"the evening edit" starts right now. ♪ elizabeth: let's go right at it with mark morgue gone, he is former cpb acting commissioner. start it off, with the horrific event in florida, two fbi agents fatally shot, one wounded in florida, the suspect dead. this is a terrible story. can you talk to us about it? >> liz, i'm a 20 year veteran of the fbi and my heart goes out. i'm so deeply impacted by this. you know, to the families of those two fallen agents, our thoughts and prayers go out. i really hope we can be united as a country to talk about this tragedy and sorrow. call these two fbi agents out as the heroes that they are. elizabeth: you know they are heroes. the fbi put their life on the

line, border guys put their life on the line dealing with all sorts of crime. if the average american knew what they saw every day they may not want to go out of the house. i know, i talk to the nice all the time. it seemed to be a child sex trafficking ring. that is what the border patrol and fbi are talking about all along. we talk about dozens of children rescued under the prior tum administration. we hope that continues. talk about that a little more. >> that is absolutely right. the human trafficking side on the border, a majority of people come into our border illegally, liz. most don't know they're being trafficked until it is too late. the predators, disgusting human beings that the fbi targets in their crimes against children squad like they were trying to do today, is part of that. it doesn't just stop at the border. i say the exploitation of the cartels doesn't stop when people illegally enter the border t continues once they enter the united states.

it is who horrific. shows how dangerous it is. elizabeth: let's move on to this. president's new orders on immigration. talk to us about reuniting migrant families under the trump administration. more than 5500 families,hundred children whose parents are guardians have not been located yet. talk to us about that? >> that number is higher than i know haven't been united. what the task force is going to see, in two years plus the lawful zero tolerance policy was stopped, what they stop the overwhelming majority of the families have been in fact united. the other thing the task force will realize, a significant number of these parents are telling us that they do not want their children back. they want them to stay in this country. the other thing that the task force, liz, is going to find out because of the broken immigration system, loopholes in our system that president trump

fixed is what they're going to find out that children for a long period of time were using the broken system to actually exploit and abuse children and buy them and use them as their ticket to enter the country illegally and stay. that is what the task force is going to find out. elizabeth: yeah. the president trump initiated 400 executive actions to close these loopholes. the republicans are getting ready to battle this out in court. president biden going after remain in mexico. that policy saying, listen if you're applying for asylum you can't just do it come in here illegally trying to get asylum awaiting your court battle. mexico, guatemala already moving military troops and law enforcement to stop regular migration and border crossings. you have this move by president biden. how do these two things square? >> it doesn't. think about it. under president trump's administration we have gone

unprecedented cooperation with the government of mexico and central american countries, liz, to really address the illegal migration. as a regional crisis that it is. migrant protection protocols remain in mexico is unprecedented agreement between two nations to really work together and it was successful that program alone enabled us to end catch-and-release. 2019, cpb and i.c.e. released over 5000 people in the united states that were illegal. in 2020, it was less than a thousand. president biden with the stroke of a pen will completely do away with that. his executive order, liz is misleading a white house directed memo already stopped future enrollment in pp. it is already been rescinded in essence and the crisis has already begun. elizabeth: okay. why undo something that is working? because texas, you know the governor in texas legislature is moving to strengthen their

borders do you to what they're seeing coming out of the biden administration. they will spendhundred million dollars to fight human trafficking and drug smuggling. that we're seeing is coming in through these caravans. that is what we're seeing crossing the border. we're talking a major crime wave south of the border by drug cartels. historic violence and bloodshed, shootouts just miles from u.s. towns and cities. so undo something that is working? >> look from a law enforcement perspective, liz, you just laid it out. from a law enforcement standpoint it makes no sense. our borders are less secure. our country is less safe. you're endangering men and women on the front lines trying to protect this great nation. at the end of the day i can only draw the conclusion this is politics over public safety. we're seeing increased violence among the cartels. we know that we anticipated that. if you open the borders, cartels control everything that come across that border. they're fighting for these very lucrative avenues lining their

bank accounts with millions of dollars. of course you will see increased violence as they fight over that because of biden's absolute open border policies. elizabeth: you know we see the aclu and sierra club also cheering and applauding the push to tear down the border wall but then we talked to law enforcement. we talked to law enforcement here. we talked to law enforcement officials in other states. we have, we also read some documents out of central america and documents about border security in europe and russia and asia. these countries use walls. don't look at it just discretely as something that looks ugly on the environment. yes, it poses environmental hazards but there is an issue around border security with the use of border walls. we're talking nearly 800 miles of border walls in europe. they work. can you talk more about that? >> they do. liz, we've been saying this for a very long time. walls by itself is not end all, be all but part of a multilayer infrastructure and personnel.

