also rejected the hundreds of allegations of fraud without investigation in the november election and as well the concerns of tens of millions of americans about the integrity of our electoral system and the counting of their votes. in a statement, president trump responded this morning saying "even though i totally disagree with the outcome of the election and the facts bear me out, nevertheless, there will be an orderly transition on january 20. with the assurance that power will soon be in their grip, house speaker nancy pelosi and senator chuck schumer today call for the removal of president trump. thirteen days before the end of his term in office. hardly consolatory and hardly a transition that could be considered gracious and appropriate. these are the two leaders who

said they wanted to heal the nation. they have obviously changed their mind. they do want to remove the president and they do not care by what means, as they demonstrated for the past four years. but now, invoking the amendment or by impeachment, which they tried before, it does not matter to them so long as the insult continues against the president of the united states. as for his part, the president elect today who has called repeatedly for healing, for unity, would not comment on the latest calls to remove president trump. the president elected however deliver what can be described only as a divisive 23 minute long speech in delaware. in which he slammed president trump, shamed the behavior of all of the supporters today, when the focus should have been

those who became a mob, those that swarmed and entered the u.s. capitol building. >> what we witness yesterday was not dissent, it was not disorder, it was not protest, it was chaos. they were not protesters. don't dare call them protesters. they were a riotous mob, insurrectionist, domestic terrorists. it is that basic, it is that simple. lou: well, he has never applied those words to the rioting and looting and violence on the streets of some of america's largest and best known democrat run cities. yesterday's demonstration, 70 people were arrested in and around the capitol building. four people died. three of them died from what

authorities call medical emergencies and the other, of course, shot and killed by a capitol police officer. her name, ashley from san diego california. a decorated 14 year veteran of the u.s. air force that served four tours of duty in the middle east. and the capitol police officer who shot her has been put on administrative leave. it is a tragedy and it will be with us for some time. the president-elect and the radical dems condoned and encouraged civil unrest throughout the spring, summer and some part of the fall, following the police killing of george floyd. back on may 25 of last year. those democrats also refused to condemn the violence a black lives matter that followed the president elect did not say

a word until august and then only to say that such violence was unacceptable. he did not condemn antifa are black lives matter and that deadly violence in the streets of kenosha, wisconsin, portland, seattle, new york, chicago and other democrat run cities, by the way, all were labeled mostly peaceful by the left-wing media on the radical dams as americans, millions of us, watched buildings burn and people killed. does anybody on the left this evening seriously believe the death of ashley babbitt at the hands of a capitol police officer justifies civil unrest for even a few minutes or certainly months afterwards? i do not. i do not know anyone that does, but that is what we witnessed on the part of the left of this

country over the course of the summer of 2020. congressman matt gates last night called out the democrats double standards. not only for refusing to condemn left-wing violence, but also for howling at republican challenges to the electoral college. >> now we came here today to debate, to follow regular order, to offer an objection, to offer a process that is contemplated in our constitution. for doing that we called a bunch of seditious traders. not since 1985 has a republican president been sworn -- when we do it is a new violation of all norms and when those things are said people get angry. if people vandalize your home, it was wrong when thugs went to

senator holly's home. we should seek to build america up, not tear her down and destroy her. i am sure glad that at least for one day i can hear my democrat colleagues call to defund the police. lou: congressman gates putting it absolutely correctly, and my opinion. left-wing activists were at yesterday's protest further brought to light they had none other than at&t cnn. that network interview demand by the name of john sullivan who has a number of videos posted to social media accounts showing thousands of trump supporters swarming the capitol building in d.c. he also has video of the deadly shooting of ashley babbitt. what cnn did not report was john sullivan's radical history. he is the founder of a group called insurgent usa.

insurgents usa, which was formed last year in response to the george floyd tragedy. a group that promoted a "kick the fascists out of d.c. event" yesterday in the nation's capitol. sullivan was arrested. a black lives matter rally in utah. he has also threatened to pull president trump from the oval office back in august. >> what is going on, everybody. my name is john sullivan. i am from utah. my group is insurgents usa. [bleep] pull him out. we ain't about [bleep] waiting until the next election. we are about to go get [bleep] lou: there are other reasons and other grounds that left-wing

