video out on the internet is graphic. want you to warn, that video is graphic. we'll not show you what happened. deneen, still, this is going on, the voters are saying enough is enough. but now they're going to switch to go after the border and immigration. your thoughts on that? >> well it is the silly season. these people are downright dangerous. they need to be held accountable, liz. what is going on with the local post officials who are allows to be simmering as long as it has for people to be in the streets, causing damage, fires, blocking roads, breaking windows, intimidating law enforcement, intimidating reporters who are trying to report what is going on in the streets to inform the country. where are the local democrat leaders in these cities and in these states. they need to be held accountable as well. how outrageous is it, that they have allowed this to go on as long as it has.

sinks. buying their own food out-of-pocket. they will be there through the impeachment trial. you are your reaction to what is happening with the national guard? >> let me just say i want to thank our national guard for what they do for our country, liz. this is just downright despicable. they deserve better treatment. there was no plan in place obviously because of the images that we've seen on the news, on television. no accomodations, no, bathroom facilities. food and water, i don't even know what that situation was like. but they feel betrayed and they don't feel respected. i'm glad this is in the news as we could see first-hand how our national guard troops were treated in washington, d.c. elizabeth: now 200 of them reportedly have covid-19. your reaction to that? >> it is very unfortunate. again, it is a very serious virus that people need to take

♪. elizabeth: joining me now is the federalist senior editor christopher bedford. chris, can you answer this question? how does the president's new made in america executive order getting the government to redirect $600 billion it spends annually to buy more u.s. made goods and services in order to create jobs, how does that square with killing the thousands of american jobs in the oil patch including on the keystone pipeline? >> it really doesn't square with that. this promise by president biden, this executive order to try to buy in america is a good thing. but a lot of it is trying to catch up with what representative donald trump did and republicans have been doing over the last four years to take back the union job man tell for the democratic party after they owned it for so long.

this is not going very well. the honeymoon seems to be over. the unions that endorsed joe biden the national unions talked to the members gotten a different idea who pushed for joe biden to be president because he was promising good union jobs was pulling one over on their members. the laborers international union for example, pushed hard for joe biden to win on national member. now they're losing, 1000 members lost a job already, 9,000 more who were supposed to be employed won't get a job. this doesn't square at all with a agenda to bring back jobs to american citizens. elizabeth: house republicans want 28 of 29 competitive seats in the election. why? because they focused on the job killing agenda, period. that is end of story. listen to this oil patchworker. he works on the keystone pipeline. we don't have the sot. we're hearing guys and women who work in the oil patch, you're threatening two billion dollars in wages in the heartland,

montana, south dakota, nebraska, oklahoma, texas. you know texas will not have any of this. they will sue and push back on this. your thought? >> they're going after texas. they're going avenue mexico. economies hit hard right now especially with the covid-19 restrictions of governor who really rely on this for tens of mosts, hundred millions of dollars to the state. when pete buttigieg, the department of transportation oversees pipeline building. when pete buttigieg was grilled a little bit by senator cruz on this he said the most important aspect for him was the climate change agenda of the biden administration. that shows that despite trying to -- elizabeth: we got bernie sanders. >> despite -- elizabeth: go ahead. >> just so despite trying to get the job agenda back from the gop and donald trump, the climate change agenda will take precedence, every time the greenies will beat out the labor jobs over and over again.

elizabeth: all right. focus on covid, 200 million doses from pfizer and moderna by the end of march. that means 100 million will be vaccinated. we need multiples of that in order to get you know, herd immunity. so hopefully 100 million by the end of march. there is no telling because there is bottlenecks, chris. we're seeing severe bottlenecks at the state level. we've got states like at bam, georgia, nevada, wisconsin, not getting supplies or there is rigid eligible guidelines in states like new york. you can't covid scapegoat trump anymore. it is on these guys, right? this is what is going to make-or-break political careers. it is jobs and it is covid-19, your word, what do you think, chris? >> the democratic governors are really trying to pull back everything they put us through for the last year under president trump when they were able to scapegoat him. whether it was gavin newsom or the mayor of d.c. just now or the mayor of chicago saying we'll let people back out.

professional prosecutor. he is not operating on a political timeline. so particularly during president trump's kind of waning months of the campaign he was frustrated none of this broke out publicly, and it still hasn't because i think durham is real prosecutor. the other thing he lost many months of grand jury usage to covid. in other words, grand juries were not convening. the delay does not bother me that much. he is a very methodical smart guy in terms of the evidence. he ask interesting in terms of the jim comey crew what he did. the inspector general's report was damning of the fbi leadership but it is not complete. it administrative type document. they don't have things like john durham does using a grand jury for witnesses. getting things like personal cell phone text messages between lisa page and peter strzok which have not seen daylight. there is lot he can do to dig into this. there is lot of comey and

