the biden administration is going to do a freeze on deportations. what does that mean for violent criminals illegally including ms 13. >> it means they get to stay. if they have been here before november 1 of 2020 they are not going anywhere. and there is no carveout for gang members, sex offenders, public safety threats, no carveout at all, only carveout for terrorism. i have a copy of the memo tonight to go and i read it for five times and i cannot believe i thought it was a joke and i called the guy up and said this has to be a joke, it is not a joke. this is the most damaging public safety document i have read in my 35 year career as law enforcement officer. this is warfare on public safety. ice can no longer do their job and i said a long time, he will

cripple them with money, they've done that they took $300 million away on top a three-page memo that says eyes you will no longer do your job and no longer pickup criminals that feels they will be released to the street unless an aggravated felon with a conviction. you will no longer arrest anybody who was here before november 2020 regard as of a mill history. this is a very dangerous memorandum and i cannot believe some but he actually wrote this. liz: tell me who wrote it, tell me who it went to and tell me specifically what it is saying, is he giving orders to ice now? >> first of all when i got this i went to properties of the memo it was written by immigration advocate. i know who the person is. whether working for the administration now, i do not know but a sad day when immigration advocate writes a memo instructing law enforcement how to do their job. liz: who signed it and is it

coming from homeland security and who was it sent to? >> he came from acting secretary david petoskey, this went to the leadership of ice, cbp "ncis", all the immigration authorities of the dhs, and went to their leadership and they have been instructed to follow the memorandum and additional instructions to the field how they will incorporate this in their operational instructions. liz: basically saying, dangerous criminals, walking through again what is the fallout on this? >> there is two parts number one you can no longer pickup criminals out of jail state, local or federal and take any actions in less than aggregated felon which is a high degree of felony and they have a conviction. so if there is an illegal alien sitting in a jail arrested for rape any post bond and gets out

ice can no longer grab him, arrest him, they cannot even file paperwork to start proceeding. they cannot touch them. the second part says after they have the moratorium in deportation which means anybody who has been your before november 1, 2020 you cannot remove, you cannot deport. even people in ice detention who have a final order from an immigration judge who is a convicted criminal they cannot remove them from the country. this is crazy. i cannot believe this is actual policy that has been set out by the department. liz: it sounds really disturbing. this matter is big for jurisdictions that are sanctuary dirt under jurisdictions. >> this is a danger to every community in this country the sheriff is put in a tough spot. if you have a guy that is a sex offender and an illegal alien he can no longer contact ice and turn them over. this memo makes it clear it is no longer illegal to be in the united states illegally.

you have to have a serious conviction and only if you entered after november 1 of 2020. this is a free-for-all to the criminals and put public safety at great risk. as a career in law enforcement officer i am appalled that somebody would write this in instructed agency to follow it. loss need to be filed, people will die because of this and it's a shame the biden administration has gone this far left. liz: we are running out of time what can be done to stop it? >> lawsuits need to be filed the government of texas filed a lawsuit and i know immigration agencies that believe in enforcement of the law but the american people need to stand up and call their senators and say what is this. we may have voted for joe biden but we don't want criminals running the streets that have no right to be near the begin with. we are protecting the criminals and not protecting the citizens of this country.
