reopening. we have a big victory for california churches. churches in california according to the supreme court can now reopen. also, yet another california democrat violates california's shutdown rules. this new battle breaking out, should local governments fire teachers just as president reagan fired air traffic controllers because the cdc and dr. fauci say it is safe to reopen schools but teachers are not coming back in. they say they have to be vaccinated first. also another black eye eye for new york governor andrew cuomo, new covid nursing death toll numbers released they're bad, will all of this hurt a political career of the governor, media darling, talk of hollywood as a potential future president. is the media finally waking up to the biden's administration growing crisis at the border. white house caught flat-footed on own damaging changes, picking and choosing which illegal aliens to deport and which ones

"the evening edit" starts right now. ♪. elizabeth: welcome to the show. you're watching the fox business network. let's get you updated what is going on in washington from edward lawrence. he is there in d.c. edward? reporter: liz, some republicans are saying the show continues again tomorrow. senator tim scott from south carolina adding the impeachment trial is just democrats further dividing this country because president donald trump did not incite an insurrection, not anymore than representative maxine waters telling supporters to get in the face of any republican in the trump administration at restaurants. >> the chances of me understanding, appreciating the severity of the situation is 100%. one person i don't blame for that situation is president trump. i don't blame the non-violent protesters outside.

i blame the individuals coming in the chamber, coming in the building. reporter: senator scott says congress should be talking about the next covid relief package. democrats working on it without republican help through the budget reconciliation process. the bill could raise the federal minimum wage to $15 an hour, something the congressional budget said would cost 1.4 million jobs and add to the budget deficit. all of this while some states struggle with the vaccine rollout. president joe biden today, virtual visit in an arizona vaccine site. arizona, california, illinois, new york and maryland are among the worst in deliver iing the supply they have been delivered. brook king research says states followed strict tear systems with no flexibility. that is the in the hands of hospitals much like the vaccine. much of the vaccine was possession of hospitals in their freezers until governors started

to slowly change the rollout of the vaccine which is happening right now. back to you, liz. elizabeth: thank you so much, edward lawrence. it is great to see you. with me now, kim klacik, former maryland gop congressional candidate. president of pac called renaissance. always great to have you back on. okay, these antifa rioters are not stopping. over the weekend, kim, they threatened to burn down, burn down d.c. this is during a black lives matter protest in washington. they were chanting, let's burn down washington and burn down d.c. rioters fought with police officers. when will this end, kim what do you think? >> liz, thank you so much for having me. i don't know when it will end. i don't think our elected officials know either. we have to take a good look at this. there is a lot of things going on right now. d.c. was closed for indoor, outdoor dining until after the inauguration. a lot of restaurants just opened. so you see antifa going through

washington, d.c., and basically heckling and even going into some of these restaurants and bothering customers and so now you have these restaurant owners, happy just to have their doors open again. now they're scaring their customers away. but then on top of that, what is the demand that antifa has? i don't seem to understand it. i don't know if anybody else does. with the capitol riots. heard a lot from mainstream media networks. we're not hearing a lot about antifa, what they're doing. i don't hear what it is that they actually want. they said they don't like president trump. now they don't like president biden t doesn't seem like we'll get anywhere anytime soon with them until somebody tells us exactly what it is that they want and somebody figures it out and tells them look, we have to put law and order in place. as far as i know, liz, the national guard is still in d.c. today. elizabeth: yeah. you're right. restaurants are trying to reopen but they harassed people at restaurants. kim, we've got some of the sound of what happened. let's take a listen.

[bleep] you're going to jail. elizabeth: you see it. this is dangerous stuff, kim. we've been reporting, you ever and i talked about how 30 people were killed in the riots since last spring. and, so, again we were wondering asking, when are the american people going to see peace on our nation's streets, because we are in the middle of a pandemic. kim, as you pointed out, people are frustrated. they're watching it going outside where they're locked in. >> absolutely it is dangerous. it is scary. as you know, we talked about before, 2015, baltimore city, we had our riots. we still haven't rebuilt city from 2015. here it is 2021.

