days. opponent don't like built-in progressive priorities raising minimum wage to $15 an hour. democrats may need to manuever around a filibuster. they might be inclined to do that to get money for vaccination sites and other resource. >> we need funding from congress to make this happen and i'm optimistic. i'm convinced the american people are ready to spare no effort and no expense to get this done. all these steps will take some time. reporter: as part of the biden's first executive orders he will enact a mass mandate on federal property and interstate transit systems. he will extend a pause on student loan payments, join the paris climate accord and stop the travel ban on muslim majority countries and revoke the keystone xl pipeline permit. he will have immigration and

for the people. forget about your revenge. we have four years of revenge. we really did. so it didn't seem as though that is going to be enough but it is time for leaders to think about the american people. elizabeth: okay. you know it is interesting republicans are pushing back hard. the democrats are going to need 2/3 senate majority to get impeachment through. they need to get 17 republicans but democrats say, there is a case, they say they still have a case, even if this was a pre-planned attack that president trump shouldn't have made the comments that he did and behaved as he did. what do you say? >> we're going to see how important that particular issue is. we have a midterm coming up. so who is going to cover and do what is right so they can stay there or will go down, hey, this vendetta is so serious forget about everything else, including the american people.

elizabeth: i hear you. there is precedent for people being impeached even after they left office. history has sown that. >> yes. elizabeth: anyway let's not get into that, i want to get into what the polls are saying. i want to talk to your piece you put up on fox news what it takes to unite the country, what are your thoughts on that? >> we can unite if we lead by example. each one of us we'll be not fighting. i'm not going to change my position. i still support life from the womb to the tomb. i will not argue and fight with people about it. i will stand up for truth and promote truth and teach people rather than impeach people. you should teach people. that is something they need to begin to think about. we can talk to, speak truth to power without fighting and without arguing. my uncle, reverend martin luther king, jr. said we must learn to live together and brothers and i will add sisters or perish together as fools. we have the ability to be reasonable towards each other.

the pleaders need to start out demonstrating they can do that. elizabeth: things that were troubling the nation during dr. king's time he battle ad lot of that and today we are, people keep telling "the evening edit" we're all hurting. all of us are hurting out there. this is covid. there is joblessness there is a lot of things troubling our cities and towns. we're all hurting. these are tough times but people say, you know, we, others are saying we all have a part to play in this as well. everybody has a part to play in this. how do you see that? >> my part, your part, is to make sure that we get our points across without hurting anybody. we should demand of our leaders think about us for a change. put the people first, rather than your political agenda. and if we're able to really do that, and even our social media, i made an agreement within myself not to put out ugly, fighting back, you hurt me, now

i've got to say something ugly about you? we are going to have to do that. we're also going to have to make sure that we see about the small businesses that have been so wounded in this particular battle. let these people get back to work. let the restaurants open back up and dress shops and various shops that have been closed down again. it is time for america to be free enough to work and to, you know raising the tax dollars and giving everybody handouts without giving people genuine opportunities, that will not help the people. we've got to give genuine compassion, genuine opportunities and you know, the vaccines, now they're admitting you get the vaccine you can still get covid. if you had covid about you can get it again. time to be honest and stop scaring the people and start serving the people from the womb to the tomb. elizabeth: what do you think of this? you know that the polls show americans value their

patriotism, their rejudge just beliefs, their resmoke respect for fairness regardless of race or sex. they want to raise families in a civil society. they want to get good information. where do you come down the media talking about hey, we have to get congressional commission to shut down conservative speech? >> i believe that will backfire because people are beginning to understand that is much that this war was really about, shutting up the conservative position and opinion. and people are really beginning to get that. there were people who have been very unkind to me. they're coming back now, i'm so sorry but you never came back at me the way i came at you because when people are saying things to me, even to the point of using profanity and everything, i say, hey, i love you. i just love you. i want to see you whole and healthy and well. and so we have to begin to speak that way to others and not have our voices silencerred.

