involved beyond hunter. elizabeth: not just an investigation into hunter's taxes. federal prosecutors in delaware reportedly working on a criminal investigation with the fbi and a unit at the irs, a grand jury has reportedly been impaneled. investigators are talking subpoenas and interviews being sought over the business dealings of china, ukraine and other countries. so you know the question is senate finance committee chair grassley on the floor today blasting the media for the blackout of the hunter biden story. what do you think happened there? >> i think the black quote was pretty obvious, right? the mainstream media wouldn't touch this with a 10-foot pole. liz, i'm old enough, billy carter commanding the headlines because he had beer and he was a redneck, he was embarrassing his brother. that was the stuff of near scandal status in the '70s. we're talking about a situation with shell companies, with oligarch wives giving checks of millions of dollars with hunter, the whole burisma thing.

sending money to hunter biden and his associates via shell companies. talking about millions of dollars, money funding a global shopping spree for james biden and his wife sarah. millions of dollars to off-balance sheet shell companies heading toward the bidens. 20 wires hunter biden involved with sending 1.4 million to james biden's consulting firm. cefc, the china company, wired five million to a shell company controlled by hunter biden. on and on. while they are wiring this money to hunter biden and his associates, china is getting hunter's help to do energy deals in russia. what is your reaction to this part of the story? -- >> first part, hunter biden was thoroughly unqualified to do anything in this sector. clearly the last name was important to the foreign investors. look, the question is not just where the money is going, the question what did they expect to get in return? that is something we don't know and frankly i have to to back up

probe. we the rowed last reported last night prosecutors probing how the chairman of energy company in china paid hunter biden with a 2-carat diamond working with lng in louisiana. there are a lot of moving parts. where do you think it goes next? >> tax probe can be a vast probe. it could be euphemistic, that they're working on his taxes and that could be woefully incomplete. i'm looking whether the leak of information came from biden's camp in a way of dampening the impact of something that comes later. in other words, two or three weeks from now there is the possibility of a biden christmas gift where hunter biden gets a very quick plea, soft terms to a tax charge that enables this thing to be put in the rear-view mirror and suppressing rest of the investigation.

i'm nervous where this could go with the information suddenly coming out in mid-december, whether we see an indictment or soft plea in next couple weeks that essentially ends all the inquiries from a federal prosecutor's perspective. >> but this is a national security issue. that is what senators grassley and johnson keep hammering home. the guy who ran the cefc energy conglomerate. he had has gone missing. he complained about a deal to take a 14% take stake, 14% stake in the russia energy company rosneft. another biden associate patrick ho, charged with allegedly trying to bribe government officials in chad and uganda. so and then his own, his other business partner devin archer was convicted on unrelated fraud charges. it feels, senators grassley and ron johnson have been working on this for a year and they're saying this is a national security risk. it can't just be a soft plea for

alleged chinese spy christine fang's extensive ties with california democrat eric swalwell. fred, you point out the gaping, huge government security loophole here. what is it? >> you know it is unbelievable, i worked for the cia and house intelligence committee staff. in each case i had to undergo an fbi background investigation every five years. they look my finances. talk to my neighbors. find out who my relatives were. at cia i had to undergo polygraph and drug test. members of the house intelligence committee don't undergo any of this. they get access to the nation's most sensitive secrets just being elected. if eric swalwell had undergone routine fbi investigation this fang fang woman have been found immediately. i think something has to be done immediately so we make sure members of congress are not compromised by foreign intelligence services. elizabeth: should there be a probe of this, should there be a special counsel looking into

this? you're saying swalwell was not cleared by the fbi with a background security check like other members of congress but he can engage with a chinese spy and see top secret information as a member of house intelligence? kevin mccarthy, the minority lead in the house say he should be kicked off, removed from house intelligence. what do you say? >> i think he should be kicked off. i think congress has to have some new rules. let me tell you another issue here. nancy pelosi said in 2015 both republican and democrats were briefed on this. i think they were briefed on something, liz, but i doubt very much they were briefed on the fact that fang fang helped fun this congressman's career and that he may have had a personal relationship, romantic relationship with her. i wonder what was really briefed to congress in 2015? either it was information withheld by james comey or did they not know the whole story in 2015? elizabeth: the question is what other politicians were targeted?

let's watch former acting director of national intelligence ric grenell. he said this is a concern. watch? >> i think that there needs to be a "gang of eight," this intelligence group investigation, certainly acting chairman marco rubio and chairman schiff should immediately call the intelligence committees together. they should get a confidential classified briefing on what eric swalwell knew and how much did he give away because the reality is he spent years downplaying the china threat and overhyping the russian threat. eric swalwell did exactly what the chinese wanted. we need to figure out are there others. i can tell you without giving away too much intelligence, this is the tip of the iceberg when it comes to the leverage that china is putting on our politicians. there is many, many more. elizabeth: all right. tip of the iceberg, many, many more? fred, i mean, so looks like this

"new york times," secret white house last-ditch effort to change the narrative and election of media gatekeepers. media gatekeepers at traditional outlets, cnn, msnbc, nbc, "washington times," "washington post," not only dismissed the story, but suppressed it. social media, elizabeth where they locked out the account of the "new york post" for having the audacity to report this story. if you actually broached as journalist, hey, maybe we should investigate this more, seems to

helping recall gavin newsom in california with rescue california.org. elizabeth: "politico" is reporting that governor gavin newsom's team is really worried about your recall effort. he, you know, we've reported on how he said you know, don't do gatherings at restaurants and he ate out at a fancy restaurant in napa valley. he botched his state lockdowns. a judge called them in the state irrational, arbitrary. he broke his own lockdown rules. now at least eight companies gavin newsom has invested in got, partially owned by governor gavin newsom got millions of dollars in loans from the paycheck protection program when it was intended for small businesses. when those companies employ, one of them employed 10 times fewer workers than the average small business in the program. we know that these businesses are in a blind trust. the governor doesn't have say what goes on, but what is your take on that story?

