the capitol. in letter to then acting homeland security secretary chad wolf bowser requested that the department of interior which as you know is over the national park service cancel any and all public gathering permits from now through january the 24th. i just got this in. i want to pass this along to you, elizabeth. a federal law enforcement source tells fox news there is an internal bureau memo from the fbi that warns of plans for armed protests in all 50 state capitols ahead of a biden inauguration. these protests could be on the day or before then according to our source. finally a bit of good news for ohio's jim jordan. today awarded the presidential medal of freedom. another busy day in the nation's capitol. elizabeth back to you. >> great to see you, kevin corke. let's welcome back to the show, good to see you, league eagle jim trusty, former federal prosecutor and former deputy independent counsel sol wisenberg. first to you, jim, your take on

snap impeachment coming from house democrats wednesday. what are your thoughts? >> the whole concept is bothersome. there is lot of vigorous debate we could have whether or not the president did something that is impeachable. ed idea of a snap impeachment is oxymoron. we shouldn't exist. we shunt talk about something that important, that weighty, rushing forward without sufficient too many to explore the evidence to push something on a dime. that is horrible precedent. i think we had a bad precedent last impeachment going forward without a clear crime. the concept of snap impeachment just aggravates that. elizabeth: sol, what democrats led by nancy pelosi is saying that the impeachment step is necessary to insure trump can never hold federal office again and to send a message but you know, we've got jonathan turley saying impeachment is meant to be deliberative. you're supposed to have inquiry looking what happened. what are your thoughts? >> i think that depends upon

what you're impeaching a person for. we all saw what happened on that day, on january 6th and the view of the democratic caucus is that the president basically incited an insurrection. if that is your view that's pretty serious and i think they're sending a signal we can't let this stand and this is unacceptable. now what i don't think is proper, if you think it's bad, go ahead and impeach him. don't try to extort the vice president to do something under the 25th amendment that is improper. the 25th amendment is for mental incapacity. it doesn't apply here. if you're serious about it, don't threaten, do it. elizabeth: jim, d.c. attorney general is looking to incite president trump for inciting riots, but more than half a dozen house republicans writing to joe biden you say you're about unity. if the democrats go forward with

this, this will divide the country. your thoughts? >> i am worried about that. look at the end of the day if there is a high crime or misdemeanor i don't have a problem with the concept of impeachment. i don't think it is that clear at this point. i'm concerned really the impeachment is a form of cancel culture, lining up everyone to see who will be on the right side of donald trump and who is not. and i'm just concerned that it is the type of thing that is unnecessary and divisive at this point. it doesn't for a minute diminish the fact we all felt a sense of horror and depression in terms of watching what happened at the capitol. people assaulted police officers or break or vandalize and break in they deserve the full penalties of the law whether or not their politics line up with mine or not but i don't think you necessarily extend that to the president. he can say a lot of very bad things, maybe dumb things, not necessarily criminal things though. that is what the underpinning of

an impeachment should be. elizabeth: we have 25 terrorism cases investigations. 90 people arrested. republicans are really upset with the president. senator marco rubio, senator pat toomey is saying republicans are horrified what happened. they're saying you know, they trusted the president. they believed in his policies. they didn't like the way he handled this. let's watch judge jeanine pirro, what she said about it. watch this. >> the actions at the united states capitol three days ago were deplorable, reprehensible, outright criminal. these frighten and repulsive actions represent the most significant breach on our capitol in over 200 years. and i don't care what happened in the past or whether those who did it think the election was stolen. that is not discussification. 75 million of us are still angry about the election but we don't

storm the capitol. and stop looking for other people to blame including those dirt bag terrorists antifa. to those of you who did this, you did it of your own will and you will be held accountable. take the veil of politics off. be totally objective. anyone watching this must condemn it. and in the end what was the point? what did you get out of it? was there even a plan when you got in there besides looking like a bunch of freaks breaking windows, carrying off a podium, sitting at nancy pelosi's next leaving a love note with fingerprints behind identifying yourselves with selfies, stealing, damaging property, trespassing, looting? five people are dead in your wake. elizabeth: sol, your thoughts on that, sol? >> well it's pretty powerful.

