get the latest from fox news's kevin corke. good to have you on again. reporter: always a pleasure to be with you. i have a question. are extreme supporters of president, end quote, planning to storm the capitol ahead after biden inauguration? if you believe "the hill" newspaper and its anonymous source that is exactly what lawmakers were apparently told last night. "the hill" says lawmakers were actually briefed about four specific armed threats against the capitol, the white house and the supreme court during that call again, quoting an unnamed source familiar with the discussion. now it is clear to me, certainly coming into the bureau today, i think anyone will tell you, numerous agencies have already begun limiting access to areas in and around the capitol especially in light of last week's violence and ahead of tomorrow's vote by democrats to impeach the president for a second time. as for his part, the president today scoffed at the notion that his speech last week incited any violence calling this latest

impeachment yet another political witch-hunt. >> free speech is under assault like never before. the 25th amendment is of zero risk to me but will come back to haunt joe biden and the biden administration. as the expression goes be careful what you wish for. the impeachment hoax is a continuing of the greatest and most vicious witch-hunt in the history of our country and it is causing tremendous anger around division and pain far greater than most people will ever understand which is very dangerous for the usa especially at this very tender time. reporter: tender time indeed says the president. as for the leader of the democrats in the senate, chuck schumer said this about president's remarks you just heard. donald trump should not hold office one day longer. his statements is proof positive, if you needed any further proof which i didn't.

senator mitch mcconnell, elizabeth says the senate won't even return to work until january the 19th. since there is no provision for impeaching a former president, it is still not clear if this will go anywhere beyond the house seeing how the president will be out of office sometime next week. so we'll see how it all plays out. one way or another, tomorrow we will witness history. liz? elizabeth: all right. good to see you, kevin, thank you so much. reporter: my pleasure. elizabeth: joining me now is house oversight ranking republican congressman james comer and former u.s. attorney brett tolman. first to you, congressman, what is going on with these threats we're hearing to the white house, to the supreme court building and to the capitol building starting this weekend through inauguration day? were you briefed by authorities on this. >> i've been briefed. i've been privy to classified information. i can say this. that the intelligence community has picked up various different hate groups across america that have suggested that this could

be a potential target but i just arrived into washington back from kentucky and i can tell you this place is fortified unlike i have ever seen it. so i have a lot of confidence in our national guard troops who are around. and i think that hopefully from last wednesday everyone has learned a lesson and we'll never see that repeated again. elizabeth: brett, sit tight. i want to stay on this with the congressman. we're hearing of four separate plans to attack washington starting this weekend through inauguration day. one involved thousands of potential militia members encircling the capitol to shoot at members of congress. is that what you were told? >> i was not told that. most of what i was told was just that they had picked up some intelligence and wanted to make sure that everyone took this very seriously. i can tell you again from arriving in town this looks like a totally different place than it did last week to a security

standpoint. elizabeth: let's get to brett tolman. you know, there is even talk of rules of engagement involved in these plans of the joint chiefs of staff has condemned any action like this as sedition and insurrection. one house lawmaker said it was horrifying what this person heard. it was chilling. if you weren't afraid when you pot got on the call, you were afraid when you got off of it. seven foot perimeter fences around the capitol. you see the action happening right there. brett, your reaction what is going on? >> first of all these are individuals who supposedly care about their constitutional rights yet they're willing to jeopardize the very structures and foundation of this country. whether you agree or disagree with president trump or you agree or disagree with joe biden we are a republic. we have been operating laws that are vital and they're key. i think this is the fastest way to get congress and the

government to encroach even further into our liberties is by these kind of tactics. it is shameful and i hope they're able to thwart them before they even start. elizabeth: now, brett, you worked as a prosecutor too. authorities are really worried about pipe bombs. there were pipe bops planted at rnc and dnc last week. they were successfully detonated. that is serious concern for authorities because they're devilishly hard to detect, pipe bombs. what are your thoughts about that. one guy was arrested with 11 molotov cocktails in his vehicle parked outside of the capitol building there is deep concern what will happen starting this weekend, bret. go ahead. >> that's right. liz, i hope that the president and other members of congress as well as president-elect biden can engage the media now and to be consistent in a message to stand down, to not riot, to not gather, to not have these kinds

