taiwan that it is not an independent nation? >> i think we're seeing the biden administration is prepared to walk back the moves towards u.s. recognizing chinese independence under the trump administration. biden plans to use traditional diplomacy to work with regional states that means our tariffs are going to be dropped. the biden administration wants to make the environment the priority. what will we trade away with china to get a deal on the environment? trade, human rights, security? -- wrote about this in "the wall street journal." china will not give away concessions on the environment for nothing. there will be a high price. elizabeth: that's right. so we're seeing that too. how much did trump reset the table on this with taiwan? because secretary of state mike pompeo lifted honk standing restrictions on contact between officials of the two governments. so how important was what the president trump did in resetting the table here? what was the impact?

sense. elizabeth: okay. so, that was pretty confusing. what do you think, christian? >> you know, two quick points. well, one the big one is the experts have been wrong again. our oligarchy in washington are supposed to expert but they aren't. we need more accurate information not just whiplash and accurate information we're on right side of the bell curve. cases have declined. deaths have declined. as we get more and more vaccinated people 65 and older you will see mortality drop to zero. we need accurate information how we can reopen and starting in early spring but we're just not getting that. elizabeth: get america vaccinated. get america reopened. stop with the distracting washington fights. we get it. dr. fauci is in a tough position. what is happening now there is push and pull on information given to the american people. they are frustrated. they have been in shutdown mode.

disregarded fbi's own documentation, their own memos, the cia memos, that carter page was working with, cooperating with both the fbi and cia for nearly a decade but they used carter page as a gateway to get a fisa wiretap in order to do a one hop through carter page to the entire trump campaign via carter page's devices. what do you say? >> yeah. i agree with you, liz. it is good to be with you again. what i saw in this recent reporting putting this timeline together, not only did they ignore the fbi's previous interactions with carpetter page and also their knowledge, the fbi's knowledge of the cia's interactions with carter page, that he clearly was cooperating they also seemed to just be desperate to get any way, to get into the campaign, to get some surveillance. let's remember, that these fisa applications are often times

used against foreign nationals who are in the united states or elsewhere who are agents of a foreign country. to get one of these fisa warrants, liz, you have to show, make a demonstration that there is probable cause to suggest that carter page was an asset of russia, was a foreign agent of russia. it is very clear the only evidence of that was the steele dossier which was completely false and made-up. elizabeth: so, that's right. and also the timeline shows that the fbi wiretapped anyway and misled the fisa courtneyaway by omitting the breadth of the steele dossier, how much it was financed by the democrat party and the hillary clinton campaign. how the campaign planned to use the research toe contest the 2016 election if hillary lost. you know what else is coming out too, matthew, the cia told kevin clinesmith repeatedly, they told

the fbi repeatedly, carter page has been working with us since 2008. so the fbi knew that also since 2009. clinesmith goes ahead and doctors a cia email anyway to get the fisa wiretap. what do you think? >> this violation of constitutional rights of carter page is really abhorrent. what the fbi did to obtain this warrant has been not only well-documented but also the court has been very critical and harsh on the fbi. unfortunately i just don't feel like a lot of americans feel there has been accountability for those up and down the chain of command that allowed this to happen. as you point out it was not only the initial filing where they got the fisa warrant but the three renewals over the course of almost a year where they would, went back to the court, essentially continued to state that carter page was an asset of russia, was a foreign agent. it just wasn't true. it was based on as you point out

paid for disinformation by the hillary clinton campaign that was going to use it as a basis for a political attack. not only during the campaign but also used to move the narrative away from her server and 30,000 emails that was deleted to try to put the attention on this narrative that there was collusion between the trump campaign and the russian government which just wasn't true. so it is really disgusting moment in american history. elizabeth: yeah. i mean using secret court, the fisa court, that is meant to catch terrorists on a political opposition campaign. by the way, kevin clinesmith doctored and falsified that cia email in order to get a fisa wiretap late in the game in 2017 after the fbi knew the trump-russia probe investigation and the case was falling aare part. they knew it. james clapper, testified there was no there there. james comey testified there was no there there. so did peter strzok.

peter strzok indicated that. so did lisa page. move on to separate story. hunter biden hired a new attorney to assist with his federal defense. that attorney was christopher clark. he worked for the new head of the head of the just at this time department at the same law firm. now these two guys, know each other from latham watkins. hunter biden has a doj case against him reportedly on allegedly involving money laundering. we don't know if hunter is a target of that, but also alleged tax evasion charges. your reaction to this story? >> just another reason why a special counsel needs to be immediately appointed. we've talked about it before. i think this investigation needs to be probably put in a separate investigative team that, special counsel's office that could do it without worry that the

higher-ups whether in the criminal division or whether in the attorney general's office or the deputy attorney general's office, that you know, that investigation is aboveboard and is run to ground and if there are charges that need to be brought that they have the discretion and the authority to bring those charges but you know these types of con incomes unfortunately with the way people move in and out of government sometimes are unavoidable. i hope that both these individuals do their professional duty and if they have to recuse, they recuse. elizabeth: there is no evidence that mcquaid had anything to do with hunter biden at the law firm. final word on attorney general merrick garland, will he have to anticipates questions about this the doj probe with hunter biden and whether he keeps it going? >> his confirmation hearing will be must-see tv. mayor rick garland will have to answer difficult questions about the hunter biden investigation, how his office will handle it

