mitch mcconnell on all of this. watch. >> thanks to the particular leadership and direction of president trump and secretary mnuchin households will receive a second round of direct relief checks, $600 per adult and per child. this is just some of the aid that will be heading americans way in a matter of hours. no sprawling left-wing wish-list, no unconstrained bailouts for state and local government, with no connection to covid needs, just smart, targeted, bipartisan policies. what senate republicans have been recommending since the summer. david: joining me now to discuss all of this is republican tom reed. he is on the house ways and means committee. congressman, thank you for joining us. this sounds like just a classic, as mr. mcconnell was saying it is a classic deal in congress. a classic compromise where

republicans get some things. they got to take out the state aid for problems that blue states have been in since before covid. on the other hand democrats took out the part that gives, that ends liability, covid liability for small businesses. so everybody gave a little. why couldn't this kind of classic compromise have been done before the election? >> no, i agree with you. this could have been done easily before the election and it is frustrating at that point in time they were putting politics first. they were worried about giving in my humble opinion, the president, president trump a win. maybe thinking thinking that woy the election one way or the other. david: forgive me, let me put a fine point on this, what you're sawing that nancy pelosi purposely withheld the compromise to make americans suffer so they would vote for biden during the election. >> i'm, today we're celebrating. i appreciate that commentary.

this should have been done before the election and i will let the speaker answer for those questions and i would agree with the sentiment. it's a shame we had to wait this long to get this relief flowing but i'm an optimist. i always look at the good what we're working on. we have $900 billion moving out of this town. we were able to do it in a smart, targeted way as mitch mcconnell saved and also did it in a way where we repurposed approximately $500 billion in regards to money that was already in the treasury, already appropriated. so rather than waste that money, you know what? let's reprogram it. so we don't have to waste it. david: let me get it clear then, the fed had received in the first covid package the fed had received about 429 billion if i'm not mistaken of funds that was used for emergency loans. some of it was sent out but they had 429 billion left over. that has been agreed to be repurposed as part of this

900 billion-dollar package? >> correct. about $130 billion in the paycheck protection program money. so rather than waste those dollars, those are hard-working american taxpayer dollars we put it where it needed to go, to small businesses to, people that are suffering with the direct stimulus checks and also making sure that things like the vaccine are distributed and resources are there. that is the ultimate solution to this crisis, getting the vaccine distributed to make covid-19 a thing of history. david: now the small business loan package does that forgive the loans? a lot of businesses say it was nice to get a loan when i needed to it keep my business open. now we have new lockdowns. i can't reopen the business to pay back those loans, will the loans be forgiven as part of the relief package? >> absolutely. pouringal paycheck protection program, individuals talking about being taxed on the original paycheck protection program monies, we made it clear this money will not be taxed,

old paycheck protection money as well as this new program will not be subject to taxation. people worried about the tax bill will not have -- tax deductibility was something we foughthard for in the ways and means committee. working together we made sure small businesses and individuals would not pay a tax bill on paycheck protection program money. david: congressman when you have this money going out of washington there is always pork and that concerns a lot of people. one thing i looked at with suspicion, $20 billion for newspapers, tv and radio. as you know there is some billionaires who own tv stations who own newspapers. i'm just wondering if this is going to lead to bailout for jeff bezos? >> it's a legitimate concern when you have a bill of this magnitude but what we really tried to do, being involved in this in the problem-solvers caucus working in a bipartisan way with the bipartisan group of senators, 50 strong in the house and problem-solvers caucus we wanted that targeted relief.

