you both, as always. we thank you for being with us. be sure to join us tomorrow. former independent counsel kenneth starr among our guest. please be with us. thanks for breaking news tonight, it has been a day unlike anything, any living american's ever seen. and someone has played with her life. thousands of prothrombin demonstrators swarming and occupying u.s. capital building just as congress began certifying joe biden's election victory. act lawmakers on both side of the aisle have called a disgrace. it all began not long after president trump books were a large crowd near the white house, still insisting the election was stolen. many, if not most of people in d.c. were peaceable. many others, they were not. apparently they were bored and determined and there was of

course fighting with police. riots were declared, hundreds stormed into the capital. a woman was shot and she succumbed to her wounds in the hospital for some protesters got into the house and senate chamber sprayed one guy raised a fist while seated at the desk, and look at this capitol hill police, guns drawn doors and barricaded to repack text lawmakers are trapped inside. got every angle on this historic day covered print versus go to foxbusiness correspondent edward lawrence for his life at the capitol this evening was so much more. now edward i hear the lawmakers are reportedly expected to restart the certification process sometime this hour. what do you know? back any minute kennedy, they are expected to start literally when the senate and house speaker offices over the chambers have been cleared. what is happening now is the mahogany box that actually contains electoral college certificates husband walked back into the house speaker chamber. we have lawmakers for about the house and the senate going

back into their chambers. they are going to restart the debate where they talk about the objection to arizona. they have about an hour and a half left in those debates or so. and then they will come back together for a joint session on the votes and how that ended up and go forward from there. as you know, took a long time. a few hours to clear the u.s. capitol. he went through all the things that what happened, that police cleared the capital but two hours ago. now they are working on the outside now getting all of the people off the streets and off the ground. now all this happening after president trump spoke to the crowd this afternoon. it's important to hear what he told them to march the capital peacefully listen. >> i know everyone here will soon be marching over to the capital building to peacefully and patriotically make your voices heard. today we will see whether republicans stand strong for integrity of our elections.

but whether or not they stand strong for our country. civic what is lost in all of this is what happened before the u.s. capitol police were overwhelmed by all of the protesters. senate majority leader mitch mcconnell, actually during his segment in the debate on the arizona criticize the objections over it for just listen to what he had to say. >> it would be unfair and wrong to disenfranchise american voters and overruled the courts and the states on this extraordinarily basis. >> they're going to object to the counting of the vote anyway. and in the process, they will embarrass themselves. they will embarrass their party. worst of all, they will embarrass their country. >> now that all happened before the house speaker and senate chambers were overwhelmed by protesters

inside. now the republicans were objecting said the election did not follow the constitution. senator ted cruz you see their sinks six states bypass legislators, for the election to change the election right before happened burden that is unconstitutional. is either done by the governor or secretary of state. in kennedy i know you like some facts to breed the last time this many people stormed the u.s. capital back in 1814 when the british burned it down. back to you. before and edward i heard the capital is loaded with pepper spray and there's residue all over the place can you still smell it? >> i am not action the u.s. m-uppercase-letter and one of the senate building set is next to the capital. but i am told yes, you can absently smell the pepper sprayed the hallway for there is a thin residue on the walls on the floors but you can also see some of the windows that have been knocked out and some the damage that happened in those hallways on the way to the two chambers their pride there is a definitely a

lingering effect of what happened inside the u.s. capital still going on there. smacks i just want to know, what it feel like? read their reporting what all of this stuff was happening? >> yes. i've never felt the tension before kind of happened. i was outside on the balcony here, looking down on the sea of people in front of the u.s. capitol bread you could see them moving sorted in a mass towards the u.s. capital, up the stairs there. and then all of the sudden everything would into locked up and started getting these messages talk about sheltering in place. stay where you are. stay away from the windows because those protesters had come inside the u.s. capitol. very tense moments forgot to tell you i am from washington d.c. and i've lived there number of inaugurations. nothing has ever, ever happened like this following election. so it is certification. kennedy: thanks about you reporting page stay safe and keep us posted on any changes there tonight. thanks so much edward. >> thank you kennedy.

