seat can change history and this may be one of the most proficiently titled books to hit theit book stands in a long tim. senator it's great to have you with us and also we recommend the senator's book to you highly. i want to begin with the fraud that we see now and many people do not realize you are a part of the republican legal team back and gore v. bush. it gives you a sense of where we are right now in terms of electoral fraud. >> look we have litigation all over the country. the results of election aren't final and they aren't final until the matters are litigated and the results have been finally tabulated and the recount is ongoing. you mentioned my book one vote away and there's an entire chapter in the book on bush

versus gore in 2000 was part of w. bush's legal team did if you think about it the news media called al gore the winner and then they switched it and call george g w. bush the winner but then what happened is al gore sent in an army of lawyers into florida and they brought multiple lawsuits in for 36 days nobody knew what the result was that they had to litigate those matters. they had to complete the recount and then at the end of the day we learned who the winner was. during that timee and in the local one vote away i take people behind the scenes and in the war room where we had a white ward on the volvo seven different -- anyone which it could have cost the president of the united states. or that time we conducted a full trial. we c went to the florida supreme court twice in the u.s. supreme court twice briefed and argued and got opinions and that took 36 days. the court system can move and can move quickly and ultimately georgees w. bush prevailed becae

when the votes were counted he have the most votes in florida and he won. the same thing needs to happen here but the litigation needs to get resolved in each of the differentt states where their pending cases and then we will know who has prevailed but that's going to take several weeks. lou: would you not agreeke that this is further evidence of just how unconstitutional the idea of early voting, mail-in voting is to realize we are coming up against two important deadlines here as a result of the disputes over these votes. one is december 8 than the other the w 14th and we have had some instances i going up to the 20th of this month, votes being tabulated. this is outrageous and how in the world did the idea of early balloting and early voting mail-in balloting to ever pass muster and get by the supreme court?

>> mail-in voting historically has been significantly more subject to fraud. it's more susceptible to unscrupulous operatives stealing people's votes, engaging in vote harvesting which we have seen it unfortunately in the arab covid a lot of democratic states in democratic jurisdictions use it as an excuse to expand mail-in voting. there's a silver lining to that which is as wech have recounts d contest litigation pending in this state on election day donald trump won a a significant majority of the people who cast in person ballots on election day.y. if the early vote, the mail-in vote biden won a significant majority. the silveror lining is that historically mail-in votes get excluded in a recount and get rejected and litigation much more frequently than in person votes because they are more often subject to fraud and more often hold illegal standards and what that means is the

litigation moveson forward there is i'm real possibility will see the voteot totals for joe bideno down as illegal votes are excluded and that's what the judicial process is meant to determine in what i expect it will be determining in the coming weeks. lou: is in their collision here between a requirement for uniform among the states a uniform federal election day and early voting, mail-in balloting or however you want to style it or term it. that seems to fly in the face of giving the power of that electoral process over in each state to the state government. >> but the constitution does ise it gives the power of setting the time, place and manner of the presidential electiond to te state legislature and its unusual. normally when they constitution speaks to the stated addresses the entire state in this instance that specifies the legislature in particular.

that is highly relevant especially in pennsylvania because what happened is the legislature set a rule and pass a law that early ballots -- lou: and republican had control was to point out. samantha democratic governor and a democraticem supreme court jut a creed that they were changing that attempting to change that is contrary to the constitution and i think of the supreme court considers that case on its merits they are likely to conclude that with the pencils up rania -- with the pennsylvania supreme court did was unconstitutional. lou: with evidence going into theid decision to pass on a rulg beforehand, before the supreme court john roberts, did he make a mistake? >> you know i think the court did make a mistake or they should have taken the t case. john roberts joined the liberals and didn't take the case before

the election. been easier to resolve it then. subsequently just as sam alito wrote an opinion which he said the plaintiffs were quite likely to prevail on the merits of the constitutional question was clear and he ordered the state of pennsylvania to segregate those late received close to keep them separate so that accorded to concluded they were illegal could exclude them. i think that really foreshadowed that if the court takes us on the merits it will likely strike it down. it's not certain the court would agree to take the case on the merits but if they do i think the president is likely to prevail on that legal question. lou: on that question and will the court take into account that the complaintst and charges of voter fraud and electoral fraud all fall upon the democrats and not republicans? that looks very bad i would think for anyone using common sense.