deceit. the deputy director is, even the general counsel has a lawyer in it that is perverting e-mails, turning them 180 degrees on their face to help get the fisa warrant it. was a pretty lonely protest for that special supervisor. elizabeth: we hear you. again this is about misleading the fisa court. also about what they didn't tell the fisa court, jim comey and his team. documents show, the top justice department official overseeing the trump-russia probe, his name dana bente, said they knew in early 2017 there was no there there. in july 2016 an fbi agent said in new york said this is completely, definitely, political. the fbi's handler for christopher steele, michael said watch out steele is completely untrustworthy. another fbi agent you pointed out quit the trump probe because bill priestap and peter strzok we'll not do a deep dive into

steele's credibility, when christopher steele's own source says there is zero corroboration for what steele is saying. fisa court knew none of this. the fbi didn't tell them this. how could threat get a fisa wiretap and not tell the fisa court what their own guys were telling them. >> they can't. they did but that is the dishonesty. that is the devastating component to this story. we built a system, a tool this, fisa court that makes sense if you ask me. it does make sense to have a very simple, serious private, or confidential court to deal with counterespionage, terrorism situations. you rely on the fbi with doj's help to peaceally be straight shooters, to do their investigation and present a legitimate package to the court. that did not happen here. let me just flag you know, one very precise procedural example of this. when you do any sort of wiretap affidavit and you put information in there like this russian dossier it is your obligation as you keep going back to the court and renewing

or updating that information to say, hey, we found out we were wrong about something. well they knew very early on, maybe before the first application, but certainly by the second or third that this dossier was funded by hillary clinton t was essentially defamation laundering through gps and christopher steele. steele and his subsources were unreliable. there was a lot they should have disclosed to the court. that is one of the big red flags. elizabeth: we got to watch this. this is about civil liberties about this is about americans privacy. again these fisa taps are possible. there is one hop. if the person under the wiretap talks to somebody the person they talk to get searched on. their bank records get searched. what they're watching on tv, who they are talking to. james comey testified that steele's information was quote salacious and unverified. so how did comey and his team sign off on the powerful wiretaps? i asked because christopher

steel, jim trusty, christopher steele testified to a british court he was paid by hillary clinton's team to big up dirt on donald trump in order to overturn the 2016 election that hillary lost. the fbi guys said this is politicized. why did they go with it? >> because they were politicized. look, steele was clearly a political actor. bruce ohr even warned the fbi, hey, chris is obsessed with seeing trump lose. they dequalify him as informant because he joins media, mr. steele and still use information through bruce ohr. they were determined to get there no matter how many rules they broke. that is what durham has to focus on, the focal points not validating ongoing informability by christopher steele, that was struck down by strzok. not updating fisa court. a lot of red flags for him to look at. elizabeth: okay, jim trusty, thanks so much for joining us,

the last four years about trump russia, saying that trump was a russian asset when fbi officials and doj officials knew behind the scenes this wasn't true. what do you say? >> well, we've been hearing this all along, if you read between the lines you had to look for that. most of the media fully embraced the steele dossier, ran with it, talked about how trump was fully, in bed with russia. became the narrative that dominated the entire administration. but you go back to greg miller at "the washington post." before trump even took office raising questions about the steele dossier. the rest of the press just ignored it. every time someone raised questions or put it out that it was really focused they would gloss over it. talk about how trump was in bed with moscow. how mitch mcconnell was, even coined a term moscow mitch. and this is, to the point where

three rnn reporters ended up resigning because of one ever their bogus russia stories. abc reporter, their investigative reporter, false reported one story that was so bad that it temporarily tankerred the stock market. and yet the russia collusion stories continued. elizabeth: okay. so even after the capital siege nancy pelosi again brought up putin. so i have mean how do you take this misinformation, this thing about the commission seriously? i mean you had cnn reporting that the steele dossier was factually checked and corroborated. "new yorker" magazine reporting on it if it was fact. "vanity fair" reporting if it was fact. msnbc's rachel maddow that russia could be blackmailing trump to get u.s. troops away from russia's borders. when that didn't happen, they still doubled down saying the steele dossier is true. what do you say? >> well it is because when you