mccabe, peter strzok and some folks involved in operation hurricane. elizabeth: the fisa court is a secret court meant to handle, terrorism cases. the fbi also used it to investigate the trump, the trump campaign for russia alleged, alleged russia collusion. the doj-ig found that the fisa court, the fbi officials misled the fisa court. fbi officials who work closely with fbi, former fbi official kevin clinesmith. he doctored an email to say carter page was not a source for the u.s. government, when carter page said i sent a letter, i sent a letter to fbi's james comey saying i am a source and that was set aside. so it's perjury. could it be perjury, fbi officials perjuring themselves

before the fisa court? could it be as simple as that? >> it could be. you could look at a couple different possible statutes here. the perjury statute is in play for intentional falsehoods under oath. false statements the coin of the realm for jim comey investigating trump. that is a charge that might be in play. obstruction of justice might be in play for manipulation of information. clinesmith is not the central figure in this story. it is compelling story that a general counsel for the fbi would flip meaning of an email to get something by the fisa court. the general counsel are there to stop the agency from messing up. he contributed to it. elizabeth: kevin clinesmith pleaded guilty to a single felony count of, making false statement, about when he doctored that email. he is in a plea agreement reportedly with the u.s. prosecutors. could kevin clinesmith be

telling these prosecutors what really went on and they're using that information to go after james comey's circle? what do you say? >> well he could be in part. he will not be able to, i don't think he will be able to tell the whole story. he also pleaded guilty, pending sentencing. pub rickly it doesn't look like a cooperator plea agreement. it could be. he could come in and proffering, to limit their own damage. unknown, i'm sure not sure he will be that central. he was carved out early as a public exercise of the durham probe. he is not a central figure. he is not the lead part of it. he can contribute but will not be the weight of the evidence. elizabeth: all right. let's listen to what carter page told us about how frustrated he was being a target of james comey and his team when he told them, what are you doing? i've been working with you guys in the cia as a source. let's listen to carter page. >> my letter that you mentioned to mr. comey was sent on sunday

night, september 25th, 2016, and i laid it all out. i explained all of the lies that were being pushed by the democrats. and also explained that i was, that i had worked or alluded to the fact that i had worked for both the cia and the fbi in the past. so which was another topic of conversation at senate judiciary last week. elizabeth: so misleading the fisa court about carter page. misleading the fisa court about the anti-trump steele dossier and the problems with that your final word? >> i think there is a lot to look at. the inspector general didn't draw the ultimate conclusions that durham good. they said there is no evidence of acting on bias. they would literally need a confession to conclude there was. durham doesn't need a confession. he needs to drill down, find out inferences he can logically draw, like jim comey new better

elizabeth: we have former congressional investigator sam dewey. always great to have you on. the justice department recently closed the investigation into massive leaking by the obama administration in the case of general michael flynn without any evidence of wrongdoing when declassified documents show a lot of wrongdoing. how did they close that out without any evidence of wrongdoing? >> it is confusing but the classified documents prevent ad compelling a -- presented a compelling story there was wrongdoing in terms of what was actually done but in terms of manipulating the safeguards in place to prevent wrongdoing and to avoid them. i think that senator grassley is absolutely correct to ask for answers on this point because there is a lack of congruence between what we've seen under

classified materials and the justice department probe. elizabeth: republican senator chuck grassley sent a letter to acting attorney general, release the departments on this, by february 5th. senator grassley is really angry over government leaks at the fbi and justice department he said poisoned and manipulated and distorted the national conversation on both general flynn and trump-russia probe right from the get-go. what do you say? >> i mean i think that is a very serious concern and i think that senator grassley has been right to pay attention to that throughout the past several congresses. i think you know, he worked closely with senator johnson as well and they have done a lot of work but we need to see the documents. we do need to have understanding of what is going on because this area is so damaging. it is damaging to release sensitive material. it is also damaging you're playing by the rules, you're

target after leak, you can't respond because the information is sensitive. so it is a very unfair situation and something that needs to be looked into. elizabeth: if we didn't see, if we didn't see the declassified documents you would not have heard about the fbi setting up that perjury trap to corner michael flynn. you know, basically without a miranda warning, without a lawyer present, using a routine briefing, turning that into a criminal interview of michael flynn. so senator grassley, sam, and others repeatedly said to us if it could happen to michael flynn it could happen to any of us. your thought about that? >> that is absolutely right. you have the manipulation of the system that the safeguards don't involve incoming president's foremost advisor that can happen to everybody.

elizabeth: okay. let's welcome back to the show young americans for liberty analyst, kristin tate. hey, kristin, what was your reaction when you heard california governor gavin newsom is lifting his state's covid-19 stay at home orders? >> well, first of all, i think this is way too late. this should have been done months ago because these orders have not been particularly effective in curbing covid but i think what is happening, liz, is gavin newsom is feeling pressure as this recall effort to remove him from office is really gaining a lot of traction. it started off as kind of the farfetched idea, but now has a real shot at happening because people are getting fed up. they're fed up lost for months on end. basically being told to wait for government checks while businesses and jobs have been destroyed by these draconian lockdown efforts that really haven't done much to stop the spread of covid?

