central u.s. and states like texas into historic deep freeze. we're talking electricity and power shutdowns. talking power outages, water shutdowns at homes, hospitals, police stations, fire stations. also water and waste management, wastewater treatment facilities. bring in right in now, house energy's kelly armstrong. he is monitoring the situation. congressman, your take on what is happening now? what are you hearing? >> well it is, first of all, we hope everybody stays okay. even in a place where we're used to this weather we can really feel for our friends and our family members down in texas but also i think it brings up a conversation which people like me have been talking about for a long time which is, we need a resilient and reliable electric grid and we are starting to see some very fatal flaws in it today in real time. elizabeth: yeah. the texas grid is now, the texas governor called an emergency to reform the texas power grid.

it hasn't been kept up to speed. also wind turbines froze over. there is a debate about that. is this a wakeup call to the biden administration and democrats in a full-court press to go full-on green or should it be all in, all energy sources. >> it absolutely should be all of the above. that is with we've been talking about. there are things democrats and republicans agree on, improving infrastructure and inneroperability of the grids but the other answer is, we know this, i mean 25% of texas is wind, energy comes from renewables. they have gotten zero percent of that over the last 48 hours. north dakota, 29% of our wind comes from renewables. last week 20 below, it was 3%. these are real serious questions. when you're in these type of situations they literally can mean difference between life and death when it is this kind of weather. >> it is can't, its true you cannot store energy from wind

turbines, right sir, is that what is going on? >> absolutely. remember when you lose 100% of a quarter of our energy combined with the weather going all the way from texas to north dakota, the energy demand up and down, up and down these systems is spiking. we have voluntarily load shedding in north dakota. voluntary blackouts right now in the state, when it is 10 below zero. this is going across the entire energy infrastructure. i mean there is no secret when cold guys down, wind goes up, reliability goes down. that is the tradeoff, we're talking about climate change. we're talking about carbon capture. we're talking about these issues. we better talk about the reliability of the grid when we need it the most. elizabeth: nat-gas, wind energy, other sources in texas, it's a perfect storm what is happening. we see oil and gas prices spiking. futures indicate that.

hitting production and causing demand to jump. nat-gas pipelines freezing. also oil wells shutting in. listen to what former energy secretary rick perry is saying. he is talking about the common-sense approach of trump administration, all-in approach. let's listen. >> if we were in the aoc world, fast forward 10 years and everything is solar, everything is wind you have this stipe of type of event, nine degrees, you don't have power to keep you warm, you are going to die. i don't hear the current administration, i don't hear the green new deal talking about anything other than wind and solar. elizabeth: okay. your reaction, sir? >> nine degrees would be a heat wave in bismarck, north dakota. i want to put it as clearly as i can.

wind and solar are not baseload power. they were never intended to be base load power. if we continue policies that make them base load power. we'll see more events happen. natural gas provides energy. oil provides energy. wind and solar provide a place on the grid but if we make them base power we'll have consequences. you don't have to look far. california with blackouts. look at germany. we see it played out. we know how it ends. it is absolutely ridiculous we would go down the same path. elizabeth: it is about common sense. congressman you're terrific. we love you are insights. >> thanks for having me. elizabeth: congressman armstrong is monitoring what is happening. he mentioned california. let's bring an expert on california. he is former california republican party chair tom del beccaro. this is a urgent situation happening in central part of the country and texas, are we ready

to go full-on green? >> of course we shouldn't. that is national security risk. i don't know what is worse the economics or hip hypocrisy. the biden administration is pushing a pipeline helping the turkmenistan regime. in california, they run commercials you have to turn your energy down because solar doesn't collect, whatever can't collect solar energy at night t lowers the standard of living. it will hurt the vulnerable. that is a national security concern. if our economy is not up to snuff, we can't run electricity at night, doesn't that create a risk, national security? of course it does. elizabeth: wind farms are inefficient. china is undercutting every country in this, including the u.s., including germany. germany saw its green energy jobs collapse. they went, that is why they went to the north stream pipeline. plus this is crony capitalism.

