off. thank you for joining us. congratulations on the election. thank you for your service. thank you for joining us. >> thank you. gerry: i'm gerry baker in for elizabeth macdonald. you're watching "the evening edit" on fox business. have a really good in new york, see you back here same time tomorrow. ♪ ♪ lou: good evening, everybody. the battle for the white house is now a full-fledged struggle for the survival of this constitutional republic. there are less than two weeks to go before the electoral college is set to cast their votes for either president trump or joe biden. president trump's legal team have made significant advances in six battleground states, and american patriots this those states are coming -- in those states are coming forward with allegation after allegation of election abuse, irregularities, anomalies, outright fraud and raw intimidation. earlier today president trump posted a message on social media

stating that the heart of this democracy, our constitutional guarantee of secret ballots, is under a coordinated assault and siege. >> within days after the election are, we witnessed an orchestrated effort to anoint the winner even while many key states were still being counted. the constitutional process must be allowed to continue. we are going to defend the honesty of the vote by insuring that every legal ballot is counted and that no illegal ballot is counted. this is not just with about honoring the votes of 74 million americans who voted for me, it's about insuring that americans can have faith in this election and in all future elections. lou: we're joined this evening by some of this country's great americans who are fighting for president trump, fighting for a

free and fair election. one of them is dr. linda lee tarver. she's seen how the radical dems have worked to steal this election in the state the of michigan, how they've worked to steal elections over the past 25 years in her home state. also with us, jesse morgan. he's the truck driver who's come forward, a whistleblower, who's made alarming accusations about hundreds of thousands of ballots being transported from new york to pennsylvania. he'll join us with his eyewitness account. and an attorney who represents congressman mike kelly is also with us, his fight for election integrity in pennsylvania charging that mail-in balloting, mail-in voting is simply unconstitutional. also with us this evening, investigative journalist sara carter. breaking developments in the challenge to pennsylvania's

election results. senator ted cruz has now thrown husband support behind the -- his support behind the effort to get the supreme court to hear, urgently, an appeal in the dismissal of a republican-led challenge against pennsylvania's mail-in system. and joining us tonight, the attorney who is representing the congressman and, in fact, the republic. that lawsuit was brought forward by congressman kelly and congressional candidate sean parnell, and our first guest is the attorney representing those two men leading the charge to throw out pennsylvania's mail-in ballots. joining us is greg tufel. good to have you with us on the broadcast. i i know you've got to be gratified that senator cruz is supporting you as are millions and millions of americans in this. give us your reading, your judgment about whether the supreme court will hear your

suit and whether or not it will come, well, expeditiously. >> so we do feel like we have a better than average shot at getting the supreme court's attention. there's a lot of competition for their attention, of course, and it's always a difficult process to get the supreme court to take up your case. so we don't want to get too cocky, but we do think we have a much stronger case for getting their attention than the typical one, and we're very appreciate ty of the -- appreciative of the support of senator cruz and really all the folks around the country that have expressed their support. lou: the straight forward drive of your lawsuit is that mail-in balloting is, period, unconstitutional. and as the president said in his message, election day has become election days, weeks and months. on its faces face it is, it mako

sense whatsoever. but then again, now there's the law and the constitution. >> yeah. in some states mail-in balloting is legal, but in pennsylvania the constitution requires it either in person or meeting the very particular criteria for absentee balloting. to open it up to mail-in balloting with no excuse for any reason at all, any reason or no reason, requires a constitutional amendment. they didn't bother with a constitutional amendment, and when they passed what's called act 77, the law that instituted no-excuse mail-in balloting in pennsylvania, they immediately disenfranchised every voter in pennsylvania by refusing to let them vote on whether we were going to switch to no-excuse mail-in balloting. lou: greg teufel will be with us later in this broadcast. we'll be taking up the issue in some detail. greg, thank you very much. well, two other attorneys supporting president trump's fight for a free and fair election holding a rally today in georgia, a raucous rally are.

attorney sidney powell and lynn wood telling president trump not to ever, ever concede, never give up the fight. lynn wood also demanding to know why republican leaders have been absent in the president's efforts for election integrity. well, the justice is -- justice department is cleaning up after attorney general william barr just a day after he said the department had yet to see any fraud on a scale that would affect the outcome of the election. now a doj spokesperson is saying there is no conclusion of their investigation into election fraud and that it is continuing its investigation into what it calls all specific and credible allegations. i would only say to the attorney general, watch this broadcast, review what we've reported here over the last four weeks, take a look at what is said on this broadcast tonight, and you will

