>> good to see you. a little more quiet than they were 24 hours when they came to work. lighter than normalor with the amount of people. and a lot of trash folks were cleaning a up. the cleanup phase and the investigative phase. trying to figure out how the folks stormed the u.s. capitol and able to get in. workers cleaned blood off the floors. they boarded up windows that are open. the atf is investigating the two pipe bombs we are talking about. one left at the rnc horde corridors and the others left at the dnc headquarters. listen to this interview on fox news earlier. >> they look very similar suggesting the same person did the rnc and dnc devices at the same time. i do not have information on that ats this point in time. >> the same person.

other devices were picked up around d.c. and also northern virginia, s but confirms those o as real. theon state of emergency extendd in washington, d.c. through the0 inauguration. that allows 6200 national guard's members to be available to deploy around the u.s. capitol and throughout d.c. in the chaos yesterday 68 people were arrested. for people that died in the events that unfolded here. fifty-six officers injured with one who was pulled into the crowd beaten. he is still in the hospital with one other officer. the chief of capitol police has offered hisn. resignation. house speaker nancy pelosi asked for that resignation and again he offered it. lawmakers are pointing fingers. >> you thought you were in the safest building and place on the planet and then chaos ensues and you have the barbarians at the gate, literally, breaking glass,

shaking doors. it did not seemed like there was much preparedness or organized plan. >> and soon-to-be senate majority leader chuck schumer says he will ask for the resignation of the sergeant ativ arms on the senate side. if not given, he will fire him come january 20. back to you. elizabeth: edward, quick question.. four are now dead. including ashley babbitt air force veteran. served four tours. they are b investigating thate right now. it looked like, we saw the video she was shot at close range. goan ahead. >> metro police taken over the investigation on all four of thb deaths. specifically with babbitt. video posted of her jumping through a window. one of the witnesses said they were telling her to back down, get off, get off that windowsill.

you could hear the shot being fired. she was shot in the neck there. protesters were trying to get her to come down off of that window as she was going in. again, they did say that there was a warning that went out, come back, pulled out, get off that window and she did not heed that warning. elizabeth: okay. edward lawrence, great to see you. thank you for joining us. back with us as congressman greg steube. congressman, it is good to see you. we spoke with you last night. your reaction to today's events. are youe confident washington is now safe and secure? >> well, it was this morning. some of the buildings were still locked down, unusually locked down for and they typically are paired. much quieter. they still had blocks cordoned off withee police vehicles. you did not see a lot of people walking around. you saw a lot of people that took partt where at the airport. they had to disperse back to

whatever state they came from. much different place today than it was yesterday. >> the question is how it is allowed to happen. how did the authorities not know when hotels were rejecting people. what else are we not prepared for. we have tim ryan chair of the panel say what transpired was the failure at capitol hill. they had a comprehensive plan to keep congress safe. wet don't want to second guess the cops. howw do they get so overwhelmed. why did they let people go? why did they let them go in other riots? >> videos of officers getting to the point where they felt overwhelmed and they let people through doors. the barricade got pushed over very easy. officers up on the barricade. the d.c. mayor said she activated the national guard two days before.t why in the world wasn't the national guard there when they knew when everybody was arrive. they knew when the crowds were

going toou be there. as a precaution, if you would have more manpower, they would not have b been able to be pushd over the crowd would not have gotten to the point where they were right outside the capitol doors and there were too many entry and exit points, too many windows from all the capitol police to try to manage. the capitol is a place with tunnels go. it becomes veryfi difficult to secure it. when youou have people at the front chamber, that is definitely a failure of whatever precautions they put in place. we certainly need to look that the left has learned to ensure safety is that something like this could never happen again. >> the u.s. attorney is asking why were people detained. we have seen riots since the spring. why washe there no swat team or

other specialized units in front ofof the capitol? questions are being asked, congress is saying they will look into it.ri we have critics saying this is not patriotism. this is next level. what happened in the spring with the riots is terrible. with the media and democrats downplaying riots that left billions of, hundreds of millions of dollars in damage to property, small businesses. dozens of people killed. people are t frustrated that tht happens. this is next level. s this is an attack. htwhat are your thoughts about that? >> this summer we had resolutions t on the floor condemning mob violence when we saw the cities being attacked across the country. democrats refused to bring that resolution. condemningon the violence, condemning mob violence. it went against their base which is black lives matter and antifa. they want to defund condemned tr

the progressive left talk about defunding the police when it was actually the capitol police that stood between them and people getting an that capitol. as i was walking up to the capitol as all of to unfold,to they were bringing the units to the front which was a west side of the capitol at the time where they had already got through the barricades. that tells you they did not have enough manpower prior to people even getting there. which means to me they were not fully prepared. they were not allowing members to leave to go back to their offices. they were not allowing us to leave anywhere which means we were all trapped. either in the house chamber somewhere in the capitol complex. which i also do not think it is a wise choice when you have all of these tunnels. members are safer in their offices. multiple doors that keep us in there. we have security measures. communication devices in our offices. you certainly do not want 435 members of congress all in one place when the walls get broke down. elizabeth: we arere showing thiz footage of how it began.