justice department subpoena governor cuomo over the coverup and whitewashing of thousands of nursing home deaths connected to como's executive orders. this is what new york's taxpayers are paying for. what do you say? >> well there is no question that the cuomo administration is trying to circle the wagons here because there is more information comes out, for months we were told by the media that governor cuomo was the modell of governance in the time of coronavirus. theying cooked books of 50% when it comes to nursing home deaths. that tells me may only be the tip of iceberg. elizabeth: como's team is doing full court brits to talk about everything but como's march order putting recovering nursing home patients back into nursing homes. the coverup of nursing home deaths. the new york attorney general said they undercounted it by 50%. 4,000 nursing home deaths after the executive order in march. we have more than 320 nursing

homes had zero covid infections. all of sudden those nursing homes exploded in covid cases. the most galling part of this, critics say, ford, is this. cuomo's office in july, put out a report, you know what his executive order is not toe blame. blaming nursing homeworkers and nursing home visitors. this is the same guy that said janice dean should stick to reporting the weather. that is sexist attack after janice dean lost her in-laws to covid-19. why are we paying this as a party? >> you make a great point. essentially governor cuomo and his administration is blaming everyone but themselves. we all know the buck stops here. what happened with janice dean and her relatives was really a terrible situation. the fact they're going to attack someone because their relatives

bromance over governor cuomo's handling all came because they didn't like. they called my home state governor, ron desantis, an idiot and dealing with more people and nursing homes. did it right. it was terrible governance. 2 caused thousands of people to die, now he doesn't want to say the buck stops with him. if you want to be governor of a state, the buck stops with you, you have to take the good, bad, otherwise. right now governor cuomo is running to his own incompetence. elizabeth: you know what the issue is, ford, final word, new yorkers do not know the full extent of this problem because the new york attorney general report was a sample of nursing homes. it wasn't all nursing homes. this could be even bigger than we realize. 12% of nursing home deaths are from covid-19 in new york state. new york state is the only state in the country that did not count you know, patients dying in hospitals from covid-19. they did not include those in

sanctuary nation. what do you say? >> i applaud them for taking this on. it is the responsibility of that committee to oversee the department. so the idea that we're going to pause deportations for 100 days with very narrow exceptions, they have a exception for national security threat and convicted aggravated felons. that leaves everybody else on the list. last year i.c.e. deported 103,000 people. it was lower year than previous because of covid. 93% had criminal background. some were convicts and had been arrested and charged with serious crimes. if the number stayed in place as it was, that is the kind of scenario you would have several people who were gang-bangers, pedophiles, charged with murder. they would be let go under that scenario of the 100-day pause. elizabeth: you know senator dick durbin, a democrat said, america cannot revert back to the belief that immigrants are enemies but

hispanic immigrant families say that is not the point. that is a distraction. that is basically, he is just basically muddying the waters here. everybody is for legal immigration. this country is built on immigrants. what we're talking about is what is posing a danger to american society because what these senators are saying is, if you did a so-called new catch-and-release program for criminal illegal aliens they could start pouring into sanctuary cities. what do you say? >> no, i think that's right. you will encourage people to come to the border. you will encourage criminals to go to these places where they know they will have sank wear. under thedsanctuary. under terms of this memo everybody not a convict or terrorist. they have permission to make arrests in the cities. they would have in fact sort of a sanctuary scenario across the country. it is not a good idea. i applaud texas and arizona pushing back on this idea. it is a bad one. it will cause a surge on the border. we're already seeing increased

activity. we know there are caravans on the way. we have sent a signal out we're going soft on immigration in the united states. i respect dick durbin but the immigration law hasn't changed. when you are criminally involved in the united states, it's mandatory for the i.c.e. to hold you in detention. the immigration law has not changed under this policy. you can't change the law with a mere memo. that is part of the problem we have here. the framework is still vulnerable to abuse on the asylum side with children and families coming to the border with their children. that needs to be shored up. the legislature needs to take that on. elizabeth: we hear what you're saying. by the way texas, what you're saying, texas and arizona have sued the biden administration over this 100 day freeze. they want, these two states want to knock it out permanently. a federal judge put a hold on it, a federal judge in texas. tom homan explained it this way, a ms-13 gang member comes in, charged, has a criminal record. is charged with a new crime.

this new policy means that i.c.e. would have to release him, is that true? >> that's true. there is no exception in the memo if they have not been convicted of what they call aggravated felony. that is a long list of crimes. if they're just merely in the country illegally, but also ms-13 which we know is deadly violent, they would have to be let go in terms of the memo. another thing they did on 21st. that memo came out on 20th. they ended migrant policy with mexico. that is one of the greatest tools we had. it was effectively working. now that is off the table. they will study effective way to stop people abusing the asylum system. they are taking off the accords with the northern triangle. you will encourage people to come from the third world locations to the border. elizabeth: all right, ron have it vitello thanks for joining us. >> good to be with you jack same