change your statement if there is any honesty the remaining whatsoever in the department of justice. meanwhile, i wayward fbi director christopher wrong wray is expected to keep husband job is if joe biden is installed as president. that must bring warmth to the hearts of millions who voted for joe biden. it shouldn't but it probably does. wray is the same man who insured that this country would have secure elections before the election, of course, occurred. president trump also fighting the tech titans of silicon valley today. the president said it straightforwardly, that he will veto a new defense authorization act unless section 230 is terminated. in a tweet the president said this, quote: for purposes of national security, section 230 must immediately be terminated. section 230 is the liability shield that exists for no one

other than technology and social media companies like facebook and twitter and amazon and google. in order to have those protections, social media sites must act as a neutral platform. that is twitter, facebook, google, others doing no such thing. in fact, doing the opposite, blacklisting and censoring conservative voices. censoring even the president of the united states with impunity, also hiding disparaging news about democrats blocking users from seeing information about voter fraud all across the country. president trump's call for immediate termination of 230 is, in my opinion, the only way this country can be saved from the technology and social media oligarchs and the left that they control. but weak-kneed rinos in congress have already begun to pitch moderation and compromise.

listen. >> what we're trying to do is look at section 230 and to see if it needs to be modified or changed. >> i'm more skeptical than a lot of my colleagues i think on both sides of the aisle about whether or not there's a regulatory fix that will make it better instead of worse. >> section 230, in my view, has to be to be rewritten. so that's the purpose of this hearing. >> mr. zuckerberg and mr. dorsey, thank you both for being here with us virtually and for your commitment to constantly improving the way your platforms are serving people across the country. lou: that is simply pathetic. and senator mike lee talking about moderation. these are rinos, they are absolutely irresponsible mouthpieces for those tech titans who are censoring the president of the united states, killing the voices of conservatives across the

attended by radical dems as well as corporate america, of course, and its pro-ams inty, open borders lobby. the event will be held tomorrow by the american immigrant business coalition. by the way, there is no coalition that exists outside business. business is driving all of this. also participating, of course, the evil u.s. chamber of commerce which works against american workers and its national interest every day of its existence, the united farm workers of america and the united we dream federation. those congressional rinos i mentioned will be working alongside the chamber of commerce which has no interest in fighting for american workers ever. in fact, they fight against american workers. the chamber's attorney successfully lobbied bush-appointed judge jeffrey white to strike down president trump's restrictions against h-1b visa workers. this at a time when millions of americans are still out of work

lou: break break news now -- breakins now, president trump telling americans that he will be fighting for the presidential election in key battleground statements. here he is. >> our country cannot live with this kind of an election. we could say let's go on to the next one. but with, no, we have to look also at our past. we can't let this happen. maybe you'll have a revote, but i don't think that's appropriate when those votes are corrupt, when they're irregular, when they get caught, they're terminated and i very oozily win in all states -- easily win in all states, i very easily win these swing states. lou: nothing easy about this election so far. president trump's attorney, rudy giuliani, will testify about electoral fraud tonight before state lawmakers in michigan.

giuliani's testimony before the michigan house oversight committee follows the dozens of firsthand witnesses who appeared yesterday before michigan's senate oversight committee. one of those witnesses is with us this evening. we're joined by dr. linda lee tarver, former director of community affairs and election integrity liaison at the michigan secretary of state's office. dr. tarver is also an advisory board member on the black voices for trump coalition. doctor, i want to first say thank you for being here and say to you straightforwardly you were a brilliant, compelling witness yesterday, and i just salute you as do millions of americans who have both read and seen your testimony. it is, it was absolutely amazing, stunning. i want to -- >> thank you. lou: -- start with, if i may --

thank you. i want to start with your statement about the fraud, election fraud in michigan, that this is not the first year that you witnessed it, but this is the first year that it's affected 74 million americans, certainly. your thoughts about whether it's reparable in the astronaut of michigan -- state of michigan, first of all. >> absolutely, especially in our urban areas. it has been rampant for years, decades, and it has only empowered those who have not seen any reper or cushions or consequences -- repercussions or consequences as a result. we have seen it. there is touchpoints in our system that if the law is followed would unsure some fort -- insure some form of integrity. but in cities like detroit, flint and pontiac, which i referenced, it is almost tossed out the door. it is a free-for-all, if you

would, on how you can manufacture ballots, how you can assert 400,000 ballots. i made a misstatement yesterday with about 71% of detroit could not be recounted. it is actually 71% of the absentee voter precincts cannot be recounted. those are the ones that are in question. is so so it was difficult to insert 400,000 into a precinct, walking into one precinct. but you certainly can find the fraud in absentee balloting, and that is where 71% cannot be recounted. and we want to open the ballot boxes. lou: why can't 71% of the ballots that are in question be recounted, are e examined? re-examined? >> well, they said it's because of clerical errors, that if the precinct does not balance, if you have, if you're off a couple hundred or 24 or 4 as the

secretary of state of michigan has indicated, it is not -- they should be able to balance their precinct. if you don't is have voters before you in the absentee voting, you should be able to balance that precinct but for the fact that you may have ballot stuffing going on, you may have overvotes going on, you may have manufactured people. they've changed some of the birth dates to the 1900s, and that is testified yesterday. that was going on. and because they did not respect the law with respect to poll challengers, the republican poll challengers, we don't have eyes on what was going on, and we need to be able to then go in and find out what's in those ballots. some of those ballot boxes could contain 900 -- the vote tally was 900, but in reality it was

