governments that are under such an attack. these are the agencies and departments that are under attack as well. as you see there, the treasury department, commerce, the national institutes of health, cybersecurity and infrastructure which is a agency that is supposed to be an intelligence agency in cybersecurity working within the department of homeland security. both have been attacked in this, in this's -- in this espionage, the d. of state, the department of defense, the executive office of the president, for crying out loud, the postal service, nuclear security administration, los alamos national laboratory, other national laboratories as well, but los alamos is critically the, it is the nexus of our nuclear weaponry.

the federal energy regulatory commission, the office of secure transportation, at least three states, the office of secure transportation responsible for the secure transportation of nuclear, nuclear weapons and nuclear power itself. and one of the nation's largest companies, microsoft, notifying us they've identified at least 40 of their customers that have been targeted in the ongoing cyber attack. microsoft says that number will rise, quote, substantially. this cyber attack is, of course, astounding, it is alarming, and it is ongoing. and equally disturbing, we still don't know the full extent of what all has been infiltrated, what has been stolen or for how long, in fact, this attack has been underway, how long the

enemy has taken control of systems and fuels within the federal -- and files within the federal government in particular but also fortune 500 companies and wall street. we will talk this evening with the former head of the defense intelligence agency, former national security adviser to president trump general michael flynn. we'll also be joined by former senior state department adviser and cybersecurity expert morgan wright. now, this massive cyber attack comes as we are gaining a somewhat deeper understanding of the communist chinese party's intentions, its espionage and disinformation and influence campaign in america. beijing, we do know, has a targeted american lawmakers with their spies for years. in some cases, for decades. targeting d.c. insiders as well

accusations that have been made against him. it's used to get to me. i think it's kind of foul play. lou: we'll have more on the hunter or biden investigation, the latest in the battle for the white house this evening. we'll be talking with former independent counsel kenneth starr, pastor robert jeffress joins us all with us later in the broadcast. our top story this evening is the ongoing cyber attack against the united states and against america. we've learned today that the attackers used a number of entry points and methods of entry beyond the software updates that were pushed to clients, for example, of texas-based company solarwinds. in a statement, the cybersecurity and infrastructure security agency says this, quote: it is likely the adversary -- the adversary, not

the enemy, the add very share, mind you -- has additional initial access vectors and tactics, techniques and procedures that have not yet been discovered. can you imagine an agency responsible for the security of this country, its cybersecurity and infrastructure, could put out a lame message like they just did? imagine a pearl harbor, suddenly the intelligence agencies of the united states saying this is going to be a very difficult, difficult war to deal with, we're just going to have to figure out what's going on. this is outrageous, what we are watching in the way of a response from the federal government. the cyber attack has left very little confidence among citizens that we as a nation are in control of our own networks, have knowledge of what is happening on our internet which

is undoubtedly rethe battlefield not of the future, but of the present. president trump hasn't been seen in public since last saturday's army/navy football game. he hasn't tweeted about this attack, nor has he sent out any statement. husband deputy press secretary -- his deputy press secretary brian morgan stern today offered this response to a question about how the united states plans to retaliate. >> president trump has made clear, well, i'll reiterate sort of what i said earlier which is that the federal government has stood up interagency groups, there are incident response teams, some of the lead agencies include the fbi, dhs, odni and the nsa. ambassador o'brien, the national security adviser, is convening meetings daily if not more than once a day, and he has been in the situation room working with the experts across our government to mitigate the

effects of any incident and to make sure that our country's secure going forward. and we will not forecast any kind of action that we may take to combat our adversaries and sort of tip them off, so we wouldn't have any comments on that. lou: that is what you call pure balderdash. they don't know what's happened. they have very little idea of what to do, apparently, and they're putting out lame statements whether it's from the energy department or from the white house press office that will satisfy no one. acting defense secretary chris miller today met with the president at about 3:30 this afternoon. absolutely nothing has been divulged about what the two discussed. congress is also taking up the cyber attack against the united states, and some members are comparing the attack to a declaration of war. fox news correspondent mark meredith is in washington and has much more for us.

