you've been watching "the evening edit" on fox business. thanks for watching. we hope you have a good evening. join us again tomorrow night. ♪. tomorrow. ♪ lou: good evening, everyone. the question tonight is, just exactly who is in control of the u.s. government. as i am speaking to you right now, we know that a number of countries are carrying out ongoing cyber attacks against various agencies and full departments of the u.s. government. the united states is under a full and ongoing assault but at least three nations -- by at least three nations. of russia is suspected of car arelying out the most devastating cyber attack in american history, and it is apparently getting worse by the day. the director of national

intelligence, john ratcliffe, believes russia, iran and china interfered in the november election as well. fox news is now told a number of senior intelligence analysts adamantly support the director of national intelligence's assessment that china did, indeed, seek to influence the presidential race. but there is also resistance within the deep state and the intelligence community in particular trying to contradict the dni. there is nothing new in that pose, of course, by the deep state. but because of that resistance, the directorrer of national intelligence has decided to not sign off on the assessment until the intelligence community does make the assessment on china, russia and iran's roles in the election. specifically and clearly. the classified report was due to be delivered to congress tomorrow.

by executive order, that is the date president trump insisted, 45 days after the election. but at least two intelligence agencies say they cannot meet that deadline, and it is now in indefinite delay. more resistance, more delay, more obstruction from the deep state. that delay comes as were gaining a greater understanding of the severity and just how punishing the cyber security attack against 12 of our federal agencies and departments really is. today we learned the energy department and national nuclear security administration which maintains the u.s. nuclear stockpile have found evidence that their networks have also been attacked, and they, those attacks continue. the cybersecurity and infrastructure agency called the attack, quote: a significant and ongoing cybersecurity campaign.

the attack is largely believed by our intelligence sources to have been carried out by russia using software from texas-based i.t. company solarwinds. the cyber attackers, russian intelligence agents and operatives, inserted malware into software updates that solarwinds sends to the government and private sector clients as patches to remove vulnerability. but in this case, it created an opening for foreign actors. in a new statement today, cisa suggested they have no idea how to remove that malware. the intelligence cyber unit within the homeland security department said removing this threat actor from compromised environments will be highly complex and challenging for organizations. for more on all of this, with

turn first to fox news correspondent lucas tomlinson in washington. lucas. >> reporter: lou, dhs says the hack against the u.s. government began back in march if not sooner. dhs didn't name russia as the culprit, but officials say moscow is responsible. quote, as you read a littling bit, lou, this actor's demonstrated patience, operational security and complex trade craft in these intrusions. removing this threat actor will be highly complex and challenging for organizations. a sign this hack might not be stopped anytime soon. senator rick weighed in a short time ago. >> if russia's going to do these type of things against our system, then we ought to be very agrandsonnive to make sure that, one, they get no benefit out of it and, actually, they're harmed occupant of it. you can't just say, oh, please don't do it again. >> reporter: tom bossert, former homeland security adviser under president trump, writing in "the new york times" about this attack, quote: the

magnitude of this ongoing attack is hard to overstate. the russian svr will surely exploit to gain control of the networks it considered purity targets. the hackers will have long ago moved past their entry point, covered their tracks and gained what experts call persistent access, meaning the ability to control networks in a way that is hard to detect or remove. the pentagon appears to have avowedded any harm to their network, they say there is no evidence of compromise in their systems. little bit of good news there, lou. lou: it is. it's news that personally i can tell you i have great doubts about because every expert we've talked with thinks this is the most severe attack in our country's history. were not responded to those private -- we have not responded to those previous attacks, and as senator rick scott was saying, lucas, it doesn't sound like -- as he is urging a response, there doesn't sound like there will be much of one. your thoughts?