agitators were in the mob it may have played some role. there is no proof, but there are possibilities. a video circulating online shows a crowd at one door the capitol and trump supporters shouting that's antifa. that crowd, that crowd, not yet a mob trying to stop a man clad in black clothing with a helmet that said trump on back of it from breaking glass and breaking into the building. in no way does any of that excuse any violence, but it should be investigated and the house speaker today dismissed any notion that any part of the chaos was caused by anyone other than supporters of president trump. >> some of the republicans and they are enabling of the president's bad behavior. they were antifa invading the

capitol disguised. lou: said one of the greatest enablers and supporters of antifa. the house speaker nancy pelosi. extraordinary. facebook, twitter, youtube yesterday censoring the president of the united states. they removed his message calling on the protesters at the capitol building to go home and to go in peace. today, facebook announced it has suspended the president indefinitely. facebook has done that. and facebook ceo mark zuckerberg who donated $400 million to the cause of the president-elect and last year's campaign said this "president donald trump tends to use his remaining time in office to undermine the peaceful and

lawful transition of power. we believe the risk of allowing the president to continue to use our service during this period are simply too great. therefore we are extending this on his facebook and instagram accounts indefinitely and at least for the next two weeks until the peaceful transition of power is complete". zuckerberg's highest and partisan statement coming after the president had already committed this morning to a peaceful transition with his public statement. let's turn for a moment to look at least at the joy on wall street where all three indexes close despite everything going on in our body politic at record highs. the dow up 212 points. the s&p up 56.

across the country, overwhelmingly right of center focused violence here in the nation's capitol and all of a sudden a lot of people have discovered the rule of law. lou: isn't that amazing. >> it is. it is shocking, but not surprising. >> we send several hud hundred hundred officers to support the capitol police when they lost control of the capitol. we began sending them beforer that happens. nonetheless, we have been consistent. right or left come up violence is not protest, it is crime. we stand against it 100% every time. we did it in portland and we did it in washington, d.c. part of the reason we continue to see it go on, to your question, because so many in the media, not you, so many in the media and politics have tolerated it up to now. maybe one of the outgrowth of

yesterday is we all finally agree that violence has no place in political discourse. >> one would think that that would not even have to be set in the united states in 2021. it is outrageous. what we do not know is why we have reached this stage. in am sure there are social scientists working on this. suddenly, there is a reflex for officers and law enforcement to reach forap guns in the nation's capitol. i would have to tell you i was stunned to see yesterday the capitol police draw weapons at unarmed protesters, even those inside. that is, to me, i have to tell you, that is outrageous. for this young woman to be shot, and io believe, i have to beliee it was entirely by accident, but that weapon was out of the

holster and it was pointed notad only at her, but the others that had become members of the mob and their own fellow agents, law enforcement officers and agents right across as you see there. that is not, that is not appropriate police tactics in any fashion, is it? >> that investigation of course is ongoing. ii don't want to comment too much. you never want to get to the use of deadly force. the wayor you avoid that, there are many people who have fought our use of things like teargas. less than lethal methods. now, those are what should have been used at the door and in fact they were. teargas was deployed yesterday, as i understand it. not done effectively or in sufficient numbers to deter a

crowd from becoming a mob. that was a feeling of the leadership there. consequences have been rolling in. two firings of the capitol police today. i want to commend the officers there. we were happy and honored to support them. it should not have come to that. they never should have been breached. the ability to use those other tactics is absolutely critical. a lot of people complaining about the outcomes yesterday, including justte as you did, appropriately, the killing inside the capitol. had other tactics been readily available, had enough officers been there to deploy them, you do not get to that point. it is a part of how you use deay force. using lower levels and sufficient numbers to never get there. lou: my t criticism of the capil hill police officer and their commanders who -- from what i

said, i think that i am inclined from criticism broadly that capitol police or law enforcement. i am saying this straight up from anyone who wants to make something of it, to draw a weapon when they are absolutely unnecessary and to have in the line of fire, innocent, innocent civilians and your own fellow officers is madness. it should have never been allowed by the commander of the capitol police. i have to condemn the capitol police. a police department putting on leave the officer involved in a shooting and firing people who are responsible in the command structure. i give them great credit, do you

as c well?, >> i do. to be clear, this is the speaker of the house. i condemned her in the past for her comments against police officers. she is the one that fired these two. agree. this is an appropriate step to make. this ise what we do with leadership. you put too much pressure on those officers when you fail at the frontio line and they make more bad decisions in bad circumstances. the leadership is largely responsiblee. lou: i make it very clear, i am commending the speaker of the house, nancy pelosi. this just does not happen. it is hopefully, a beginning of in this country in the way of which our law enforcement agencies respond and expect to be held accountable

fors their decisions, particularly in command as well. >> great responsibility and great authority at the same time lou: we g are grateful to every single one of them. i want to find out where the intelligence, what the intelligence is saying to you and other authorities and high officials about who was involved, how that mob was created from what was, at that point, a peaceful and orderly protest. there are even moments where you can see where they are walking between the rope lines. they are not even moving out of the rope lines and then suddenly, that has become a violent mob. >> well, as so often happens, lou, what was overly well-meaning hundred peaceful for most of the day.

