"the evening edit" starts right now. ♪. elizabeth: joining me now former federal prosecutor jim trusty. jim, thank you so much for joining us. jim, what is your take on what direction the fbi and the justice department would go in probing cuomo? what would they be looking for? >> you know it is interesting i'm not sure that the fbi and the eastern district of new york are going to end up really addressing point-blank the issue of were elderly patients put in harm's way by governor cuomo. it may not be the actual substance of his decision making and what happened to these

folks. i will say this, federal investigators take subpoenas very seriously. if you have got a situation where the governor's office decided not to comply fully, they're getting these inquiries, they're giving half-baked numbers, they're misleading federal investigators that is a different pandora's box he is opening up. that is obstruction or false statements and what's amazing about this normally the division is was it negligent or was it intentional. did they fail to comply with a subpoena because they didn't have their act together or were they trying to mislead the investigators. that secretary for the governor blew it wide open telling how we froze because after federal investigation. we were worried about trump so we had to mislead people about the actual numbers. that is a bad moment for the governor. elizabeth: the transcript we read, because the transcript has been released, it is indicating they are were just fearful this like trump, treating it like a political football. that is why they froze that

trump would use the data against him. but the issue is the justice department doesn't say to any state government you cannot release information because we want it first. they had every opportunity, cuomo did, to reveal the data to democrat state lawmakers, jim who were demanding it for months how cuomo created a superspreader disaster in nursing homes with his executive order last year, saying nursing homes, you have to take in patients and you cannot test them for covid. the doj doesn't shut down a state or anybody saying you can't release the data. >> look he faulted across the board. there were freedom of information requests. there were state assemblymen requests. there was doj. fighting it across the board. there ain't a trump exception. yes, but trump was doctoring doj to ask for these things that was not going to fly. the fighting over information coupled with the secretary's comment is devastating about what the intent was when they

didn't give real numbers. elizabeth: the issue he covered up the true death toll to make him look better. it is not 86,000 but 15,000 and counting according to the associated press. he is trying to sue the federal government. he is trying to blame shift, blaming the cdc guidelines. legal experts say he doesn't have a case. they're guidelines, not rules or laws set in stone, set in cement because florida governor desantis, we didn't adhere to the guidelines. we separated patients out of nursing homes. they wouldn't put them back into nursing homes. we put them in separate facilities. does he have a leg to stand on with that? >> that is the key. the guidelines are not a defense to the dishonesty part to the destructive part. would come into play if an aggressive state prosecutor tried to characterize the nursing homes death, second-degree murder, involuntary manslaughter, a recklessness based crime in turn of the actual death. you could get into the fact that

we were getting a all this conflicting guidance, we were following all these guidelines that would work fighting off a defense, but not the false statement stuff. that will not help at all. elizabeth: again cuomo blocked democrat lawmakers. they demanded the data for months. they say they own claim clean after democratic attorney general letitia james reported they are undercutting this by 50%. you're not counting nursing home patients that died in hospitals. i want to get to the story of ronald kim in new york. he says cuomo threatened to destroy him. watch ronald kim here. >> the governor's mother is well off, protected in her home. she does not represent the thousands of, you know, minimum grant and minority and all sorts of community loved ones still stuck in nursing homes worried that the governor and the administration is hiding information about life and

death. why did it take so long for the executive to change course when every other state recognized the fatal mistake that they might have made by sending covid positive to nursing homes. they immediately rescind it. they immediately changed course. it took us almost two months before the governor decided to change. in fact a month later, at a press conference he said he didn't know about it. he lied. just like he is lying right now. elizabeth: what do you say, jim? >> when two politicians are fighting it is not always easy to figure out who is being perfectly credible. when you say, representative kim says he was told, you will fear my wrath, or words to that effect that is certainly sounded like something cuomo would say. i would just say look, there is a lot of room for political fallout for moral blame. but whether criminal case ensues is a different issue. we'll have to find out. >> okay. jim trusty, thanks so much. let's bring in republican tom reed from new york. great to see you, tom.