kennedy: as i said lawmakers were in the middle of debating the certification of joe biden and his future presidency when it all began. many of those lawmakers had to put on gas tasks to stay safe by think about that. our lawmakers sheltering in place of the u.s. capitol building with gas masks on. because a violent mold of so-called patient storm the place for joining me now tom mcclintock, he was in the capital earlier today. so tell me about your experience? and is there anything in your personal history you can compare this to? >> oh no. i lifted the vietnam war era. i remember those protest for this was unique. i was listening to the debate on the house floor. there is a general change in the ambience on the floor. more, conversations going on, a flurry of activity and suddenly the security detail came in with the leadership out of the chamber. it was told we were to stay put the capital had been

breached. the next announcement was tear gas have been deployed in the rotunda we should all reach for our gas masks that are stored nearby. i thought that was just an over abundance of caution until i looked through the main doors of the chamber which were frosted. and there were flashes going off on the other side of those doors. that is when it began to look really strange. they quickly evacuated us out of the chamber, as i was moving down one of the tunnels , i could have sworn i heard on the radio's of the police officers as we are passing by going the other way that shots have been fired on the house floor. >> consummate mcclintock hold me on vice president pence is talking we are going to listen and then get your reaction. >> those who defended our capital today. we will always be grateful to the men and women who stayed at their posts to defend this historic place.

our democracy has carried on. the united states and united states congress have faced on much greater threats in the unhinged crowd we saw today. we have never been deterred before. and we will be not deterred today. they tried to disrupt our democracy. they failed. they failed. they failed to attempt to obstruct congress, this failed insurrection only underscores how crucial the task before us is for our republic. our nation was founded precisely so that the free choice of the american people is what shapes our self-government and determines the destiny of our nation. not fear, not force, but the

peaceful expression of the popular will. now we assemble this afternoon to count our citizens voted to formalize their choice of the next president. now we are going to finish exactly what we started. we will complete the process the right way, by the book. will follow our precedents, our laws, and our constitution to the letter. and we will certify the winner of the 2020 presidential election. criminal behavior will never dominate the united states congress. this institution is resilience. our democratic republic is strong.

desecrated. it's windows smashed, our offices vandalized, the world saw america's elected officials hurriedly ushered out because they were in harm's way. the house speaker and senate floors were places of shelter until the evacuation was ordered. leaving rioters to stock these hallowed halls. lawmakers in our staffs, average citizens who love their country, serve it every day, feared for their lives. i understand that one woman was shot and tragically lost her life. we mourn her and feel for her friends and family. these images were projected to the world. foreign embassies cabled home their home capitals to report the harrowing scenes at the very heart of our democracy. this'll be a stain on our

country, not so easily washed away. the final, terrible indelible legacy of the 45th president of the united states, undoubtedly our worst. i want to be very clear. those who perform these reprehensible acts cannot be called protesters. no, these were rioters and insurrectionist. goons and thugs. domestic terrorists. they do not represent america. there were a few thousand violent extremists who tried to take over the capital building and attack our democracy. they must and should be prosecuted to the full extent of the law. hopefully by this administration. if not, certainly by the next. they should be provided no

leniency. when i think many of the capitol hill police and secret service and local police who kept us safe today. and work to clear the capital and return it to its rightful owner and rightful purpose. i think the leaders, democrat and republican, house speaker and senate. it was speaker policy, leader mcconnell, leader mccarthy and myself who came together and decided these thugs would not succeed. that we would finish the work that our constitution requires us to complete. in the very legislative chambers of the house speaker and senate that were desecrated. but we know always belong to the people. and do again tonight. but make no mistake, make no mistake my friends, today's events did not happen spontaneously. the president who promoted conspiracy theories that motivated these thugs.

the president who exhorted them to come to our nation's capital, ed them on. they hardly ever discourages violence and more often encourages it. this president bears a great deal of the blame. this mob was in good part president trump's doing. incited by his words, his lies. this violence in good part is responsibility, his everlasting shame. today's events certainly, certainly would not have happened without him. now january 6 will go down as one of the darkest days in recent american history. a final warning to our nation about the consecration of a demagogic president. the people who enable him.