maybe the first time in my life i fully agree with the judge on something but i think that you have to recognize that this is the crossing of a rubicon. i agree with jim by the way. this is not a crime by the president. it is not, let's put it this way, it is not criminal incitement under supreme court case law. there are other statutes that might apply but it is very, very unlikely but you do not have to have a criminal offense to have an impeachment. all i'm saying it is very clear, it is not an unreasonable position for somebody in the national legislature to say you know what? this is something different than anything that has ever been done. this is a president stoking a crowd up, while we are finalizing a presidential election. while we are counting the certified votes from the state. states. that's something nobody has ever

done before, certainly not a president of the united states. you know, professor dershowitz or turley one of them, i think dershowitz said this would set a terrible precedent but really how often do we think a president will do what president trump did out there? elizabeth: jim what is your response to what sol just said? >> i don't think sol and i are that far apart. i have a different standard what i think should be the basis for impeachment. but i'm not standing here and say i like the way the president reacted or he did the right thing in terms of shutting down the possibility of a riot. there is so much we do not know yet in terms of the actual peoples involvement, the leadership, the communications, the premeditation. there is a lot of things to explore before we reach a snap decision that holds the president accountable when he doesn't overtly say let's go commit crimes. that is where i hesitate. but i'm very concerned like sol is about the overall state of the union when it comes to

♪. elizabeth: okay, let's welcome back to the show young americans for liberty analyst kristin tate. she is a great author and columnist. when you saw "60 minutes" lesley stahl call out house speaker pelosi saying you were obstructing covid-19 relief for eight months. pelosi dodged it, the question, rather. what was your reaction to that? >> well, pelosi has shown she is completely capable reaching across the aisle and that her priority is not working for the

people but harming her political opposition. the fact that she held out on a covid relief bill for eight months is a prime example of that. i mean this bill could have been passed back in july or august when mitch mcconnell was saying that the country needed a relief package, very similar to the one that was just passed but pelosi and her democratic ilk, they held out because they wanted to create bat optics for president trump and the republicans. the american people, they should be furious that their relief was used as political tool. quite frankly, liz, they should be furious the same democrats were cheering on draconian lockdowns for nearly a year that devastated the economy, killed thousands and thousands of jobs and put an untold number of businesses out of business for good. perhaps we wouldn't have need ad 900 billion-dollar covid relief bill of filled with pork. elizabeth: let's watch what

obstructionists and it was a mistake. >> i don't remember anybody saying that. they may have but it isn't, it wasn't a mistake. elizabeth: okay. you see pelosi going for the emotional gut punch, bringing up first-responders but we have the reality. we have the facts, kristin. may 2020, senate republicans said led by chuck grassley a bipartisan push with cory booker we'll get families and the first-responders more money. that is in may. we are also seeing more p p.e. money for first-responders back in the spring. we're seeing more government benefits the senate was talking about for first-responders, for teachers, transportation, good workers health workers back in the summer. they started out with 2.3 trillion. nancy pelosi admitted she stonewalled because she wanted to give joe biden that victory, because the election was quote a

total game-changer. we've got joe biden. now you what you just said they have locked down, shut down the economy. pelosi sat on it for eight months. they're giving joe biden a one trillion dollar bill to sign off. they're working on that. your thoughts on that? >> that is exactly thought. it is all about politics. all year the media and the democrats were using this pandemic for political purposes. the media continued to write these fear-driven stories on covid not based on science or facts while the democrats refused to pass stimulus bills and close down the economy. now that biden has been elected i expect the covid fear-mongering to stop. i expect many blue states and cities to reopen and, they're probably going to credit biden with an economy that is on the mend. elizabeth: they locked down the economy, they locked down the economy, they locked down the economy for eight months. they started out with

2.3 trillion. pelosi sat on it to give joe biden a victory while people and families are losing their businesses and getting wiped out! you see more children, tens of thousands more children being malnourished because they fought in d.c. over our taxpayer money who was going to get it. now it is loaded with pork for overseas countries, really? they think this is leadership, kristin? i am tired of this personally. i know first-responders. we have teachers, firemen, we know cops, we've got firemen in our family. they have to deal with pulling dead bodies out of houses and putting them up on the island and they're not getting any money because these guys sat on it to give joe biden a victory. sorry, your final word, kristin. people are tired of this. >> i couldn't agree, elizabeth. a lot of of their employees have been without paychecks the better part of this year. it is so sad. many beloved restaurants in

in san diego. they assaulted a female social media journalist in new york city. they assaulted a group of conservatives in san diego. the question is antifa heading to the state capitols, is the next stop d.c.? you talked about normalizing it. we shouldn't normalize it but the democrats said no to bills and resolutions brought by republican senator mike lee of utah, ken buck, greg stuebe, condemn the riots. put laws in place to stop this. force and back up our authorities. we still have, david, 220 riots. 30 people dead in the rioting, riots last year. 2000 cops sulted. what do you do? >> what americans have to look to the local leaders because we have been failed by the department of justice in part, in not taking action against antifa properly as a domestic terrorist organization which is what they are. what by the way what they have

on. okay, we had twitter and facebook trading down in stock trading today. twitter approached correction territory, was the worst performing stock in the s&p 500 after banning, after they banned president trump on their platforms. your thoughts on that? >> it is extraordinary when you attack trump for many people. it is attacking them. i lost a bunch of followers through some magic as well. ron paul being silenced. others, so they're doing it direct attack on a lot of consumers and that's a risky thing to do and so it is no shock that it is going down. it probably needs to go down further unless they change their policies. elizabeth: even the aclu is saying wait a second, quote, unchecked power of twitter and facebook, basically banning people because of political realities of the moment that you agree with, aclu is now questioning it saying what they did was wrong.