all the small businesses are being hurt. you see across this country. if you're a restaurant owner or restaurant employee, unless you live in florida you're hurt the most throughout the entire pandemic. we see that 1.9 trillion stimulus bill come out. it still doesn't target small business or families, especially restaurants. they're not even going to see relief here. so we need more law and order. we need our elected officials to actually represent individuals that put them in office. elizabeth: kim, you've been out front on this you've been way out in front on this you're in baltimore. you're right in 2014 president obama called in the national guard in baltimore after the freddy gray riots. he condemned those rioters, those who looted and started fires in baltimore should be treated like criminals. thousands of troops were deployed to your city. that was president obama saying stop it. what changed since then, kim? >> i don't know. i guess catering to those extreme leftists that want to push this black lives matter

movement and watch to push this narrative that everybody and everything in america is so racist. you're right, president obama, he actually condemned it. the difference is, we had a lot more arrests happen during those 2015 riots. that is why you saw it taper off so quickly. because he did, he said look, you've got to restore law and order in baltimore. but unfortunately with we're seeing especially mayor bowser in d.c., they're not doing anything. they're allowing criminals to run free and run their cities while regular, local people patronizing restaurants are living in fear and in danger. elizabeth: you know, no, let me back up. americans aren't for political extremism, especially violent extremism. it is about moderation and consent of the governed. you and i were talking about that for a long time. last, but here is not what is talked about, kim, last year we saw the largest year-over-year increase in homicides ever

recorded in u.s. history. the homicide rate in 34 cities was 30% higher in 2020 compared to the prior year. "new york post" is going to run that story. i think they just ran it. this is according to the national commission on covid-19 and criminal justice. kim, the victims of these homicides are disproportionally african-american. 8600 black lives were lost to homicide in 2020. don't those lives matter? >> you know, we asked that question all the time. here we are in 2021, in baltimore city, we already had 31 murders. they're all of black individuals. so you know, i see billboards in baltimore right now by the fbi, by the local fbi asking about if we have any information on those that breached the capitol back on january 6th. there is not one billboard asking about a murder, somebody's family member here in baltimore, right? we don't have our cases being

closed, about 30% rate we're closing cases. witnesses are not coming forward which we know is the biggest impediment in all of these cases. so when will we actually truly act if black lives matter? i just don't know. elizabeth: we had u.s. missouri senator josh hawley's wife filing a criminal complaint against the man who organized a protest outside of their home in virginia. erin hawley filed a criminal complaint. senator hawley and his wife had an infant inside of their house and their home vast vandalized. we have that happening. fight over reopening. kim, like your reaction to this. we had teachers unions, teachers union, they're not, they're saying we're not going back into schools yet until we're vaccinated until it is safe. you have nurses, firemen, cops, grocery store workers, mailmen going back on the job. so we have teachers unions saying defund the police. the teachers union in

♪. elizabeth: joining me now is ari fisher, former white house press secretary for president george w. bush. ari, good to see you. we love having you back on. so buried deep down in president bidennen's order to cancel the keystone pipeline was another order to suspend president trump's executive order to protect america's power grid. trump's order blocked any foreign adversary like china from putting their own technology and machinery in our nation's bulk power system that delivers power to the entire country. what is going on here? >> i don't know, liz. this is baffling. i can only wonder did somebody in the biden administration

overlook this? i cannot imagine they would have done this willfully. i don't think this is a partisan issue, democrat, republican matter. so the benevolent side of me says they just missed it. they shouldn't do it. need to go back to restore it. russia used cyber warfare to shut down the electric grid in the war with ukraine. we do not want to let any foreigner, any adversary do anything like that to america's grid. if anything needs to be self-reliant it ought to be our grid scoot bulk power system, includes electric power substations, transformers, high voltage power lines, anything that moves power from electric plants to consumers. biden order, omb, you have to look at this for 90 days. wasn't the solar wind story showed russia already cyber hacked our software running our systems including nuclear

energy? why do this? why weaken cybersecurity defenses. you point out ukraine. you're right. we just don't get it? >> that is why i say this is baffling. maybe this is something that just got caught up in overreview of all the executive orders of president trump. this new administration wants to review them for a period of time and they didn't realize they had this one in there as part of the normal review. look, new administrations do reverse a lot of their previous administrations executive orders. that is why laws are better than executive orders. whoever follows joe biden will do something similar to joe biden. you have to do it smart, do it right, you never ever jeopardize national security. elizabeth: let's look at this, hunter biden, his father, joe biden, indicated yes he is proud of his son hunter, coming out with a book. hunter biden, ari, still owns a 10% stake in chinese equity fund financed with 1 1/2 billion dollars from china. he promised to get rid of the stake but he hasn't.