wherever it is, data show all measures of success improve, including less violence and attacks against border agents on the front line. that is a fact. anybody that says walls are not effective, they're lie being to the american people. that is not is political reality. they're endangering men and women on the front lines. i find irony, hypocrisy they built walls around the capitol to protect members of congress, that is okay. walls not to protect our southern border are not. it is ridiculous and hypocrisy. elizabeth: we would like to live in a utopian world where you don't need walls. this is pragmatic this is reality. this is real, every day, stuff, you guys, mark morgan have seen. thank you for your service our country. >> you bet, liz. elizabeth: byron york about the biden agenda. it is about to hit a wall. never has an administration come out of the box so strong to kill

♪. elizabeth: okay. welcome back to the show fox news contributor byron york. byron, your reaction. have you ever seen a president so fast out of the box killing jobs? >> no. i mean he did it on day one but you know, you have to say this is what the most activist part of the democratic base wants, from their new president. the executive order killing the keystone pipeline costing about 11,000 jobs, that is a campaign promise. that's what the activist base of the democratic party wanted, to, no exploration on federal lands, killing dozens of thousands of more jobs. that's what they wanted. so president biden is not just making it up. he is fulfilling campaign promises. elizabeth: yeah. now we got 85 house republicans out with new legislation to protect the keystone pipeline and thousands of jobs.

the small businesses in main street america, they also, you know, they make a living off of jobs like this. that legislation would cut out president biden's permission for the keystone. don't know if it will pass the house or even the senate. but now there is push back by republicans. even montana democrat, jon tester, jon tester, he supports the keystone pipeline. what do you say? >> well this is a good thing to debate to have in congress. obviously a law would trump a executive action from president biden that would be a very big deal. what you're going to see here is a debate between the people mostly, republicans who are arguing that the action is killing existing jobs with those democrats in the administration like climate czar, john kerry, who are saying that oh, no, this will create thousands and millions of new jobs. joe biden has a goal to create 10 million green jobs in his

administration. and, you know, if you remember back this is exactly what barack obama said when he became president. remember he appointed a man named van jones to be the green jobs czar. they were going to kill the coal industry and keith all sorts of new grown -- green jobs and it didn't happen that way. maybe, 3, 3 1/2 million jobs could be called green jobs today. the idea of creating 10 million more is just going to happen. what you have is there was a case you remember, solyndra, companies that benefit from special treatment getting government largess for products that can't really make it on the market. elizabeth: yeah. you know china dominates solar panels. they dominate lithium batteries. dominate the chemicals, components for all of that. we had top obama officials warning hey, you can't immediately dial back and shut down coal and fossil fuel jobs

and expect all of sudden solar plant is going to pop up in west virginia. it doesn't work that way. john kerry's family owns a private jet. private jets pump out 40 times as much carbon per passenger on airliners. john kerry lectured that oil and gas workers you have you have to lose your job while flying around in a right jet. even admits majority emissions come from overseas. >> he also know paris alone is not enough. not when planet's mission, global emissions come from outside of u.s. borders. we could go to zero tomorrow and the problem isn't solved. >> they can be the people to go to work to make the solar panels. i think workers are going to see that with the efforts of the biden administration so they will have much better set of choices, frankly it will create more jobs.

elizabeth: all right. that kind of top down talk is just not going to play with republicans already. i mean they're going to fight this in court. i just want to make this final point about why the biden agenda is going to hit a wall in congress. because they think they can ram through stuff on budget reconciliation like covid relief, to do that, to get a simple majority vote you have to abide by the pay-go rules. that means if you're going to incur new debt you have to cut spending elsewhere. if they do anything that incurs new debt they have to cut medicare or farm subsidies or get 10 republicans agree with what they're doing to bust the filibuster to do a 60 vote. what do you say to that angle? is the biden agenda going to hit a wall? >> of course it is going to hit a wall. remember, biden took office saying that we are now going through four simultaneous crises.

