official mark morgan on outrage over the biden of administration ordering ice to free all deportations, could it result of all detainees being set free, one e-mail in one memo saying yeah it's going to lead to that. here is the debate, what happens to violent offenders like ms 13 gang members and other criminal illegal aliens who have been charged or have charges pending. what about them? the story is next. >> when you say you will not enforce the law for 100 days, that will create the caravans, make people want to come here, it will only increase the amount of drug trafficking in this country, i would say your real problem here is fixing the immigration problem and saying strong on border security just like president trump is done for four years, it's only way we will be able to combat this.

president biden made our borders less secure, less safe and danger the men and women of cvp and ice. in just a couple of hours of taking over as president. that was my first thought. liz: we have seen e-mails and memos going around saying that means release them, release detainees in your custody is that what's going on to. >> of course common sense for your viewers, we have a white house driven dhs police memo by an acting secretary who has been there for a couple of days, without any consultation delivers this memo to ice and cvp, it limits deportation and if you're limiting deportation, limiting those who they can arrest and limiting isis bed space to just over 30000 and they also have covid restrictions they have to comply
9:56 pm
with which is contained in the memo, the effect of the ice is going to have to release people that they currently have in custody that are illegally. it is outrageous. liz: correct us if we are wrong, we are seeing data that there is something like more than 14200 detainees and ice facilities, within 70% are criminal illegal aliens who have have charges pending against him. is it more than 70%? >> those are the numbers consistent with what i know, you are spot on, here is a key issue, some of that category are convicted felons and some are being charged, they have not been convicted and that's a clear distinction because the memo only goes out to those who are convicted, you can be charged with murder and a child
9:57 pm
with rape, this memo says ice cannot deport you, they can only deport those that have been convicted aggravated a felon. everybody is in more danger because of that memo in this administration and that is a fact. liz: tom homan, he is a former acting ice director per he was on with us friday, we broke this news on friday, tom homan broke the news with us about this memo and he talked about on air about the biden of administration stopping the removal of criminals who are charged with the hideous horrific crimes that we have ever seen. let's watch tom homan on this. >> this is the most damaging public safety document i've read in my 35 year career of law enforcement officer. this is warfare on public safety, ice can no longer do their job and i've said for a long time, they will cripple them with money, while they've
9:58 pm
done that they took $300 million way and on top of that they wrote a three-page memo that says i she will no longer do your job and pick up criminals and jails they will be released in the street and less than aggravated felon and with the conviction, you will no longer arrest anybody who has been here before november 2020 regardless of the criminal history. liz: do you agree with tom's assessment? >> 100% tom is a patriot and has been serving this country for many, many decades, he is spot on, everything that tom said is factually accurate, this is arbitrary november 1, 2020 deadline but what about those that got away and we did not apprehend, how are we going to approve and think about it because of this memo if you're a gang member and been charged but not convicted, you cannot be deported at some point ice will
9:59 pm
fill the bed space and have to release them into the country. it is ridiculous. liz: what's the next step what happens from here the state of texas is filing a lawsuit against the biden of administration. will it be able to be stopped in the courts? >> i hope so because i believe saying the president stopping deportation for 100 days i believe that is illegal on its face is contradictory to the naturalization act which by law gives eyes some of their authority. i think it is illegal what is asking ice to do on top of dangerous. liz: texas is saying it's against and then violates federal law, there saying it violates the constitution. what do you think of that. >> i agree with that just like daca i believe on its face unconstitutional illegal as well and here we go again, right now the caravan that we talked about
10:00 pm
that are coming make no mistake, that is happening because this president open border strategies and just getting worse. liz: mark morgan, thank you for joining us. we appreciate it's good to see you. you have been watching "the evening edit" join us again tomorrow night. lou: good evening everybody most rhinos, person they would rather quit altogether and then actually fight for truth and justice and the american way of life. these rhinos who are playing the fight, or simply afraid to stand up against the radical dems in the left-wing in the deep state. the chamber of commerce of course and wall street and big tech. in the senator rob said that he is not going to run for reelection next year because in his words, it is gotten harder
