[laughter] having fun. connell: jeff flock chasing a dog in a house in illinois. that does it for us "after the bell." we'll see you back here at the same time tomorrow. ♪ lou: good evening, everybody. we begin with a major development in the battle for the white house. the u.s. supreme court has rejected the republican effort to have all mail-in ballots in pennsylvania thrown out which, of course, would reverse or the outcome of the election there. the court, without comment or without signature, refused to rule on the constitutionality of pennsylvania's election law leaving in place whatever the circumstances of this extraordinary election. the expanded mail-in voting

stands, and at a white house event today president trump made calls for an act of courage to save the republic. >> hopefully, the next administration will be the trump administration because you can't steal hundreds of thousands of votes. you can't have fraud and deception and all of the things that they did and then slightly win a swing state. you just have to look at the numbers, look at what's been on tape, look at all the corruption, and we'll see. you can't win an election like that so, hopefully, the next administration will be the trump administration, a continuation, which has led us to the highest stock markets we've ever had, the best employment numbers we've ever had, a rebuilt military. if you look at the tax reductions are the greatest in history, the regulation regulations, the greatest in history. it leads us to space force which nobody thought was possible. all of the things we've done, and we were rewarded with a victory. now let's see whether or not

somebody has the courage whether it's a legislator or legislatures or whether it's a justice of the supreme court or a number of justices of the supreme court. let's see if they have the courage to do what everybody in this country knows is right. lou: well, the supreme court demured. courage lacking. and the willing to stand up -- the will to stand the up for the constitution now very much in question. joining us now to take up this breaking news story, attorney greg teufel, he represents congress al caughts mike kelly and sean parnell, their attorney to seek a ruling by the supreme court that pennsylvania's acts were unconstitutional. i know you've got to be extraordinary thely disappointed, greg. your thoughts about, first, the

ruling. >> we are disappointed9 that the court decided not to grant an interim injunctive relief. that's all they could deny today, so they haven't indicated they're unwilling to take up the case in any way, shape or form. this is a strong the indication they're unlikely to grant relief with respect to the 20 election. this doesn't necessarily mean they're unwilling to grant relief as to future elections in blocking the application of act 77 and mail-in voting in future elections. they could still theoretically consider relief, but one would think if they had that in mind, that they would have granted an injunction in the meantime to preserve the status quo until they reached a final decision on the merits. they have decided not to enter an injunction, so that's not a positive sign for the 2020 election. lou: it is not entirely unexpected though. most of the legal analysts that, who have addressed the issue

publicly have said that they thought this was a narrow chance to gun with. to begin with. which is extraordinary in and of itself since millions of americans have watched this process unfold not just in pennsylvania, but around the country, and there are clear acts of theft of an election, a fraudulent election in various places. what would be going through the court's mind in not taking this up? >> it's hard to read their minds as to why they were not inclined to grant injunctive relief while the petition for certiorari was pending. they, no doubt, were swayed by the issue of millions of people voting in reliance on what they thought was legal and the difficulty of dealing with that issue. that's a very difficult issue to confront. what do you do about all of

these people were misled into voting in a way the constitution doesn't allow in pa? maybe they don't want to wade into it. lou: well, they made it pretty clear they didn't want to wade into it. a 4-4 decision to defer the issue, in effect, before the election. now this with the addition of amy coney barrett, most had thought that it would be a more favor the bl outcome -- favorable outcome with her on the court. it's clear that they referred this to the entire court. the order doesn't have a signature, doesn't say anything except referring it to the court. that suggests it's at least 5-4 to simply throw up their hands and retreat to a dark corner somewhere. i mean, it really looks awful for them not to have said anything, to have not been enlightening in any way. it's downright frustrating, but

it's also very cowardly on the part, it seems to me, of the court. >> we're very disappointed, obviously, that they didn't take action to deal with what was an all legally-conducted election. lou: and so is there, there is no legal recourse for you or for the republicans in pennsylvania, is there, greg? >> there is. we're -- all we filed was an application for writ of injunction. we can still do a we petition for certiorari which would ask the court to take up the case on the merit. the court could still issue a decision in our favor as to all the issues or as to some of the issues. they just refused by this denial to enter an injunction to try to preserve the status quo while that petition pending. so while that petition is pending -- lou: how long would that take? >> they could decide such a

petition very quickly. so it depends. i mean, normally it's a matter of at least the -- at least months for a petition for certiorari to be resolved. in this instance the, they could decide it more quickly than others because it relates to a pending election, or they may decide to let it flow because they've already decided not to grant any relief as to the pending election. lou: yeah. as you said at the outset e, that seems to be the only inference possible from the way in which they have reacted to the pleadings for injunctive relief. greg teufel, we thank you very much, we appreciate it. look forward to talking with you again soon. thanks so much. president trump hailed the development today of at least two china virus vaccines under his leadership and the support of his operation warp speed that produced vaccines in the course of eight months. vaccines from pfizer and moderna

