your take on this, harmeet. >> you're absolutely right, liz and if you've paying attention over the past many years you will see what the democrats are doing here not very different than what we've been doing in the past. they make big promises particularly to their special interests and accommodate them. all of sudden some states, some localities like san francisco today is suing san francisco unified school district. that is happening in d.c. as well. all of these years, these democrats have been propped up by the california teachers union and other large teachers union. they really control them. so that is why children did not get educated this past year. suicide issues abound and mental health. i would not trust the crocodile tears of the democrat on these issues. they are very hypocritical. they caused this monster in that sense. they will not be very credible in resolving this problem. elizabeth: so there is that fight. then there's a big push. we need to get america

defensive. elizabeth: okay. it's not his only choice to fly private, harmeet. he can fly commercial. private jets spew out more pollution and carbon than commercial jets. harmeet. >> by order of magnitude. you see how he did a very common trick by politician answer a different question than the one he asked. nobody questions said he should fly or swim to iceland. he has to fly. it is manner which he did it. one should not be surprised by this other celebrities on the left, leonardo dicaprio and others all jet-set around in their private jets to accept awards for environmentalism and third world issues. everybody should see this coming. that is great comfort to the pipeline workers and others who are being peeled other people will get solar jobs, you should be happy with the overall effect of the environment of you losing your job. he is completely out of touch.

50-year-old woman who has been working for oil and gas company, who has developed extraordinary expertise, who has kids in school, who has a mortgage to pay, just to quit your job because we're going to fire you anyway and go back to school and, they were you can go work in a green job but we haven't told you which one yet. i mean, you know, put down the bong. that is just not realistic. elizabeth: harmeet, your reaction? >> yeah. put down the bong, indeed. this is globalism 101 and this is what the left has been preaching for generation, it is okay to outsource american jobs to rest of the world. who cars. americans can learn some other job. of course this doesn't work in real life. that is why they have done such a terrible job. look at all the people who lost their jobs in the energy sector over the years and in our rust belt in the united states a. and so the callousness, the

to offset through cuts to medicare or cuts to farm subsidies. president biden's poll numbers are dropping in the "quinnepiac poll," down below 50%. covid relief, we may not see it for months says senator joe manchin. >> you make great points. the way they go off, fudge numbers and cuts with projections and projections are usually partisan and fit whatever outcome is desired. so i am glad to see some people pushing back but i frankly don't believe any of that will necessarily last. today's joe manchin can be a different person tomorrow. that is often what happens in politics with the shifting sands of politics. you pile on the fact that in addition to all of this, democrats wanting to push through $15 an hour minimum wage will insure more americans will lose their jobs permanently. there will be a lot of economic carnage to come from political sources before we begin to think about a recovery. some jobs will never come back.

♪. elizabeth: joining me now is texas representative brian babin. congressman, it is great to have you back on. congressman, you were in texas with kevin mccarthy and other republicans about what the biden administration is doing. the biden administration is facing a crisis at the border. it has to reactivate a overflow facility at the border to take in hundreds of migrant children coming in the next two weeks. these are the same facilities that vice president biden attacked trump for using, that the obama administration had used. can you talk to us about this? >> absolutely. he is facing the same situation and his rhetoric all during the campaign, in fact all of the democrat candidates across this

country had the rhetoric that gave the idea to everyone that wants to i am my great legally or illegally, especially illegal ones, across the word, especially down in the northern tray angle and mexico, if biden won it would be an open border. this is why we had caravans on the way up here. sure enough, we thought maybe biden would be, would go at a slower pace than what he has shown, especially on the border situation. and, but he hasn't. he is, he is eliminated the wall building. we've to the 450 miles of very, very efficient wall. it is laid off 5000 americans down there in construction. he reinches -- reinstituted catch-and-release. he ordered release of 14,000 detained illegal immigrants.

i think 9,000 of which are criminals. and of course he is, he is reenstatuted the, or eliminated the traveled ban, i should say, which keeps terrorists out from terrorist-heavy countries around the world. and of course trump was just chastised and persecuted unmercifully for instituting these types of policies. they have also, with a stroke of his pen biden is, has eliminated the migrant protection proh protocols, remain in mexico, if you will. we know since last year, liz, over 9,000 immigrants that have come in and been custody ever i.c.e. have tested positive with covid. so all of these add up to the fact that the biden administration is placing the american people in a very dangerous and precarious position. it is really sad.

