and make no mistake, there are no innocents in the democrat party. they have all either led, followed or act by yeted in this dark assault -- acquiesced in this dark assault, and their venal efforts will go down in history as the democrats' most evil enterprise since slavery. democrat leaders have undertaken to destroy former president trump since he was a candidate for the office back in 2016. and now they are in total control of our government with the election of president joe biden. biden has approved this latest attack on both the constitution, the nation and, of course, the former president as well. in his first white house interview, president joe biden had the temerity to claim he isn't, quote, looking for retribution. in that interview with "people" magazine, president biden

dems blasted the trump administration for using. that facility is being prepared for the possible arrival of as many as 700 more illegal children immigrants in the next two weeks. some 5,000 unaccompanied minors are now being housed along our southern border with mexico. it's not just a crisis along the border with mexico that the biden administration is struggling to grasp. they're also working out how to deal with the rising threat of communist china. for more on that, we turn to fox news correspondent rich edson at the state department. good evening, rich. >> reporter: good evening, lou. and the biden administration says it is reviewing some of the major foreign policy challenges as house republicans say they're pressing the administration to deliver some more information on how specifically this administration will con front china. this as the state department says that china is the biggest threat to the u.s. >> if we are going to hold china

to account, we need a confirmed ambassador to the u.n., a confirmed united states permanent representative to the u.n. ambassador thomas greenfield has been sounding the alarm on china for decades now. the biden administration is prepared to outcompete the chinese across the board. >> reporter: ambassador greenfield's vote in the senate foreign relations committee is delayed. senator ted cruz is objecting over a 2019 speech that greenfield gave where she said the u.s. and china can be positive influences in africa. two weeks in this administration's already confronting a major challenge in the region. the government overthrow in burma. the u.s. has called it a military coup, but china state media outlets described it as a cabinet reshuffle. the state department has yet to say whether the u.s. is

consulting with china on the burr a ma coup. and as reports say china's government tried to hide vital information about the coronavirus outbreak, investigators are in wuhan. they are examining that virus research lab there as part of their investigation to try the find out the origins of the coronavirus. lou, back to you. lou: rich, thank you very much. an opportunity denied the w.h.o. and american public health authorities for the past year. as rich edson just reported, the world health organization was allowed to investigate the wuhan institute of virology. investigators today talking to chinese doctor nobody as the bat lady who's been conducting coronavirus research involving bats. for their part, the chinese propaganda machine making allegations about the virus starting in the wuhan lab as not even worth refuting. and china's foreign ministry saying the united states should act like china and invite the

w.h.o. to investigate the virus' origins in america. apparently giving us one year in which to respond to that kind invitation by the communist chinese. there are promising developments on the fight against the china virus pandemic. new cases are down 62% from their high earlier this month. deaths have fallen 23% in the same period. and hospitalizations across the country are down 30%. more americans have also been vaccinated against the china virus than have been infected. 26.5 million americans have received at least windows of vaccine. one dose of vaccine compared to the 26.3 million cases reported by the cdc. in other words, the fight against this pandemic is going much better than most left-wing news organizations ever claimed

while president trump was in office. there is slowly a shift to recognizing a more positive reality on the part of the national left-wing media with president president biden in office. former president trump, you may recall, promised 20 million people would be vaccinated by the end of 2020. and how, how he was, how that remark was scoffed at by the, oh, so smug left-wing media. well, it was a target that was ultimately are reached, and -- ultimately reached, and it was reached some 20 days late, but just in time for president trump's last day in office, january 20th. we need to see more stories about how close that forecast was than the derisive, the derisive media have claimed. things are much better. they're not good, but they're getting better. now to a developing story in

south florida. the fbi there is investigating how a so-called routine search warrant ended in bloodshed and murder. this as a new report says a child porn suspect was able to shoot two fbi agents dead after watching them approach through a doorbell camera. fox news correspondent steve harrigan is in sunrise, florida, with new details on the suspect. steve. >> reporter: lou, that gun battle took place just after 6 a.m. in the dark at the gated community behind me. the fbi now naming the shooter as david lee hoover. they're not releasing his photograph. he's 55 years old, lived alone, had a computer consulting company and no criminal record. the fbi also confirming to fox news that hoover watched agents from a child pornography task force approach his apartment through a doorbell camera. he then opened fire with a

high-powered assault rifle, firing directly through the door. he shot five agents, killing two of those agents, wounding two more with multiple shots. two of those were hospitalized, one has now been released, and the fifth was treated at the site. it really shocked this gated community. we've been talking the neighbors all day who said this man was very little known, but they were shocked initially by the gunfire, then saddened that someone nearby could to that. the two slain fbi agents, both of these had years of experience in fighting child pornography, one of the most difficult assignments there is, and they are being lauded today by fbi officials as heroes. >> it takes an incredibly special person to answer the call and do the heroic work of an fbi special agent. it requires self-sacrifice.