>> reporter: senator scott was very clear, he said in the past there hasn't been a responsive course in the past, iran or other countries have hacked into the united states. it took some time to kick them off the system. one of the biggest problems that officials that i've spoken to is how do you kick russia or new other adversary off america's networks, it's are hard, it's very difficult. however, in the past the u.s. has struck back. remember stuxnet is the back iran's nuclear program, lou. lou: one of the rare instances of known aggression on the part of the united states, an initiative against the nuclear buildup by iran. lucas, thanks so much. lucas tom runsson from washington. -- tomlinson. joe biden today weighing in on the cybersecurity attack against america. he said in a statement, quote: i will not stand iewdly by in the face of cyber assaults on our nation. in 2015 during the obama/biden white house, however, the

personnel data of 4 million current and former federal government employees was stolen by hackers. the fb with u arrested a chinese national then suspected of creating malware used in that breach in 2017, did absolutely nothing about it. joining us now to take all of this up, former senior state department adviser, cyber security expert morgan wright. i have -- i don't recall a single time previous to this in which the u.s. government has said this is a grave, grave attack on the united states, and they make it clear that the department of homeland security, that they have no capacity to stop it. your thoughts. >> yeah, lou, anytime you call a meeting on saturday of the national security council, it's serious. i mean, this is almost like a prelude to war. so what you were just saying earlier, what you reported on, not only were the government agencies hit, we've got

companies like lock heed martin, fireeye, very good cybersecurity companies being targeted by this malware. i think a lot of this -- now, they were in the system for nine months, lou, but it took several months of preparation. this very well could have started after the 2018 election, after they were kind of sue lent during that time. -- silent at that time. they knew we were going to be looking at them for the election, so they took a different tack, and instead they attacks the one system, the one company that had over 300,000 clients, many of those government clients and very significant private sector clients. lou: you're talking about solarwinds? >> yeah, solarwinds. they have over 300,000 customers worldwide. only a small portion, 18,000 were affected. lou, 18,000, my goodness. we're talking 18,000 companies, many of those like you were just talking about, the nuclear agencies, we've got the treasury, we've got, you know, many other government agencies, w got private sector companies that do defense work, lockheed

martin. this is not something you say, oh, you know, it's just a minor if thing. they exploited the trust mechanism that every company relied on to deliver these updates to patch the vulnerabilities. instead, they were introducing new hidden vulnerabilities. they said, no, the updates were secure. they were securely delivered, but they contained a malicious payload e that allowed them to exploit. we don't know how many, it could be hundreds or thousands of companies. lou: those companies, all of them part of the military industrial complex, all of them in the federal system with access to, as we've already been told, the nuclear stockpile which means in this instance also very likely it means that our national laboratories have also been compromised. the fact that it's ongoing and that everyone is acknowledging at least those who are speaking that there is no fix here,

quote-unquote, and that the right now foreign actors are in control of the u.s. networks and systems, the u.s. federal networks and systems. there's no other way to read this, is there? >> no. they already told department of energy, look, you're on your own. we don't have any band buttedth to be able to -- bandwidth to be able to support you with. we don't even have the number of people it takes to respond to this. and, lou, i will tell you, this has a lot of hallmarks, the trademarks of what russia did to ukraine december 23, 2015, when they land. ed the black -- launched the black energy malware. this were practicing this in other areas. this is their kind of trade craft, but there's another thing, the military calls it ipb, russia by getting into the nuclear agencies and our government and, as you said, the military industrial complex, they are assessing our capabilities, our strengths, they're looking at where's the u.s. going, what can they really

do, and the ferc, they contain -- they don't regulate the energy transfers, but they know where all the soft spots are, all the vulnerabilities are. russia now has got the entire playbook if they want to, for example, how to talk down the u.s. energy -- take down the u.s. energy grid. lou: and there was a change of dock run the in the obama administration -- doctrine in the obama administration, i believe it was 2015, in which we declared as a nation that a cyber attack and described, certainly, would be a perfect fit with this situation, that it would be considered an act of war. what in hell is the u.s. government doing waiting to respond? >> you know, it's -- i hate to say it this way, but even though we have all the good ideas, you know, two days after 9/11, 24 hours after 9/11, we knew it wassal dude. we could assign at trucks. what's going on, who's affected, what's affected, what kind of