they're letting still trend on twitter, twitter still is allowing to trend on its platform attacks on vice president pence. calls to execute vice president pence. calls to hang vice president pence after they banned trump. so that was still allowed up along with iran's ayatollah, communist dictators in china whatever they say and more. your thoughts on that? >> look, no one can debate whether the violence last week was okay to do. it clear hi was not. this represents its own danger. this chilling of discussion in america, i said recently america was born of dissent. it shall perish if dissent is forbidden. if we get to the point where it is on campuses, in communities, social media networks, the crowd shouts down dissent, opposing points of view. that is a real danger. it will be a danger for a long time. it is very chilling.

elizabeth: okay. so we have the iran ayatollah tweeting out our stance against israel is the same stance we always had. israel is a malignant cancerous tumor. it has to be eradicated. twitter allowed that to stay on. communist china, officials talking about hong kong. journalist glenn greenwald, youtube, you're putting up far more violent extremist content on your pages like promoting extremism in south america and asia and communist dictatorships overseas. how is this okay. >> it isn't. it is clearly political. facebook took down the page of the democrat walkaway unit. i remember last summer that on twitter i was reading about in real time the messages on how to burn down the city right next to where i live and the city where i work and nothing was done about it. this is clearly political.

now we're moving into businesses wanting to hound out people on the right. this is a very dangerous trend. elizabeth: well, it is about, what twitter and, what they're doing on social media, let me back up. you got to stop treating people as others, as otherring people as if they're objects. everybody is human beings. we all have the same anxieties. twitter feels like they're broadcasting. it is not about dialogue. it is not about clarity. it is not about emotion, getting hooked to stay on platforms longer with algorithms manipulating you, no information about dialogue. when you go on there, emotionally get hit. you feel emotions getting manipulated, tom. that is how you make money with advertisers, the longer you stay on, the longer you are hooked. they will make money. >> that makes it interesting the way they're dropping certain

people and "shadow banning" people of that nature. the question how far does this go if twitter does this? if amazon takes down parler what is next? what page won't be taken down? it is no way to run a civil society. you know i wrote the book, the divided era. this creates even greater division, now this there is sphere right of center, they're over there and under attack. this the is first incoming administration in american history, certainly the television age attacking the outgoing administration. joe biden should say what happened last week we are going to move past this. he is not condemning the censorship. very different from fdr gave the four freedoms much, freedom of speech was number one. different from truman who said how important freedom of speech is. elizabeth: i hear you. what happened last week was

elizabeth: with me now republican strategist ford o'connell. great to have you back, ford. don't know if you saw the news, new york state governor andrew cuomo now saying this, we can't stay closed down until the vaccines hit critical mass because we'll have no businesses left to open. his state was the one that did severe lockdownss right? >> you're absolutely right. to your point prior to right now there is a reason why florida is open and california and new york locked down. they continued to double down what doesn't work hoping for a different outcome. i have to tip my hat to florida governor ron desantis. he figured out what works, what doesn't. discarded policies that don't work with an eye towards keeping the economy open and schools open versus having masks and indefinite lockdowns. elizabeth: what a story new york versus florida. i mean we've got 23,000 deaths from covid in florida, but 39,000 deaths in new york from covid. and then you know, florida has a

bigger population than new york state and it has way more senior citizens. you have got here in new york vaccines are actually being thrown out in the garbage because new york state rules create lack of eligible candidates who can get vaccinated. so the rule making is literally killing people here, ford? >> you're absolutely right. let's also remember what happened with governor cuomo in new york and nursing homes as well. here is the problem with governor cuomo. the media fawns all over him. hollywood gave him an emmy. the problem he spent too much time in political one-upmanship versus doing his job as governor. ron desantis, said look, i have to find a way to keep the economy moving, keep people safe. he first made sure the nursing homes and elderly in florida which is much greater population than new york were most secure. elizabeth: so you see, you know, cnn not doing the reporting and legwork to zoom in hard on what