i'm sure there will be those questions raised and we are scrubbing the bill as we speak. those newspapers, businesses employ a lot of people. we want to make sure people are employed. david: congressman, quickly, as you know there is a new strain of the virus closing down the uk to a lot of countries around europe. we have a lot of flights in new york, i'm sure some are going elsewhere in the united states to london. should the flights be shut down because of the new strain of covid virus? >> it is concerning. i hope public officials will make that call, make it soon. any threats with the new strain of the covid-19 virus need to be nipped in the bud. just like president trump shut down flights from china we should consider that as an option in america. david: congressman tom reed, thank you very much. merry christmas to you. >> merry christmas to you, david. david: markets were up even with the new strain of the covid in uk. even if the strain doesn't come

california.org, we're sending out over 1.5 million petitions. we passed the50,000 mark. these lawsuits are -- 850,000. l.a. admitted they don't have scientific proof outdoor dining cause as problem. so yes, there are places making a difference. david: what kills me, tom, you always hear from democrats, they're there for the little guy. republicans represent the big corporations. here is the dirty little secret to these lockdowns. they are killing the little guys while the big guys, these silicon valley high-tech firms are making out like bandits in this situation. i mean, you know, no fault to them. the fact that they're making a lot of money but there is a 26 billion-dollar tax windfall that's coming from silicon valley in terms of the extra money that they have been making, money going to california. and so, while they're putting the screws on the small buses,

many of whom are going out of business, the big companies, the high-tech firms are doing fine with all of this. >> yeah. keep in mind, i'm a small business attorney and i have talked to client the last thee or four weeks about what do we do? do i go out of business? what do i do about my lease? we have to go through the math. are they worse off staying in business or just going under? as far as the little guy, you hit it with your first guess, this $600 for each person, whatever, why didn't that happen in june? six months later, if you cared about the little guy why did you withhold all that money and hypocrisy you see. this is why people are so frustrated with washington and it is reaching new heights. david: congressman couldn't say it directly but i did. the key is that the democrats wanted americans to suffer more so they could put the blame on the current president in order to win the election. that is what that was all about. that is my own opinion. >> i second your motion.

about a dance. this is not about a gesture. this is about our lives! david: about the future of america. that was ivanka trump and kamala harris in georgia, as both republicans and democrats campaigned ahead of the january 5th runoff. former acting attorney general matthew whitaker. thank you for coming in. i heard optimistic reports from republicans like karl rove for example, on fox news suggesting that based on the 1.5 million early voters, there is some reason to be optimistic if you're republican. do you share that view? >> well let's remember, georgia has traditionally been a red state and you know, i know that we saw some, some, it ended up not being that way for the presidential election but ultimately i think georgia republicans will vote for these

well-qualified candidates, send them back to the senate and let's just hope that those voting irregularities we saw on november fifth are fixed by the state officials and, that we have a clean election this time. david: i hate to say it, i think that is unlikely they will be fixed. look, people are still arguing about the 1960 election you know? and there are reasons to argue. there are legitimate reasons to argue about 1960 and about 2020. and we have to be clear about that. that, some of those probably will be resolved years from now. so, with that cloud, that dark cloud hanging over a lot of republicans that voted for donald trump, particularly in the state of georgia, will that prevent some of them from going out on election day and voting for their candidate in the runoff? >> i don't think so. i understand the president's going back before the election. david: right. >> and so i think that will, he has been, the second time he has been in georgia.

vice president pence has been down there several times. i think ultimately the trump voters in georgia will vote for these two well-qualified senators around i don't think there will be any problem of trump nation staying at home in georgia. david: now we just wanted to put out, i don't want to focus too much in the weeds here but the total mail-in votes, talking about the prevoting, come in at 569,504 total in person early votes, are about 900,000. that is what adds up to about 1.5 million. the fact that you have about twice as many in-person votes as mail-in votes, that is i believe while, some republicans are saying it's good for republicans. would you agree? >> david, nobody told me there would be math involved today. but that being said, i think you know karl rove is a very smart political mind. i know that the ground game for loeffler and perdue is very strong. they're knocking doors.