you're on house ways and means. congressman, there is a backstory in this. cuomo is reportedly furious at kim and 14 other democrats. they say cuomo gave nursing homes and hospitals protection from lawsuits of covid-19 after nursing homes gave cuomo millions of dollars in political donations. what do you say to that? >> first of all i agree with jim's representation on cuomo's number two misrepresenting the department of justice. cuomo is so furious to change his story, change statements clarification what they knew about the department of justice. these lies are starting to compound and the governor will have problems. but i've always been looking at this from the perspective of a coverup is criminal. but also we need to make sure we understand why was the order having covid-19 positive patients sentenced to our nursing homes where you had seniors, most loved ones there

that weren't covid positive exposed to superspreader event. when you start peeling that back like we have, that is a problem. elizabeth: melissa derosa, cuomo's top aide aide, her father, brother, sister, work at a lobbying firm for hospitals and nursing homes. the issue is, questions are mounting that new york patients, that new york under cuomo put patients back into nursing homes and hospitals to keep the medicare around medicaid money flowing to them. the cuomo team says this is absolutely outrageous and wrong. the doj is probing because of the false claims act because nursing homes get paid by medicare and medicaid. congressman, here is ronald kim, democrat lawmakers with a report saying liability shields are linked to higher nursing home death rates. that people are seven 1/2 times more likely to die from covid-19 in nursing homes and hospitals in states with those legal immunity to facilities for

lawsuits. what do you say to that. >> why would you send covid-19 positive patients into nursing homes with argument like that? cuomo will sue the federal government, blame government, that was ruled by "politifact" as false statement months ago when we were yelling from the mountaintop don't send covid-19 positive patients into nursing homes this is exactly what cuomo is, he was doing this from day one. he was being and influenced by folks that big-time multimillion dollars lobbyists. daughter and brother and sister, whose mother-in-law is attorney in southern district of new york. it is well-connected people. it is disgusting this happened with this order. we'll get to the bottom of it. this is just the tip of the iceberg. elizabeth: what do you want to see done when you say you want to get to the bottom of it? what are you going to do? >> i want to know exactly communications from lobbiest to

fox news meteorologist rick reichmuth. rick is there any end in sight for people without power? rick: it is about to get better. we have couple more days but then there is relief coming from this really long stretch from record breaking cold. it has been so bitter. so many frozen pipes, all of the water, so many areas in homes with the water pipes bursting and then freezing. massive problems. those are overnight lows temperatures from last night. what we saw overnight lows, 23 in dallas. 12 in abilene, texas, 31 in houston. everyone pretty much in texas at freezing temperatures overnight. this is what it feels like in texas and oklahoma right now. it feels like still into the teens for everybody. 11 in oklahoma city. not just a texas event. goes up into areas of oklahoma to areas of the north of that as well. we'll start to see a bit of a warmup. low temperatures, very, very cold. tomorrow night temperatures very, very cold. we'll start to see day time high

temperatures creep up just a little bit. by tomorrow, almost everybody above freezing. by the time we get in towards saturday, we jump another 10 degrees. these temps are below average this time of year. at least we get the temps above freezing. by monday, tuesday, wednesday, next week we'll see temperatures getting a little closer to normal. still a couple cold days to get to but it is about to look better. there you go. liz? elizabeth: we're hoping rick. so great to have you on. really appreciate it. let's talk to one of my favorite guys. i loveliesenning to him, former deputy commerce secretary and texas rancher, david sampson. you're so practical, filled with common sense. what is your take on the blackouts in texas going out there? >> as rick said, this storm has unprecedented severity and duration. the dynamics are this.

texas had four new million residents the base generation, it is all about the base generation generation electric capacity. coal fired from 33% down to 20%. there is no new nuclear energy unit built in texas since 1992, and gas-fired generation has been stable. so tex has doubled down on greater reliance on wind and solar which can be helpful when conditions are perfect. but that is not what you need when the weather is severe and that's really been the problem that we've encountered over the last week. the wind and solar hasn't worked. elizabeth: you know the government is not delivering wind turbines to hospitals and fire stations and police stations down there in texas right now. it is about nat-gas. texas, the talk we need to get off their own power grid and join the southwest power pool. the issue, as you point out, not enough backup energy. there is no ramp up obligation

we're hearing like nat-gas. wind and sole solar don't have to pay to maintain the reliability of the grid. the wind executives say we don't have the battery capacity right now to store wind energy. your thoughts on all of that? >> wind energy is not, is not an economically feasible. it has to be subsidized in texas to even be built. so, it's not, it is not a stable source of energy when the weather is bad. elizabeth: okay. so this is one, feels like a once in a century event, david. where do you see this going forward, final word? >> i think there will be a complete relook in texas at our energy generation capacity. elizabeth: all right. david, i love your common sense. you're so practical, down-to-earth. you just gift information. we love to hear it. david, thanks so much for your insights. >> thanks a lot, liz. elizabeth: we're coming into the bottom of the hour, you're watching the fox business