obama's sole sole deals show a tiny koetterry of green energy insiders make a ton of money off the government, right, tom? but if you question that you're attacked. >> yeah. this hurts the standard of living over time. my sister diane in houston, texas, texts houston governor, talked about turning toasters off or unplug them because they are out of energy. this is houston, what is that the energy capital of california? this unsustainable. a lower standard of living, weak economy, hurts the poorest among us. we talk about that last week. by the way, i did get the haircut. california finally reopened this is no way to help the poor. if you want to help the poor, energy prices, gas prices are up 18% since biden has come in. why is that? because the just the threat of a green new deal will hurt people. when is he going to start helping the poor instead of

piling on costs? elizabeth: okay. we have power outages, people losing their power. now people losing their jobs. john kerry and energy secretary-general per granholm saying oil and gas workers should sacrifice jobs for climate change. there are tens of millions oil and gas jobs. they are higher paying than green energy jobs. those jobs are $19,000 a year. government data shows only 600,000, 750,000 green energy jobs versus tens of millions of oil and gas jobs. china is making things cheaper, tom. your final world? >> absolutely there is no way you can sustain a 20 trillion-dollar economy that has worldwide national security concerns on solar energy. it's unreliable. you know what? the grid isn't even built to handle all solar. it requires turbine input to the grid. this is a disaster. hey, come to california you can get a preview. elizabeth: okay, tom, great to

>> we found out about the mandate on march 25th. there was rumors it would be happening. we couldn't believe it. we contacted of course the facility. they were not transparent. and my brothers contacted the attorney general's office. i contacted governor cuomo's

office and just left a message. and no one has gotten back to us at all in regard to this. >> it was cold, callous, arrogant, uncaring unfeeling. i don't know what else i can say. it was just completely unacceptable to us. it just goes to show you the type of person that he is. elizabeth: okay that was phil and cindy and ted, three siblings who lost their mother agnes in a new york nursing home due to covid-19. new york lawmakers roundly condemning governor cuomo what was a disasterous press conference a lot of fingerpointing, blame shifting, taking no responsibility. let's welcome to the show, daniel and peter organi. they lost their father norman in a nursing home due to covid-19. daniel, this is your father. can you tell us what happened? >> glad to. my father was 88 years old,

vivacious, strong, working, driving, sharp as a tack. he got sick after christmas. through a couple of mishaps and illnesses he ended up in rehab. between rehab and in the hospital, back and forth, he had become bedridden because there were no workers taking care of people in either the hospital or the nursing homes because of the virus was hitting. yes? elizabeth: no, go ahead, finish. >> we were told that the march 20 fifth order was coming out we should take my father home. we were very involved taking care of him. we worked as hard as we could to get him out t took a couple days because the hospital unfortunately didn't take care of him. the nursing home did what they had to do. we got him home. i'm sorry to say 10 days later, almost 10 days later my father passed away from covid. not only that did my father die

of covid that week, we had three other family members, my uncle and two cousins died of covid. three of the four were in nursing homes. elizabeth: this is, this is just so outrageous. i mean, we can't even express how much sorrow we feel for you guys and your family. it is just terrible. peter, governor cuomo is doubling down. he is not apologizing for his order critics say created a superspreader disaster in nursing homes. he is instead blaming nursing home visitors and workers. what do you say? >> i would say his administration said that they froze because of, trump administration sent them a letter about the deaths. i would say what does he think and put in perspective, we froze. we were in a race for our father's life on march 25th. we were on a race to save him from this order and covid and, unfortunately we did the best we