first global asset manager to gain consent and begin mutual fund operations in china. so what do the communist chinese have to gain from all of this? china's foreign minister is asking their old friend joe biden to reset the chinese relationship with the united states. of course, by reset they mean for america to change direction, to move back to an establishment-approved path which permits china to become the top economy in all the world. corporate america, wall street, the radical dems, rinos and anyone else who allows this to happen operating against the interests of the united states. but other interests, obviously, have prevailed. it's why we've said here on this broadcast over and over that the chamber of commerce and the business round table representing america's big business establishment are often

is threatening to subpoena the chief executive officer of dominion voting systems. congressman, state the congressman matt hall says he'll use his subpoena power if dominion's john polis doesn't appear voluntarily before his house oversight committee. no dominion representative or official has answered questions directly from lawmakers since the contentious november 3rd election. our next guest tonight has yet another charge of election fraud in michigan, and joining us is christina caramo, an election observer from michigan. she saw a number of ballots counted for biden. she contends that many of those ballots may have been filled out for president trump or even a third party candidate. but she was watching, he says, fraud. christina, great to have you with us. let's start with how is it that

you saw this occur, and what did you see that makes you so certain it was, in fact, fraud? >> yeah. hey, lou. so i was actually -- i'm a poll challenger, and i was at the adjudication table. so, basically, if there's any kind of inconsistency with a ballot, say a person voted for more candidates than they were supposed to, that ballot would come across the adjudication screen. so a ballot came across the screen where it was the person had voted for joe biden, and they voted for the green party candidate for president. and the poll worker gave it to joe biden when that should have been quarantined and tossed out. but a ballot came across the screen where it was straight party democrat, straight party republican, and the poll worker decided to give it to the democrat, and i said, no, no, no, i'm going to get your supervisor, i want to challenge that ballot.

at that time the supervisor deferred to her, asking her what she thought. it didn't matter what she thought, it was completely illegal, and the girl wanted to give it to the democrat. make a long story the short, i went to get the supervisor who was overseeing the 10 p.m. to 5 a.m -- this was roughly about 4 a.m., the gentleman's name, i forgot. i went to go get him, and he deferred to the girl again saying what does she think. it didn't matter. the law was, the rules are that ballot should have been thrown out, and he wanted to give it -- she wanted to give it to the democrats, and he gave her the green light. an argument broke out between me and the man, told her to push it through, push it through, push it through, and he told her to push the ballot through even though i objected and it was an all legal vote. lou: so what happened? what transpired? how many times did this occur? >> well, that particular incident i saw, that was just one incident i saw, that

particular thing at the adjudication table. i asked for the numbers between the changes of the shifts from the tabulation machine in addition to the ballots being hand keyed in with the fake birthdays of january 1, 1900, i attempted to challenge one of those. and i'm not the only one. there are a whole slew of people who have seen um proper things like this -- um proper. of it's a pattern, and, you know, when things are a pattern -- lou: and all of this in detroit and wayne county, and so many questions raised, so many poll watchers either moved aside or just simply dismissed or removed from the counting rooms as well as adjudication tables. now we've got a ruling from the supreme court that they're not going to intercede in this election, that whatever happened happened, and they are basically retreating from the arena.

what's your reaction to that news today? >> well, you know, lou, to be honest with you, i call upon the leadership in the michigan legislature to step up. there are some patriots, i know that for a fact. but unfortunately, the leadership in our legislature, they have done nothing. they won't do anything. they should have been calling for a forensic audit a long time ago. i filed my complaint with the gop as soon as it happened. as soon as this incident happened, so did many other people, we were complaining right away. so if they don't do anything with this, then these hearings are a mere dog and pony show. you know, the democratic party has become high efficiency destructors of america, and the republican party, thanks to the rinos, have become low efficiency opposition. and the fact that our legislature leadership have sit here and done nothing about it, they've become complicit in the fraud. and they sit here as though we're going to forget, and i'm here to let them know that we will not forget. you guys can think you can do these things, you can pass the

time, and we'll eventually burn out. if you plan to run for office again, we will remember exactly what you did right here, right now. the democrat party is not the party of jfk, they are the party of karl marx, and it's time for people to respond as such. we elected republicans to defend the constitution and, unfortunately, many of them are not doing this. they are republicans in name only, smiling in our face, asking for donations only to go and screw us over and not answer our concerns when we ask them to. we're simply asking for a forensic audit that'll clarify anything, and many of them don't want to do anything. why have they waited so long? that makes us feel like they're complicit in stealing the election from the american people, especially michigan. lou: well, a number of states can, could well fit that characterization. kristina karamo, i look forward to talking with you again soon. thanks so much for your time. we'd like to hear your thoughts on all of this. share your comments.