against the former president is, quote: airtight. the fantastical raskin also says the trump legal team 's response to the article -- the article of impeachment -- is full of absurd constitutional arguments. well, our first guest this evening can well respond to raskin's remarks. he's part of the legal defense team for the former president. joining us this evening is attorney david schoen, member of donald trump's defense team. he's been a federal criminal defense attorney, civil rights attorney for more than 30 years, part of roger stone's defense team. it is great to have you with us, david, and we appreciate it. let's start with jamie raskin who seems to be, well, capable of some considerable fantasy. suggesting that those are absurd constitutional claims made by you and your attorney colleagues.

>> i certainly stand by all of the constitutional claims. this senate has absolutely no jurisdiction to conduct these proceedings. they're unlawful proceedings. the constitution's quite clear on the issue. a number of scholars have debated the issue, but if you go to the language of the constitution, it's clear that -- and everyone knows, the impeachment proceeding is intended for the removal of office of a sitting officer. the impeachment occurred during the -- the impeachment occurs in the house, of course. that occurred while president trump was president, but they held the articles until he was no longer president. there's absolutely no jurisdiction in the senate to try former president trump than there is any other citizen in the country. and i would suggest to you that if you think any citizen in the country ought to be hauled off the street and brought before the senate for a trial, a trial, by the way, lacking in all due process, and we've got a very sad situation, dangerous situation in this country. i want to say this about the due process. we're now six days away from, six days away from this trial. we have absolutely no guidance as to the rules that will apply.

we know a free-for-all, there was no rules of evidence, but we don't know yet whether they intend to call withinses, how much time is going to be given to the sides, nothing about this thing. and it's really incredible. but this is why they want this proceeding to go on now, because especially before the evidence comes in. this is a complete rush to judgment. everyone in the country now knows that the evidence is developing, that what happened at the capitol was preplanned. more and more evidence comes out every day. they want to rush this thing to trial before the evidence really comes out. that's not the american way. lou: no, it certainly is not. and it's clear to all -- democrat, republican, independent, you name it -- there is no evidence. the claim that he made some statement is false on its face. and i guess the question comes up, david, why is the president even responding to this? because he is a president of the

past, he is not a president in office. therefore, he cannot be removed from office. so why should anyone take seriously this absurd, stupid, malevolent claim of the radical dems and pretend that there's something to it? not even pat leahy presiding over this is rooted in constitution or law. he will not be presiding. the constitution makes it clear that if the president of the unite is to be tried, that the chief justice will preside. there is no chief justice presiding. there is another senator who also turnses out to be a juror as well as a judge if the democrats have their way. this is patent evil nonsense. why are the republican leaders of the senate even giving it any breath of credence let alone going along with these maniacal,

sinister claims by the democrat party? >> you ask a very good question. you know, some responsible commentators have actually suggested just what's implied in your question. that is, the former president shouldn't even respond to this, shouldn't appear at all. i think that the former president believes that this process is ongoing. he understands the appearance to the american public of the process. he believes in the sanctity the of the constitution of the united states. he believes firmly and correctly the constitution's being violated here, but he intends to stand up -- lou: well, good lord -- >> pardon? lou: yeah. david, you just referred to the sangty ity of the constitution -- sanctity of the constitution. >> that's right. lou: it does not honor the constitution if you permit others to violate the constitution. this is enabling. this is giving permission and approval9 to the dems to proceed with this awful fraud on the constitution. on the american people.

