is keeping everyone awake. what do neighbors do? they call law enforcement because it's too noisy. >> is just like a noise ordinance. any more than six people over for turkey could be big fines or jail time. yes or going to rot in prison, catch culvert and die. good stuff cates. some officers that they will refuse to knock on any doors. same goes here in new york where a handful of sheriffs have publicly said they will not a big governor andrew cuomo's lockdown orders. and boy is andy furious. in california people are protesting all over the golden state. and in the streets over gavin newsom's strict new curfew. he got to stay home from 10:00 p.m. until 5:00 a.m. or it is lights out sally pay less or walking your dog or grabbing a frozen dinner from the grocery store. in a few minutes i'll talk to a los angeles restaurant owner who is getting killed by all the rules there. it is awful. but at the end of the day it's about freedom and individuals.

to ground zero on this in terms of the lockdown. we have taken on some more information, that is how we have 25% capacity for dining indoors. we have outdoor dining while i don't los angeles has shut that down. what really concerns me that was the highest category that getting sick right now is 2229 years old. gas is going home for thanks giving her 20 to 29 -year-olds. i just met six hours in line with my mom to get covid test strata by kids were going home to visit their parents and grandparents for the holidays. that i do see is a serious risk. no one should turn into a narc and i doubt anyone turns into a cop. i remain concerned young people are going to be going back and forth. they are and those orgies in force or maybe fortunately. i don't want to judge again libertarian. so let's talk a little bit about the difference between suggestions. and good ideas. and things we should be doing things we are forced to do.

what is the line? >> of course politicians can make all the suggestions they want. but the american people don't need politicians or these unelected bureaucrats to tell them how to keep their own family safe. and frankly, candy, a lot of these rules make no sense. like the rule in oregon about not having more than six people over for thanksgiving. having people have different sized houses. a person with a small house would still be in close contact with their guests if they have six people over. whereas a person with a large house could have far more than six people over and still socially distance. but typical government bureaucrats they come up with these irrelevant numbers they can apply to every single household. it makes no sense. stop based on data or science. but i think the real purpose to a lot of these lockdowns is to grow the size and scope of government and state power in our lives. that should terrify all americans just as much is the virus. absolutely right. we are seeing states he spent

l.a. county to do? again it's home to 10 million people. join me now the lux group partner and los angeles-based restaurant tour, caroline styne. welcome to the show. >> hi thank you for having me. kennedy: i really feel for you. i spent the better part of 25 years in los angeles. i have a home there. one of the best things to do is to go eat out, try different neighborhoods, try different foods. but you can't do that now. a lot of restaurants, this is one of the few places you can stay open to the fall and winter. they have invested in these outdoor covered patios with elaborate heating systems. and what does it do to these businesses to be shut down this particular three weeks of the year? >> it is incredibly devastating. we have already suffered such huge losses this year. you know, our sales are down i would say at least 50 -- 60% from last year. we were able to make it up a little bit during this period

in which we could have outdoor dining. and yes, we invested determined this amount of money into building out a patio in our parking lot. and bringing in heating, fencing, plans to make it beautiful. and now, all of that money is now down the drain. we are in a worse position than we were back in march to be truthful. kennedy: and march was devastating. did you have any idea how intense the impact would be? and how long this would go? was there any way for the typical independently owned restaurant in los angeles to brace for something like that? >> absolutely not. either member back in march when all of this first started and we were getting into stay-at-home order. we kept saying wellin a few weeks, we reopen we can do this, this, and this. to the few weeks turned to a few months. here we are eight months later. and the restaurant industry

throughout the country has suffered more greatly than any other industry. we suffered the most job loss. and 20% of the unemployed are from the restaurant industry. and we all have gotten through this point and we are not any moneymaking situation. in doing outdoor dining that we have been able to have in l.a. it has been treading water to get through to the other side kind of situation. >> that is a really good points. that is a really good analogy to show people. but now, this is the time of year where restaurants are typically catering to people who are out shopping. who have relatives who are coming into town. and this is when restaurants can make a little bit more money because people are tipping more. i have to say, a new york and los angeles restaurants have been the most flexible and creative in terms of reopening. whether it's menus that you