they're making voter contact. there is no doubt that republicans in georgia, those that are trending to republicans are being activated, they're going to show up and i think there is reason to be cautiously optimistic. david: matt, final question, this concerns something i will be talking to ken starr about in the next segment as well but attorney general, since you heard, acting attorney general, attorney general william barr deciding not to appoint a special investigator for either the biden affair what happened in the elections, do you think that was the right decision? >> well obviously there is a regulation that governs. it requires a conflict and also needs to be in the public interest. obviously bill barr doesn't think that standard is triggered, however, i will tell you in order to insure that those investigations continue to their natural conclusion i think ultimately a special counsel will be needed to be put in

david: joining me now the perfect person to talk about all of this, former independent counsel ken starr. ken, you're more than familiar with the role of independent counsel here. have you seen enough evidence coming out of hunter biden's laptop and all of those email exchanges and eyewitnesses like, former business partner of his, to warrant a special prosecutor? >> let me say, david, the evidence is very serious. it seems to be accumulating. so this is a very serious case but bill barr is continue to be honest and goodness cop. you can all them as he sees them, you can agree or disagree, has not seen fit, note, the key words, at this time to appoint a specs counsel. attorney general barr has great reliance on the integrity of the justice department. something will happen on

january 6. if vice president biden becomes president-elect by virtue of action of congress an reviewing electoral college results at that point in my judgment is conflict of interest will now exist. it doesn't exist right now. it may exist for the acting attorney general, jeff rosen when he comes in. question of timing. david: because you don't have a biden administration in power. as you say we'll all know that the second week of january but according to the biden people, everything is okay. jen psaki, the spokesperson for mr. biden is quite adamant about the fact that he will not interfere in any particular investigation of hunter. let me play a sound bite from her and get your reaction. play tape. >> no decision has been made about who he is going to nominate to be the attorney general. he has been emphatic that that person will oversee an independent department. he will not be discussing an investigation of his son with

any attorney general candidates. he will not be discussing it with anyone he is considering for the role. he will not be discussing it with a future attorney general. david: here is a former vice president who felt so close to his son, hunter, that he was willing to have the appearance of conflict of interest by having him on air force two, fly to china, fly to the ukraine, have his son get off and immediately make deals, million dollar deals. i mean, if he didn't see that as a conflict of interest, i really wonder whether he is going to create a huge barrier between him and the justice, his justice department over investigations into hunter? >> well, we will check, won't we? he has made it very firm through his spokesperson, a very firm commitment. i will not go there. no conversations whatsoever. that means the attorney general, whoever that attorney general is, if a special counsel hasn't been appointed by that time, that winning the first decision.

i think the special counsel regulations will cry out at that time, sorry, mr. attorney general, madam attorney general, guess what you get to do? you get to appoint a special counsel to investigate the hunter biden matter which is clearly going to touch on the president at least as a witness, i'm not saying as a subject, not saying as a target, but at least as a witness. david: again we have to trust president to keep his hands off an investigation into his son when while he was vice president he had no qualms about appearances of real, appearance of conflict of interest? >> he needs to turn over a new leaf. the appearance of -- david: a little old for that, forgive me, no? >> he better turn over a new leaf because the special counsel regulations are absolutely fitted for this kind of situation where there is conflict or appearance of

conflict. i think both exist here. will exist. david: one sign that he hasn't turned over a new leaf his unwillingness to address specific questions. of course a lot of that is the fault of the media. we have one reporter, fox news reporter, peter doocy who is willing to ask questions. let me roll tape of that. get your reaction. go ahead. reporter: did hunter biden commit a crime? have you spoken to your son, mr. president-elect? >> i'm proud of my son. reporter: are you confident your son hunter did nothing wrong? >> i'm confident. >> will you appoint a specs counsel to handle the hunter biden investigation? david: i don't see any new leaves there, do you? >> well blood is thicker than water, so, i don't think we're going to have a confession by vice president biden, yeah, hunter did really wrong things and he is rightly under investigation. so of course we're not going to

get an admission from him. the key is his relationship with the attorney general. whoever that is going to be and is that a relationship with integrity or is that a relationship that will be compromised early on. the jury is out. david: yeah. very quickly, on another subject, we had congressman devin nunes, former head of the intel committee when the republicans ran the house calling for a criminal investigation over the fbi and the doj withholding some text messages from peter strzok, between peter strzok and other people at the fbi and doj. this could have really revealed the details of the whole russian hoax before we all realized it was a hoax. let me just play a sound bite from congressman nunes and get your reaction. roll tape. >> these are kind of the text messages that we've all been waiting for, we knew probably existed, that give the hard evidence that our investigation really needed several years ago.