♪. elizabeth: okay. let's we come former house oversight chair jason chaffetz back to the show. great to see you again, sir. your reaction to news u.s. attorney john durham, john durham is moving on to looking into the top echelon of the fbi under the obama administration after looking at the cia. people keep, we're hearing from our sources where are the indictments? you've got the evidence of fisa court perjury, the fbi misleading the fisa court. where are the indictments from john durham? >> if the news durham is moving i'm happy, i'm thrilled. i want him to be thorough, accurate, right on the money but remember the inspect general handed them more than 1000 pages

of documentation about all the malfeasance that was going on there at the fbi. so they should have had a running start at that. i think kevin clinesmith just getting probation, no jail time for what he did was fundamentally and totally wrong and it is very difficult to look at what the intelligence agencies were doing, perhaps in concert with the fbi. so if those reports are accurate, hallelujah, let's figure out what this is. if people did wrong and broke the law, they should be indicted. they should be prosecuted. many of them probably should be in jail. elizabeth: you know, so, former dni ratcliff, you know, he talked about this recently, sir. durham's investigation began nearly two years ago in may 2019. again where are the indictments. listen to former dni john ratcliff on the durham probe. watch this. >> i sat in a room last july with john durham and with attorney general barr and we

point. elizabeth: okay. your reaction to that? >> i think the american people are fed up without seeing justice administered. look, the former director of national intelligence, jon ratcliff, i served with him in congress. he is as straight of an arrow as it can possibly get. he is one of the finest prosecutors. he understands this. he looked at this intelligence for years and has come to very definitive conclusion that there are i think, these people, they have got to be held accountable and being held accountable isn't just being allowed to retire from your job or giving you back pay. to the contrary, they did something that, they are given special police powers. they abused those powers. it is all laid out in the inspector general report. and i hope he's right, at that there will be additional prosecutions but, liz, how long is it going to take?

it's been going on forever. elizabeth: our sources in intelligence and the fbi, they have repeatedly said there was per jury committed at the fisa court. the fisa court was launched to catch terrorists after 9/11. it wasn't meant to spy on political opposition campaigns. the obama administration, fbi abuses were about misleading the fisa court, not disclosing information to the fisa court, about democrat-funded opposition research being used to justify wiretaps. this is really intrusive stuff on civil liberties. your word on that? >> yeah. i was never comfortable with the idea we had a secret court in the united states of america. now should the department of justice prosecute? yes. are they have they shown any propensity to prosecute one of their own? no. unfortunately though the court could also hold these people in contempt. are you aware of any other court in the land where if you purposely and knowingly lied to

♪. elizabeth: okay. let's welcome "the daily caller" editorial director vince collagnese. vince, first to this, a delegation of new york congressman, led by elise stefanik, tom reed and lee zeldin, they say justice department you have to subpoena governor andrew cuomo. he covered up nursing home deaths after his executive order put back recovering covid patients back into nursing homes. will he get subpoenaeded? >> i hope so. he has a lot to answer for maybe more than any other government official in the entire country. that is why we have a justice department. one hopes they actually act on

this issue. governor andrew cuomo, remember this all started in march of last year. he has this order, yes, these nursing homes have to take sick coronavirus patients back into the nursing homes. it wasn't until the end of april, when the "new york post" and others took notice, wait a second, thousands of nursing homes residents are dying. comb comb's order sent them there. when a bunch of funny business happened in the new york state department of health. they changed the way they count nursing homes and deleted andrew cuomo's order, attempted to scrub it ever existed and cuomo spent the year denied it ever happened. elizabeth: he denied the language in it. the order still exists. that is an important order you put out there, nine health officials through the summer and fall claiming that cuomo was politicizing health decisions over covid. his order not only said nursing homes, take back in recovered

covid patients, you cannot, you cannot test them for covid before you take them back in. so again and again we asked, how is it that a governor gets an emmy and writes a book about his expertise during a pandemic, when this is going on? then we have this, vince. he is playing a blame game. blaming trump, federal government, media, "new york times," nursing homeworkers themselves. we have now this breaking news. superior court judge just handed down an embarrassing decision against new york governor cuomo, saying your administration, you guys broke the law. you did not provide a government watchdog group with the total real actual real nursing home death count from covid-19. no other state in the country counts it like new york governor andrew cuomo counted nursing home deaths. your reaction to that? >> that is why we have public disclosure laws. groups you mentioned can ask simple questions of the government. for instance, how many people

died in nursing homes or who came into nurses homes from hospital? the new york department of health has obligation by law to answer that question. the judge made that really clear today. instead we've gotten a gigantic coverup this follow as week where we found out from the attorney general of new york state, letitia james who looked into this, wait a second new york state is reporting they have somewhere in the vicinity of 8,000 nursing home deaths. the number is 56% higher. it is much closer to 13,000 of them and andrew cuomo again to your point has been relishing in kid glove media coverage which treated him extraordinarily well in the face of a lot of unanswered questions about the deaths of people's loved ones in his state. apparently at the direction of his government. elizabeth: you know, here is the thing. only new york state counted nursing home deaths if they occurred inside of the nursing home, not nursing home patients who went to the hospital and died in the hospital.