this video that you see right now on cameras how it started. we also have this. we have conservative columnist, former house chair trey gaudi saying it started when the president told supporters to go to the capitol, tell congress do the right thing. you have to show strength. senator tom, crenshaw, multiple individuals condemning the president for that. we have nancy pelosi, chuck schumer invoked the 25th amendment, remove the president now. seven oh officials resigning from the trump administration including transportation secretary. congressman, i would like you to listen to senators lindsey graham, rand paul -- right now. take asi lesson. >> heighten tension that everything has been stolen.dy leading to this feeling that nobody believes there is any

the. we saw it with black have to do. if they have broken crimes, they need to be held accountable. i was individual on a flight back with me to sarasota and said that there were antifa individuals that were identified that were part of that aggravate her's and this organization. there was a bus of them that was dropped off. you can see that in some of the video in tactical clothing. tactical helmets. those were people that were dropped off to cause violence. some reports say they were individuals that were part of antifa. until wen know all of the investigation that comes from these people involved in this, people start getting arrested, i think we will have more answers for the american people. this cannot happen in america, at the u.s. capitol or anywhere in this country. >> it is a powerhouse.

chase. make more of what's yours. . elizabeth: okay. let's welcome back to the show former fbi deputy assistant director danny. we love having you on. our demonstrations possibly moving out of d.c. or do you see more unrest in washington coming? we are now tracking 13 states. it is not contained to one area of the country. thirteen states seeing unrest. what do you think? >> i think we will see more of it. we learned a lesson from seattle and portland that it is okay to riot. we have officers there assaulted every night. no prosecutions came out of that law enforcement is important. we have to fund it properly. the capitol police are not. we did not prosecute anybody.

game on. >> we are talking colorado, oregon, washington state, minnesota, michigan, mississippi, oklahoma, florida, arizona california. we are spot checking and seeing unrest. we are seeing in certain states that state capitals have been surrounded. people taking to the streets of los angeles outside of city hall. they went to the governor's house, the governor's mansion in washington state. so, yes, danny, you know, what we are seeing now is the distracting debate in the media. you know, so forth. this is about everything is on. you are making the point that it should have been shut down in the spring. people are really frustrated and angry at what has been happening. >> they are frustrated and angry. they are frustrated about these shut down things we are seeing. people cannot go to church. they go to walmart.

they do nothing about these homeless camps. infested with all kinds of serious diseases. they don't do anything about that. they come back and say, but you cannot go to church. the frustration level is higher than i have ever seen it. we need to get rational. do things appropriately. people that violate the law, we need to come down on them like a ton of bricks. the right or left, it doesn't matter. the united states attorneys have the courage to do that. elizabeth: the issue is that leaders need to step up and allow people to vent their frustration and acknowledge it. the media needs to acknowledge her frustration. it is not excusing it. it is not moral equivalency. what happened in d.c., they should throw the book at them. throw the book at everyone that riots. let's watch a retired u.s.

they permanently kicked the president off their platform? >> elizabeth, it would be a dangerous precedent that we are setting here. here youou have the leader of in on twitter saying that israel, an entire country should be wiped off the face of the earth. that twitter account is still up and it's not locked out. you have elements of the chinese government saying the coronavirus was invented by the u.s. army and that is why it is killed millions worldwide. that sort of tweet still gets left up as well. you either get to be completely consistent which is impossible in terms of who you will band, opt out, not allowed to use your platform anymore or you allow free speech and allow adults to be adult enough to not buy into whatever they are being sold. elizabeth: even the media says stop the w debates about -- we e saying all riots are bad.

no moral equivalency between riots. the chaos in washington was not formed in a bell jar. it did not come out of nowhere. months f and months of people excusing, often downplaying the riot, looting, arson and vandalism that took place in the spring to the fall. what are your thoughts on that? onn this debate? >> well, i watch the show and i'm taking your turn. that is exactly right. it is the whole picture. there is such inconsistency. itst is completely intentional,y the way. it is about precedent. we saw a nightly basis in portland, seattle, minneapolis, atlanta, new york, chicago. riots, not really protests. multiple debts. these things were horrible and they should have been condemned from the get go. we are told by actual reporters on the ground that these are mostly peaceful protests while there are infernos going on.

you had one cnn primetime anchor who actually compared antifa to allied troops storming normandie on d-day.. msnbc josé and i'm quoting people get mad, people get sick of it, people are risking covid to say we are fed up. the causes bigger than the virus. this is for standing for something. it is for standing for anarchy. they did not have a cause. that is what we saw during the summer and during that repugnant sickening display at the capitol yesterday. that should be condemned as well. you cannot be defended by that when you did not do anything about it as the media. never denouncing that violence over the summer. >> again, what i you are looking at on camera, this is not patriotism. throw the book at them. you vandalize federal property.

you w are right about chris who said at one point why should we, and i'm paraphrasing, since when did protests become peaceful and polite? this violence is okay because we believe in the cause. no. no violent protest should be accepted in this country whether it is what we saw yesterday or what we sell night after night over the summer. the bottom line, elizabeth, we live in a country that is moderate to right of center. we are allowing the extremes to controlza the narrative. >> you have noted 7% figure where people in the media are saying 7%. 7% that turned into riots. 7% of 7750 demonstrations and protests that turned into riots. you are talking in all 50 states. you are talking 220 violent demonstrations. property damage. two dozen people killed.

