protect livelihoods. one of the new problems with the lockdown orders, all counties in southern california are lumped in together. the fact that you have los angeles and san diego in the new same category, our icu capacity is very different than los angeles and yet we have another change in the rules and regulations. we have another one size fits all policy. in californians are hurting, particularly our small businesses who have followed the rules. they have done everything they have been asked to. once again to get a new executive order from the governor that is not, and i repeat not based on science when we say, when he says you're going to cut down on outdoor dining, you will cut down on the family's ability to take your kids to a playground it's not working. jackie: okay let's talk about that for a second because there are two components locking people down. we have to talk about

enforceability. you can shut the restaurants, tell the businesses, tell people they can't go out. at the same time we know from thanks giving for example, a lot of people traveled, even people who didn't travel were potentially spreading the virus in their homes just because they were gathering for example. you could see people gathering in their homes as social outlet, because we're all dealing with covid-19 fatigue here and still have a serious problem on your hands, correct? >> yeah. exactly. you have to remind folks. we have one goal. how will we keep everybody safe? do not get complacent. to wear that mask. practice social distancing. to continue to do the right thing. at the same time be able to strike that balance so you can particular hi protect your small businesses who have been following the rules, who have been doing the right thing and again to see this new executive order that comes down again with no science based that outdoor dining is in any way contributing to the spread of covid-19, that is why you're seeing the frustration. that is why you're seeing the

anger, not just here in southern california but up and down the entire state. when you're going to essentially be putting folks out of business right now with no help and support and particularly in california where unemployment department, we have over 500,000 californians trying to get their unemployment support but haven't been able to do that, there is a lot wrong with what is happening right now in sacramento. jackie: let me ask you this, i'm not sure if you have particular insight to add, i'm sure you can comment on it. we're looking at a stimulus package. not as grand as the democrats were hoping, a little less than a trillion dollars. one aspect that won't be included is the 1200-dollar stimulus checks. there is 300-dollar extra weekly unemployment benefit there. >> yeah. jackie: it will extend the freeze on evictions. there will be a second rounded of ppp to potential hi help

small businesses. some democrats said if 1200-dollar checks are not in there we're not signing off on this. your comments what congress is bringing together? >> my sense we've seen a lot of momentum particularly the last week and rightfully so. we need a lot of help and support particularly for our small businesses. folks need that extra help and support. i'm more positive than i have been in the last five weeks to get the stimulus bill across the finish line. we need it. time to get it done. jackie: i'm looking at new york city specifically. governor cuomo had a new metric he would judge indoor dining. he said if hospitalizations, if the rate wouldn't increase in five days he would shut down the indoor dining. this city is devastated. it would have huge impact. mayor de blasio our mayor. he closed the schools down but is opening them again. doesn't this all seem chaotic and confusing to you?

>> it does. that is part of why we're pushing back so hard particularly out here in california. again when we see a continuing changing of the rules, a moving of the goal posts, when families have been doing the right thing and when we have said to our folks to be outdoors, take your kids and family out there, follow the science and yet we get new orders that don't follow the science yet we'll shut down outdoor dining at least in the case of california saying you can't go out to a play ground, you will have to shut down, that is incredulous. it doesn't make any sense for anybody. it undermines what we've been trying to do to keep everybody safe, get on the other side of this. jackie: hhhs secretary azar says there will be a vaccine all will have access to but it won't be until mid 2021. dr. birx said, yes, a vaccine is a great thing but it will not save us from the current spike we're seeing right now. do you think this country,

states individually, municipalities have until what it takes to make it until mid 2021? >> we're all in this together. we'll all mushing hard. i have one goal as mayor of san diego, to keep everybody healthy and safe. we'll try to keep open our small businesses and economy. it is not a either/or situation. that is what i've been strongly advocating before. we have to continue to do the right thing as i said. those vaccines will being on the way but in the meantime we have to make sure our elected officials are actually putting down policies that have a basis in reality. that have a basis in science. unfortunately that is not what we've seen with the latest round out here in california. jackie: quick last question, so many differing opinions on this. each individual citizen operating as part of this will have their own opinion as well, in california, riverside county, the sheriff said there he won't be used or his group won't be

used as muscle, for example, to enforce newsom's orders. he called them, he said it was dictatorial kind of attitude. your thoughts on enforcement? will people abide by this even if you shut the businesses down? >> again, when i think you're seeing once you lose some of that faith in what is coming out from some of your elected officials and the hypocrisy it makes it very difficult. i said clearly you can't ticket your way out of covid-19. you have to make sure you're educating, doing the right approach, keeping people safe, constantly doing the right thing. what people don't spanned to very well threats from sacramento that we'll cut off your funding if you don't do x, y or z. that is no way to approach this. i think it is incredibly important that you continue to do the right thing, push very hard with folks to follow those safety guidelines but as i said before, you're not going to ticket your way out of covid-19. jackie: absolutely. sir, thank you so much for your time tonight, mayor.