♪. elizabeth: okay, back with us now is florida republican greg stuebe. he sits on house judiciary. congressman, it is always great to have you on. we haven't had you on in a while. good to have you back on. so we're going through the government documents, congressman, and we found james comey testified to senate judiciary multiple times he is quote, responsible for everything that went wrong with the trump-russia probe. so does that mean u.s. attorney john durham has a case against him? >> i sure hope if john durham has evidence that jim comey committed some type of crime, he absolutely will send that to a

grand jury, to look over the evidence and make a decision. the challenge we're now under a biden administration, the question is this durham investigation has been going on for so long, a lot of republicans have asked, it is well over a year, when will this end? will there be indictments come to this? only one with one of the attorneys part of this. jim comey was head of the fbi when all this happened. he was the head of the fbi when they used and weaponized the fbi in fisa court to spy on members of the trump campaign. so i certainly hope if durham has evidence of wrongdoing or a crime he is charged with that. elizabeth: the issue, the debate, that he has enough evidence to bring perjury charges for misleading the secret fisa court meant for terrorists, that the obama administration used on the trump campaign. let's listen to james comey before senate judiciary last september. watch this. >> apparently everybody's responsible but nobody's to blame is not the right answer. does the fbi director have any responsibility to make sure the

facts are right when they're given to the court? >> not in connection with the certification but in general the fbi director is responsible for everything that is being done underneath the fbi director. i hope you don't hear me to say i'm not responsible. i was leader of that institution. so this reflects on me entirely and it is my responsibility. but no, i'm not looking to shirk responsibility. the director is responsible. >> are you responsible for this misleading evidence given to the fees fisa court, yes or no? >> yes in the sense of command responsibility. no, i didn't have personal knowledge that would have led me to understand that we weren't supplying complete information. elizabeth: okay. the last part is what critics are saying comey, that is objectionable because, under comey, the comey fbi, congressman, you and i talked about this, the cia warned comey that this is internet rumor, the

anti-trump steele report financed by hillary clinton campaign and the dnc. comey's was informed by steele's own source, that this was just gossip said over beers. comey testified later in june, 2017, congressman, that the anti-trump steele report was quote, unsalacious and unverified. he knew it was unverified but they still used it to get a wiretap against people like carter page. your reaction? >> they still use it to get a warrant. they still misrepresented and omitted information intentionally to the fisa court to get a fisa warrant to spy on carter page and others in the trump campaign. you can't tell me that they didn't know. he was the head of the fbi. he would have been briefed on all these things. if he didn't know he sure as heck should have known the information wasn't corroborated, wasn't accurate. they had a duty to investigate that. so i sure hope if there is evidence that john durham has that there was misinformation that was given to the fisa court

which we know he absolutely should be held criminally liable for that. elizabeth: so january 2017 comey emails then dni clapper saying that the steele report, the anti-trump steel salacious information, was quote, uncorroborated. but then, at that same time turns around to the secret fisa court saying it was verified in order to get a powerful fisa wiretap that can violate a private citizen's constitutional rights. it is powerful. it can be a one hop, two hop, anybody they talked to, who those people talked to, they can be listened in on. listen to james comey, congressman it, seems like in the same testimony, the same hearing that when james comey is saying i'm responsible, i'm responsible, i'm responsible, he may have realized what he was admitting to because then james comey backtracks, then he starts saying this. roll tape, listen to what james comey ended up saying.

>> i year, i don't remember anything. i don't remember being told that. i don't remember anything about the facts. i don't remember anything. i don't recall being informed of that i do not remember being told. i do not remember any information. i don't remember learning about them or being told about them, not that you recall, no. i don't remember any discussion. i don't recall that. i don't remember using that word. i don't remember every being informed. i don't remember if democrat party but i don't remember us using that word. i don't remember doing anything. i not that i recall. i don't remember, hearing those words i don't remember the exact words. i don't tend to remember exact words unless i write them down. elizabeth: your reaction? >> that is pretty telling. criminal defense lawyers, one of the first things they tell you to do to not incriminate yourself saying i don't recall. he knew he was under oath. he was under oath at the committee hearings, if he lied about anything later could be