steps should everybody be taking, but then to stop folks like china, russia and iran, you've got to hit back. they've got to unleash u.s. cyber command even more, let general knack sony take his cyber or troops and go on the offensive and start teaching some of these folks there is a price to pay if you attack the united states. lou: or there is, alternatively, the other possibility, that we simply lack that capacity and would have to respond in the physical world, not the virtual to this attack and make the punishment -- i don't know how you would make it other than, you know, absolute destructive force in any way sum metally call to this assault on our systems. this is a cyber attack of, well, of nightmare proportions. and apparently, dimensions and longevity. your thoughts as we wrap up here, morgan. >> yeah. the russians are contesting this. before when you would find a bad

actor in your system, okay, you caught us, we're out of here. this time they are contesting the ability to remove them. that's why this insertion into the updates for solarwinds, it is so hard. you cannot simply rip and replace all this soft war, it's either shut it off or cut it off, and neither one of those is a good alternative. lou: i also want to put a point on one thing too as we wrap up here, morgan, and i appreciate your time. we just heard from the former head of cisa that this was the most secure election in our country's history. this is the very same intelligence organization in cyber who had no idea that there had been a yearlong, it looks like at least a yearlong, attack that is still ongoing, and we're listening to him say this was a secure election? are you kidding me? if this is the situation we're in right now with the entire

federal government, what in the world are we to think of the evaluation of this former e head of cisa on secure elections? i mean, that would be a light effort compared to what they're doing right now. am i wrong? >> you know, it's been reported that dominion voting systems also was a client of solarwinds, so you start looking at where did the russians go? what could they have done? you say that it's the most secure election was it's based on what they did not know, and to your point, we had this campaign going on for at least nine months if not longer penetrate thing some of the most sensitive areas of our government. they snuck in right underneath our nose. it's like finding a burglar in your home that has been loving in your house for nine months. this is beyond tragic, and with don't even know the extent of the tragic. it will take weeks, months before we truly realize how bad the damage is from this attack. lou: well, this is an intelligence, cyber command, it

lou: breaking news now, and this ought to make your blood boil, the fbi refuses to brief the house minority leader, kevin mccarthy, on congressman eric swalwell's ties to a chinese spy. mccarthy tweeted this, quote: i have asked the fbi for a every briefing on respective swalwell's ties to a reported spy from china. twice it has been scheduled, twice it has been canceled by the fbi. swalwell is a national security liability. this is too important for the fbi to continue to stonewall. well, so much is too important for them to stonewall, but stonewall -- [laughter] they continued to do. our next guest sits on the very same house intelligence committee as does eric swalwell. he's also been briefed on the

cyberrer attack being carried out by russia against our federal departments and agencies. it's an attack that also breached los alamos' laboratory defenses, that, by the way, the national, the national repository of our nuclear stockpile designs and secrets. it also may have been an attack that has now are vealed to the russians -- revealed to the russians and other perhapsal lieus in this attack -- allies in this attack on the ways in which they could disrupt our electricity grid. joining us now, congressman chris stewart. as i said, a member of the excellence -- intelligence committee. congressman, great to have you with us. and i should start by saying congressman stewart is a great american for whom we have great respect here. of give us your sense, to the degree that you can, the proportion, the extent of the

damage that is apparently ongoing and that has, as best we can inventory, already been done? >> yeah, here's the bad news. it's bad. the worse news is we don't know yet how bad, but we truly don't know an inventory yet of how deep or broad this goes. we know as you've with indicated that it's into our department of energy labs, los alamos, one of the most sensitive information in the u.s. government, but we don't know where this ends. i don't think this should surprise anyone, lou. i mean, look, this is an e -- enormous challenge for us, but with you said something earlier, and it was so insightful and something i wanted to reiterate, and that was i've been an advocate for years now of we allow these foreign governments to attack us through cyber means with impunity. i mean, we never enforce any sanctions or any repercussions because of that. and because of that, there's no