don't care about the facts, when you, and that is what we've had for four years, the media claiming trump lies, they lie all the time and nobody calls them on it because they're lying politically, that means they're lying to push their agenda and their agenda lockstep with the new administration and democratic party. nancy pelosi talks about something the press never want to correct. by the way we told you falsely four years about russia collusion just wasn't true because if they do that they have egg on their faces. so since the news media history as it happens and then the history books write based on that, they know that they will be able to write and say whatever they want absolutely. elizabeth: but they're also getting leaked to. they're getting leaked to by the fbi and other justice department officials, even after the revelation in the fall of 2017 that steele's intelligence, steele was getting paid by the democrat national committee and

clinton campaign, the media kept going. then you had in april of 2018, former fbi director james comey, he was on a book tour, he is launching his books saying you know, telling abc news, implying it is quote possible that the steele does say was correct. that the infamous moskow hotel videotape exists. he is implying the thing is correct. even behind the scenes, he is testifying it is salacious and unverified. what is going on here? >> what is going on here is basically, the deep state and the news media were fully incoordination with one another to take out the president of the united states. and they knew when they came out with that hotel allegation, i don't even want to dane to say what it was, they knew when they came out what it would do. it was designed to infuriate trump, to undermine trump. they knew comedians would joke about it all the time as they did. they knew it would be part of

there? >> well i think that, you know, for years on this network i have said that big tech is a bigger threat to america and her values in the here and now and immediate future than china. you would be hard-pressed to find a bigger china hawk than me. america was founded on exchange of ideas and free expression. free expression and competition is what makes us better. it is better to have opinions out there duking it out for the hearts and minds of people so we can make america a better place. right now what you're hearing from big tech, corporate media, they're more concerned with the bottom line and making more money than they are upholding american values. elizabeth: you know hbo's bill maher, he is no fan of trump but he is also saying, watch out, we're headed toward, quote, one, one true opinion bubble. that we're heading into a one true opinion in liberal bubble is what he said. he is a free speech person. again he is not a fan of trump.

♪. elizabeth: okay. back with me now retired i.c.e. acting director tom homan. we love having you on. did you -- we think you saw the footage about the fighting and clashes that broke out between illegal border crossers now in a caravan head into the southern border out of honduras. we are hearing numbers anywhere from 1000 up to 6500, maybe even more. what are your thoughts as they try to push their way across the border? >> that number is up to 18,000. intelligence reports shows at southern border. look they were invited. they were invited by joe biden who promised them they won't be detained or deported for at least 100 days. he will not allow asylum-seekers come from mexico. make false claims. nine out of 10 don't qualify but released into the u.s. when you're not detained or deported and can get a job illegally, because biden said he will stop i.c.e. enforcement operations, on top of that you will get free health care, why

would you not come? he lit the fire with his own words and fire is raging. we're going to see a surge at the border like i haven't seen in my 35-year career. elizabeth: like you haven't seen in your 35-year career. you're saying it is going to get much, much worse? >> absolutely things will get much, much worse. to top it all off, this is why it will be worse, liz. what people are not talking about. i.c.e.'s detention budget was slashed by over $300 million. they went from 55,000 beds to 31,500 beds. during the surge they will fill beds in four-days. what do we do with tens of thousands of others across? catch-and-release. they will be released into the communities. joe biden seems to forget when he was vice president, the first surged happen in 14-15, they gave us more money to have more people in detention. he forgotten about all of that. i said earlier today, i am upset with him because he has been

through a surge before. he knows what causes these surges. he knows how to stop these surges because he was around before but he gave all that up to win the votes from the left to get elected president. he sold out and he put his political ambitions ahead of this country's security. because he knows better. he was around. i personally briefed the white house numerous times in fy 14-15, what causes surges and what we can do to prevent him. elizabeth: when you gave testimony that information what did they say to you? they have a biden team member saying don't come now, it is unsafe. immigration activists don't do it illegally. it is dangerous. they found remains of hundreds of people who tried to cross at the border with mexico, more than 800 in fiscal 2018 and 2019. when you said that to them back in 2014, 2015, when you gave