300 ballots in the box. we need to see the box. open the boxes. lou: open the boxes. and as anyone listening to your -- is anyone listening to your cry on this? because the attorney general of the united states isn't, the department of justice isn't, the fbi isn't. this is fraud, this is a politically corrupt justice department in washington, d.c., a politically corrupt fbi, and i don't know whether he's a dullard, a fool or a liar, but the attorney general of this country is not enforcing the law. and i don't know what he thinks he's presiding over, but it will not, i guarantee william barr this, it will not be a quiet surrender of this constitutional republic. not in michigan, not anywhere in this country. >> hear hear. and, you know, this is not the only person, only entity that can open those ballots.

there's no appetite for the attorney general or the secretary of state who are all democrats here in michigan to truly open those ballots and to prove us wrong. prove us wrong. we know that dead people voted in michigan. we know there are people who are nonexistent. we don't know if they're martians or where their origins are from, but we know that there are people who are made up. those things, we know for sure. and we know that people are voting at addresses that do not exist in detroit. and so we know these things, we've got statisticians. we need to open up the ballot boxes. there are various people who have the ability to do that, and we need to prove us wrong. but we know we're right because we'll find a breach in what we have. when they're talking about running a recount, you're only talking about a recount of 29% of the absentee ballots. we need to recount and do a examination of forensic audit of

all of the ballots. what is in the box, what are you hiding and why can't the american people -- especially the people of michigan -- need to know what's in the ballot boxes. and we need that integrity. we're persuading at this point our lawmakers. after yesterday's testimony, our lawmakers understand better the processes and what is happening and what is not happening x. i'm hoping that i can contribute to that. and i hope that my testimony contributed to their understanding of why in the urban areas especially we are missing our opportunity to strengthen our integrity of our vote. lou: well, i'm going to urge tonight, if you do not mind, i'm going to urge the attorney general, the fbi and the department of justice to contact you. because if they have not awakened to what is happening in the state of michigan after watching that hearing -- and i want to commend the senate

♪ ♪ >> the mail-in voting scam is the latest part of their four-year effort to overturn the results of the 2016 election. and it's been like living in hell. our opponents have proven many times, again and again, that they will say and do anything to get back into power. the corrupt forces who are registering dead voters and stuffing ballot boxes are the

same people who have perpetrated one phony and fraudulent hoax after another. lou: well, hoax is a nice word for what has been the effort of the radical dems in this country, the deep state to overthrow the president of the united states. and that's the president making damning accusations of voter fraud. nearly 200,000 completed mail-in ballots were smuggled from new before they inexplicably disappeared. those are the charges of jesse morgan, a truck driver. he's a subcontractor working for the u.s. postal service, and he joins us here tonight. jesse mo began, who has -- morgan, who has signed a sworn affidavit charging that those hundreds of thousands of ballots were taken across state lines. jesse, i want to say, first of all, i commend your courage for

standing up and speaking truth. i know that it's got to be tremendously difficult for you, anded i add hire your trent in so -- admire your strength in so doing and your concern for your fellow citizens who depend on an electoral process of integrity. good to have you on the broadcast. i want to start, if i may, with how it happened that you were picking up these boxes filled with ballots. >> how did it happen? is that what you asked, lou? lou: yes, sir. >> all right. first, i just want to say thanks for having me on your show. greatly appreciate it. how it all happened was that just one day i went in, i -- normal process, i walked up, gave my slip to the expediter. she was going to go cut off the seal, and as this is doing so -- as she was doing so, she made

the comment that i'm going to be taking mail-in ballots back. and i was like, oh, that's pretty cool. i'm like, you know, cool. and went back and she made the comment again about taking the mail-in ballots back. and i said, okay. i went to my trailer, watched them unload, and then they brought up the gaylords, and they had the ballots in it. and i watched them be loaded onto the trailer. lou: those are boxes of, those are boxes containing what turned out to be ballots, gaylords. >> yeah. the gaw lords and then inside each gaylord was totes, and they were stacked on top of each other, and each tote had envelopes which were the ballots. and as they were bringing them in, some of the ballots kind of came out of how they had them

stacked, can and you could see them laid on top. i wasn't looking for addresses. be honest, i thought i was doing something to help out the presidential election, you know? that's how it came across. i'm like, oh, sweet, this is, this is awesome, you know? like, cool. lou: absolutely. >> doing something to-out here, you know? -- to help out here, you know? lou: well, you are helping out, probably in ways in which a lot of people didn't ever, never expected. the boxes, you saw that they were ballots. did you see all of the boxes and their contents? did you see that they were, in fact, filled out? >> yes. yes, sir. i saw them all loaded, i saw -- now, look, this is how it is. it's, like, i couldn't see every single ballot, okay? i wasn't on really paying attention -- lou: right. >> what i saw, so how they had