while ago. he is in good spirits. i wish him a recovery. the whole incident is under investigation. the accused will have his opportunity to respond in court. i don't want to lose focus of the issue that is hundreds of small businesses that are suffering. they cannot sustain themselves. they are going to be forced to close whether it is restaurants and hair salons been shut down by governor cuomo's arbitrary restrictions. these are individuals who are about to lose their livelihood. the governor is saying, perhaps on monday they may have a full shut-down of new york city restaurants that would be tragic and for some of these restaurants, that i know in the community, it will be the last straw. they will close their doors for good. i think about the employees that are this, how will they support their families. we're coming up on the holiday season. so the entire situation is very tragic. we really urge the governor to reconsider some of the arbitrary restrictions put in place, not just for the restaurants but the houses of worship which the

supreme court ruled against last week and also for our schools that need to be reopened because children need to get an education. jackie: i've done extensive reporting on this. estimatessed kate 60% of small businesses including those closed during the pandemic will close after this. that is the backbone of this country. back to the issue at hand. mayor de blasio says the staten island bar owner should pay the consequence for his action, taking a tough stance there. the attorney saying these police officers might have contributed in some way making the scene more chaotic than needed to be, we need to train police officers better. we live in new york city, a police where specifically they want to defund the police and have slashed the police budget. your thoughts? >> what we have to remember whether it is the deputy or the nypd or any law enforcement agency they're there to enforce

the laws that are provided on the books by our state and local government. in some cases our federal government. what we have to remember is that governor cuomo put in place these arbitrary restrictions there is no excuse for any attack or assault on a police officer. i always stood by the men and women in uniform because they do a very difficult and dangerous job. what we're asking for a reasonable approach to reopening our economy. we want to insure that we keep in mind that we know more about this virus than we did six months ago. studies have shown that the lockdowns and shutdowns don't work. we're seeing this happen in states across the country. we're also seeing a mayor that shut down our school system, defying the science that our children don't transmit the virus. we have students now not in school. we have public schools athletic league programs not in place. this is affecting the mental health, the physical health of our young people. so you know the damage being

done by lockdowns and shutdowns mentally, people are reaching their point of desperation. jackie: absolutely. a huge issue. congresswoman-elect, in the last minute i have with you, switch gears i want to talk about the gop women, record number elected to the house that is a significant achievement. i wonder how you ladies are planning to take on the squad for example as you move forward? >> we have an amazing freshman class, i can tell you right away a few of us really bonded over the fact that our families have fled situations of socialism and communism. this is a group of individuals who love this country, who want to preserve our freedoms. they want to preserve the american dream for future generations. we must push back against those who are pushing a socialist agenda. i intend to do so as the daughter of greek immigrant, cuban refugee. that is something i'm very passionate about. i think first step is first.

with me now former u.s. attorney brett tolman, trump 2020 advisory board member harmeet dhillon. great to see you both. i will go ahead and start with you, brett. let's talk about procedurally what the issue would be releasing an interim report. there would be no political ramifications, the election is over. why not tell us where they are in the investigation now? >> well you know it's tricky, because if that report gives, gives away information that you're concerned that certain targets of the investigation may adjust their behavior or do things in reaction to it, i get and understand why john is asking for that. it is not a bad idea. it might be a little bit tricky but keep in mind a special counsel like this, it is very difficult to get rid of. you can only terminate or fire a special counsel if there is misconduct or conflict of interest. it was a good move by the attorney general to designate durham in this manner.

jackie: harmeet, ratcliff says that there was fisa abuse. that it was clear and that people need to go to jail. i mean you've got a, folks, center group of folks saying this probe, this report, it cannot be dropped. we have to get answers here. >> absolutely and when our attorney general converted this probe that was initially sort of an investigatory, regulatory type of a probe into a criminal investigation which he did before the election but secretly, he actually specifically authorized both an interim written report and a written final report in a form that may be released to the public. so a sitting attorney general clearly had the intention to make sure the public is reassured whatever happened here we get to the bottom of it, we names. we make sure that this doesn't happen again. so the secondary goal is also to make sure that the next president, if that is joe biden, does not interfere with it. i'm sure this issue will come up