flynn. the political persecution of president trump's former national security adviser appears to be over. but he, judge sullivan, is not through. in his 43-page ruling, he included a reference saying that flynn's presidential pardon doesn't mean that he is innocent. that level of vitriol against a decorated military man, a general who served this country for decades and a great american outrageous. his defense attorney, sidney powell, said this: the case against general flynn and judge sullivan's handling of it is a national embarrassment. we appreciate the president ending this travesty of justice. joining us now, phil kline. he's the direct or of the amistad the project filing

election fraud lawsuits across the country, also former attorney general of kansas. and, phil, it's great to be -- to have you with us and to be able to talk about this cause first in -- this case first in pennsylvania in which we saw the supreme court, without comment or signature, simply deny an injunction against the state of pennsylvania. your thoughts on the court's ruling today. >> well, it's unfortunate, and i think it's somewhat consistent with what was justice roberts' concern about it and the united states supreme court interpreting a pennsylvania statute under the pennsylvania constitution. i do think that there was what we call an as-applied case that should have been considered by the court, in other words, that the act itself may have been within the pennsylvania constitution, but the way they administered it was contrary to the constitution of the united states. but i don't think it was quite postured in that fashion. and, lou, if i could back up and comment on judge sullivan --

lou: sure. >> -- and his opinionated manner of writing his opinions which, by the way, borders on unethical for a justice, to opine in this fashion. lou: i would think. >> i would say this -- yes. you would say this about judge sullivan and maybe just coincidence, but his order in the case, ordering the post office to sweep up all of the ballots downstream on the eve of the election so that they can be counted fits right into the narrative of our whistleblowers who show up on november 4rd, and the post office claims you forgot ballots as a subcontractor. they say, no, we didn't, we brought all the ballots. no, you forgot them. and so suddenly we have all of these ballots to une cert into the postal stream -- insert into the postal stream for an election that ended on november 3rd. the judge's order may be coincidence that he enabled this nationwide, but what we're seeing in post offices across the country is this claim of

back dating, and we're also seeing the insertion of what we believe based on the testimony of jesse morgan to be fraudulent ballots traveling across state lines. and the judge's order they've been covered to do this. that's deeply concerning. lou: well, it's -- almost are everything we're looking at connected to this election is concerning nearly all of us. let's, let's turn to this court for just a moment. by the court, i'm referring to the federal judiciary. it is as politicized as the justice department, it appears. every bit as politicized as the fbi. expect american people -- and the american people who elect, who have elected people to go to washington are just being told basically go to hell. the constitution is a fine document, but it doesn't merit our enforcement of it. and this is a difficult case, and we don't do difficult cases

particularly if we have liberal leanings. it's, it seems to be that straightforward. and justice roberts is -- i won't call him a name, but the fact of the matter is he is behaving in ways that are, to me, inexplicable. your thoughts. >> well, i'm hoping that the court might take notice. we're getting ready to file suit and maybe it's unaware of this. but you have state legislatures, the constitutional responsibility to elect electors. they are to do is so under the united states constitution. now, what happened is they have delegated all of that authority virtually all the way down to local election clerks to certify elections. and the the way the laws work with certifying the election is that the clerks almost have to. in other words, if certain data matches, they have to certify, and then the governor rubber stamps and the legislature is

forced to accept the result. that is an unlawful delegation of their authority. in other words, their supposed -- they're supposed to assess was this election fair, was it proper and do we have faith in the result. and instead, for example in pennsylvania, the legislature's not even in session to consider whether the election was fair. we believe that that rubber stamp process is a violation of the duty and responsibility of the legislature to assess whether the election was lawful. and, lou, you and i know the election was not lawful. there are admitted violations of law. i'm not talking about criminal -- lou: right. >> -- i'm talking about kicking people out of the counting room. that's a violation of the law. making sure that nobody sees the count. that's a violation of the law. breaching the chain of custody of these millions of absentee ballots dropped in dropboxes. that's a violation of the law. and when it's a lawless

election, the legislature should step up to the plate. but what they're done is they have made it impossible -- they have done is they have made it impossible for them to step up to the plate. lou: phil, you're a man of great energy, and you're doing the lord's work trying to move forward to achieve justice and restore integrity to what has been a controversial election at the very least. we've got about 30 seconds. tell us if you believe that you've got a case that you think will, will stir the principles and the spine of the supreme court. [laughter] >> well, we hope. i can't say that it will, but i know this, we will continue to fight to make sure that this does not happen again. america cannot risk this type of election. lou: yeah, well, if we lose this one, phil, the rest of it doesn't really much matter, i don't believe.

