currently under attack we know that at least three state governments that are under such attack, these are the agencies and departments that are under attack as well as you see there the treasury department, commerce, the national institutes of health, cybersecurity and infrastructure which is the agency that is i supposed to be an intelligence agency andse cybersecurity workg within the department of homeland security. both have been attacked in this espionage, the department ofnt state, the department of defense, the executive office of the president for crying out loud, the postal service, nuclear security, law solid must national laboratories, lost almost is critically the nexus of our nuclear weaponry.

the federal energy regulatory commission, the office of secure transportation at least three states, the office of secure transportation is responsible for the secure transportation of nuclear weapons and nuclear power itself. one of the nation's largest companies microsoft notifying us they identified 40 of their customers that have been targeted and the ongoing cyber attack, microsoft says the number will rise substantially. this cyber attack is of course astounding, it is alarming and it is ongoing and equally disturbing, we still don't know the full extent of what all has been infiltrated, what has been stolen and for how long this attack hasas been underway, how

long the enemy has taken control of systems and files within the federal government in particular but also fortune 500 companies. and wall street, we will talk this evening with the former head of the defense intelligence agency, former national security advisor to president trump, general michael flynn, we will also be joined by senior state department advisor and cybersecurity expert morgan right, this massive cyber attack comes as we are gaining a deeper understanding of the communist chinese parties intentions, it's espionage and disinformation and influence campaign in america. beijing we do know has targeted namerican lawmakers with their spies for years. and in some cases for decades.

targeting d.c. insiders as well as elected officials, chinese agents pervasive throughout wall street, the fbi which is supposed to be aware of such instances and investigate such matters seems to instead been acting more of a weapon's political tool of the democrat party. rather than a national security agency defending this country. one of the d.c. insiders targeted by the communist chinese member of they, democrat party is eric swalwell, swalwell the target of chinese communist in a relationship with a chinese five, thefb fbi today briefed house speaker nancy pelosi and houseno minority leader kevin mccarthy on the incident. let there be no confusion, the national security of the country is in grave, grave danger,

russians roaming undetected in our computer networks since at least march of this year, many suspect it has been for years. the communist chinese have solidified their positions of influence at washington state capitals, academia, corporate board rooms across the country, although that is even placing more scrutiny on joe biden and his involvement with his son hunter biden's business dealings in china. fox news today obtained text messages, messages that clearly show hunter biden's former business associates were pushing to get joe involved in a joint venture with the chinese owned energy company. joe biden however, says any investigations of his son are simply unwarranted. >> we have great confidence in our son, i am not concerned

about any accusation that has been made against him it is used to get to me and i think it is felt play. lou: we will have more on the hunter biden investigation the latest of the battle of the white house this evening, will talk to former independent counsel kenneth starr, robert jeffress joined us all with this later in the broadcast. our top story this evening is the ongoing cyber attack against the united states and against america. we have learned today that the attackers used a number of entry points and methods of entry beyond the software updates that were pushed to clients for example a texas-based companyny solar winds, in a statement the cybersecurity and infrastructure security agency says this, it is

likely the adversary, the adversary, not the enemy, the adversary has additional, initial access vectors and techniques and procedures that have not been discovered. can you imagine an agency responsible for the security of this country, the cybersecurity and infrastructure could put out a lame message like they just did, imagine at pearl harbor, the intelligence agency saying this is going to be a very difficult war to deal with, we will just have to figure out what is going on. this is outrageous what we are watching in the way of response from the federalrn government. the cyber attack has left very little confidence among citizens that we as a nation are in control of our own networks, have knowledge of what is happening on our internet which

is undoubtedly the battlefield of the future but of the present. president trump haven't been seen since army-navy football game, he is not tweeted about this attack nor has he sent out any statement, his deputy press secretary ryan morgenstern today offered this response to a question about how the united states plans to retaliate. >> president trump has made clear, all reiterate what i said earlier, federal government has put up inner agency groups and incident response teams, some of the lead agencies include the fbi, dhs, odie and i, and the nsa, ambassador brian the national security advisor is d convening meetings if not more once a day and he's been in the

situation room working with the experts across our government to mitigate the effect of any incident and to make sure our country is secure going forward and we willil not forecast any action that may come back or adversary and tip them off so we would not have any comment on that. lou: that is what you call your delderdash, that entered they don't know what is happening and they have very little idea what to do apparently and they are putting out lame statements whether the energy department or the white house press office that will satisfy no one, acting defense secretary chris miller met with the president about 330 this afternoon, absolutely nothing has been divulged about what the two discussed. congress is also taking up the cyber attack against the united states and some members are comparing the attack to a declaration of war.

