know. i have to back up and talk about the congressional investigations. it is never conclusive and they are always easily dismissed. they are critical compared to investigations. i put a lot of stop working with a criminal investigation divisionst of the irs and hopefully the fbi to drill down and find out exactly what we have heren rather than the 30,00 foot level really knowing on a very detailed level where this money was going and why wasn't it reported. ecagain, what did they expect in return? foreign corrupt practices act or foreign registration act. >> let's show the details of what the information, we have another fullvi screen we want to show the viewer about. what is swirling around hunter biden. we have the southern district o, new york, the securities unit looking into hunter biden, you know, finances as well. again, potential criminal probe,

it is also potentially a tax probe saying we reported last night prosecutors potentially probing how the chairman of that energy company in china paid hunter biden with a 2.8 ^-caret diamond in louisiana. there is a lot of moving parts here. where do you think that it goes next? >> keep in mind a tax probe is a criminal probe. kind of spreading out information that they are looking at as taxes. that can be woefully and complete. it could be a lot more. what i am concerned about, information came from biden's camp in a way of dampening the impact ofth something that comes later. two-three weeks now there is a possibility of a biden christmas gifts. soft terms to a tax charge that enables this to be put into the rearview mirror and also has the effect of completely suppressing the rest of the investigation. i am a little nervous that that

is where this could go. whether we will see an indictment or a soft plea in the next couple of weeks. it potentially ends all of these inquiries from a federal prosecution point. >> that is what senator grassley and thompson keep hammering home. the guy has since gone missing. heon had been complaining abouta deal to take a 14% stake in the russian company. another hunter biden associate charged with allegedly trying to bribe government officials in uganda. and then his other business partner devon archer was convicted on unrelated fraud charges. it feels, senator grassley and ron johnson have been working on this for a year. they are saying that this is a

national security risk. it cannot just be a soft plea for hunter biden, they say. >> i don't think anyone is in favor of a soft plea. i think that there will always be limitations on the political front when it comes to congressmen standinghe up and shaking their fist at the outrageousness of it. from the information they see versus criminal federal prosecutors and what they would be able to see on their own. i do not have a problem acknowledging that there are a lot of people that create a bad picture. the exact type of characters that would participate in a pay for play kind of scheme. the exact kind of countries we do not want to have that relationship with. china, russia, pakistan i think it was or kazakhstan, in a bad way when it comes to the highest reaches of the u.s. government. it certainly looks like that may have been the intention. it may spread beyond hunter.

national security implications. the chinese spy extensive ties with swalwell. you point out that huge government loophole here. what is it? >> you know, it is unbelievable. i work for the house intelligence committee staff. each case had to undergo an fbi investigation every five years,t they looked at my finances, they talk tout my neighbors and found iout who my relatives were. cia a polygraph test and drug test. members of the house and intelligence committee never go through any of this. they get access to the most sensitive secrets just based on being elected. eric swalwell had undergone a routine fbi background investigation. this would have been found immediately. i think something has to be done immediately. we have to make sure members of congress are not compromised. liz: should there be a probe of this? should there be special counseln

looking into this? swalwell was not cleared by the fbi like other members of congress, but he can engage with a chinese spy and he can see top-secret information as a member of house intelligence. minority leader in the house should be kicked off, remove from health's intelligence. what do you say? > i think he should be kicked off. i think congress has to have new rules. let me tell you another issue here, nancy pelosi said in 2015 both republicans and democrats were briefed on this, i think they were briefed on something, but i doubt they were briefed on helping fund this congressman's career andl he may have had a personal relationship or romantic relationship with her. i wonder what was really brief to congress in 2015. information withheld by james comey or did they not know the whole story in 2015? >> the w question is what other

helping recall governor gavin newsom in california. >> politico is reporting that governor gavin newsom's team is really worried about your recall efforts. we have reported on how he said do not do gatherings at restaurants and then he ate at a really fancy restaurant in napa valley. he botched his lockdown speared calling them irrational and arbitrary. he broke his own lockdown rules. now at least eight companies gavin newsom has investigated, they got millions of dollars in loans from the paycheck protection program when it was intended for small businesses. one of them employed 10 times fewer workers than the average small business in the program. we know that they are in a blind trust. what is your take on that story?