proved he did know that information and lied to a senate committee in a hearing about that he could be held accountable for those lies. he is going to say, i i don't recall, i don't remember, when in fact he probably did. i sure hope there is evidence out there in this john durham investigation for him to get to the bottom of this. elizabeth: critics and americans we keep hearing it, tired, he will be held accountable, right? the doj inspector general found the fbi team led by comey committed 17 significant errors and omissions as well as 50 errors in the rules that protect u.s. citizens constitutional rights when it comes to powerful fisa wiretaps. they're called the woods procedures. seems like there is enough there. your final word, sir? >> this has been going on the entire time i've been in congress. republicans, republican members of congress are frustrated by the fact it has taken so long to get to the bottom of this. we keep getting told, members of congress keep getting told it is

would of 10% ownership stake in the chinese fund that invest in materials that compete with u.s. green energy and also are connected to companies that are committing human rights and child labor abuses. your thoughts on that? >> i think we really have to stay focused on the policy. that is really crucial. we're at a crucial point. we were climbing mount everest. we to the to the second step. biden said go back to base camp to talk about this the message the administration is sending twofold. we want to think about policy with china. china is not thinking. they are moving out. china is tough but we cooperate where we can. news flash on every critical issue to us the chinese are on the wrong side of the coin. so when are we going to cooperate on useful for us? the answer is nothing. so the united states doesn't lead with a strong policy, then, we know what the chinese are going to do. they're going to push the ball

down the field as far as they can to take advantage of that. if you want to be tough later on, you're playing catch-up. elizabeth: republicans consistently say the biden family is taking on advantage of the president's position in order to make money by selling access. ric grenell talked to us about about that with us last night. he says the media is continuing down playing seriousness of biden family ties to china. watch this. >> joe biden said during the campaign he didn't know anything about this. he never spoke to his son about any of these deals. yet there is evidence showing video evidence, of them on a trip together into china. none of this is making sense. and media in d.c. are completely disinterested but the fact of the matter is, is that joe biden keeps talking about russia because he doesn't want us to look at china and go deep on what his family has been doing which is selling access.

talk about technology at ports. talk about facilities. talk about technology between the ports but at same time they don't hire one additional agent. they talk about the authority the secretary exercised to put the wall down in 2006 and 7 and latest iteration of wall. the secretary has authority in act to waive environmental statutes to get it done. why was it in the homeland security act. you couldn't build border without authority. you would be sued. we would still being sued by cases from the 2006 installation. it is a lot of insecurity here. it is thin on the security part. there is nothing about hiring agents or closing loopholes for amnesty. you have the jail audit of the authorities. you have more use of alternatives to detention which is a expensive social welfare program for people who are here illegally. leads to very, very few

deportations. we sent out another signal like a month ago. we'll go soft on immigration enforcement. we'll go soft on the border. everyone knows it. why the caravan is formed. they talked about record numbers at the border last month and so far this month. they had to do releases early last week at the border. you're putting conditions in place where you will have another surge. 14 was bad the first one. 18 was worse five times. we took all the tools off the table. think about the workforce have to go through yet another humanitarian crisis. these agents and officers can't skype into their jobs. they have to put hands on people. these people coming over in crowded conditions. they're in trailers. they're in stash houses. we have to interact with them, go home at night to their families. think about the stress that will cause just thinking about another surge on the way to the border. elizabeth: exposure to covid-19. you know, there is, we're hearing another caravan is heading to the border.

"politico" now reporting democrats in border states like texas are really uneasy. they don't like what the white house is doing. they're saying the white house, is quote walking into a political buzzsaw due to the freeze in quote, the halt on deportations. that basically the, president biden will soon be dealing with a minority in congress if he continues down this path. sir, you and i talked about it. this is about crime. it is not about immigration. and that seems to be a lack of focus in the biden administration when you see per capita homicide rates just south of the border higher than the middle east. you see hard narcotics shipped across the border via drones, place, saab marines and boats, shoved into vegetable trucks or into, you know, house wares vans. any which way, even into things like food like burritos we're seeing them trying to get drugs

across. human smugglers, if those guys, those migrants don't pay the human smuggler they are dragooned into becoming drug mules. this is about crime, sir. your reaction? >> you're correct. it is about all of that. the only people that will be benefiting from a softer border is the cartels. they will make money on all of the transactions you talked about. people who represent border states, they know what that is like. we've seen it happens. we know what happens when you take all the tools off the table. you send a signal to the world that the border will not be enforced like it was for the last three years. elizabeth: all right. so where do you go from here? what are you guys going to do? final word? >> the republicans have to hold the side on the political side. we have mo make sure we security regime. if we secure the border. i think american people will be generous give be benefits people here. without that confidence, we