mark? >> reporter: lou, good evening. lawmakers have plenty of questions, also plenty of outrage over this cyber attack showing how vulnerable american computer systems are, as you've been mentioning, so many questions left to be answered. earlier this week lawmakers started to receive briefings from top officials about a what has been going on behind the scenes, but they also said there's still a lot they don't know. as you mentioned, illinois senator dick durbin saying this is essentially a declaration of war by russia. we also heard from senator marco rubio of florida also on the intelligence committee saying this is a major concern. we're also hearing tonight from republican senator susan collins of maine. she put out a statement about all of this kind of getting to the point, i thought it was interesting. this cyber attack, likely perpetrated by the russians, spotlights the glaring vulnerabilities of our federal cybersecurity system. the president should immediately sign the ndaa, the national defense authorization act, not only to keep our my tear strong, but also because it contains

significant cybersecurity provisions that would help toward future attacks, that ever sis on future attacks. the chairman of the house armed services committee says the solarwinds cyber operation bears every hallmark of cybersecurity that can undermine our national security and it is imperative that congress move forward to understand the root causes of this campaign. we're hearing from lawmakers not only demanding more information, but also wanting to know what else can be done to stop this. we have not heard from president trump on camera or on twitter about in this cyber attack. there's been a lot of questions about whether or not he would weigh in or not. you heard from the white house spokesperson, but these questions, lou, you can bet are not going to go away as lawmakers want to know is there another attack coming and what else is vulnerable. lou. lou: do you think, mark, the lawmakers -- you mentioned susan collins, others -- have any understanding this is an ongoing attack? it isn't something where you sit around and twiddle your thumbs

and talk about the possibilities fill so farically -- philosophically of suggestion months, a year from now? this is an ongoing existential threat to the united states, and we have elected officials and officials of this government acting as though -- i don't know. i'm stunned by the fact they're not being transparent and reporting to the american people who have a right to know the dimensions and the proportions and the energy of this highly kinetic attack on the united states. it may be cyber, but make no mistake, this is war on the united states by an enemy. how does that escape our elected officials? that's a rhetorical question, mark. my question -- >> reporter: well, lou, i was going to say the one factor -- lou: will the me finish just for a second, mark, then, please. have we received any information about our forces being put on high alert? have we had any indication of

any kind from any source that this government has moved to respond, to react? >> reporter: well, you're asking about what's happening behind the scenes, but there's a big x factor and why you're not hearing from lawmakers, why you don't see people like me chasing people in the hallways, and that is because of the pandemic. right now there are just few or people around washington and those institutions. so many other people working remote. so maybe you're not hearing from people directly are. but the other factor, lou, you've got the government facing another shutdown at midnight tonight, you've got the stimulus talks with the coronavirus as well as the vaccine being rolled out. of course this is important, but you imagine how many different priorities are being juggled here, so trying to keep the eye on one ball not easy. a lot of lawmakers realizing just how bad this attack is. lou? lou: mark, thank you very much. an excellent job of reporting. and as i said, this is -- it has all the earmarks of being an

he doesn't seem concerned about what is the worst attack on this country, a cyber attack that is, well, right now we don't even know the damage that has been done and is still being done. clapper took the time to say that the principal challenge that transcends all others, apparently including this one, is climate change. we wonder why we've had so much trouble from our intelligence community with gifted minds like that working at the, as the national director of intelligence. our first guest this evening is the former national security adviser to president trump, former director of the defense intelligence agency. joining us now, i am pleased to say, is general michael flynn, a great american, and we appreciate your time, general. this, this attack, your seasons seasons -- your sense of it, how for vasive -- pervasive, and

what are the dimensions and how concerned should every american be about our government and our country? >> well, i mean, a all of these cyber attacks that have occurred have occurred from in most cases foreign influencers. lou, can you still hear me? if i'm sorry. lou: i'm sorry, we're having trouble -- you're back up here, general. apologize for the -- >> well, what i would say about, what you would say about the sew landwinds is that solarwinds is an entry point into the rest of our entire u.s. critical infrastructure. so everything that touches the united states government if you entered through this solarwinds attack that we received, you now have access, you have, basically, you have keys to the vault, and you're inside of the, you know, you're inside of our home, and you're able to rummage around and do damn near anything. so it's a very, very serious attack. i would say on one hand, okay?

