield from third party lawsuits, beg your pardon, lawsuits from third party content. jason chaffetz talked about ftc lawsuits. we don't know where that is headed. it was a striking admission, right? this is a story not going away with the hunter biden story.

senators ron johnson, chuck grassley, plan to investigate business dealings overseas. what do you think will happen next there? >> well they have. i mean that i think the most telling part of the "new york post" story and twitter, you and i talked about this before. nobody actually denied any of it. hey, we made a quick determination it was hacking, hacking is a thing. like there is evidence that it occurs. you don't just pull an article 30 seconds out unless you're trying to do it for -- in this case political reasons. i mean it is obvious that they were trying to keep a story off of their platform that was harmful to candidate biden. i'm glad senator johnson and graham are going to continue the investigation. elizabeth: i hear what you're saying. we have senator ron johnson, homeland security, senator grassley's senate finance, both putting out a report, those committees, saying they found potential criminal activity and it involved business dealings with kazakhstan, russia and china. we have "the new york times"

reporting that the cefc energy conglomerate that hunter biden did work with, there was connections with other family members, that cefc was working as a middleman to basically facilitate oil deals and energy deals with iran. and also was alleged to be dealing arms in conflict zones. that is the chinese conglomerate that hunter biden was connected to. so you see that. now you see "the daily caller" reporting that hunter biden still owns 10% of chinese-based private equity firm, bhr, bhr equity fund. it houses off-balance sheet llc companies. congressman, senator johnson says there will be more coming out, more financial transactions. it probably has to do with the shell companies, right? >> absolutely. i think you know, foreign agent registration act was not used all together that much before the mueller investigation.

but now it is out there. it has been used -- it was obviously used for political reasons against the president during that entire episode and may come to regret that decision because this seems like a much more worthy endeavor for what the foreign agent registration act is. again, this is all worthy of more investigation. there is a paper trail that continues to get bigger. we need to continue to follow it and know what was going on. elizabeth: we got some breaking news. senator chuck grassley has been diagnosed with covid-19. we do wish him well. wanted to give the viewer that information. we also wanted to move on to this, here is the question, should the inspector general of the justice department, michael horowitz, should he investigate the fbi's handling of the hunter biden laptop and whether or not the fbi failed to act in a teamly manner to investigate potentially criminal material on it? we don't know what is going on with the laptop. we heard it is connected to a

money laundering probe. this feels like a repeat of the fbi handling of the anthony weiner laptop in 2016. what do you think, should the i.g. step in here? >> i don't know necessarily it would be the i.g. we dealt with inspector horowitz. i think he does a fair job. i don't think he would connect the last dot as quickly i would like him to connect it but absolutely there is lot of different things that gone on with this thing. they had the laptop in their possession for a tremendous amount of time. obviously the information on there was volatile and doesn't seem they did a whole lot with it. elizabeth: getting back to senator ron johnson telling "the hill" magazine, when they came out with their senate report on biden business dealings overseas, involving a lot of shell companies, millions of dollars coming out of china, russia, kazakhstan, ukraine going towards the bidens, he says that broke the logjam when they came out with that report.

tony bobulinski, hunter biden's business partner step forward. then you have the story about the hunter biden laptop come forward too. there is more shoes to drop. what do you think, congressman? >> prior to that "politico" was writing about in in 2013. the obama administration was concerned. this is dud not just pop up. it has been going on a long time. if they used the vim and vigor the way they investigated trump a lot more would have dropped earlier. they need to investigate it fully. elizabeth: congressman, good to see you come back soon. >> thanks. elizabeth: next up north ted ser cruz is with us. we will give us his view on the hearing today. is anything going to be done about this? he is next. >> your policies are applied in a partisan and selective manner. you claim it was hacked

what was the your take on the performance of jack dorsey and mark zuckerberg? jack dorsey and zuckerberg are denying censorship. senator blumenthal says they're not going far enough to stop conservative misinformation. what is your reaction to all of that? >> liz thank you today was a rough day for big tech and rough day for twitter and facebook and between facebook, twitter, google which is the 800-pound gorilla we have enormous concentration of power. i think they collectively posed the single greatest threat we have to free speech in this country because they have been getting more and more brazen and twitter is the most brazen about them. in censoring speech they disagree with, in silence, viewpoints they disagree with. we saw a few weeks ago, twitter for 12 days banned "the new york post." the newspaper with the fourth

leading circulation in the united states and big tech asserted the power to just silence them because they didn't like what they were reporting. i think it is really dangerous. i'm glad we had this hearing today. i will continue to lead the charge to lead accountability and protect free speech and stop abuse of power from big tech. elizabeth: so they're taking political positions. they're not a platform. they're acting like editors deciding content. "new york post" doesn't have that protection. jason chaffetz says the ftc could move against them because this is unfair trade practices. are they going to lose their legal liability shield from lawsuits over third party content? what is happening. what is the advancement on that front. >> well i hope so. let me step back for a second. what to do to stop big tech censorship is a difficult question. nobody in their right mind wants

to see the federal speech police. how you fix this problem is complicated. i think there are at least three different potential avenues to fix this problem. the first you made reference to is repealing what is called section 230 of the communications decency act. section 230 is a special immunity from liability that congress gave big tech that nobody else has. it is essentially, it is a subsidy to big tech. the reason congress gave it over 20 years ago was because congress believes at the time tech would be neutral, would be a public forum, essentially a fair marketplace of ideas. big tech isn't pretending to do that anymore. now they're openly sense suffering. they shouldn't get -- censoring shouldn't get special. big tech is larger, has more market caps than at&t was when it was broken up under the antitrust laws. it is bigger and more powerful