fox news correspondent mark meredith is in washington and has much more for us. >> good evening lawmakers have plenty of questions and plenty of outrage over the cyber attack showing how vulnerable american computer systems are as you mentioned so many questions still left to be answered. earlier this week lawmakers received briefing from top officials about what's going on but high in the scene but they also said there's a lot they don't know as you mentioned durbin saying this was essentially a virtual declaration of war by russia and we also heard from senator marco rubio and intelligence committei saying that this is a major concern, were also hearing tonight from republican senator susan collins of maine she putme out a statement getting to the point, i thought it was interesting, she said the cyber attack likely perpetrated by the russians with a glaring vulnerability of her cybersecurity system and the

president should immediately sign the nda, the national defense authorization act not only to keep her military strong but because it contained significant cybersecurity division and future attacks and emphasis on future attacks, determine of the armed services committee says the bears every hallmark of a sophisticated nation-state activity that could undermine our national security and it's imperative that i congressman forward to oversight to understand the impact and root causes of the campaign, were hearing it from lawmakers not only demanding more from to know more information but what else can be done to stop this, we have not heardou from presidt trump on camera or twitter about the cyber attack, there's a lot of questions about whether or not he would weigh in or not and you heard from the white house spokesperson but you can bet these question molds will not go away as lawmakers want to know what else is vulnerable but is there another attackot coming. lou: do you think the lawmakers that you mentioned, you mentioned susan collins and others have any understanding that this is an ongoing attack

and it's not something where you sit around and twiddle your thumbs and you talk a possibility philosophically of six months, a year for now, this is an ongoing exponential threat to the united states and we have elected officials and officials, this government acting -- i don't know i am stunned by the fact that they're not being transparent and reporting to the american people who have a right to know the dimension and the proportion in the energy of this highly kinetic attack on the united states, it may be cyber but make no mistake this is were on the united states by an enemy. how does that escape our elected officials, that's a rhetorical question. >> i was going to say the one factor. lou: let me finish just for a second, please. have we received any information about our forces being put on high alert, have we had any

dimensions and how concerned should every american be about our government and our country. >> all of the cyber attacks that have occurred have occurred from foreign influencers. lou, can you still hear me, i am sorry. lou: i'm sorry werein having trouble, you are back up i apologize for the technical. >> what i i would say about the solar wind, solar winds is an entry point into the rest of our entire u.s. critical infrastructure. so everything that touches the united states government if you enter through the solar winds attack that we received you now have access, you basically have keys to the ball enter inside of our home and you're able to rummage around in judea near anything, it's a very serious

attack, i would say on one hand, on the other handno we cannot be distracted because this attack, we believe we've known for about six months the way i understand it. when we talk about our election security, i think this is all part of it because there is a relationship between the solar winds attack which is basically penetrated our critical infrastructure as well as our helection security. we have to look at everything we are doing and everybody's gotta take a deep breath and back up and say with all of the agreed just behavior we have seen on our election security, we cannot stand for foreign influence which we have direct evidence of foreign influence and we also have evidence now from other countries, other foreign partners who have evidence and in fact they were watching the attacks on our election system,

our election process on the third of november and they're willing to provide that directly to the president. we now have the evidence and we received that today, it's very important, there are foreign partners and allies willing to help us with the foreign influence against our election security in the solarar winds system is really, really dangerous and more has to be done. lou: let's take this in some order, first in terms of the breath inen the urgency and the immediate threat is without question, this attack on the united states t government. i understand the use of language like infiltration, cybersecurity attack as if in some way is not an attack it's a cyber attack but the reality is, we don't know the damage and we don't know what agencies have control