on the other hand, we cannot be distracted because this attack, with now, i believe, we've known about it for about six months, the way i understand it. so when we talk about our election security, lou, i think this is all part of it, because there is a relationship between this solarwinds attack which is basically penetrating our entire critical infrastructure as well as our election security. so we have to look at everything that we're doing, and we have to, you know, everybody's got to talk a deep and back up and say, okay, with all of the egregious behavior that we have seen on our election security, we cannot stand for foreign influence which we have direct evidence of foreign influence. we also have evidence now from other countries, other foreign partners who have evidence, in fact, they were watching the attacks on our election system, our election process on the

3rdrd of november -- 3rd of november, and there are willing to provide that directly to the president. so we now have that evidence, and we received that today. very, very important. so there are foreign partners and allies that are moving to help us, but this foreign influence against our election security and into this solarwinds system is really, really dangerous. and more has to be done. lou: well, let's take this in some order. first, in terms of the breadth and the urgency, the immediate threat is, without question, this attack on the united states government. and i understand the use of language like infiltration, cyber security attack as if in some way it's not an attack if it's a cyber attack. but the reality is we don't know the damage, we don't know what agencies actually have control of their systems, we don't the

know what has been compromised, we don't know what to do about it according to the -- and this comes from the agency, some of the agencies themselves. they have no idea how to rid themselves of the malware. there are reports that fbi agents are walking away from their computers because they're beyond repair or ree mediation. >> right. so, lou, what we're really talking about is we're, we are in an information war and probably the principal nemesis is china. this is an information war. they are masters at it. we, we believe we're pretty good, and i do believe we're pretty good. we have certain capabilities to be able to sort of block and tackle in this information warfare domain that we are fighting within. there has to be biggerrer decisions by the president of the united states. he's going to have to -- he should pull in the director of the national security agency, he should pull in the director of homeland security, the director

of defense -- or the secretary of defense, and he needs to pull these people in immediately and basically get from them what is it that's happening, and what do we need to do, what decisions does he need to make. and it is all related, because this is not manager that just happened this past weekend. this has been going on for months. this has been going on for months -- lou: by the way, general, we're told that this may have been been going on for years at this level. >> yeah. lou: and the damage is not even right now, the united states government can't even estimate the damage or the, tent of the infiltration or what has been taken out, exfiltrated, by then hu. and why don't we call these people the enemies? these are not cyber attackers, this isn't just foreign influence, this is a damn enemy of the united states, is it not? >> right, it absolutely is. i mean, absolutely, lou. we're not -- these are no longer competitors or, you know, equals. these are threats to our

national security. these are direct threats to our national security. and we're talking about -- because we know we have evidence of foreign influence in the election, and that goes, and in this case you're talking countries like china, countries like iran, countries like north korea, like russia. these are adversaries that want to basically dominate with their ideology this country. and we cannot kid ourselves any longer and play games in this world of cyber attacks and act like it's just some video game. this is real stuff. they are stealing our intellectual property, they are stealing our designs, they are stealing the innovation, they're stealing damn near everything from this country, and they're going to use it against us in some capacity whether it's in, whether it's in trade, whether it's in duh proposal city or whether it's -- diplomacy or whether it's against us military to military. it's very, very dangerous. the decisions that the president

♪ lou: we're back now with general michael flynn who's been gracious enough to wait through these commercials to continue the conversation. the general has just told us that other countries' intelligence agencies have been, were watching our election on november 3rd and have important intelligence to share with the united states. general, how soon can they provide that to the united states? >> well, i think that they'll provide it directly to the president once we present the evidence to him and to the, you know, through the legals process that we have. and they're more than willing to do that, from what we understand. in terms of these cyber i attacks, you know, this is -- we talk about foreign influence like it's some i esoteric thing.