could. ultimately we failed our father and i can't imagine that they say they froze from a letter that all they did was require them to say, tell us what the real deaths were. but what did they do to thousands of family members that either knew about the order or didn't know about the order? the order has defies common sense. defies science, and they acted, cuomo administration acts like the victim in this and we're the victims. my brother and i have gotten much exposure, more than the thousands of families have and all we have asked for was an apology dating back eight, nine months ago. if you made a mistake, admit i had, let's learn from it. let's investigate it and stop being the victim. we're the victims of the march 25th order. elizabeth: yeah. we hear you loud and clear. let's listen to governor cuomo doubling down and fingerpointing yesterday over his own obstruction and coverup, watch

this? >> the truth is with all we know people still die in nursing homes today. people still die every day. this past year there is a toxic political environment and everything gets politicized. covid did not get into the nursing homes by people coming from hospitals. covid got into the nursing hopes by staff walking in to the nursing home. we should have done a better job of knocking down the disinformation. you would never knock down all the conspiracy theories, the political conspiracy theories because they generate 10 a day. elizabeth: okay. you know is saying who cares. he also said who cares, daniel, people died. if it is really who cares he shouldn't care about releasing all the transcripts, all the documents, everything that went

♪. elizabeth: joining me now is heritage foundation senior legal fellow hans von spakovsky. this is a story, where is u.s. attorney john durham in the trump-russia probe? congressman matt gaetz said the obama administration did engage, a quote, premeditated effort to

out of and get rid of president trump based on newly revealed government documents. what do you say? >> well what they have revealed, is at the very same time that james comey was certifying to the fisa court on an application for a warrant that they had confirmed and verified the steele dossier at very same time he sent a email to james clapper saying they hadn't verified the information and claims of the steele dossier. that is a very serious problem for james comey because it looks like he may have lied to a federal court. that has got to be investigated. frankly, if that is the, if that is what happened, it needs to be prosecuted for that. elizabeth: so this is a smoking gun email that was sent in january 2017 from then fbi director james comey to then director of national intelligence clapper.

comey said, the fbi quote, was not able to officially corroborate christopher steele's trump reporting that was after he was signing off on wiretaps to go after the trump team at the secret court meant for terrorists. let ace listen to matt gaetz on this, and like your reaction what he was saying on "hannity" last night. >> not only did our own justice department set up the president on the russia hoax, they did it on rotten information and they knew the information was rotten when they did it. you know, i know, all the viewers know there will not be accountability under the biden justice department, none of the career people there say to move up in the biden justice department is expose the russia hoax. elizabeth: your reaction, hans? >> i'm afraid he is right. if the national security division of the justice department doesn't investigate this, that is a sign unfortunately partisanship of

the justice department under joe biden. look the pfizer court can and should investigate this -- fisa court. if they fail to do something about the director of the fbi potentially lying to them, that will be a sign to the public that they are not willing to police the misconduct and misbehavior of federal agents and federal lawyers at the justice department and that will be a very shocking development, particularly with regards to the use of the fisa statute. elizabeth: yeah. then it is full-on katy-bar-the-door. you're allowed to commit perjury for the fisa court. >> right. elizabeth: that is meant for terrorists. not meant for political opposition campaigns. all right, so, in june of 2017 comey deafing to congress that the steele dossier was salacious and unverified. the fbi was told by that carter page was a fbi asset.

told by steele's own source, it was gossip said over beers. they knew the trump-russia probe and flynn case was falling apart. they were told that the hillary clinton campaign and the dnc paid for, financed the steele dossier. that hillary wanted to set up the trump russia narrative to vilify trump and over her email scandal that was not told to the fisa court. what do you say? >> i think it was the worse, if not the worst abuse of federal law enforcement powers and their powers, counterespionage powers in the history of the united states. the worst thing about it all, so far no one has paid the price for this, which means this kind of abuse could happen again in the future. elizabeth: here's the thing, i mean, james comey was pressuring then dni james clapper to include the steele anti-trump reporting inside of the intelligence community assessment on russian meddling.

at that time, the fbi, by that time the fbi already let go christopher steele. he was thought to be, by many in the fbi to be unreliable, not trustworthy. even his own supposed russian sources said he is not trustworthy. he was let go for leaks to the media. the fbi let him go, but he is still reliable enough to put his stuff in the ica? your final word. >> this was, he was obviously not reliable enough. but all of this makes the director of the fbi frankly look worse, even than herbert hoover was, j. edgar hoover was in abusing the powers of the federal bureau of investigation for purely political purposes, and that is unacceptable today in our political society and culture. elizabeth: all right. hans von spakovsky, thanks for joining us. we knew who you meant it was j.