the scope of electoral fraud in the november election. the judge is none other than tim think baton who asked -- tim think baton who asked sidney powell in court, quote: is this whole cause not moot from a standpoint of even if you were to win and win georgia, could mr. trump win the election? sidney powell responded aptly: fraud, your honor, can't be allowed by a court of law to stand. irrespective of circumstances and consequences. finish powell added she believes president trump can win the election, and many other down-ballot races as well could be flipped if the fraud is fully exposed and the law properly enforced. breaking news now, louisiana has joined texas' petition to the u.s. supreme court. they are looking to block electors in pennsylvania, georgia, michigan and wisconsin

of jurisprudence, most people realize that there were things that went wrong from the very beginning of the mail-in and early voting project. ask all of these states' legislatures' procedures were overturned by sometimes state magistrates, bureaucrats, but more often state judges or state supreme courts in a way that's unconstitutional. and when it got into the election, all of the affidavits, the people who were not registered voting, the same-day registration, all of that warped the election are. and now we're at the situation where the narrative has changed from there was no irregularities to there was some irregularities but they were minor, to there may have been irregularities, but they didn't favor one or the other candidate to they did favor joe biden, but they were not of a magnitude to make any difference, so what does it matter. and now it's being adjudicated by the democrats who are basically saying, and i think liberal judges are saying, okay,

what do you want me to do? we've never done this in american history, we've never had the congress decertify a state's electoral the voting. we very rarely have had a state legislature overturn the mandates that reflect the state's popular vote, so are you going to do that. and that's their position, apparently, that it would be such a historical anomaly that they just don't want to take the rusk of doing it, and that requires more and more public opinion, more and more evidence at a time when time is running out. and that's the strategy, i think, that we're dealing with. lou: it's that strategy, i wonder what the counter-strategy is from the republicans, from the white house. we know what the democrat strategy is. where in the hell have the republicans been? >> yeah. i think the strategy is maybe justice alito would make a historic ruling or maybe one key state would reject the

certification or maybe we would see some evidence. i mean, we have this evidence that's pretty overwhelming, the video evidence and the mainstream media say in georgia with the nocturnal bringing out of -- lou: yeah, yeah, but i don't think most people -- victor, excuse me. i mean, i don't think most people would argue the point. we have seen video after video after video of what -- >> no, no, they don't. you're right. yeah, nate silver at 538, he said 6 out of 10 of americans don't believe in the authenticity of the vote. that's from a liberal source. 60% of americans don't believe the election was conducted fairly or represents the actual vote. and so most of the -- lou: that should restore our faith in the american people. >> yeah. but they didn't -- [inaudible conversations] lou: -- a vote of integritiesome. >> yeah. no -- lou: again -- [inaudible conversations] >> it's taken the american people to wake up. and so now what's happening, the

ball is rolling, and these judges are saying, oh, my god, the people are starting to believe what happened, but it's putting a lot of pressure on us, but there's not much time left in historical standards, so we're going to take the easy way out. that's how i think what's happening, what we're witnessing. lou: yeah. >> and that means every republican legislator the at the state level and people in congress are now making not a jurisprudence calculation, but a political calculation. to what degree does it help or hurt me to turn over this election, and are the people with me when i do that versus can i just kind of let it grow -- go. so we're in the realm of pure politics now. i don't think it has much to do with fairness or -- lou: well, the democrats have been in the -- >> i wish it weren't that way. every decision that seems to be made has a political calculus behind it. don't you think so? lou: well, you know -- >> seems that way to me.

i'll take it. it's a win. we're back now with his attorney victor davis hanson. and, victor, one of the questions, it seems to me, that's really important to examine is this, this first term of this president in the which he has been under fbi investigation through the plotting and a conspiracy by his political opponent in that campaign in 2016 and the democratic party. he has then had to face a special counsel, again, with no basis and with no, nothing but exoneration for him. then a silly, farcical impeachment inquiry all designed to destroy his agenda and his presidency. and then an impeachment effort. and now a fraudulent election. and the republicans have never once stood up and said this will

not going to play by their rules, and no republican had done that except, i guess, lee atwater in '88. the second thing was he said the problem not republicans or democrats, the problem is this permanent administrative state and this toxic culture of media and high ranking bureaucrats and high ranking military officials and entertainment, silicon valley, academia. and i'm not going to listen to them. i'm not going to bring anybody in from them, i'm going to try to resist all of them because what have they done? and he went through all the disasters we've had in foreign policy, all the things that have happened domestically, and he said why can't we be the world's greatest gas and oil producer? why can't we be -- and he did, but he offended everybody in the process. you have to. lou: why, why can't this government respond? our judiciary is compromised, it is as politicized as the justice