i think that there is a universal concern about the united states. the fully functioning ethnic democracy having something like this happen. no one expected yesterday morning that we would have a bloodied day on the capitol that the capitol building would be breached the way that it was. it is surprising to us all. to go to your point, liz, they look to us because we are, i think, a better organized democracy than most of them and we have policies in place that the world at myers. our constitution has been modeled for many of those nations around the world emerging democracies to follow. i understand their concern and their horror because we share it. on the other side, you say, you look at the sweep of yesterday,

from the sheer drama and the bloodied nature of what happened, losing life end members of congress being huddled together trying to be safe. by the end of the night, in the early morning hours, we had done a course correction. democracy worked. the electoral college certified the election. that took place. i think that part of the story is not getting out right now. [inaudible] they are deeply misguided in the end and very quickly. >> do you think it is pretty rich that you have iran, china and russia trying to criticize us for this now? >> no. they criticize us every single day. when their foreign ministries and their spokesmen come out and say the u.s. has an arcade, democratic process, that is what the russians have said or the

chinese have said today that our protesters are like the protesters in hong kong who are actually agitating for freedom. i do not take them particularly seriously because they could not do what we did yesterday which was to certify an election despite the fact that there were protests and confusion. also, our system is so unique. we have 51 sovereigns in the united states. fifty states. below that, localities that are part of the system. the complicated nature of our democratic process is something that i think has been on display in 2020. in addition to all of these sovereigns, we also have a robust civil society. this is what advanced democracy looks like. we have a lot of adjusting to deal. a lot of work to do, but we are still the model for the world and we will prevail with a peaceful transition of power.

mandate? a pretty tight edge. what do you think? hadoes he have a mandate? >> it is not a mandate. the only way you get a mandate is if you have a sizable advantage in these houses. that is not what joe biden has. by way of kamala harris tie-breaking vote in the senate. that is hardly a mandate. the american public clearly very upset with democrats. nancy pelosi lost so much ground. we saw democrats lose ground in state legislatures across the country. a year of democratic party excesses including defund the police and the outright adherence is to socialism desperately hurt that party. despite anything else you heard in politics that is a big story. >> what are we going to see?

it is much harder to pass parties unilaterally. split twice in the last six decades. ballpark this. former spokesperson for hillary clinton, sayingn, they will tryo pack the courts to do things like eliminate the filibuster. weus understand that you typicay need 60 votes to pass most legislation. democrats can try to change the rule. there will be a big fight on that trying to raise taxes through budget reconciliation or do something like obamacare through budget reconciliation. >> one of the most democrats in the country. he definitely speaks for the aggressive aspects of their base. chuck schumer has not embraced this idea that they will get rid of thest filibuster. in particular, joe mansion, the west virginia senator is known more as a moderate democrat.

to launch. we are going to sue the biden administration even more than we sued under the obama administration. they want two thirds under the obama administration. your thoughts on that? >> think about the trump years. how many times did they go judge shopping. find a judge that was favorable to them and get nationwide injunctions. i imagine you will have those that say all right, let's do it. let's play that game. if we can get a judge to lock up the biden administration and its policies, we will do that where it is necessary. on that issue of a mandate, if democrats overplayed their hands, remember what happens in 2010 when president obama and the democrats expended all their political, capitol to ram obamacare through, they lost control of the house.

>> i have not seen senator johnson's proposal. i absolutely believe that if it is done the right way, there should be a truly bipartisan commission not made up of senators and representatives, but made up of citizens looking into this with subpoena power. looking into the election so that all the various rumors can either be dispelled or proven. i think there needs to be a comprehensive look at both the election in 2020 and what the problems are and what the problems may be going forward. we had a very unusual year with the pandemic. itat is very important to people have very legitimate questions about what happened. for example, lower-level officials or judges basically aggregating state statutory law.

all of that is a legitimate issue. it does not mean that by looking into that that you are denigrating the wing of biden. i think that former vice president biden legitimately won the election and i believed that from day one. but, questions, you know, questions need f to be answeredn a path forward needs to be looked at. weet don't want this situation again. elizabeth: there is data out there that georgia reliance on mail-in voting exploded sevenfold spirit we are seeing uncounted votes. custodial questions about the ballot. you are saying subpoena power. what would that do? how would that be used?

them were decided against him based on procedural grounds. nevertheless, there were a few cases where his team was allowed, where they were allowed to litigate the merits and they lost. in one of those cases, the pennsylvania case, they did not even allege fraud. the wisconsin case, the allegations were minor. about the dominion machines and being laundered through offshore , there is not a bit of proof on those. again, i think that there is not a case that has been made at all based upon what i have seen with the election results in 2020 being wrong, but there is nothing wrong in doing a more thorough examination. most of the cases that were decided were decided on procedural grounds against presidenter trump's team and its very hard to gather evidence,