♪. elizabeth: okay. joining me now is former acting attorney general matthew whitaker. matthew, great to have you back on. reports are coming in that republican lawmakers and staffers on two of capitol hill's leading investigative panels, house oversight and senate homeland security, they still plan to pursue pay-to-play conflict of interest accusations involving the biden family. what is the low-hanging fruit here? what do you say? >> well there is sure a lot. i'm glad to be on with you tonight. i think hunter biden situation continues not only to be investigated by the department of justice but i think congress through these committees in the house and senate should continue

to pursue that. there are also other family members, his daughter-in-law, his brothers have also needed some attention to what their business dealings are in this administration. i think the real concern liz, is, that for the next four years if there is not an active oversight function of congress looking into these pay-to-play allegations and not only previously when he was vice president, also now that he is president, i think people could get away with very bad business deals without the attention of the republicans in the congress. elizabeth: you know, one of them includes biden's son-in-law who taughted his link to the president. he is the chief medical officer of startup health. the company invested two billion dollars, more than 350 tech startups over the last year. companies are approaching his company because of his access to the president and they want to get into federal and state

agencies with things like covid vaccine you know, distribution software and the like. what are your thoughts about that? >> that is a very dangerous area if people are approaching him because of the relationship he has with the president, trying to get attention for their product and commercial interest. i suspect this will continue to have a spotlight on it. we need to pay attention to what this company, the son-in-law is involved in and others in his family to make sure that they're not getting any special treatment or you know, being able to cut the line and get federal money or federal attention, that they don't deserve on the merits. elizabeth: you know, it's, critics are saying seems like it is par for the course of the biden family because joe biden's brother frank was featured in ad for a law firm, berman law group, showcased his ties to president biden, saying my brother. he is not a lawyer.

he is an advisor to the law firm. it seems like so out there inside the biden family it is okay to run advertisements touting their connection to the president. >> my sense this is not new for the biden family. for the eight years joe biden was vice president there were allegations especially with his son hunter, others in his family they were taking advantage of that relationship and that access. so this is, i mean this is something that this president has made statements about being aboveboard and about being more than ethical about doing things the right way. i really want to see the proof in the pudding. i want to see that they have taken the right steps to make sure that these family members don't have access. that is not consistent with the highest ethical standards. elizabeth: we hear what you're saying. we hear the rhetoric and the words. what is your feeling about the fact that there is still that justice department probe into hunter biden for alleged connections to money laundering and tax evasion involving

overseas business dealings? so you know, the person running the criminal division there, matthew, you and i talked about this. >> yeah. elizabeth: is former business partner, law firm partner to hunter biden's own attorney. so that is who president biden put in to run the criminal division at the doj overseeing his own son's probe. what is going to happen there? >> yeah, liz. that relationship obviously is concerning that somebody was not only a law partner but worked cases with the head of the criminal division in private practice is representing hunter biden but in this case the u.s. attorney in delaware is leading that investigation. there will be very few things the criminal division would need to be access to get permission to do. in fact if it's a tax case a tax evasion case, that is actually going to be handled in permissions and approvals handled by the tax division which is separate and distinct from the criminal division. i know that relationship is concerning. we talked about it before as you