in senate confirmation hearings if we get to that point of an attorney general under the biden administration. jackie: brett, before we get to what joe biden is going to do about this i just want to stick with bill barr for a second because he did come out and said there was no evidence of widespread voter fraud. people were sort of thinking maybe there was some, you know, upset within the trump camp that he may not stay on, fox news a doj official told fox news today barr intends to stay in his post as long as the president needs him. in the days ahead up to january 20th, does barr's role, if he stays on, is that crucial or essential, if some reason he steps away, could we see this go another way? >> you know i've confirmed as well with some sources in doj that the attorney general remains on the job and intent on staying on the job for as long as the president would like him to. so i think that is appropriate. there is still a lot of work and

effort that has to go forward. but i think right now you have issues, when you talk about the election fraud, for example, i think the attorney general was speaking about what he had seen so far, what had come across on his desk. there was still a lot to be uncovered. i don't have a problem with him indicating that but we're certainly seeing now more than we have ever seen. jackie: harmeet, bring it to you and bring it back to joe biden. that is sort of looking forward. the senate is clearly battling over the barr's special counsel f the senate judiciary committee will hold hearings on this, on his attorney general pick, will hold, you know his feet to the fire and ask for a pledge he will not interfere with durham's work? >> okay. you're talking to a bit after cynic here. we've seen a lot of hear national the senate where a lot of republican senators point the finger, pound the table, ask

contributor joe concha. joe, it is always great to see you. you heard kelly loeffler's comments there. you know, they sound pretty extreme and they certainly is taking a stand. is she overdoing it here or is she actually telling people how it is? >> well i think elections usually come down to broad strokes and contrasts in the end, jackie, right? she is going to say when it comes to rafael warnock, radical liberal as many times as possible. remember the senate minority leader chuck schumer said we'll take georgia and said we'll change america. that is what is at stake here. again if democrats win both those races you have a democratic house, a democratic senate, and a democratic president. that is a blank check for abolishing things like the electoral college, i.c.e., the filibuster, or for expanding the senate, expanding the supreme court, eliminating student loan debt on raising taxes for

trillion dollar programs like the green new deal or things like free college. these are things at stake in this election. in the end you win elections by not only defining yourself but defining your opponent and that is kelly loeffler's mission right now. jackie: president trump echoing that sentiment as well. he was in georgia over the weekend. if you don't vote the socialists and the communists win. >> yeah. well you know, the president actually has had some mixed messages, right? this could be a problem because remember, jackie in the 2020 election the difference between joe biden and donald trump as it stands right now, 10,000 votes. that is literally almost nothing when you think about all the votes that were cast in the peach state. look, with these mixed messages coming from the president or lynwood, an attorney, people should boycott the election. there are even billboards down there, quote, perdue, loeffler didn't deliver for trump, don't

deliver for them. with the races being so close i think the president probably has to go down there a few more times, drive home the point, yeah i think i got robbed in georgia, at the same time your votes will count this time around and we have to keep the senate if that means making joe biden again, probably not a very effective president because you have the house that has democrats smallest majority since world war ii. then if you have a firewall in terms of the senate staying with republicans, then joe biden will not be able to get a heck of a lot done. in 2022 gop takes back the house. before you know it, president trump if he decide to run again, i think he will, running in 2024, breathing down his neck. that is how important in terms of what joe biden can, and can't accomplish in his term as president. jackie: indeed. 2024 is a long way off. let me ask you. it was a very close race, i will not peddle conspiracy theories,

there are a lot of people questioning if their vote will count there. what are they doing in georgia this they prove to the american public that this is a fair runoff and there are no irregularities? >> that is the thing. one poll from cnbc that said 3% of trump voters, 3% believe that joe biden is a legitimate president. wow. that is something that you have to overcome now as republicans to say, you know, look, i know you don't believe what happened back on november 3rd in the days following it but you have to get things together now because again, this is for control and the state of the country moving forward. but again, we got to fix the way we do elections jackie, in the end. the fact we had to wait four or five days while votes were being counted as they were coming in michigan, wisconsin, in pennsylvania, that just kept the suspicion and people's mistrust growing because we're yoursed to having an election called election night or maybe early that morning.

they see president trump win fairly decisively in florida. takes ohio by eight points. looks like he is on his way. all the leads he had in places like georgia evaporated. we have to figure out how to run the elections a lot better so we have a call within 12 hours of the polls closing. we see the result when 3% of one side believes that the other guy didn't cheat. jackie: what a roller coaster ride that was. both side want this at stakes as you mentioned laid out for us. by my tally, the latest figure i have seen, 329 million in ad spending from both sides on this this is very serious. it costs a lot of mon city. >> it is, i will leave it here, jackie. 100 was spent on the kentucky race, with amy mcgrath, and mitch mcconnell. they thought mcconnell was in trouble. all the money comes in, tell people how to vote it tends to