is it relevant in the high court? >> well in terms of laying out the evidence of voter fraud that really is a step that has to play out in the trial butbo this state trial court in the federal courts. it's hard a for any of us as informed citizens to really know except we would have been see something on twitter and you see a story here or there but he donned about the facts are and that's why we have a judicial system where in a court the trump campaign in the biden campaign will send in their lawyers and put on expert witnesses and hear testimony and the judicial system will make the determination of the facts. that's how we find out what occurred as we have a system to test the facts. so i'm hopeful and what i expect to happen in the coming days and weeks as the trump campaign put on their evidence and hopefully to convince the factfinder that their allegations of fraud are accuratete and supported by the evidence. lou: there are two elements.

with one of course is the appearance that least of fraud across a broad number of states and in each instance the charges are against democrats and not republicans. the other part is we have a president who the court will also be able to judge very clearly. the democrats have been trying to both lock his presidency, to overthrow his presidency through impeachment as well as absolute in my judgment treason on the part of a number of government officials in the deep state if you will. those things should be taken into account don't you think as well by the court to see this as a continuation of what has been the resistance? they did not call it the healing. isn't that interesting in 2016? now they are calling it the healing period then it was the resistance until this very moment. as we wrap up here.

>> i don't know that the supreme court necessarily will give that great way but i do think the american people see that for four years the democrats attacked president trump and denied the legitimacy of this election and fought it at every stage produce target with andrew mccabe before the judiciary at gary committee. the behavior of the doj and the fbi under barack obama politicized it and used it to attack their enemy and it was disgraceful. i think the american people see that and the impeachment saga a was abuse of power as well but that's one of the reasons why over 70 million americans came out to support president trump. we need every vote to be counted in every legal vote to be counted and i'm hopeful at the end of this process we will determine the winner and i very much hope president trump's reelected. you mentioned a minute ago the georgia senate race. two senate seats on o the raise january 5. control of the senate hinges on the state of georgia and if you

one of twoer republican membersf the wayne board of canvassers, with an monica has since rescinded her vote to certify those results. monica i can only imagine what you, have gone through here in the last few days but i applaud and appreciate you being with us tonight to tell your story and what has transpired and wayne county one of the most controversial locations in the state and county where priests also much happening just before our cameras working out of cardboard windows to prevent the public from seeing what's going on. tell us why first of all you did not want to certify the results and wayne county you and one other republican member of the board of canvassers. >> when we were given a verbal

summary of the precincts to find out the reports whether the precincts were balanced or unbalanced there were an excessive number of precincts that were unbalanced without explanation and it is the job of the canvas to find the explanation and the difference in the balance. therefore in my opinion we did not have complete and accurate documentation for the total number of votes on d the precins that didn't have explanations and that is why he voted no. lou: it is one of the cane requirements of the canvassers to find that balance and to have an explanation for the in balance, correct? >> that is correct. lou: so that board meeting in wayne county was underway.

there was videostreaming of it. there was some contention in the room and it was going out to everyone. suddenly the video stream, of the public meeting, was interrupted. itit was stopped. what happened when the cameras went off? >> i'm not sure how the camera stopped. i wasn't operating a laptop but airing it the vice chair pulled me aside and offered a suggestion on a win-win solution that would get wayne county election results certified and would provide a route to get explanation to the precincts that were out of balance at that point and offered me a personal guarantee that he had higher authority promising him that we

could get an audit done a comprehensive independent audit in that comprehensive independent audit should able to provide the explanations that are currently missing. fit's for that reason the only that i voted for the certification knowing that we would have an audit that would provide the explanation for the differences. lou: of course that has not occurred and you have been threatened. you have been harassed. what are the most serious threats against you and your family? >> i have received text messages with awful, awful photos of naked women and a photo of my daughter that was taken off-line in a note letting me know that is what was going to happen to