happening at at anti-trump lincoln project. it is a escalating scandal. can you talk to us about it? what is going on? >> you're absolutely right, emac. the more we learn about the lincoln project the worst it gets. let's be perfectly honest, had they not been a vicious anti-trump organization we would found out much of this long ago. frankly they would already be disbanded but it appears many people are trying to make this story got away because it was again a anti-trump organization. elizabeth: it stopped taking donations. it yanked its fund-raising page. a second minor, teenager coming forward, that cofounder jon weaver sexually harassed him. now 20 minors, teenagers coming forward saying he sexually harassed them. the cofounders reportedly knew about it, as early as potentially march of last year, what was going on with him. they pull in $90 million. half of that money went to

companies that cofounders control, ford. >> well, look the weaver allegations are absolutely atrocious. i hope somebody gets to the bottom of that. i'm concerned that the law firm they contracted to look into this, paul hastings has its own conflict of interest. to your point, covering up for john weaver is not the lincoln project as only since. it appears they engaged in corrupt business practices in a sense they only spent 1/3 of money they raised, $90 million. they sent 50 million to their own direct companies. i think donors should push for accountability. they might have a real lawsuit on their hand when it comes to corrupt business practices. elizabeth: should there be a government investigation? should the irs look into what they were doing? you cannot personally, you know, take in money for your own personal expenses. we gnat that it is loosey-goosey

elizabeth: joining me now is national border patrol council vice president art dell quaid doe. it's always good to have you on. border patrol is reporting they're trying to rescue dozens of people caught in dangerous ice storms down at the border states. they were crossing in. they were brought in by human smugglers. so that's what border patrol is now dealing with. your thought on that. >> you know, the agency has dealt with rescuing people for many years now. but what this shows, this shows the disregard by the human

smugglers themselves. they don't care about these people. at the end of the day, to them it's just trying to make a profit, and they're willing to bring some across, leave them in dangerous conditions and go back knowing full well they can bring more people across. and sometimes, to be honest, a lot of these things, what they cause is a distraction for agents, that way the drug smugglers can bring in drugs in another part of the border itself. elizabeth: yeah, that's a dangerous situation. and if the person being humanly smuggled in doesn't pay up, they're turned into mules for drug smugglers. you're right, it's a dangerous game. what do you think of president biden promising to keep americans safe before authorities warning the freeze on deportation of criminals will result in dangerous crimes potentially here in the u.s.? >> hook, a lot of the -- look, a lot of the thing, it comes down to policies. when you step into a new administration, you realize

they're going to change some things, but you expect them to change policies with other policies that could also work or at the same time adapt and keep those policies that have been working. so a lot of the policies that have been working is sending people back to their country, having them wait there because you can't just open the floodgates. what happens is you create a magnet. that magnet makes more criminals come through. at the same time, you'll have people, you know, false claiming finish not amnesty, but they'll be false claiming a asylum. and that's also dangerous because you never hear from them again. at the end of the day, it comes down to the people smuggling organizations, they take advantage of all this. they realize that it distracts agents from their day-to-day job. what we see in rio grande valley right now is you're seeing a lot of unaccompanied juveniles. when you think of unaccompanied juveniles, a lot of people think of children. but then you look at the tucson sector, and the juveniles in that sector are more 16 and

17-year-olds that are claiming to be juveniles, but you realistically don't know. elizabeth: it's interesting, we hear exactly what you're saying. so, you know, it appears that, you know, there's so much pressure now on border patrol, and here's what recently happened, i.c.e. dropped detainer requests for 26 criminal illegal aliens in the state of texas alone. most were convicted of drug charges or drunken driving. but two were convicted of sexually assaulting a teenager, and a third was convicted of indecency with a child. and when you look at what's happened in recent weeks, you see something like we're seeing thousands, we're seeing catch and release totals, at least 2,000 released into this country. what do you say? >> liz, it's a magnet. at the end of the day, it's a mag innocent that's being created with these policies that's allowing criminals to thrive in the u.s., and it's also allowing criminal organizations to be able to bring in their up and comers, i