downside for them. so they push and they push and they push. and, look, i understand, i've talked to some of the smartest people in the world about this. i understand there is a downside when we punish them, but i think there has to be a cost. you look at the opm breach, 22 million americans' records taken from which the chew news were able to discern -- chinese were able to discern incredibly sensitive information. look, i'm not suggesting we bomb russia, of course, but there should be a price to pay, and too often there just isn't. i just think we have to fundamentally relook at that policy. and then the second thing i'll mention very quickly, when anyone stands up and says, the example you used, this was the most secure election in u.s. history, there were no breaches by foreign governments, if you say something that defin tufly about anything regarding cyber, you're simply wrong because we just don't know. so you can say we don't think there was a breach or we think this was a secure election, but the truth is you never -- and you can't preserve anything as

100% secure. and if you do, then you are messing with security. lou: yeah, and we have too many examples in our recent history of massive cyber attacks whether it be on opm, whether it be against the energy department, the agriculture department even this time amongst the departments as you well know. it is, it's fascinating to hard people speak with such certainty about who the actors were when they don't even know what they've done or where -- >> yeah. lou: -- where they got in and precisely how. we know solarwinds, by all of the accounts from the government, was one of the, one of the ways. >> yes. lou: the difficulty that we face as a nation, we're not in control of our government right now. the bottom line effect of what is going on, as i understand it -- and please, correct me if i'm wrong -- russia could be,

china could be, any number of actors could be in control of our government rather than our duly-elected government. >> yeah. yeah, look, it is an incredible frustration, and it's frightening. it should frighten all americans. and the example that you used, the house intelligence chief is designed and used -- committee is designed and used to provide oversight over the most sensitive in the u.s. government, provide insight over department of justice, fbi or and every other agency who are given, by the way, enormous power. the ability to provide surveillance on new u.s. citizen. and when those agencies refuse to reply or to respond to kevin mccarthy, for example, or to the intelligence community -- lou: right. >> -- as they have done again and again and again over the last four years, how many times have we asked them for information on the original russia hoax, and they stonewalled us, socially, not for months, not for years, forever. they never provided some of that information. how in the world do you tell the

majority -- or the minority leader in the u.s.house, cell phone mccarthy, hey, sorley, we had something come up. we can't come down and brief you on eric swalwell, we're a little too busy today. that's outrageous that they would cothat. now, to do that once, maybe, but to do it e again and again like we've seen? the arrogance of it is just incredible to me, and they just fundamentally don't understand that they work for the american people, that they have to respond to the american people. they're not an entity unto themselves. lou: and the committee is chaired by a gone straited and -- demonstrated and proved liar, we'll just saw his name, adam schiff, who lied in so many instances of the assault -- >> yeah. lou: -- the resince dance of the left against this president. it's outrageous. congressman, we thank you for being with us, we appreciate it. please come back soon. congressman chris stewart. up next, president trump responding to growing calls for

attack on the united states -- >> yeah. lou: the united states government, our federal government. it is ongoing, it is pervasive, and we have idiots walking around talking about it's a hack on national. [laughter] -wing media -- national left-wing media. this is an outrage and an affront against the nation, is it not? >> absolutely. and this began, in many ways, four years ago a. i've been saying for several years now that people like john brennan, james comey, andrew mccabe compromised u.s. national security. they made a laughingstock out of this country when they attacked and ran an operation against the president of the united states. and the fact that as of yet no one has paid a price, it's shown it's not as if our add adversars do not read the american press and they don't understand what's going on. that's what's made us vulnerable. it's the u.s. national security establishment that has made us vulnerable to these unprecedented attacks.

lou: i'm stunned when i think about the chairman of the joint chiefs of staff getting involved in nonsense. and publicly are contradicting the president of the united states. bringing into question the strength of the command structure of the united states military. i'm furious when i watch the chairman of the intelligence committee lie his teeth off and not be held accountable even by the milquetoast left-wing media. and then to watch mr. krebs, the former had of cisa, say it was a perfectly -- the most secure election in american history, it's absurd. as we are watching u.s. military secrets of all kinds, fortune 500 companies under assault and no one knows what to do about it. in effect, right now if russia is the principal actor here, the enemy is in control of the u.s.