my daughter and i was viewed as a terrorist and my husband and my daughter and i should all give up our lives. my employer has been harassed. a wedding bridal shop that i shared a post from i don't know how long ago, they have been harassed because i shared a post on my page on twitter. where does it stop? lou: it doesn't stop monica. we watch the country be harassed and intimidated from may through august with street violence across the largest democrat run cities. we have seen a supreme court justice intimidated, some say broke in referring to justice kavanagh. we have seen the ugly side of

about people treat people in this country right now are hurting in so many ways but economically certainly among them as the result of the china virus. what did you learn? >> i learned that right now 50 million americans are going through crisis were all of the institutions that once held them together the family, the faith community and another element of social capital had collapsed. we spent so much time talking about partisan politics that meanwhile there are millions and millions of families that have seen the social fabric shredded beneath them. lou: the social fabric and there's also the social contrach we have in this country, medicaid and we have medicare and all sorts of programs, food stamps and s.n.a.p.. you y name it we have an extraordinary safety net for people who are in pain. why isn't that working in these communities that have lost so

much? >> the united states currently spends more than $1.1 trillion a year on poverty programs and yet the official poverty rate hasn't changed a since 1968. it's because the policies that have failed and failed year after year they keep getting renewed. policymakers keep doubling down. we need real systemic changes in how we think about poverty in order for that number to change. lou: of this president applying economic enterprise zones, creating all sorts of programs that are outside the mainstream of thinking, social justice programs for example, prison reform trying to do what could be done in these first years of his presidency. what doou we need to do? the know you believe in conservative solutions and not programmatic solutions. what are the two or three top

lou: raking in is the country's largest votingng machine groups have close ties to a government agency. it disputes any irregularities in this years election. on november 12, the cybersecurity and infrastructure security agency, part of the department of homeland security and cyberintelligence unit issued this statement. said in part quote the november 3 election was the most secure in american history and quote. among the many things the agency failed to disclose is that dominion voting systems and another several voting companies

are members of their election infrastructure. it's a mouthful. supervisory council counsel to the dhs. one of two entities that authored, that wrote the november 12 statement. also sitting on that counsel in addition to dominionists mart maddock another company we have reported on and detailed on this broadcast with documented issues with their voting machine software. election systems and software, ess and hard to enter civic also on the council. those companies take up 90% of the voting companies working on american elections, extraordinary. but very helpful apparently to dhs. they didn't see a conflict of interest and that for some reason but then again why would

>> well i think i'd been listening to god's word rather than w.h.o. when it comes to worship. one of the things going on since we last talked lou cho governor cuomo doubled down in his appeal to the supreme court on why he had to be allowed to place restrictions on liquor storest and big box stores but put oppressive frustrations on churches. the answer is simple. the fact is what cuomo is doing is not only equitable but it's unconstitutional. there is no first amendment right for a liquor store to be open. thee constitution gives an absolute right for churches to be open. our forefathers thought worship was so essential that they carved out a special perception fort in the first amendment and my real concern is once thison pandemic is over, and it is going to be over sooner rather than later because of the great leadership of president trump

reminder to republicans that elections have consequences. you would not see a governor like cuomo in the state of texas for example. first of all you beat run out of the state. what do you think? >> well that's absolutely right and the democrats are a party of frustration, party of a a government and we have seen a lot of democratic states that want to regulate how you celebrate thanksgiving. i have a pastor in another state who says more people are allowed to attend the funeral than a thanksgiving gathering next week so he's telling his members to ccall their thanksgiving gatherings a funeral for a turkey and they will be okay. that is just absurd what's going on under these democrat leaders. lou: it's absurd but it's also telling. they start with telling us what we can do or cannot do to celebrate thanksgiving.

they then will tell us what we can or cannot do to celebrate christmas and the level of passive at the end apathy on the part of americans putting up with all of this nonsense, it's truly disturbing. what are you advising pastor -- pastors around the country ass they confront these orders to lock down and shut downn their churches and congregations and also refused to celebrate thanksgiving, christmas? >> lou we could b. socially distance and practice good safety measures but we can't shut down and as the bible says we need to obey god rather than man. a pastor has a responsibility to keep his church safe but to keep it open. lou: pastor robert jeffress at size good to have you here. good to see you pastor.