scan, or hand sanitizer at the table. the weight restaurants are able to shield patrons from wind. it is little things that have shown that this is really an industry who knows how to take care of itself. but there's only only so much you guys can take. what would help you, from governor gavin newsom or mayor garcetti right now? what would ease the burden a little bit? >> obviously being able to cater to our clientele in our restaurant. even outdoors would be huge. i would not have to lay off the few employees that i still have left working for me. and i would not have to think about the idea of having to close my business. i think even on a greater scale, what we need is a full on restaurant bailout. not a bailout a restaurant stimulus fund. and there is one called the restaurant act that is already been introduced to the heroes

those tough questions. and when he is challenged he just weaseled his way out of it by trying to play tough guy. the trouble i had with this and i spent some time with janet deem this week impaired her husband lost both of his parents within days because of covid. they not only could not say goodbye to each other, they could not say goodbye to anyone else in their family. and they could not have proper funerals for them. i mean this is a disgrace. and you know what happens to all these families, the thousands and thousands of families that here andrew cuomo say things you've got to take responsibility. getting an emmy traumatizes them. and that is awful. >> will i am troubled is in trouble obviously by the tragic death in new york nursing home spread although the governor disputes the criticism it's hard to deny the policy he adopted did lead to many unnecessary deaths. at the same time it's a time when new york city as an

you closer to asking the president to concede? and if so why? >> the examiner, we wrote after the election president ron trump you have every right to fight. to make sure no state certified too early or anything like that. but her editorial at the end of last week said it's time to concede. lost the race. the reason they did a hand recount in georgia, they looked into the problem in pennsylvania. in pennsylvania the creepy thing where the judges rewrote election law to a lead late absentee ballots are mailed and balanced account. it turns out the number of late absentee ballots with a tiny fraction of biden's large margin of victory in pennsylvania. any irregularities there are, we don't know what they meant, they will not make a difference in any of these close states, georgia, nevada, arizona, wisconsin, pennsylvania or michigan was only barely considered right the irregularities will not add up to the difference there.

it's time to move on. trump lost the election. kennedy: and also some of the appeals that trumps the legal teed has had two lawyers in terms of affidavits. for example the judges have said that there is not enough evidence within the affidavits. particularly one of the applicants who claimed there were biden votes are brought into the back of the hall in detroit's. and they judge basically said most of this is hearsay. so what would it take for one of these judges to act, stop counting and potentially discount some of these biden votes? >> you would need actual evidence. in an affidavit a witness can be evident you need actual evidence that was not sort of immediately demolished by one thing or another. hearsay is not actual

evidence. so much of this was i talked to somebody who said these votes were counted differently. or something like i saw vote counters and from my distance it looks like they were rooting for biden and that kind of thing. those things do not count as evidence of fraud, evidence of any violation of the law. that is the thing. what we are getting in the press conferences from team trump are these bold accusations. but what they say in court when they say in their filing there sort of under oath these lawyers are really dialing back there claim to either the hearsay reports or were made to stand too far away from the table. for these handful of ballots, we don't think should have been counted. what they're actually saying in court, even if they are right, does not add up to anything close to overturn the vote count. >> there are two things here that i've been looking at all along.

as many of you have as well. and that is, the stories of weirdness. that should be disturbing for people. how are these elections being run? is or something we can do between now and the midterms are now in 2024 to shore up some of these disparaging's? as you pointed out there is a great deal of weirdness. with the mail in voting, how do we fix that? >> the mail in voting is a much bigger problem than anyone is willing to talk about. some people to simplify their falsified ballots are forged ballots for that might be a issue. much bigger issue has to do with coercion and the loss of secret ballot. we know people showed up and show up in assisted living facility or something like that. hey can i collect your ballot? i know you received it. oh did you not finish filling it out? we know there were its opportunity for coercion and

over 2016. and yet the rejection rates drop to nearly a tenth of what they were in 2016 for their some real serious questions about the pre-canvassing taking place in states like pennsylvania, michigan and wisconsin. where it is illegal to do that and cure ballots before election day for they only have two weeks but if they can't figure it out you're probably going to see something around december 7 or 8 right when the electors start voting or trump might actually say we fought the good fight, it's time to move on. >> we need to come up with some objectives standards. i'm not time but a national program. but i do that their people, republicans, democrats the multitude of parties underneath who are more than willing to work together to come up with a system that means you don't have even questions of fraud. i did enjoy, jessica, some of the claims sidney powell was making. not because i thought they might be true because it took