government. >> right. remember what happened in july of 2016 according to documents declassified by dni john ratcliffe. john brennan briefed barack obama in july 2016 that the russians were aware of hillary clinton's plan to vilify trump as a russian agent. and, again, the russians were aware of that, the russians were aware that the the fbi played along. the russians were also aware that john brennan used that as the basis for husband intelligence community assessment for at least four years. foreign add very sauers have noun that our intelligence services are not serious. it's not a deep state, it's a clown show. and that's whew our adversaries are taking advantage of it right now. lou: indeed. the election, right now we see so many people with so little regard for the possibility that

it was an election with integrity. it's stunning where we are right now as a nation. what would you, if you had the president's ear right now, what would you suggest to him? >> well, i would declassify as many documents as possible, i would wrest them from the hands of the director of the cia, the director of the fbi. i think that's very important. from my perspective, i get that special counsels are important, but i also believe that a biden doj would get rid of these special counsels immediately. finally, the american people deserve to have some sort of clarity, some sort of transparency about what's been going been going on for years. we will not be protected by our national security establishment. we have to figure out different ways how to protect ourselves. lou: well, it's clear that we're not being protected right now by either the defense department or our intelligence community. >> absolutely.

lou: breaking news now, officials inn bay, wisconsin, reportedly solicited a million dollars from a voter advocacy group backed by

facebook ceo mark subor burg. that would be the amount necessary to conduct illegal voter drives. according to "just the news" reporting, the city filed a grant questionnaire with the center for tech and civic life. that group given a quarter of a billion dollars by mark zuckerberg and his wife in september. the direct point? to influence the outcome of the election, of course. attorney phil kline says that grant application shows private money used to fund partisan political activity. he calls that a violation of the constitution. and that should mean that it's a crime. we'll find out. john solomon, editor-in-chief of "just the news," best systemming author joining us tonight -- selling author joining us tonight. john, shouldn't that be a crime? >> well, to be determined, right? it's clearly a violation of the constitution when you talk to the legal experts. why that? the election officials in green bay are charged being neutral

arbiters of the election. the election judges, the election preparers, the election executioners. and when they get into the business of doing get out the vote registration drives, they're moving into partisan activities. and you see in these documents we obtained under a freedom of information act request that green bay wasn't targeting all voters for registration the, they were targeting minority communities that they believed would be beneficial to the democratic party. and that's the sort of thing we don't want -- lou: so what do we -- >> the yeah. lou: so what are we pus su -- pussy footing around about? this stuff used to be called walking around money -- >> yeah, right. [laughter] you're exactly right. lou: it's illegal as hell. yet mark zuckerberg, a billionaire, multibillionaire, one of the world's richest men, can just throw a few bucks in the direction of a group like that and if have his way. i mean, this is an obscenity.

>> it is. lou: the elections are rife with corruption and fraud. now, we don't know the extent of it. you know, for crying out loud, shame on me, i don't even know if there's a single election voting machine in the country that's been certified by the federal government, do you? >> we're going to have -- lou: i don't know. >> they aren't certified by the federal government, the question is, is the certification any good. we've got another foia tomorrow about lou, dominion voting machines in the state of georgia. you're going to find out they had a little problem about four or five days before election day that required some last minute scrambling. i know you're going to be shocked by that -- lou: i am shocked. >> -- we've got those documents under foia. more to come. believe, suing the federal government for being fired -- >> yeah. lou: -- fur such -- i mean, it's ridiculous -- [inaudible conversations] >> yeah. listen, he should have been paying a lot more close to the russian meddling that that went on in our own national security. forget the election. national security was breached in a major way. this is a pearl harbor-style attack, and this guy must have been asleep at the switch. lou: yeah. i'd say the whole bunch of them are asleep at the switch. i mean, look -- i mean, the august fbi, cia, the intelligence community, i mean, what are they paid for, to subvert presidents? to try and run a four-year effort to overthrow him? these people are appalling, absolutely disgusting and americans have every right to know what in the hell is going on with an election and what we're getting for our money if in this intelligence, with this