>> it just feeds into this narrative that he thinks he is above it. his kids were going to private schools when others could not. he traveled when others could not. he had this big event at a restaurant with many people from many families when he was telling others they could not do that sort of thing. he sits there in his own office making rules and regulations for everybody to live by, meanwhile he is driving restaurants out of business. there is big pushback from small business in the state. it is very bipartisan. with the signatures that we have so far for this effort, it is not a republican effort. it is a very bipartisan effort to push back. quite frankly, we will get the signatures and we will have to call governor gavin newsom on the ballot. liz: all right.

shingrix protects. liz: joining me now is former u.s. attorney brett tolman. great to see you. how do you think the supreme court is going to rule on the texas lawsuit alleging that the for battleground states were unconstitutional and how they conducted their 2020 vote? >> look, it is a different lawsuit than what we have seen. this is a conflict between state. the supreme court is the only court that can hear this. there is more motivating to share the case. it is still an uphill battle. the supreme court has been somewhat reluctant. especially when they have significant standing issues. what i mean by that is there is a question as to whether one state can enforce what is happening in another state. the reality is there are some good arguments.

this is a well-written lawsuit. it is very likely that the supreme court is giving it very serious consideration. liz: we have republican attorney general in six states, missouri, arkansas, louisiana, mississippi, south carolina and utah joining the lawsuit. filing friend of the court brief. it is a challenge based on the constitution. texas is saying that the swing state officials unconstitutionally changed voting rules, but the u.s. constitution only gives state legislature the authority to make changes to the state election law, not state judges, not other state officials. texas attorney general, because the way they conducted their vote undercuts the power of their vote in texas. not sure how that is undercut. that is really the issue. right? >> it is a good argue by the

attorney general in texas. here in essence is what he is saying. the due process clause of the 14th amendment and the equal protection clause are protecting other states that on a national election rely upon the validity of the other states acting in a constitutional manner. he has not necessarily asking for the supreme court to overturn this election but instead look at the unconstitutional effort or rules were passed by those states which now impact their protection in this union. it is a clever argument. liz: it is really interesting what he is saying. in other words, texas is saying we follow the rules, the constitution, these other states did not. supreme court chief justice john roberts and justice elena say they do have the final word and how the state constitution are

risk. many of them have already had their day in immigration court. a single district judge decided it would be better for them all to be released into the community because of the threat of covid or they had covid. you are compounding the dangere --dash. liz: a little bit of technical difficulties there. he is back on. your shot froze right there. i just want to revisit what you said right there. they forced i.c.e. to release more than 250 illegal aliens from a detention city in the state of california. freeing up space because they had covid. >> it is covid related. it was brought by people who wanted them out because of the circumstances and detention centers because of covid. it just makes it worse for

everybody else. these are criminals released into the streets. if they are infected it is causing problems for the entire city. if they already had their due process. better to have them released. it is compounded in california because -- liz: it is a sanctuary state. here is the other thing. they have criminal records. why aren't they immediately deported. convicted for things like assault with a deadly weapon, battery, child cruelty, violating protective orders, driving without a license, drunk driving, false imprisonment. we have five dozen of them that have final orders to be permanently removed from the country, but they are still here. they are released back into the

communities. youou wonder why more lawsuits e not brought against the counties in california and municipalities for allowing this to happen. >> this is a problem. it is not over until it gets all the way through the due process. that is a problem as it relates to that. the cityy and states are prohibitedar when they have dangerous people in custody. many of them will reoffend and pick on emigrant communities. they will be a threat to those very communities that people ary trying to protect. the immigrants themselves are the ones that they will prey upon by these individuals.dr >> isis has been arresting dozens and dozens if not hundreds of criminal illegal aliens across the country. 95% of those illegal border crossing that have been elected, major criminal convictions or