you have not heard anything about it at the ronald reagan building because there was no problems there. the capitol was the epicenter yesterday, and we all knew that. we protected all the federal buildings. we understood where the crowd was going. it was not like 25,000 people turned violent. it was a very small minority within that crowd that decided that the opportunity presented itself and they would become violent opportunists and commit crimes and be violent. it had all sorts of terrible consequences. lou: we have just 30 seconds. am i correct to assume that there is a vigorous investigation of all the actors? >> yes, there is. lou: good to talk with you. we appreciate everything you do and have done.

lou: first of all, i wish we had even more time, the supreme court had two opportunities to stop all the violence, to stop and i think create an opportunity had it taken on the unconstitutional acts of the number of state governments in defiance of their legislatures. and they, chief justice john roberts declined twice. your thoughts. >> well, the supreme court is very parsimonious as a general matter. article three limits to what is called cases and controversies with a party having standing. i was very sympathetic with the texas attorney general in that effort. the supreme court was unanimous with the three trump appointees likewise agreed that the attorney general did not have

standing. it is tough.ou it is tough to get in the court. lou: it is tough. [inaudible] lou: i don't care what the court said, unanimous, five-four, i don't care, i don't care, they have a role in this government and their responsibility. on its face, you know, some nonsense about what we should see with our own eyes that it happened in pennsylvania. that was illegal what was done. it was unconstitutional. they should have been the court of resort for that contest against what is plainly and obviously unconstitutional conduct. if they can come up with an excuse not to perform, why do we need a supreme court? the hell with it. this is ridiculous. it is. >> take a deep breath. i totally agree with you, by the

legislatures to step in. lou: i agree. >> up to the state legislatures to step in a nun would do it. let's face it, the process that has unfolded here and upset so many people, understandably so it is a project of state legislatures not stepping up to the plate and saying you don't fool with our laws this way. they did do that with bush b gore. w facts were all over the place. lou: is there a quota here we don't know about?u: >> i'm sorry. lou: is there a quota here? one state, two, three, whatever the number is. >> no. i would argue, lou. [laughter] lou: i would certainly not try to out argue you. i will just try my best to understand our legal system.

it failed us, in my judgment. i am hearing you say at least in part you agree with that. >> yes. lou: if we cannot find a way to deal with the efforts, a four year long effort to overthrow a president that was persistent, animated, coordinated and concerted. it began before the president was even elected. and we have watched our courts do nothing. by the way, i am talking about all ofgo the institutions of the federal government and the left got away with this. now they did not have a role in stopping what was absolutely and at least in three instances outright, and outright disgrace and a violation of the constitution. unconstitutional conduct. should the state legislatures have acted? absolutely. but they did not.

what have we learned going forward that can be applied and changed to save the republic? >> i will say this. i think we have to be much prepared to go into court. in my observation, some of our efforts fell short because we just did not have the facts to show and the prosecutors frequently say, you have heard this, lou, there is a difference between what i know and what i can improve. you have too be ready to go. lou: we all know that now. >> okay. be prepared. the boy scouts were onto something with respect to that. the other thing is you have to take these legal roles, which you may not like, into account, but they are the rules of the road. the courts will be reluctant to step in and that is regardless of who was on the supreme court. it goes back to the very beginning of the public. clerks do not want to run the country.

they want those that are elected to run the country. that is exactly what the court said in bush versus gore. now the florida supreme court is changing things. you cannot do that. i agree with you on pennsylvania. that was clear-cut it seems to me. agreeing totally with you on this that the supreme court of pennsylvania and governor of pennsylvania exceeded their powers. [inaudible] lou: yeah. yeah. b he saidd so, but they did not do much. we appreciate it. you are right. you have out argued me as you suggest. now i am upset. not t only with the supreme cout but all the other courts. both political parties and, of course, all of state government and all of the areas in which there was t a high number of questions about their integrity. kenneth starr, you elevate us every time. we appreciate it.