where the -- and i'm asking quite a similar, as you suggest that he should not go, but i am saying to you that the senate majority leader, the leadership of the senate, the republican party should say to the democratic party, hell no. and you will be held to account for this vile, vile enterprise. >> well, i'm hoping that the most important part of what you said, i think, is what i'm hoping. that is that the american people hold the senate democrats to account. i'm not a political partisan in any way. but what's happening here is supposedly being run by one party who has chosen party over country, and that's just wrong. this is simply the partisan political weaponization of the impeachment process contrary to the constitution. the constitution is more important than this. as for the republican leadership, again, you know, you'd have to ask them. i think that they are making their position quite clear. i hope that when we argue jurisdiction in this case, more votes will come in recognizing

unprecedented power of big tech, social media and even the national left-wing media. your thoughts about governor desantis and what he is doing here to protect his citizens. >> you would think everybody would be onboard, lou, with governor desantis. including, including especially civil is libertarians and mostly democrats as well as republicans. but they're not. it certainly is political, it certainly is biased. we've seen big tech side with the leftists, and it is extraordinarily dangerous. and this is why governor desantis has threatened $100,000 a day fines for big tech companies that censor political candidates or lawmakers. he is 100% right when he said that parler, removing parler was like a decapitation and that it was completely frightening. it's terrifying to know too, lou, the reach of foreign governments in some of these big

tech companies like china in big tech. and we also have to look at the fact that twitter, they don't censor iran. we've seen that over and over again when the iranian regime targets israel or threatens the jewish people or betweens out anti-semitic trope. we don't see the same type of response. but the 88 million people that followed president trump on twitter? oh, boy, they weren't allowed to follow him anymorement they were completely removed from the picture and so have a lot of others. it wasn't just president trump. we're seeing a lot of people, conservatives particularly, being removed from the platforms, being depalace formed completely -- deplatformed completely. lou: absolutely. and the border crisis, we hear the biden administration and from the radical dems on cap aing toll hill that jobs -- capitol hill that jobs are very important, a priority for them the even as the administration

china virus pandemic relief package instead of bowing to the wishes of those awful people on the radical left. the chamber, of course, welcomed joe biden to the white house. they, in effect, work for him. and 15 of the 23 democrats that the chamber of commerce endorsed in the 2020 election won their races. that's more than the 10-seat majority the radical dems currently enjoy in the house of representatives. so what is the chamber of commerce doing? well, we're going to take that up and more with former speaker of the house of representatives, newt gingrich, best selling author, great american. newt, great to have you with us. i have to say, there is so much delicious irony. [laughter] it's a fool's beast in washington as you watch these players. the chamber of commerce wants to sit down and reason with our my

president. -- our new president. what do you think the odds are that they can meet and come to a sensible resolution? >> i think it's virtually impossible. i never understood the chamber's strategy this year. they watched a tax-cutting, regulatory-reforming, pro-business president for a tax-increasing, regulation-increasing, anti-business, pro-union liberal. from the standpoint of the chamber of commerce that i used to work with, i can't understand how they could possibly sell that to their membership. it's a terrible deal, and it's going to cost their members billions of dollars. lou: it's going to cost them billions, but the multi-nationals who actually run the chamber of commerce and for whom the chamber of commerce is most effective and most

reliable, it looks like tom donohue has, well, he's bent a knee once again to wall street, the business round table and nam. a disgusting performance by an organization that has well lost its way and is learnly working -- is certainly working against as often as it works for the national interest. we see a country now in which there is no countervailing influence to the corporatist elites. what are we to do about it? because big tech, social media, wall street, they are absolutely at the pinnacle of their unprecedented power. it's -- and we are just sitting here watching as their consolidation of power intensifies and they hold sway over all public policy without exception. >> look, we've been through a

couple cycles like this before with the railroads, with standard oil, with ibm, and over and over again the system balances itself. you just had a great story about one of the most effective governors in the entire country, governor ron desantis, who's taken -- lou: yep. >> -- the third largest state in the country and drawn a line in the sand for the big tech people. hope governor abbott in texas will follow suit. there are a whole series of republican governors around the country. i hope all of them will dive in and do the same. and i think you will see the system begin to rebalance. remember, the house is a very narrow margin, the senate is tied. and if senator manchin actually votes like west virginia, they're not going to get much through the senate. so they can do a lot of stuff with executive orders. they're appointing wildly radical people to positions of power. my favorite being the washington state employment secretary who

lost $600 million in stolen unemployment compensation to a nigerian gang that filed 123,000 fraudulent requests for insurance. but, you know, you're going to see a radical, corrupt and job-killing administration, and the system will start to balance itself. lou: i, you know, i know that you take the long view. you're an accomplished and talented historian -- [laughter] and i take the long view occasionally myself unless someone has a knife to my throat. and right now i feel like someone has a knife to our throats. this is, it seems to me, an existential moment. it is a pivotal moment in our history, in point of fact, if i may say. i'd like to get your thoughts about that as we are now six days away from a fraudulent effort to impeach a president who is now a former president