lou: right. >> this is a direct intervention into our national security, into our ability to run our country the way we want to run it. this is -- when we say a cyber attack, that's exactly what it is. it's like any other weapons system that is attacking us, only in this case it's through information, it's through deception, it's through theft of that information. lou: right. >> so we have to really take this seriously. i think that as a nation, i think a couple of things. so what to do about it, i think the team around the president needs to shore themselves up. i think that the political camps that we have in this country need to come together on this, because this is a very, very dangers situation. we're in a dangerous period of time right now for our country. and i think that, i think that -- in fact, you would say that i know, i know that americans, the american people are more than willing to support whatever the president decides to do in this regard, because we're talking about the safety and security which is the

the insip cent point or certainly how to end it. your thoughts. >> yeah, you know, you put me in a tough position, lou, great insight from general flynn. just don't stand there, do something. get the message out, start doing things. look, there's been at least updates, i've been following the alerts and notifications coming out from cisa, we're starting to find out new things about what was going on, it appears the solarwinds software is not the only way they were able to steal information. we're starting to see things about some of the sophistication that were planted into the software that was -- it add had a time delay on it, lou. you put it in this there, and then a lot of these organizations, they put what they call a sand box around it. they look at it, it comes in, it makes suring nothing bad happens. this thing waited 12-14 days to get into the optional environment. so following up on that, the fact that just this one as% alone means we have no idea where this is right now.

we need some clarity, some guidance to say here's what we know, here's what we're doing about it, and at some point i think this is so big you're going to have to get some resources from dod to remediate, find and fix, because cisa is overwhelmed. there are just not enough bodies to do what needs to be done. lou: cisa is a joke, morgan, in my opinion. the words coming out of that office are ridiculous. they have -- this is the same agency that said the election was secure. they have, they seem to have no idea in hell what they're talking about. am i entirely off base on that? >> you know, they were, they were ready maybe to do disaster planning, this is cats few planning. i mean, we're well beyond what a single agency like that is even capable of handling. you're talking about the skill set needed from a leadership standpoint. so i mean, yeah, we've got a lot of work to do, lou, probably for the next 2-3 years. lou: amazing.

a part, mark lanier, one of the nation's leading trial lawyers, is very, very pleased to be outside counsel to the state of texas. we intend to move this forward very quickly. lou: well, i sure hope that you can do better -- [laughter] do better than the department of justice. it seems absurd. you testifying this week that the presidential election was an unprecedented use of mail-in ballots and have given rise to a number of questions. are you saying it was outright fraudulent? >> there clearly was fraud. apparently, the appearance of fraud. there were so many irregularities, and so what i think senator ron johnson, the chair of the senate committee on homeland security, rightly said, called upon people in both parties, have an open mind. let's now reason together and explore what happened. there's very troubling testimony, as you know, lou,

from both the state of nevada and from the state of wisconsin. so not all questions got answered during the five weeks of the litigation. that's been enormously frustrating. we do know because jimmy carter and secretary of state baker rightly said 20 years ago almost this use -- lou: right. >> -- of absentee ballots is really a recipe for fraud. so you need additional safeguards. this year those safeguards were taken away in all too many instances. lou: ken, let me ask you this, or we've got just about a minute here. >> okay. lou: what should the president do here? the supreme court is running from this. they look like, i don't know what the legal term for coward is, but they're behavinged -- behaving badly. there's been not a single evidentiary hearing in the country despite the fraud you're speaking of. what should he do? >> well, ooh i'm not going to