that is what cuomo's administration knocked out of the numbers. only new york state counted it that way. new york state was like a war zone here. the trump administration responded when cuomo complained. they sent in the usns comfort. that ship, that navy ship, hospital ship was hardly used. the jacob javits center, massive amounts of ppe, beds put inside of the jacob javits center, hardly used. when he complained people responded and tried to give him what he wanted. at the same time he is covering up this information. why not just be honest about it? why not be transparent? why not just tell the truth? >> the answer is because he is as brazen a politician i think i have ever seen. the only thing he cares about, not the lives of people lost in new york unfortunately. his behavior demonstrated only thing he cares about his political future. he has aspirations beyond the governor's office in new york. as a result is doing everything

he can to hold on to any semblance of legitimacy. so far he has gotten way too much coverage from the press to do that very thing. elizabeth: but when the biden administration did not hire andrew cuomo his initial reaction was, i'm going to sue you, biden administration, if you don't give new york state money to do a vaccination roll quote and to help us. the state anything cuomo asked for the state has gotten. now the threat is to sue the biden administration? the word he wasn't hired by the biden administration, it's a leadership issue. go ahead, vince. >> fascinating about this vaccine distribution issue is "the new york times" report that you just referenced a moment ago about how nine different workers, top level workers in the health department in new york have quit during the duration of pandemic because of cuomo's leadership, one of the things they were upset about, he was distributing vaccines through the state hospital

what happened when the two fbi agents were shot and killed in florida? >> yes, ma'am, i can. there were five shot, two killed. they had a warrant for child pornography to search on this man's apartment. he watched them over the video camera on his doorbell. he saw them coming. retrieve ad ar, ak-47 rifle, one of the two. when they approached the door he opened up on them through the door. killed two, one severely, one superficially, committed suicide. it might have been a better if he committed suicide that morning before they came. that is the way i feel about it. you have to understand about these people. they're extremely dangerous, once they are arrested they will get convicted. the fbi doesn't lose cases. once they go to prison they will be killed there.

prison inmates don't like these guys. they do everything they can to eliminate them. they will take every opportunity to kill them. they have nothing to do, do it on the street so it doesn't happen to them in prison. it is a terrible dangerous situation for our agents and policemen. elizabeth: fbi agents are heroes. we lost two of them. laura schwartzenberger and daniel alfin. both of them specialize investigating crimes you're talking about. we're covering stories that don't get a lot of attention, what people are doing to keep us safe. >> yes. elizabeth: so have you ever heard of an individual shooting through a door like this? i don't think we've seen the loss for the fbi like this in four decades? >> well the last one in miami was a vehicle assault where two of our agents were killed because of superior firepower of two other individuals, criminals. two of our agents were killed, ultimately the two subjects were killed. that is not that uncommon, you would take a shot through a door, either a 9mm or 45 or .40,

or this case a assault rifle will penetrate any door you have, even metal ones. elizabeth: even metal ones. thank you for that information. so this is again one of bloodiest days in fbi history in south florida. among the deadliest of the history we've seen of the fbi as well. that crime coincide what we're seeing in terms of human trafficking, in terms of what government, u.s. marshals is doing to rescue missing children, danny. we have been tracking this story. we have 421,000 children missing in this country. now the u.s. marshals rescued more than 150 of them in six operations in eight states. your reaction to that story? >> kudos to the marshals service, kudos to them. they do a good job. every federal agency has these things.

customs and border patrol have been doing them for decades. the fbi, i started one of these in 1994 if you can believe it going after kiddie porn guys and human traffics. it is pervasive. what is going on in the border, it will get a lot worse. that is where a lot of them come from. these kids have value tags on their head. i can tell what you they charge for one of these children and it's despicable and it is a huge national crisis. elizabeth: it is absolute disgrace. talk to us more about human trafficking and what is your reaction to whether or not the administration and, you know, individuals and congress understand the severity of human trafficking at the border. why you need to keep border security tight to stop this. >> yes, thank you for having that. that is the best question ever. when we had these surges, we saw them before, and thousands of people come to the border, that siphons away border agents and

customs agents to that location. there is an an fin knit number of those people. cartels know if we put a bunch people at point a, all these customs goes will go there. you have point c, d, e, there is no customs and border patrol agents. so all the human trafficking things go to that location. it is essentially a giant diverse to bring in human trafficking victims and drugs. by taking away security at the border, by taking down the walls or not finishing the walls, all they're doing is propagating human trafficking. disregarding it. they need to listen to the professionals, guys, border patrol people can give great briefings on this they give them to me. it is disgusting and disgraceful that our country would even think about reducing security when you have illegals coming in. there are illegals and also when they bring in diseases and more