elizabeth: yeah, they're nearing 1.5 million signatures needed by march 17th. they're at 1.2 million right now to get the recall effort on the ballot in california. people in california are really fed up as you pointed out. they're also angry, they keep moving the goalposts for reopening and they're not disclosing key data for standards they're using to reopen, right? so they have been kept in the dark about that, kristin? >> that is exactly right. the basically the state imposed extreme economic pain for virtually no discernible public health gain. over the last year, liz, business owners suffered gavin newsom and the entire bureaucratic class in california has been completely out of touch because these orders have impacted them financial at all. i believe newsom and his whole staff enjoyed full, guaranteed taxpayer salaries all year. meanwhile gavin newsom had people locked in their homes. police were sent out to arrest

small business owners while the left-wing rioters were allowed to be out in the streets terrorizing cities and towns with near impunity for almost the whole year. so people are getting fed up. i would add it is not just the governor's handling of covid that has led to this recall effort. newsom big government policies have led to failing public school systems, exorbitant costs of living and housing costs, a spike in violent crime and that is why even though california has some of the most natural beauty in the country people are fleeing that state in record numbers. elizabeth: yeah. you know, nationwide we've got something like stats, 30% of small businesses have been destroyed because of the covid shutdowns. everybody understands covid is lethal, do everything you can to protect itself to stop it. we had two natural disasters happening at the same time. let me put it the other way, natural disaster if you could say it that way of covid-19 because you don't really know the origin of it and man-made

disaster of the botched should downs. we have now, kristin in a dozen states, now it is growing, people suing in over a dozen states nationwide, pushing back against the state elected officials and state health officials saying you know what? you don't know what you're doing. you're ruining it for everybody. you're completely botching this and you're incompetent, we'll see you to stop it. defacto basically not operating at the will of the voter but, out of their own volition making these rules ad hoc and on the fly. what do you say, kristin? >> that is exactly right. people are fed up not just because of the poor policy, liz but also the flagrant hypocrisy. i mean as gavin newsom's orders were causing people to lose their jobs, their businesses, their life savings, their dreams, he goes out to a fancy restaurant with a big group of his friends, doesn't socially distant, doesn't wear masks, flagrantly defied his own orders. we've seen other democrats

across the country also violating their own covid orders. the hypocrisy is so insulting but it will get a lot harder for democrats now that trump is gone, because for the last four years these democrats have easiest applause line ever, which is some version of trump is bad. now that trump is no longer president these democrats are going to be held accountable increasingly for their own actions and given what is going on in california with the botched rollout of the vaccine, the spike in covid cases and these failed lockdown orders, for gavin newsom, that's a bad, that is bad news for him. he really could get throne out of office for this. elizabeth: it is also about common sense. why did california shut down, why did california shut down outdoor dining when their winter months are not as severe as the rest of the country? you had a l.a. count official voting to ban outdoor dining and then she went, ate outdoors at a

restaurant within hours of voting? then you have big box stores are allowed to stay open. we're talking target, costco, home depot and walmart, then the little guys have to shut down. the mayor of chicago saying that the restaurants, you got to reopen them. they are going above and beyond what they are being asked to do. the little guy fighting for their lives. of course they will try to do the right thing. your final word, kristin? >> all about virtue signaling for these democrats. mind you, these are the same people who have been shrieking about science and data for the last year. their draconian lockdowns are not often based in science whatsoever. they have been devastating to business owners and private sector workers in this country. people are finally getting fed up and pushing back, hopefully these democrats will be held accountable for that now. elizabeth: kristin tate, thanks for joining us. good to see you. >> thanks for having me, liz. elizabeth: coming up tough

the people that they currently have in custody there there illegally. it is outrageous. liz: mark, correct is if we are wrong. we are seeing data that there is something like more than 14200 detainees and ice facilities and more than 70 percent are criminal, illegal aliens meaning that they have been charged criminally or have charges pending against them. he is a more than 70 percent. mark: yes and those numbers are consistent with what i know negative but here's a key issue. some of that category, some of them are convicted. convicted felons and some of their are being charged. they've not been convicted . is a distinct and because the memo only goes out for those who are convicted . so you can be charged with murder, or

molestation of a child rape. in this memo said that ice cannot deport you. they can only deport those who have been convicted of aggravated a felon. every a market citizen out is in more danger because of that memo. and because of this administration that is a fact. liz: okay, tom homan, the former acting ice director. he was on with this friday. we focus news on friday. he broke the news with us about this memo. and he talked about it on air about how the biden administration is stopping the removal of criminals who are charged with hideous horrific crimes that we have ever seen. let's watch him on this predispute if this is the most damaging public safety document that i have read my 35 year career in law enforcement . this is warfare on public safety. ice can no longer do the job. they won't cripple them with money. what they've done that, the