♪. david: house minority leader kevin mccarthy wants fellow california congressman eric swalwell off the house intel committee over swalwell's ties to a suspected chinese spy. roll tape. >> the intel committee is different than any other committee. this is where america's secrets are kept this is where the individuals are able to know things that other members are not. the one answer that i got out of that briefing was, there is no way eric swalwell should continue to serve on the intel committee. i'm going to request that every single member on the house

intelligence committee gets the exact same briefing from the fbi that i did, because if this individual is sitting on this committee, eric swalwell, they have got to know the background of what has gone on. david: are there others? that is a question i will bring up with hudson institute director of chinese strategy, author of the 100 year marathon, he has written a whole book about chinese, how chinese influence american politics. it is called "the hundred year marathon." michael pillsbury, a pleasure to see you again. knowing how the chinese agents and how they are masters in beijing operate, do you think that swalwell is irredeemably compromised? >> well, i agree with kevin mccarthy, david. that the other members of the house intelligence committee should get this one hour briefing on exactly what happened. you can imagine that the fbi could have entrapped congressman swalwell. instead of being warned off, he could have been arrested and

prosecuted. so that is a very lucky break he got. we don't know the details of what this fbi one hour briefing might be. obviously it is serious enough that kevin mccarthy is invoking a clash now with nancy pelosi. why did she do this? why did she appoint such a junior member of congress to an important post usually discretion and prudence is required of all members. because they don't have security clearances. it is assumed because they were elected that gives them access to secrets if they're on that committee. david: it's a very, very select committee. they usually appoint people with years of experience in foreign policy. this guy had none. zero, zero experience in all dealing with intel material, how people gather things, certainly not what he should not be doing if he is member of that committee. but it leads me to question, to ask you, how could he in just a second term with no experience, get on this committee? could the chinese have influenced his ability to get on

the committee somehow? >> well the chinese overall strategy for influencing american politics and american congress is to focus on getting people early so that they think the right thing about china. they don't see china as a threat and cultivate them over many, many years. so that seems, it is possible. i don't know. i haven't had the fbi briefing but it is possible that he was directed or it was suggested to him by the chinese that he could help to be on that committee. it is a strange assignment. he is not really involved in his career with this kind of thing. it's a mystery why nancy pelosi chosen to do this. she needs his vote for speaker t will be a close vote. perhaps more cautiously he could resign from the committee after the election and nancy pelosi as speaker. david: now we know that there have been other edge cents that have been dealing with u.s.

politicians. senator feinstein is the best example of that. she was, she was briefed once the u.s. government found out about it, once our intel found out about it but could there be others and how many others could there be in the u.s. congress? >> there could be others. i think there are two separate categories of influence, chinese strategy works on. classic espionage, getting people to sell secrets. that is criminal offense, 20 years in prison. the other is much more ambiguous, to be an influence agent to help china in various ways give them tips, especially to block legislation that might hurt china. that is quite a few bills now the senators and house members introduced to take extra measures against china, hold them accountable for the virus, for example. david: yes. >> someone like eric swalwell and many others could block that kind of legislation. frankly that is equally important to be good influence agent versus to be a spy, face a

chance of 20 years in prison if you're caught. david: the question of course, what the chinese give in, for that, that help that they would receive by congress. we now have, as a president-elect, a man whose son, whose entire family, essentially, benefited from a reciprocal gift by either the ukrainians or the chinese but specifically with regard to the chinese. this has to be quick, michael. do they believe that american foreign policy can be bought? >> i think they do, david. i think their technique, it has worked very well, they seek out people who already are in favor of china. people who think china is a friendly country. they work on them. they're not going to seek out a you or maria bartiromo to recruit. they're going to seek somebody already writing, talking about how china is a wonderful place and then recruit them. david: it is extraordinary. it is going on at least, at