president's conduct over the last 24 hours i probably should not comment on any further until i calm down but i can type this the people who started the capital are not the folks that i know back home who supported the president these past four years. violence in the pursuit of political goals is the very definition of terrorism. the people who stormed the r-uppercase-letter tears they're not good people. and i think that this is an opportunity for all americans to come together and condemn this disgraceful act. this attack strikes at the most sacred act of our democracy. that is the peaceful transfer of power. ever since i was a little kid in grade school they kept hammering it into us. one of the things we're proudest of is americans is the peaceful transfer of power. what happened today was outrageous, it was a threat the most fundamental principles as a free people. and it is a wake-up call that we cannot go any further down

the road that we have been on. kennedy: how much of what has happened over the summer, we sought riots like this antifa certainly in places like portland and seattle and the occupied zones trying to occupy the federal courthouse. and i was one of the people condemning those riots and the violence. i never condemn protest. i think americans have a right and obligation to protest rate this is not back. when someone loses their life and things are taking over by force, as a libertarian that is not freedom. that is not an appropriate expression. or an internalization about the first amendment is supposed to protect. how much of that has to do with what we are as a country and maybe this to be happening if hillary clinton was president trump how much you think this had to do with this in president in the waning days of his administration?

>> as i said i do not want to comment today over the president's conduct recently because i am so angry about it i'm probably going to say something i shouldn't. but i think the vice president said exactly the right town. as did mitch mcconnell and chuck schumer. i think they were all pretty much on the same page. i think all of us as americans seem to be on that same page. these were not peaceful protesters these were violent people who desecrated our capital during, as i said the most sacred act of democracy. when we are peacefully transferring power. that is what separated from so many countries over so many years. >> and our country was founded upon and the constitution was written upon rational principle principles. it was completely irrational. i have a hard time seeing that.

our person is never going to be elected president. but i don't see the liberty minded going in and destroying property and inciting violence because their guy or their gal didn't win. what in jamaica today? >> first off, just like you i condemned violence when it came from the left, when it came from antifa when it came in the black lives matter movement. in those very sympathetic to protest against police brutality. i think this country need an overdue reckoning to deal with. that said, today i don't think had much to do other than trauma. i don't think it had to do concerns about recounts, concerns about mail-in voting. i think this is been a long time coming. i think trump has telegraphed his approval of violence over the last five years for he has signal both in 2016 and 2020 he would not accept losing election result. in this age legal challenge

before welcome back. it is the crazy days still going. with got it all for you. what was supposed to happen today before the storming of the capital, lawmakers were gathered inside to certify the electoral college vote from joe biden for the same time both democrats, or declared the winners of the georgia senate runoff election. huge day. even without the riots. and the party panel is back. guy benson, michael starr happens, anthony fisher. so let's talk a little bit about what happened in georgia, guy. we sought the polling go back and forth over the last couple of weeks. the tiny lead shifting between all of the candidates.

so what was for senators perdue and loeffler last night? back turnout. the polling was useless but it came out who is going to turn out there people put in the democrats had a system, they had a machine. and they have unity. the republicans had a circular firing squad they're trying to overcome. it was is a delicate balance of trying to bring some people back from the suburbs, traditional voters to support a guy like david perdue. while not turning off the trump base in georgia making sure they turned out at the levels or at least close to them working back from november. and trying to thread that needle did not work. and i think that, asa problem for republicans now because they are facing a senate minority with camel harris brickner tyson chuck schumer writing the agenda pray that it's very bad parts not the end of the world bad think there's a worse stuff they would not have votes to pass but some of it they will. we worked very hard to try to convince people to turn out

and vote in those elections by the democrats prevailed. i think it is a microcosm of the problem the republican artist country faced with moving forward and a lot of places you take a look at what happened today on capitol hill, think there's very few people who said that is good but i endorse and support what happens. but the folks who were at the rally the stop the steel rally before it went off the rails, that is a lot of the trump base were as you have got a lot of folks in the middle moderate center that are horrified be the whole spectacle. to beat the left its drug and a challenge the republicans have to grapple with for years. kennedy: you're right about that. there's a big division within the republican party, there has been for some time. it has been clips to for a few years by the division any democrat party, michael starr

>> is the kind of violence that conservatives have condemned all year. and all summer. and even into the fall. and yet, here we all seeing this. it was nice to see that the joint session of congress was back in action. as a display that the work of the people's house will not be thwarted. you have to wonder, what happens to this movement? how much damage has been done to the movement that so many people felt a part of? because they had been so disenfranchised from the political establishment. what happens to that now? >> there will always be those who claim to be part of a movement but are in fact drawn to violence. and they have no place in our society. they have no place in the republican party. so i think that is something that is very clear. they think they are republicans they are not.