that's a-e-r-o-trainer.com. lou: vice president pence today rallg voters in georgia. the vice president called for georgians to send david for due and kelly loeffler back to washington -- david for due. and joining us tonight, vernon jones, democrat of georgia, state respect ty. he's been courageous in the husband support of president trump. and, vernon, it's great to have you with us. this, a lot of people are asking, as i've been, what do georgians expect to happen in this race if they haven't reformed their election protocols and changed anything? are you confident in the integrity of this runoff election? >> well, let's be clear, we demand a fair, free and transparent election. the people of georgia feel that way. already the gbi's doing

investigations on possible fraud. the secretary of state finally, with a push from the voters, is doing an audit with the signatures. you're seeing more more people feeling like if they don't vote, then the left will win, so they are determined to go and vote. and having senator loeffler and having senator perdue there, they are the ones who are holding the line in georgia. so goes georgia, so goes this country. and so there's too much at stake. socialism, as a matter of fact, defunding police and other issues like raising taxes, school choice. and so i think georgians know what's at stake, and the country knows what's at stake. lou: yeah x. if two new states. we would have the state of puerto rico and the state of d.c. we would have how many people on the supreme court, would it be 12, would it be 24? we don't even know. the issues are pretty, pretty profound, aren't they? >> well, it's scary. can you imagine with joe biden

being there and a democrat house and senate, antifa, black lives matter would run this country, our first and second amendments would be trampled all over, you'd see the courts stacked so they can go farther and farther to the left. you would see a nightmare. this is not the country that we were born and raised in, this is not what our framers of our constitution intended for this country to be. and so, lou, i am very serious about this. we are working hard. and when you see stacey abrams and others who have worked with the secretary of state and closed doors, back room deals that really put us in this spot, with would not allow this to happen anymore. and i'm sure when they meet the second monday in january, this state and many other states are going to take action as it relates to what laws should be to address the mail-in fraud and the abuse that's taken place there as well as other things. i'll give you an example if, right now when someone registers to vote in georgia, they could be registered to vote somewhere else in a different state.

do we have a national database so we can see if someone is registered in a different state before we register them in georgia. the president was right, there were some serious doubts with the mail-in ballots, but more importantly the american people are right, because at least half of them feel as though this has not been a free and fair and transparent election. and in the african-american community, their folks have been us enfranchised because they have not had an opportunity to have their votes be counted fairly as well. there's too much at stake here, clearly too much at stake. lou: and the fact of the matter is this the president has reached out to the minority communities across the country, african-americans, hispanics and more and more minorities have voted for this president and supported him. he's done something for the republican party that everyone told him would be impossible and that is to go out and make this

a much bigger and broader base for donald trump, the 45th president of the united states. it's really the trump party right now, the republican party. >> well, this president has come up with a great playbook that everybody can succeed. it doesn't matter what your color is, your agenda, whatever. if you're willing to work and want a job, if you want to start your business, small business, or expabd it, veterans, he hooked out for veterans not only first responders, our military, this president's been on target, even standing up to foreign countries, building the wall, doing those things, keeping our taxes low, cutting taxes that inspired growth. this president has been about results. i am fearful with ark oc, nancy pelosi, chuck schumer and joe biden at the helm, you're going to see, again, our first amendment being taken away from us, our first amendment, i should say, protecting our second amendment. but you're going to see more influence from china and those foreign countries because joe biden is not strong enough to

stand up to them, especially when he's been doing back room deals with him and his son hunter receiving funding, money. and i'm against stacey abrams. let's be clear about one thing. she has been working with antifa giving antifa money, george soros money. i would not be surprised if she's not getting foreign money to influence this election. i'm telling you, they are desperate. they'll do anything to win, and that's why in georgia we have to hold the line. we have to make sure everybody dose out to vote. if we don't vote, we lose to the.