♪. jackie: chicago is reeling from a weekend marked by a remark of gun violence. five people were killed. as many as 39 others were wounded in shootings. the latest city crime statistics show murders are up 55% from last year. shootings up 53%. joining me now is chicago native and fox news political analyst giano caldwell. great to see you. look, i live in new york city and the stats are alarming there

as well n november 112.5% increase in shootings in this city. common thread that i can see, democrat mayors. >> always a sad time when i join you guys for segments reich this my family personally impacted by the violence specifically in chicago. a few years back memorial day weekend my younger brother was in a car with two of his friends when two men walked up shot the car 25 times. he lived thankfully but his friend died in his arms. alarming what we've seen in the city of chicago. to give statistics, almost four thousand people shot in the city of chicago since january. that is almost 1500 more than what we saw last year. what is the distinction? between last year and this? we're in the midst of a pandemic

with a city shut down, with a state partially shut down in areas and what is more common than thought the elected officials within the city of chicago and the state of illinois have failed the citizens. what can americans do? jackie: gianno? >> yes. jackie: that is a sobering story. i'm so sorry for your loss. it really shows us all that nobody is exempt from this. when crime is out of control it can happen to any of us. so i am sorry for your loss. but i want to ask you this -- >> my brother lived. his best friend died. ly little brother. my brother is still with us. jackie: i'm wonder, as we're looking at these cities part of the problem has been police officers, i always say is defunding the police the answer? or do you actually, around i know it sounds counterintuitive you throw more money at the problem and you train them and you teach them and you make sure that they are out there fighting crime? somebody has got to do it?

>> you know i just had this conversation on my podcast outlawed with giano caldwell, with daniel cameron, the attorney general of kentucky who oversaw the breonna taylor case on the defund the police issue and the truth of the matter is, i personally subscribe to listen to the interview out today, truth of matter, individuals like aoc, other members the squad in congress ad advocating defunding of the police you see it is happening in chicago, los angeles, the blood of the individuals is on their hands. i may not agree with everything law enforcement does. law enforcement does not need reforming. not every cop is a bad cop as folks try to say like aoc, i represent a police organization, and a national police organization. there are a lot of good officers out there. so when you talk about this i really believe that as

legislators they're doing more harm than good. yes, reform the police. certainly not defund the police. people in chicago snead the police, especially in these poverty-stricken areas where violence runs wild. we have to have common sense discussing these issues. those elected in these particular positions, aoc and others are not implementing common sense. creating a dangerous narrative where people are dieing. >> there is a quality of life problem for citizens who live in a city like chicago or new york city. i've done extensive reporting here how some people left because of the pandemic. because of the violence and fearfulness at this point. the city is losing revenue. it will be very difficult to regain that revenue and to attract people to come back. so not only are you creating an unsafe environment but potentially long-term, harming the longevity of your city? >> not only that, the trauma it causes. i will be honest. i grew up in neighborhoods very, very dangerous where people were

shooting left around right. what i was able to afford to be in a better environment, just going back to visit my family, gave me trauma. i'm being very honest when i say it. it doesn't bring me any pride to say it. what a lot of folks in the city of chicago are going through, on the southwest side of chicago, other parts of the city. that is why it is important for chicago wants to take this moment to realize you have to replace lori lightfoot the mayor of chicago because she has not made it safe. she has not made eight destination city. she made it partially helped to create a hellhole environment for the people that live there. they can't afford to put their childrens lives in danger sending them to school when the schools were open. this is dangerous issue which needs to be solved. leadership has to change. that is the only way i can see things becoming better. jackie: when people don't have the quality of life if they can afford it they leave. >> absolutely. >> that's what happens. gianno, great to see you. >> thank you for having me

first place? >> first of all lopez obrador before he makes this ridiculous proposal he needs to fix the corruption in his military and law enforcement. this is nonstarter. he would have never attempted this with president trump. president trump supports the law enforcement. i hope if joe biden becomes our president he tells him this is nonstarter. our law enforcement officers are risking their lives every day helping them with the crime situation. we're playing away game. because we don't want to play the home game. we want to stop the drugs down there before they get into the country. one i.c.e. agent was ambushed driving down the highway. one was secure ambulance bulletproof, cartels could not get to them, the agents refused to open the doors or unlock or present themselves because they didn't trust the police. they are on the phone with the u.s. embassy to get a vetted unit to come to the rescue.