of threats to our country. i think it is important for both side to do that. these are severe felonies that will result in long, long prison sentences. elizabeth: that's right. brett. they're talking 20 years in prison. the fbi working 160 cases we're seeing now. you're seeing the video after capitol police hero, he actually distracted, distracted rioters pouring into the building away from the senate floor. this one guy is being now called justifiably a hero for defending the capitol there. so you know, let's turn now to this. congressman, state capitols, we see that in your state, your home state of kentucky. we're seeing protests breaking out in frankfurt. state capitals, there is concern in wisconsin, michigan, other states around the country, because what authorities have repeatedly said, listen, we're not equating this to 9/11. we know what happened here in

new york in 1993. they hit the world trade center with a bomb. people said this is a preview. worse is going to happen and it did. when you see what is happening are you concerned about state capitals too? because d.c. could be a distraction and something could hit a state capital? >> i was a state legislator in frankfurt for many years. i can tell you they don't have any hardly any security. i was talking to local law enforcement in the franklin county area, which encompasses the ken state capitol they beefed up security. the kentucky national guard will be there. the 16th and 20th of january different groups would approach different capitols about protesting. hopefully that message has gotten out and that potential threat has been thwarted. elizabeth: okay, brett, what we're going to show now the debate about impeachment. show the president's remarks

last week. you will start seeing what he said on january 6th. we will never gyp you have. we will never concede. you do not concede -- you have to fight like hell for your government. is this enough to impeach him on, brett? >> you know, the language that was used, many have argued in its context was the problem but these types of allegations about inciting a mob really require specific language and if you look at supreme court precedent, this language fails and falls far short in terms of what the supreme court and other courts have indicated as speech that is not protected by the first amendment, that does cause incitement. this is an interesting time. it doesn't qualify, if that language doesn't qualify that this impeachment starts to look a lot more like a political move on the democrats on the house

side. elizabeth: congressman, where do you come down? >> well i'm against impeachment. the president has seven days left. they're wanting to go ahead and have a impeachment vote tomorrow morning. the president has had no due process. if we believe in the constitution and our democracy we believe in due process. so it is just something that makes the democrats look more political. i think this is an overreaction. what pelosi criticized trump for doing is getting his base all riled up. she is doing this to please her extreme liberal base. you can't impeach a president with seven days left in his term without giving him an opportunity to defend his case and hire lawyers and things like that. so it is very unfortunate. a time when we should be coming together in america, not further dividing america. elizabeth: the vote will come in tomorrow. republican tom reed said censure instead. we'll stay on the debate. congressman scales comer, brett

come out of washington this is helping a chinese company and if you're registering to lobby in the u.s., it means you're helping them with bombs they have in the united states. you're helping a chinese company beat the united states. you know that's really untoward for a former senator. i don't know what barbara boxer's finances are. it is hard to believe she needed to go to do this. it comes off of a career she was known to be somewhat soft on china as is her colleague from california, dianne feinstein. elizabeth: the trump administration added hike vision to a trade blacklist in october 2019. this company barbara boxer is working for was blacklisted for doing repression, mass arbitrary detention and producing high technology surveillance of muslims in china's province and cameras were used to surveil the

u.s. military. according to "the wall street journal" a few years ago, our streets and neighborhoods too. your reaction to that? >> these are the bullets of the 21st century. this is what keeps the chinese communist party is the surveillance state. they use technologies to surveil people abroad, in particular to run a police state. the charges against it, the accusations against it by the u.s. government applied using slave labor. you have to wonder doing anything in st. john where china operates concentration camps with million or more uyghur muslims t would be one thing if barbara boxer represented a company that made and sold fruit in vietnam this is the heart of the chinese surveillance state. why a prominent senior democrat felt it was appropriate to do this is kind of shocking. elizabeth: biden, reports coming in biden inaugural committee will refund, send back a check,

donation from barbara boxer, sending that check back to her. we'll track the story. let's listen to secretary of state mike pompeo warning china is not just at the front door. it is inside of the gates. it is already deep inside of the united states. watch this. >> the chinese communist party inside our gates, inside our government, inside our institutions of higher learning, inside our research institutions. if we get that right if we control and insure that our security elements are protected in a way that is appropriate than having chinese students study here is perfectly fine. the whole world needs to do that. it is not u.s. institutions. they're studying in institutions in europe, australia, around the world. this is not just the u.s. challenge. the whole world must take this on. elizabeth: christian, your reaction? >> chinese government uses these students as agents of espionage and agents of influence. you know if they are in stem areas their job partly to steal

mistake. elizabeth: okay. after the, after this, actually, let me back up. in the fall, this happened in the fall. pelosi admitted stonewalling. he said the game-changer for doing a covid relief bill of $906 billion. remember they were talking 2.3 trillion. so that is a third of it. pelosi admitted the game-changer for doing it, the bill was the biden victory. that it was not a mistake, it was a decision, it was, a decision to sit on this bill and wait because of the game changer that was the biden victory. i mean the political posture something the real game-changer. the political use of u.s. tax dollars when american families are hurting. and now we're talking about, by the way. you and i deneen talked about this. republicans, democrats fought for months. senate had packages in the spring helping out americans that nancy pelosi just tiktoked.