network. welcome back to the show fox news contributor, scott martin. we love having you on. you're a wall street pro. gamestop, looks like the gamestop frenzy is game-stopped. are you worried this will spread, this bubble mania, will spread to other sectors besides silver, besides these reddit meme stocks, what do you think? >> it is became over, emac. it is a lesson learned really. i don't think it will spread as much as we would have thought on monday. if you look at silver trade it, was basically over noon on monday by lunch. it didn't last long. gamestop frenzy, nokia, frenzy, it lasted several days. some shorts taken out of position, some were taken off-guard, that allowed the gamestop frenzy a little longer. next time i don't think they will be as surprised. elizabeth: there is a lot of talk about this morality tale

about this being david versus goliath. little guys taking on the big guys. this is bubble mania this is terrible for investors in the market. people get hurt. they lose a lot of money this is not a morality tale. this is financial game of uncle, right? >> yes. and frankly, emac, a game of arithmetic. if you look what happened to gamestop's stock, easy for me to say, over the last several days, emac it, rallied 35%, 40%, 60% every couple days here and there. then it lost off of big numbers, a 30% draw down. then a 50% drawdown. when you look at arithmetic, losing less amounts off of bigger numbers, 480 was near the top, you realize how much money you were losing. individual investors emac, calling me, emailing i don't understand why i lost so much money. i thought i made more than i

lost? you were losing more off of bigger numbers. that to your point to individual investors there is no such thing as free money. elizabeth: let's explain it this way as one of my pals at a wall street shop told me, let's talk about it this way? finance a big chat room with crowds of day traders who artificially boost shares had in failing companies, mall retailers like gamestop. you loan inexperienced traders $150, for a share that is worth $300. this sound the like investing in a ponzi scheme. you know what i mean? we have that happening. the question why didn't nyse, delist these companies, dropping into penny territory? why is congress talking about fixing the problem with a wealth tax or a tax on stock trades when hedge funds stopped congress enacting a tougher uptick rule? which you would mean have a

firewall within the markets you can't short a stock unless it is on a uptick. we had that in prior decades that is a natural fix, right? >> great point. the regulators were out to breakfast, lunch, dinner, midnight snack on this one. it got out of control. i think to your point, the fact this is allowed to go on, emac, all last week was near criminal t was allowed because it was within the rules but it was a bad move. tell you what else happened along the way too, on thursdayish, some sharks got in the water. meaning some big institutional investors were shorting names again with puts or outright shorting the stock f you saw what happened on friday, a lot of platforms you referenced some individual investors, mom and pops were trading on friday, started cutting off liquidity to a lot of investors needed liquidity to most, get out of the way. they got stuck in the trades,

were not trapped. weren't letting people early out of the exits, monday, tuesday, people have lost another 50, 60, 70%. elizabeth: that is, you laid it out perfectly scott. what the lay of the land there, what happened. i mean, you know, they're going limit trading when they run out of capital to clear the trades. that is what happened with robinhood. robinhood ceo talking to house financial services expected to testify. finally talk to me about senator elizabeth warren wanting now a wealth tax which is unconstitutional. you would need an army of irs auditors the size of russia to enforce appraise everybody's net worth, meaning value of your houses, value of your car, mark-to-market, what your net worth is. irs officials have told me they don't want this. they hate it. you need an auditor, army, appraiser army size of russia to enforce it. it is patently observe. breathtakingly idiotic what one person told me.

your final thoughts, wealth tags to fix it? >> words i can't say on tv, emac. not only is the wealth tax very expensive on its wholesome, itself, the fact of enforcing it, the cost of actually enforcing the wealth tax will probably need its own tax. it will be so costly, people need to go out there to find the data points, find these figures. it is absolutely ridiculous. something that would really impair the u.s. economic growth picture. elizabeth: yeah. that's right. you have, that's right, you have to raise taxes even more to pay for that irs army to do it. scott martin, thanks for that great insight. your perspective there. good to see you, scott martin. >> see ya. elizabeth: still ahead, tom del beccaro. he is the man leading the movement to recall democrat california governor gavin newsom. he is going to give us an update on that and whether or not, is governor newsom really going to be kicked out of office? that threat is looking more serious by the day.