of their systems, we don't know what has been compromised, we don't know what to do about i it -- this comes from some of the agencies themselves. they have no idea how to rid themselves of the mall where and seport the fbi agent are walking away from their computers because they're beyond repair or remediation. >> right, what were reallyre talking about, we are in an oninformation war and probably e principal nemesis is china, this is an information war and they are masters at it, we believe were pretty good and i do believe were pretty good, we have certain capabilities to block and tackle in this information warfare domain that we are fighting within, there has to be bigger decisions by the president of the united states, he should pull in then director of the national

security agency and the director of homeland security and the director of defense or the secretary of defense and he needs a police people and immediately and get from them what is it that is happening and what do we need to do, what decisions does he need to make, it's all related this is not something that happened this past weekend, this is been going on for months. lou: by the way, we are told this may have been going on for years. at this level. in the damage, right now the united states government can even estimate the damage or the extent of the infiltration or what has been taken out, x willn traded by the enemy and why don't we call these people the enemies, these are not cyber attackers, this is not just born influence, ifn, the dm enemy of the united states is it not. >> it absolutely is, these are no longer competitors or equals,

these are threats to our national security, direct threats to national security and we know we have evidence of foreign influence in the election and in this caseko countries like china, like iran, north korea, russia, these are adversaries that want to basically dominate with their ideology this country and we cannot kid ourselves any longer in play games in this world of cyber attacks and act like it'sh a videogame, this is real stuff, they are stealing our intellectual property, they are restealing our designs, their stealing innovation, damn near everything from this country and they will use it against us in some capacity whether it's in trade, diplomacy or whether against us military to military,

it is very dangerous, the decisions that the presidentnt s to make, as i said he needs to call the members of his team in and i believe he's done some of that but there are some he needs to pull in and say guys and gals what is that we need to do right now and i need to understand. lou: if i may interject general. let me just say at 330 this afternoon he was meeting with the head of the department of defense chris miller, he has recalled his national security advisor two days ago because of the urgency of what is happening and they have been meeting as we understand it throughout the day, general can you join us on the other side of this quick commercial break and we could pick up the conversation from there andul particularly about e intelligence of other nations about the security of our own election if you cannot do it, and understand but we would invite you to do so if you can.

they don't even know the dimensions of the damage or the extent of it or the incipient point or how to end it. your thoughts? >> following up with general flynn you put me in a tough position, great insight from him, just don't stand there, do something, get thee message out and start doing things, there has been updates and i've been following the alerts and notifications coming out from cisa we are finding new things about cisa what was going on it appears orion the software is not the only way they got in and that's not the only way they were able to steal information, were starting to see things about the sophistication that the softwarento that had a time delay on it, you put it in the and a lot of organizations put a sandbox around it, they look at it and make sure nothing bad happens, this waited for 12 - 14 days to get out of the sandbox to get into the operational environment so following up on that, the one aspect alone means we have no idea where this is right now, we

need clarity and guidance to say here's what we know and here's what were doing and i think this is so bigav you will have to get resources and help from dod to remediate, because sisera is overwhelmed there is not enough bodies to do what needs to be done. lou: cisa is a joke, the words coming out of the office are ridiculous. this is the same agency who said the election was secure, they seem to have no idea in hell what they are talking about. am i entirely off base on that? >> they were ready maybe to do disaster planning, this is catastrophe planning were well beyond what a single agency is capable of handling, you are talking about the skill set needed from a leadership standpoint, we've got a lot of work to do, probably for the next 2 - 3 years.

source software eddie perez for his views, he is the global detector at the open source election technology institute, we asked him for his assessment of smartmatic in recent claims about the company. >> have you seen any evidence that smartmatic software was used to flip both anywhere in the u.s. in the selection. >> i'm not seen any evidence that smartmatic software was used to delete change, alter anything related to vote tabulation. >> smartmatic says the software was not used outside of l.a. county in 2020, do you know whether or not that is true. >> that is my understanding, smartmatic functioned as a contract manufacturer for the los angeles county voting system and that was a customize system that was effectively built to the counties order, i am not aware of them having any other direct customers, relationship