show you what the fund invested in. invested in big time energy projects that compete with the u.s. this is hunter biden's bhr fund. the other thing too, when you look what it is invested in, it is invested in chinese general nuclear, ari. that is a company that the doj charged with stealing nuclear technology and stealing u.s. secrets from the u.s. and the, an executive from that company was sanctioned and charged. so what is going on with this bhr that hunter still owns a stake in? >> look, this is ethical level highly worrisome. you know what stops people making ethical misjudgments like this, the pressure of the press. when the press pounds on an administration and they ask about family members and they want to know if there is any financial considerations that could put the president in an embarrassing spot, just as hunter biden did self-admittedly when he was on the board of burisma, ukraine, an energy

company when joe biden was in charge of fighting corruption in ukraine. he later admitted it was a conflict of interest. shouldn't have done it. the state department went to then vice president biden is conflict of interest. if the press doesn't bang an out about these things, people in government can sweep it under the rug. the problem, liz, only people raising issues are conservative networks. new york times, nbc, abc, cnn they're giving the biden family a pass. this is not issue of a pass. this is an issue to draw a black line. elizabeth: senate republicans including chuck grassily, ron johnson, this is a serious issue. take out the names. look what happened. it is about putting your nation's security at risk. your final word, ari? >> don't forget hunter biden also received $500,000 from the wife of the mayor of moscow. why? this is influence peddling. this is what is available to families of first, for the presidents and vice presidents

♪. elizabeth: okay. let's welcome back to the show former federal prosecutor jim trusty. jim, we love having you on. okay, the american people deserve answers. they deserve transparency. only a fraction of the fbi trump russia documents that president trump ordered declassified have actually been declassified. what we've seen anywhere from a third of the content or 40% have been heavily redacted. don't the american people deserve answers? this is their tax dollars at work. they deserve to know what happened? >> liz, i'm usually pretty hard-line about protecting governmental confidences. i don't want to see people get killed. i don't want to see people be

defamed. i don't want our manner and means of intelligence gathering compromised but, look the russia investigation deserves full transparency. if they are slow-walking still the release of documents that is a horrible sign and one where again i look towards director wray, i say you need to distance yourself from jim comey because the comey regime undeniably did some pretty terrible things when it comes to manipulating the system, being press hounds, being dishonest with the fisa court. wray needs to stand up at this point we'll not have this anymore. this cult you are is gone. i'm getting a little leery of waiting for that moment to finally happen. elizabeth: he hasn't done it yet, right? fbi director, that may not happen. so, jim, does john durham, the u.s. attorney doing the criminal probe of the trump-russia probe, does he have access to unredacted documents, all of it? can he see all of it? >> i would think so. i mean i can't tell you from

first-hand knowledge of how he is operating, how the agencies are treating him but i would expect durham has unfettered access to the raw materials which could make a big difference in his investigation compared to what we're seeing publicly right now. elizabeth: so, when we talk to our fbi sources, what they keep saying, they are really worried about is this one thing. they're worried about a lot of things. but what they talk about frequently, jim, is how the fbi under the obama administration abused the secret fisa court meant for terrorists. they fear that the fbi's integrity and credibility has been permanently damaged before the fisa court. we know that the fisa court has been doing a scrubbing of prior fbi fisa requests. so when you see the fbi justify secretly spying on carter page, because the fbi merely quote, believed page was going to write a book, defend his innocence in the media, talk about his book in the media, when the belief

and speculation should not be enough to get a wiretap. that is what our fbi sources say. they're absolutely outraged and disgusted with how james comey based and their work with the fisa court. what do you say? >> if you look at the cabal of fbi politicized group, comey, strzok, page, they did things any field agent in iowa would be drummed out of the bureau would be doing. they broke the rules. they manipulated the press. they manipulated the story in front of the fisa court. when you go in front of the court, much less the fisa court, you state things as facts or beliefs in your investigation are you're supposed to back that up with evidence, not supposition. by the way, if you're wrong, you're supposed to go back to the court, hey, last application where i said, maybe this russian dossier was something that is political in nature, i understated it. it was much more than that. we know it was actually funded