i mean when you see the dodging and deflection here what was your reaction here, what was the reaction when you saw it? >> i'm surprisessed she was even challenged, first of all. it was interesting toe watch her facial expressions. nancy got testy. she doesn't like to be challenged. she doesn't want to answer questions she doesn't feel like she has to answer. she is the speaker of the house. she can do anything she wants. it is all about power for nancy pelosi. she is the poster-child for term limits in our congress. and for her to sit on the relief package for americans, i think voters should absolutely be outraged about it. but i also like the fact where lesley stahl brought up the fact that ocasio-cortez is critizing the democrat leadership because they're not grooming younger representatives or people, or, yeah, younger representatives in the house. so there is infighting within

elizabeth: that is okay. i didn't even remember. >> they hadn't been listening to liz who has been talking about this for the last year and hundred of liz's guests who have been talking about it for the last year that you can't sustain these kind of standards where people simply weren't allowed to live and the state has been falling apart and everyone has been saying -- at some point this is really remarkable. at the moment tum trump loses, como says, we can't sustain it anymore, we got to open it all up. the media should be, liz, i can't understand the media not covering what is happening in oklahoma or nebraska, or texas. they don't go there. they don't understand those states but we're talking their own backyard.

that cuomo, de blasio have destroyed. you got to be kidding me. one year after you destroy our state suddenly we have to reopen? elizabeth: now we've got this too. cnn complained on the air that governor desantis of florida was basically putting seniors first before essential workers when it let's watch this.ons. >> florida, one of the states bucking cdc recommendations and vaccinating seniors ahead of some front line workers. it is a massive undertaking an ryan young is out front. elizabeth: okay. but then, you have cnn host, saying hey, governor desantis, you're quote an ass for pushing back on our reporter who was saying your vaccinations of seniors are not improving. you're not doing a good job. he was first in the state you know what?

we'll vaccinate 65 and older. cdc said 75. we'll do 65 and older. now the cdc says do 65 and older. what is going on at cnn? they are trying to have it both ways? >> cnn is the news network, news equivalent of the jerry springer show. the reason it got testy because the governor would not shut up to let the governor answer a question. the response from cnn, he finally said please let me answer a question. yes, look at the numbers. the numbers tell the story. again the backyard of the news media. look at florida versus new york. in florida, 823 people per 100,000. new york, 723 people per 100,000. only 1/3 of the vaccinations available have been given in the state of new york. only one quarter of the vaccinations being available have been distributed in

approaches to managing and handling how they govern, okay? so on one hand florida has treated its citizens like adults. everyone is an adult. staggered business openings but they're open. they asked you to wear masks inside. they basically tell you sanitize, all the common sense stuff. social distance. you know just act like an adult. you don't want to get sick. it is in your interest to do the right thing for yourself. that is how they handle it. that is what people are doing. everyone crosses the street when they're passing you. it is common sense good governing. on the other hand you have bill de blasio. bill de blasio has a nanny state. i'm not really sure where he is sitting doing this nanny stating. he has run new york so heavy hand he hadly. no restaurants to eat. outside in zero degree weather. jenny was there in december.

>> first of all -- elizabeth: florida has two million more people but new york state has 16,000 more covid deaths. covid is lethal. it is awful. you got to shut it down. >> absolutely. elizabeth: these guys, these guys aren't rolling up their sleeves. they're not going out to small businesses saying how can we help you? how can we help you stay open? do you need plexiglass? do you need temperature devices? how can we help you get back on your feet? because this economy is now destroyed. would you buy property here in new york state, given what you see? >> you know, new york, it is interesting. so new york of course is the land of have and have-nots, right? like a lot of places are. so the luxury sector in new york is doing very well. it is back to pre-march levels. >> right. we've had 27 contracts over four million signed last week right? so over four million dollar market is doing very well. we would say the luxury market. at the low end we're seeing a little bit of struggle.