than standard oil was broken up under the antitrust laws. that includes the ftc using section 5 authority for deceptive conduct. the third avenue is, is focusing directly on consumer deception and breaking the promise to consumers. stated very simply when you sign up for social media the promise they make to you if you follow someone you're going to see what they have to say. if someone follows you they're going to see what you have to say. big tech is breaking that promise every day. they don't like your views, they silence you, they shadow ban you and i think we ought to pursue all three of them. i will say though, today's democrats don't want to pursue any of them. instead they're viewing their roles as protectors of big tech and wanting big tech to censor even more, not less. elizabeth: yeah, that is what "the intercept" cofounder glenn greenwald is warning. that the democrats could apply, give them even more power to

censor. let's show what glenn greenwald tweeted about so i can show the viewer what he is sayings. he is saying democrats could give them more power, more than ever and president obama even talked about you know, how do you regulate these guys. he is saying that you know, they could start censoring their adversaries. people who disagree with them as national security threats, as fascist terrorists. that is a direct quote. basically justify you know, shutting the other side's conversations down. he is saying cnn, nbc, "the atlantic" sold the country on the iraq war, russia collusion, we're getting more twisted diss information out of twitter the more power you give them. your reaction to glenn greenwald there? >> i think greenwald is exactly right. i don't agree with everything greenwald says, we are covering from different political spots on the spectrum.

he is courageous speaking out for free speech and speaking out against efforts of censorship. there used to be in a time in the democratic party where you would have defenders of free speech, you would have defenders of a free media. today's democratic party doesn't do that. one of the most chilling aspect of today's hearing in the judiciary committee was senate democrat after senate democrat, their questions were essentially, and you mentioned senator blumenthal. he was one of the more aggressive on this. their questions were why don't you censor more? why do you allow these views we don't like to be heard or to exist? i think that is really, really dangerous. i do think you're going to see the abuses of power get worse in coming years with aided and abetted by democrats that want to silence someone who disagrees. elizabeth: yeah. you know what is also interesting, the other thing happening twitter allowed a tweet, for example. twitter allowing tweets from

antifa connected groups in which one tweet, from the pacific northwest, liberation front, they were praising and applauding a alleged firebombing attempt on a cop's car outside of his home. this cop lived outside portland, oregon, they were tweeting, this is so school. social media is publishing, allowing, not doing enough to stop the personal home addresses and personal information of police officers in you know, cities like seattle and portland. these guys are getting doxxed. they're getting vandalized. harassed at their own homes. that is going on too, senator. your final worried? >> well i think twitter is very biased it allows and what it doesn't. twitter allows the ayatollah khamenei, the so-called leader of iran to tweet antisemitic attacks on israel but at the same time twitter censors the president of the united states. they are operating like a

♪. elizabeth: okay. let's welcome to the show oklahoma senator james langford. senator, it is so good to see you. thank you so much for joining us. let's deal with this first. the media is saying you did a 180. that last friday you said this needs to occur, that biden should be getting intelligence briefings but now you're saying not in a hurry to facilitate that. can you break that down for us, to explain what is going on? >> that is classic media twisting. i came out said joe biden should receive the same briefings during the time he was a candidate. that those should continue because we don't know who won the election yet. the media is running out declaring him as president-elect. we don't know that yet. meantime both should receive the same briefings they were

jerry bustos to possible biden administration. in the house there is a divided democrat party. republicans will have more, keep control of the senate. what do you want to get done? >> well we definitely need to win georgia first that makes it absolutely deadlock certain we're holding the senate. if joe biden wins the election, then and they win georgia, then kamala harris becomes a tie breaker vote. if there is chance we end up 50-50, chuck schumer starts to lead. we have to win georgia to make sure it is 52-48. we have a lot of things to work on. we still have to deal with small businesses non-profits on covid-19. more work on vaccines, testing, on education with covid-19. we tried to work on that for months. pelosi blocked every phase. there is infrastructure needs to be done. we need to finish out additional tax policy. there is unfished business on that for economic growth. quite a few issues are sitting

the way they would open up their economies is by going back to the state capitols doing work that is needed because gavin newsom just shut down california or over 90% of california, for the foreseeable future. he said to slow the curve. we've seen that before. in addition to that newsom as well as telling people they can't gather together for thanksgiving he decided to attend a fancy dinner at french laundry, one of the top restaurants in the country. democrats in washington said you're not allow to join together for thanksgiving, even christmas may not be on the table were planning to have dinners for the new lawmakers in the capitol gathered together like families are not allowed to do or supposed to do until they got shamed out of it. governor pritzker said there is a lockdown. don't do what you have to do. shutting down business at a level that is going to end up destroying a lot of them. his family apparently plans to spend thanksgiving in florida, a republican state with none of

numerous injuries. four cops were injured including one almost blinded by a chemical spray. instead of condemning the violence, stelter is accused of painting a picture, conservatives are taking assaults out of context. looks like he was suggesting they were asking for it or you know, somehow justified. when you see tweets like that, what is the first reaction? >> those tweets are inflammatory, designed to prey on and play on our emotions. the more frightened we are, the more emotional we've become, we're not able to think. and we're not able to deal with these problems. and so i mean i heard your segment right before mine. you can't have the six people at your house for thanksgiving. they won't die. they want law enforcement to go in to lock up if they have more than six people. you can't go to pray, you can't go to worship. no. we have to say enough is enough. i believe the media is not, i'm