♪. elizabeth: okay, we're in breaking news mode. let's welcome back to the show west virginia governor jim justice. governor, the supreme court just moments ago handing another major victory to a group of churches in california, letting these churches conduct indoor services with a few limits. the supreme court handed down ruling on friday saying california, you got to open upchurchs. you know, they were shut down

under covid restrictions while retailers like target, strip malls, tattoo parlors remained open. your reaction to this ruling? >> i think it is absolutely the right ruling. in west virginia, liz, first of all, thanks for having me, but liz, you know in west virginia we declared all of our churches right off the get-go as essential. and so our churches never shut down here. we had issues from time to time but we dealt with it and not big issues. from the standpoint of just arbitrarily shutting down our churches, one of our most sacred freedoms and everything, i just, i think the supreme court is making axe chutely the right decision and, along the way, the people of california honestly they have got so much to think about their fabulous state, beauty beyond belief and everything else but they have made, the leadership has really made some really questionable moves on the chessboard along the way. you know, i, i'm not being

braggadocios about west virginia about the standpoint what we've done or what i've done, people in west virginia have maintained their economics and done the right stuff along the way. it is not rocket science but there is a lot of things going haywire in california for sure. elizabeth: when you're in a pandemic, you need, you know, houses of worship and spirituality and you know, that kind of, suffer of the soul people are going through tough time. interesting you deemed them essential. you mentioned what is going on in california. governor, another california democrat broke the shutdown rules. he is a district attorney out side of sacramento. she is thought to be next in line for california's attorney general. she holds a big wedding at her house. she backed rules, no big gathers

at home. people from other households come into your home. she said they social distanced. she broke the shutdown rules. other california politicians have been breaking shutdown rules. what do you think of this? >> you practice what you preach. really at the end of the day things come home to roost. you know, liz, going back to what you just said earlier, about people needing places to worship. i mean, for crying out loud, our soul drives us. with all in us. our relationship with god above in every way is so sacred and to take that right away, just say, we're not going to do that, we're going to do this, this, everything else. it may sound noble in some ways to keep people away from one another but it is surely not the right thing to do. i'm a real believer. i'm a christian through and through. i believe with all in me that god above will take us through this pandemic but it has been

tough. you know liz, i've got to mention one other thing, back in march, in west virginia, the poorest state, the little state, that didn't really have any, any way of surviving this, had a day of prayer. in that day of prayer, i said a prayer. i'm not saying reverend jim but with all that and everything, since that time forward, just look how west virginia has done. led the nation all the way across the board. we started with the a day of prayer. from the standpoint of the attorney general doing what they're doing, she has done everything there, i have don't see how in the world anything could be as crazy as that. on top of all that, the governor at a french laundry, and doing all that i don't get it, i don't get it because if you don't keep the people with you, you will be really in trouble. that is just all there is too it -- to it. >> we talked about churches. let's talk about schools. president biden promised a

to get to that point in time. i'm a real believer if we would have, we would have had solid leadership, whether in the chicago area, california area, whatever it may be, if we would have led people along -- in west virginia we put all of our teachers back to work. we're not in a situation where teach remembers demanding things like crazy or everything or the unions are going crazy. we have just as much union issues here as they would have in california but really, truly, when it boils down to it, just think about, you know remote learning isn't working. we know that the needs of our special needs kids are unbelievable. and we know that kids absolutely, when we don't have eyes on them, bad things are happening to them all over the place. you know, in west virginia, we moved, we moved up the teachers and service personnel age 50 and above and got them vaccinated. then we put everybody back in school. you know, for the, i mean, again, i just can't believe what

administration that campaigned on data and science. well we've known for months now that virtual learning has been a failure. we know that in-person learning really does not contribute to covid spreading between students, teachers or staff and the virtual learning has really hurt minority students and disadvantaged students most. it widened the achievement gap between rich and poor students because of course, students who come from families with means can simply go to private schools, hire tutors, those without means are stuck in this failing system at home for months on end while their parents are in this horrible position where they try to hold down a job and watch their kids at home all day. so unfair. elizabeth: yeah. two million single moms estimated have to stay at home to take care of their kid because they're not in school. they can't go to work. now we have this story, kristin. new york state finally released a total for covid-19 deaths for