reminded as i listened that just a few days ago was a tragic anniversary of the assassination of when lui and rafael ramos in their police car in new york city. this is years in the making. we've seen a concerted effort to destroy law enforcement in this country by those who claim to be elected leaders. they're not. they're elected officials with an ideology that is dangerous to our communities because without law enforcement, we lose a critical bond that keeps us not only safe from crime but also keeps us safe whether it is an accident, a medical emergency or otherwise. david: we know that because we know what works and what doesn't work. david, when they got the crazy new bail reform, they call it reform bill through in new york city where essentially letting violent criminals out of jail without bail, we knew it was

going to lead to problems. they claimed it would reduce the prison population and cut down on violent crime. in fact shootings have gone up 94% since then and now you have a rising prison environment as well. >> you know, if you look at this realistically from a common sense perspective which the data bears out there, are multiple causes, multiple reasons for crime as it exists. how could one action, bail reform remove that issue? this is like putting a dirty bandaid on an open wound. the open wound is crime. what we need to do is do everything we can, you remember the days when the broken windows theory was put in place in new york city. you reduced the small crimes, the medium, higher level. you stop that and when you do, you actually clean up before you get to this dirty bandaid which is what bail reform is. david: we went from 2200 murders a year to less than 400.

♪. david: l.a.'s new liberal district attorney george gascon sparking outrage over his far left policies like ending cash bail, lessen charges against violent criminals including child rapists and murders. joining me is l.a. county deputy district attorney john hatami. john, i'm curious, he was d.a. in san francisco. during his 10 tenure there he failed miserably. crime went up even the san francisco mayor wouldn't recommend him for the post in l.a. so how did he get elected? >> thank you for having me. that is a tough question to answer. i mean i honestly don't know. i really don't know.

recently george gascon backtracked on some of the policies he implemented on day one takes office. at that same day while friday in pomona, he told the mother after murdered child to shut her mouth and she was uneducated. can you imagine? this is a mother who, when she went home, can you imagine the despair the hurt of losing her child, plus the hurt of having the district attorney tell her that she is uneducated. can you imagine what she must have been thinking which is, if the d.a. won't fight for my murdered child, who will? so i don't know. i can't answer that question. i think a lot of people are asking that question. the d.a. now said that we don't need special enhancements, we don't need allegations because underlying crimes, serious murders and rapists they serve

enough time, they serve 25 to life, they will serve 50 to life. the problem at that statement, you look at one of his special directives it indicates chide murderers, child rapists, serial killers, he will reevaluate their sentence after 15 years. so any of those individuals, right in his special directive he says he will reevaluate their sentence after 15 years. that is scary. that is scary. david: it is not only scary, it has been totally disproven by experience. it is not as though we haven't been here before. these are regressive. this always bugs me say progressive policies. these are regress serves policies. we tried them in the '60s, '70s, turnstile justice that releases prisoners too soon, that allows the community to be endangered by maniacs and it doesn't work. crime goes bay up. so by the way does the prison population as we've seen in new york, all the promises that

their new bail reform law would lower the prison population and lower violent crime, it is exactly the opposite. so we've been there we've done that. but you know, there ask one question, first of all, there is a question a lot of people have about you, you're the deputy d.a. isn't he your boss? how can you be so critical of him if you're working so closely with him? >> he is my boss but i'm also a citizen. i'm also a person. i'm also a father. i love my community. i'm not, i don't have to bow down to somebody that i don't believe is trying to protect children. i know i'm risking my job but i'm not going to sit idly by while somebody gets released and a child gets killed. that is just not what i believe in. david: have you talked to him? have you explained to him your reasons for dissent?

>> no. he hasn't, like we're like the military. i was in the infantry. and the d.a.'s office is similar. i just can't go up to my boss's office. he needs to come down to see me or come down to talk to me. there is a chain of command. he has not come down to my office. he has not gone through the chain of command to ask to see me. he is not talking to any of my victims t not looking at any of my cases. >> john, we have only 30 seconds, we should mention he was in the army. he is a former cop. what do you think happened to him? >> i don't note. recently through a spokesperson he said i was delusional. he challenged and said i wasn't fit to be a lawyer. this is somebody who has never tied a case. has never had a child on the stand who was molested. who was sexually assaulted. i think there is issue with empathy. i honestly don't know what happened. other than i think, go ahead.