give the president advice, that's for sure. i think we've already heard he's called on senators to follow on senator tuberville's lead. we've moved from the legal front to the political front in this sort of final debate, we're looking at the january 6th joint session of congress overseen, presided over by the vice president of the united states. and there, there may be some dramatics and some fireworks, we shall see. but we've moved, i think, beyond the legal framework into the political framework. lou: yeah. ken starr, thank you for being with us. always a sober and clear mind on the issues that frustrate us all. we appreciate it. thanks so much. and a great attorney. there are lots of opinions about the integrity of the election, the irregularities of mail-in voting, of election voting machines and voting software. one of the companies is smartmatic, and we reached out to one of the leading authorities on open source software for elections, eddie perez, for husband ine sight and

views -- his insight and views. eddie is the global director of tech development at the open source election technology institute. we with we asked him for his assessment of smartmatic and recent claims about the company. >> have you seen any evidence that smartmatic software was used to flip votes anywhere in the u.s. in this election? >> i have not seen any evidence that smartmatic's software was used to delete, change, alter anything related to vote tabulation. >> smartmatic says its software was never used outside of l.a. county in 2020. do you know whether or not that's true? >> that is my understanding. smartmatic functioned as the contract manufacturer for the los angeles county voting system, and that was a customized system that was effectively built to the county's order. i am not aware of them having any orr direct customers -- other direct customers, relationships with officials in the united states. >> what about smartmatic and

dominion? do you know if they're related? whether one owns the ore? whether dominion uses smartmatic software? >> both dominion and smartmatic have individually and respectively put out very clear statements from their corporate headquarters, each of them indicating they are independent companies, there are not related to each other. it is my understanding that neither one of them has an ownership stalk in the other or anything like that. they are, again, for all intents and purposes, two completely separate companies. >> have you seen any evidence of a connection between george soros and smartmatic? >> i'm not aware of any direct connection between george soros and smartmatic. it is my understanding that an executive at smartmatic has some sort of relationship with one of soros' foundations. that's the extent of my knowledge. >> have you seen any evidence of smartmatic sending u.s. votes to be tabulated in foreign countries? >> no, i'm not aware of any evidence that smartmatic is sending u.s. votes to be tabulated in foreign countries.

again, i'm not aware outside of los angeles county of smartmatic tabulating any votes in the united states because i'm not aware of them having any customer relationship ares in the u.s -- relationships in the u.s. and secondly, as others have pointed out, you are respective of which -- irrespective of which voting technology vendor we're talking about, in the united states the ballots that are cast in the united states are tabulated in the united states. >> are you aware of any instances in which smartmatic's technology was banned in the u.s. in 2020 due to security weaknesses or wrongdoing? >> i am not. i am not aware of any instances where smartmatic's technology was banned in the u.s. again, it is my understanding that outside of one customer in los angeles county, smartmatic has no presence in the voting technology marketplace in the united states. to support a strong immune system,

really available. this is nothing but great news so far. your thoughts on it. >> absolutely, lou. you know, the bible teaches that god created government to protect its citizens. and, sure, human nature has corrupted government, but it still does some good things, and this vaccine is a great example of that. we are grateful for president trump whose leadership forged a relationship with private business, and they've created this vaccine which will bring healing to millions of americans. and i really believe we ought to view these vaccines as early christmas gifts from god, not some tool of the antichrist as some conspiracists are suggesting. this is great news for america. lou: and we've heard some pastors are saying to their congregations not to take the vaccine. very quickly, a thought for those pastors? >> well, some of them i know, but i would say two words: it or

[laughter] god promotes healing, and if you value life, you'll take these vaccines. lou: and the number of churches we're with hearing about, so far it's just a few, but they're talking about reparations, raising money? >> yeah. lou: the church and reparations, that's a peculiar, it seems to me, an odd juncture. >> yes. they're paying millions of dollars in reparations. and look, lou, racism is a sin, we all agree with that. but the basic premise of christianity is we aren't responsible for other people's sins. we've got enough of our own to be worried about x. there's really only one person in history who can pay for the sins of others, and he's the one whose birth we're going to celebrate next week at christmas. lou: well, next week at christmas, you know, that's approaching rapidly, and it's nice to hear you talk about the