is happening with new york state governor cuomo but going after ron desantis, calling him, quote an ass because ron desantis said we'll not do cdc rules. only vaccinate age 75 and older. we'll lower it to 65 and over. of course that will create lines. of course people will come into florida because florida is saying we'll give as much vaccinations as we can but not giving context. instead to personally attack him through ad homonym attacks. that is always refuge of the weak when you start talking like that. this shows you don't have a case, you didn't do the legwork, didn't get information for the viewer. what do you say, ford? >> right. they wanted to put this on trump. any supporter of trump like governor desantis must be doing something wrong because they're evil. what governor desantis did was govern. he looked after his

constituents. we're in terrible times. we we're in this together but we have to keep a way to keep the economy moving keeping those vulnerable safe. the media wanted to buy into the narrative. the reason why governor cuomo is admitting lockdowns don't work besides the fact they don't work, essentially the election is over, they decided to govern. that is unfortunate to new yorkers. that is why they're coming down to my home state of florida. elizabeth: ford, basically florida is treating people like adults. dot do the social distancing sanitize or else you will die. people in florida get the message. here in new york way topdown. we'll tell you how to live. how you can eat at restaurants. what businesses will stay hope in the tri-state area. who will be allowed to stay open, make money, put food on their family's tables. we'll decide whether or not to keep you open or shut you down. they're at their wits end, final

today. i wasn't going to talk about it. he honored. awarded me the national security medal a great day for me. it is kind of the top of my career. so it was a great day. i met with the president. we talked about some things. he awarded me the medal. i will be with him tomorrow on air force one. elizabeth: okay. so you're going on air force one to go to the border wall in texas. what will happen there? we have completion of more than 400 miles border wall, right? >> we'll celebrate with the men and women of border patrol is begging for that wall for so long. 400 miles, taking i-95 from florida to north carolina that is the tremendous success this florida has. he did it for men and women. this is trump's vanity, waste of money this is america's wall. this is the border patrol's wall. it wasn't a waste of money. "washington post" in editorial saying illegal immigration is

going up, wall is being built, what is going on waste of money? illegal immigration is going up because of biden effect. what "the washington post" article is saying illegal immigration is going up where there isn't a wall. so the wall is working exactly where it. it follows people so border patrol can catch them. less gotaways and drugs. elizabeth: we've got this, joe biden will say he will have the justice department investigate trump separation of family with the children promise. that is the zero tolerance policy. we understand that policy was around since 2001. but the trump administration is being accused of being way more aggressive than other administrations in separating families. your reaction to that? >> well i was part of that trump administration way more aggressive saving lives. that policy wasn't about anything but saving lives. 31% of women were being sexually assaulted of. children were dying.

everybody on tv was raising hell about it. we'll enforce the law, zero tolerance to save lives, save women from being sexually assaulted. take millions of dollars of day out of hands of cartels, the same cartels that would kill our agents this is about being aggressive to secure the nation to save lives. nothing more. they will -- elizabeth: aclu, forgive me, but the criticism has been that 1100 children were separated from their families and their parents because of that policy. what do you say to that? >> i would say that a lot of the parents, it is in the reports, a lot of parents chose not to be reunitedunited with their child because their sole effort to give with the other spouse here illegally relative or get american education. a lot of parent did that. at the same time they complain about the percentage of separations. liz, there were 14,000 children in the custody of hhs their

parents hired criminal organization to smuggle that child into this country in a back after tractor-trailer, trunk of a car. 14,000. no one wants to talk about that. anything inhumane is putting your child in the hands of a criminal organization. elizabeth: yeah. we understand that. we understand that human smugglers used children for fake false family units. that is happening too. and the obama administration, there was children put up for, with foster families as well. also children. we understand the use of fenced in, walled in areas and all of that but i want to turn to the crime that has been happening at the border and the success there. the criminal alien convictions for different crimes. drug trafficking. and the human trafficking. talk to us about that, how, has that dialed back? has that gone down under the trump administration? >> yes. elizabeth: crime at the border?

>> right. yes it has because the president shut the border down. he has the most secure border of my career but the problem is now in the last three or four months the issues are on the rise because of biden effect. they know we'll have open border. promise moratorium on depouring stations. they're gearing up. cartels is gearing up. surge is coming. drugs will increase. during the trump administration, drug seizures increased. you know why? border patrol agents and cpb agents doing their jobs and vigilant. they were not feeding, taking families to the hospital, changing diapers, making baby formula. the seizure of drugs went up. it is very successful. if joe biden is smart he will build upon the success and keep building that wall and keep these policies in place and have even more secure border.