>> it just feeds into the narrative he thinks he is above it. remember his kids were going to school at private school while others couldn't. he traveled when others don't. he had this, these big events at this french laundry restaurant with many people from many families when he was telling others they couldn't do that sort of thing. that's what is fueling the pot fire. he sit there in his own office making rules and regulations for everyone to live by. meanwhile he is driving restaurants out of business. there is big push back now from small business in this state and it is very bipartisan. i can tell you with the 800,000 signatures we have so far for this effort, it is not a republican effort. it's a very bipartisan effort to push back on him and quite frankly, we're going to get these signatures. we'll have recall of gavin newsom on the ballot in 2021. that will be the big national story other than georgia. elizabeth: tom, we want you back

call your doctor today, and ask about prolia®. jo joining me now is former u.s. attorney brett tolman back with us. brett, great to see you again. >> great to see you, liz. elizabeth: good to see you. how do you think the supreme court will rule on the texas lawsuit alleging that the four battleground states were unconstitutional in how they conducted their 2020 vote? >> look, it is a different lawsuit than what we've seen. this is a conflict between states and the supreme court is the only court that can hear this. this is more motivating them to hear the case but it is still an uphill battle because the supreme court has been somewhat reluctant, especially when they have significant standing issues. what i mean by that there is a question whether one state can try to enforce what is happening in another state but reality is there are some good arguments. this is a well-written lawsuit.

it is very likely that the supreme court is giving it very serious consideration. elizabeth: yeah. we've got republican attorneys general in six states, missouri, arkansas, louisiana, mississippi, south carolina and utah joining the texas lawsuit. 106 house republicans filing friend of the court briefs. what you're saying is. lou: it's a challenge based on the constitution. texas is saying that the swing state officials unconstitutionally changed voting rules when the u.s. constitution only gives state legislatures the authority to make changes to the state election laws, not state judges, not other state officials. so ag paxton says he does, texas attorney general ken paxton sauce he does have standing to sue because the way they conducted their vote undercut the power of the vote in texas. not sure how that power of the vote is undercut. that is really the issue, right? >> right. and it is a good argument by the attorney general in texas.

here is in essence what he is arguing. he is saying that the due process clause of the 14th amendment and the equal protection clause are protecting other states that on a national election rely upon the validity of the other states acting in a constitutional manner and so he is not necessarily asking for the supreme court to review and overturn this election, instead to look at the fact that unconstitutional effort or rules were passed by those states which now impacts their protection in this union. it's a clever argument and it may work. elizabeth: yes. really interesting what he is saying. in other words, texas is saying we followed the rules, the constitution. >> that's right. elizabeth: these other states did not but supreme court chief justice john roberts and justice elena kagan said state judges do have the final word how the state constitutions are applied

to election rules, that the courts ought to supervise state legislatures right to voting laws in order to protection constitutional rights. so, wow, this is going to be a deep, intense look at how the states are allowed to conduct their vote and how the u.s. constitution is abided by. your final word? >> that's right. i mean, liz, you hit the right issue there on that prior ruling by the supreme court. it was a fractured court. it didn't also address squarely the constitution ever those states may have been violated this will be key. it will be the conservatives on the supreme court. elizabeth: we'll watch justice amy coney barrett. people are saying that she could be a key vote or impact here. we'll see. >> that's right. elizabeth: we'll see. she is a fair, you know, judge, so we're going to watch how she is. >> she is. elizabeth: good to see you. >> good to see you, liz. elizabeth: coming up former i.c.e. acting director ron sit

worse for everybody else. if they are infected it is causing problems for the entire community. a single district judge should not have the kind of authority who regulate people in custody, especially if they already had due process. better to have them released. it is compounded in california because it -- elizabeth: it's a sanctuary state. ron, here is the other thing, they have criminal records. why aren't they immediately deported? they are convicted for things like assault with deadly weapon, battery, child cruelty, violating protective orders involving domestic violence, disorderly conduct, driving without a license, drunk driving, false imprisonment. why are they not, five dozen of them have final orders to be permanently removed from the country but they're still here. they're released back into the communities. you know, you wonder why you

know, more lawsuits are not brought against the state, against the counties in california and the municipalities and in the state of california for allowing this to happen? >> yeah. this is a problem. immigration process and people going through courts, even when they have final orders it is not over until it gets all the way through the due process. that is a problem as it relates to timing but you're right, it is compounded in california because these cities and states are forbidden to assist i.c.e. with people in custody. many will go out and reoffend and pick on immigrant communities. they are picking on immigrant communities they're trying to protect. immigrants are preyed upon by these individuals. elizabeth: you know i.c.e. has been arresting dozens and dozens, if not hundreds of criminal illegal aliens across the country. over 95% of those illegal border crossers, who have been arrested, they had major criminal convictions or pending criminal charges at the time of

their arrest. so, you know, so this is, it is unclear why california is discuss not not fixing the problem, deporting them? i understand it takes a long time for cases to wind through the courts, but you wonder, the california voter and the immigrant who came here the legal way, they got to, this feels so unfair? >> i agree. i agree. that is why you have to have strong borders. you have to have an immigration system that has integrity. interior enforcement removing criminals from streets should be a bipartisan policy initiative. these people violated the law coming here illegally. they went on to offend communities which they resided. so the local authorities saw fit to take them into custody, put them in jail. why wouldn't the authorities in the state of california work with i.c.e. to get them removed from the country, have those threats lessened both at the border and what happens in those cities and towns where they're