'em in the totes, okay? and then as the pallets were being bumped around, the don'ts were being bump -- toteses were being bumped around, some of them were laying on top. now, i probably seen, say, five or six in the one pallet, then three pallets lauter there might have been twenty that i saw, then ten pallets down, there's twenty m you know, all the way up until they put the last box in. lou: and -- >> if you get what i'm saying. lou: -- at this point -- i do get what you're saying, and i'm sitting here thinking about the time we've got here. i'm going to ask you, if you would, to stay with us through this commercial break as we continue your journey from new york to pennsylvania and what happened to that trailer load of ballots. can you do that, jesse?

box withs from new york -- boxes from new york to pennsylvania. jesse, i want to turn tout route that you took -- to the route that you took, and if we could put up that map going from bethpage, new york, to harrisburg, pennsylvania, which was to be your destination. but when you got to harrisburg, they wouldn't check you in, they wouldn't give you a slip for delivery, and instead they directed you to lancaster, pennsylvania. that correct? >> yes, sir, that is correct. it was absolutely -- i've been hauling mail now for about 16 months, and 16 months i have never, never had this happen to me before. i was made to wait in the yard, and i sat there and i waited roughly, like, about six hours. until i went in and i was, like, what's going on here, guys? like, what's the hold up, you know? i'm getting, i was pretty upset.

my brother just moved up from texas, and i wanted to go hang out with him -- lou: right. >> finally, they couldn't give me an answer, and finally, like, a transportation supervisor came down and told me to basically leave and take the load to lancaster which never, never, i've never talked to that man, never talked to a transportation supervisor the whole time i've been doing this. i've strictly dealt with the expediters. they're the ones that i would see when i came in, they're the ones i checked in, the ones i checked out with. and he told me to leave and go to lancaster. lou: now, this is the night of the 21st of october, two weeks before the election -- >> yes, sir. lou: -- you're carrying 24 boxes -- >> yes. lou: -- tens of thousands, perhaps hundreds of thousands of completed ballots, by all appearances. you get to, now, lancaster. did you ever get the paperwork,

the proper paperwork for running that delivery? >> no. and that's the thing is that, once again, i never leave a place without paperwork. and the man refused to give me this paperwork. he refused to give me the slips. and his reasoning was i'm not getting unloaded there. and i said, well, let me get a late slip at least so so that way people know that i've been here. he refused to give me that too. lou: so i've got to ask you this, two weeks, you've stepped forward. were you treated differently? did anything change as a subcontractor to the u.s. postal service? i want to know if you've been threatened as well. >> there's -- let's just say this, lou, that there's been a lot of things that have happened to me leading up to yesterday since i've come out. there's a lot of things that we

aren't talking about that i've been told to kind of be quiet on just for -- lou: yes, sir. >> -- investigation. lou: right. well, you have excellent legal counsel, and i want to say again to you with, jesse, thank you so much. >> can i say one thing? lou: what you've done is very brave. yes, sir, you may. >> i want to e say if there's anyone else out there there that's been in the same shoes that i have, don't be afraid to come out. they're just intimidating you. don't be scared to come out. and i will say, lou, going through this whole experience, i will say that this whole system is really corrupt. it is really corrupt. and i'll put that right out there. and i challenge, i challenge everyone -- law enforcement, the congressmen -- i challenge people to do something different, do something different for your country. stand up for your country. lou: thank you very much. appreciate it. >> you're welcome, lou.

given that those agencies and departments seem to be where truth goes to due. let's go to the next step in your case and how soon will we know whether the supreme court will actually stand up against political corruption in this, in obvious political corruption whether it's in the state of pennsylvania or a host of others. >> so there's a few procedural steps happening in the background. today we filed a motion for a stay the, an application for a stay the in the pa supreme court asking them to reinstate the injunction9 that the commonwealth court had entered putting a halt to the certification of the vote for the 2020 election in pa. and the pa supreme court required the other party to respond by 3:30 today, and they did. is so now that court will probably, probably deny that request, is what we would expect and probably do so fairly quickly. after that the we will officially file our application