our group rescue.org took in 20,000 signatures yesterday. we need 1.495 million ballot signatures. we expect to pass that in the middle of february. then we'll keep pushing to get to 1.8 to create a cushion. elizabeth: are californians waking up to say to themselves we don't need or have to live the way we've been living under this governor, is that what is going on? democrat state lawmakers in california, wait a second, what is the data you're use towing shut down or lock down california? he is being secretive. go ahead. >> not seem secretive. he is refusing to give it out. we have democrats donating big money to rescue california.org. those 1.3 million signatures, a lots of democrats. in november they turned down gavin newsom's policies of a tax increase, getting rid of uber and lyft as we know it an

cashless bail. his policies are not practical and they're not popular right now which is why he took a big dive in the poll in the last four months. as "l.a. times" put it, he is plummeting. so there is blood in the water. democrats are coming out and thinking about running. this is going to be an exciting next couple of months. the rest of the year, the election recall election will be in august. elizabeth: yeah. so he is leaving voters in the dark about what data he is using to shut down and lock down california. the administration there, governor newsom's administration saying well, voters won't understand the data when you have silicon valley and you know, really smart people in california who i think have figured it out. you have we are things like the california health department, saying restaurants in california you're not allowed to turn on your televisions because it could attract more people to watch it and spread the virus? listen, everybody knows covid is deadly. we have to be careful, really

you have got to shut off tvs in restaurants now in california? >> what about the workers if they want to watch it? think about the policy having vaccination points at dodger stadium. for years they have been telling seniors don't go near crowds. dodger stadium is a crowd by definition. you're right, if they disclose this stuff some very smart people in the state would be able to give their input and improve it. why west virginia, as you remember that governor talked about his private public partnership. we don't have that in california. they are government centric and government failure on covid, water, electricity, poverty, homelessness, on and on. elizabeth: yeah. so you know, i think, you know, people are saying what a turning point was when he shut down california, shut down restaurants and he is caught eating out at a luxury restaurant. shuts down schools. but then his kids are in private schools. california has wildfires, power shutdowns, water shortages,

michigan. welcome fox news contributor david webb. david, here is what else is happening. at least 15 states and washington, d.c., now seeing major fights between teachers unions and school boards and parents saying, the fight is over reopening. talk to us about that. >> well there is so much to say here so let's try to unpack some of this in the short time we have. first of all obviously the students are losing. we're losing a school year but more than that they're losing the advancement, education, socialization. think about things that get caught in schools. abuse and other issues. over 50% caught by teachers, by school counselors and officials. so that is another issue. food security, for these kids in poor communities. now let's talk about the women around america. women have been some of the biggest losers in jobs since the pandemic began especially in the service sector jobs, restaurants, and other service sector jobs.

they typically overlap with poorer communities. single parent, another hindrance to economic security. when they lose even more because they have to stop to take care of their children, they're unable to work which after effects the economy. there is a long term here. the long term is that we have generation that will be hampered, that may affect our workforce, a big economic story. elizabeth: okay. well, here's the fix. mayor lori lightfoot of chicago is also bringing up this fix. other mayors are saying this is the fix too. the cdc says you can reopen. the journal of journal of the an medical association says yes, you can safely reopen. the mayors are talking about more ppe. they're talking about temperature checks. they're talking about cleaning school classrooms in order to be safe but the teachers are saying, we want to be vaccinated. we are not going back. some say they will not go back until the year 2022, threatening to go on strike.

private schools, catholic schools, charter schools, back in schools. your thoughts. >> if private schools are open, data supports that children should be back in school, more than that, it is a broad application, there will be individual cases why are those schools not open? the answer, these in some cases are selfish teachers and unions. many of these teachers want to go back to work. let them go to do their jobs. they spent hundreds of millions of dollars in some districts on safety protocols, on equipment, on training and what's not working is online learning and remote learning t doesn't work for the school system. doesn't work for the students. doesn't work for the community and therefore not the economy. elizabeth: yeah. poor families, low income families cannot afford computers and laptops for their children. so it is really hurting them too. i want to read you this quote from the "journal of the american medical association," quote, there has been little evidence that schools have