that warning, what did they say? >> they gave i.c.e. funding to build over 3,000 family beds. we expanded detention facilities around the country. we built the facilities to hold children in until they are turned over to hhs. they threw more money at us than they ever seen before. they listened. detention and consequence worked but he is thrown all that out of window. he says he will end i.c.e. detention. he is not going to deport anybody for 100 days and he is going to let asylum-seekers come to the u.s. knowing very well in fy 14-15. 89.6% of central americans claimed asylum at border never get relief from the court because they simply don't qualify. this is, this is the same scenario accept they're attacking complete opposite and opening the gates. elizabeth: well the messaging is, the messaging, you know, people experts keep telling us has been totally wrong on this. they keep saying it is unfair

what these border crossers are doing. we understand, yes, humanitarian issues, but you know, we have laws here, we have border laws here, just like other countries have, in europe, canada, asia, africa. but for some reason, our border gets to be abused. that is a direct quote from an immigration rights activist. so the migrant caravan is now calling on the incoming biden administration to quote, honor your commitment to us. your reaction to that? >> well it is ridiculous. this administration needs to commit to the american people, the taxpayers. they need to commit to the citizens of this country and not other first. this is what is going to happen, liz, you will hear the same thing. overcrowded detention facilities. border patrol stations haven't grown. when they get surged of family groups you will hear the same arguments, bad detention

tests? we reese them in to the i.c.e. facility not knowing they're infected or infect others? say the border patrol get rapid testing. 10 of 150 have covid. the whole group is infected what do you do with them? take them to the border patrol station, infect everybody there including border patrol agents? do you put them in i.c.e. facility, cut drastic beds which they want to relis them to american communities? do you take them to hospitals? what is the answer? i would like to know? i don't think this administration has a plan. elizabeth: does border patrol have the ability, they have to rapid test now for covid? there are some programs at the border. we're looking at 114 illegals packed into the back after u-haul in the laredo sector. four tons of hard narc tucks caught -- narcotics caught at last fiscal year. methaphetamine, nearly 200-pounds of fentanyl,

thousands of pounds of heroin and cocaine and more. we're seeing thousands of criminal illegal aliens being arrested here in the united states and then released. manslaughter, sex offenses, domestic violence, drugs, robbery. now you, now border patrol, tell us the status of having to rapid test for covid-19 for illegal aliens? can you talk about that? >> they don't have the capability to rapid test these large caravans coming across. but if they do get the ability, they do test them, what do they do with them? what do you do with them? take them to hospitals or border patrol stations to infect others? here is the point you made is very important point when you talk about drugs and gang members. humanitarian crisis like they did in 14-15, border patrol says 50, to 60% of our manpower is no longer on line, changing diapers, making baby formula, making hospital runs. half the border patrol is tied

up doing these things, that is when 68,000 americans died from opioid overdoses because drugs came across that border. that is when gang members came across the border. the humanitarian crisis turns into a national security crisis because the border is unguarded because you're tied up with these family groups. elizabeth: let me correct myself t was four tons of hard narcotics seized in the fourth quarter of 2020 alone. tom, what is, what is the guidance for border patrol officials, what is the federal government telling them to do with illegal border crossers and covid-19? what is the guidance? >> i don't think there is any guidance for the new administration yet. that is my question. i don't think there is any good plan. during the global pandemic, it is to have, for the president-elect to say, i'm not going to detain you, i will not deport you, i won't let let

asylum-seekers enter the country where 90% of the claims are false, that is dangerous. hospital covid cases brought into the u.s. and there is no plan for it. and any plan is not a good plan unless you keep them out of the country which president trump has done under title 42 designation. if joe biden does away with that, this country is in trouble. elizabeth: is he going to do away with it? >> i hope he doesn't. i think he would do away with remain in mexico program. hopefully as long as pandemic is going he will keep the title 42. 100,000 people come through the border. they're not all going to be caught, all right? border patrol is tied up. 50 to 60% will be tied up with family groups and others will come in. others that could an infected with covid. locking the border down like president trump has done, remain in mexico program and title 42 designation is the way to go especially during a pandemic. he shouldn't change any of that but he promised he would.
