the evening edit starts right now. ♪. elizabeth: welcome to the show. you're watching the fox business network. back with us now retired i.c.e. acting director tom homan. tom, great to have you on. what was your reaction you heard a federal judge in texas, banned and blocked indefinitely biden's attempt to freeze deportations? >> well look, i thought it was a great decision. i'm a party with the lawsuit, liz. i worked with the texas ag. i filed an affidavit as expert on the border and what the consequences would be. i think it is the right move. what the biden administration is creating a public safety nightmare. that is what my affidavit said. we won this one. one for the good guys. elizabeth: the judge said biden deportation violated federal law and put risks and costs to the

states. can you break down to the viewer what this was all about? >> the texas lawsuit is about, with no exaggeration, all the criminals i.c.e. arrested and deported say for last year, 90% of those people could not be removed under this new policy. so 90% of the criminals i.c.e. removed last year could no longer be removed under this policy committed theft, assault, dui. i.c.e. could no longer remove them. the argument if you stop deportation 100 days, not deporting worse of the worse, because the memorandum, only carved out for those terrorism and recent border thefts but didn't carve out anybody was a rapist or murder he. what the argument was, you stop deportations i.c.e. is required to release the people back into the public where they will recommit. the recidivism rate is 50, 75% depending how far out it is. releasing criminals is bad for public policy, create more

crime. state pays more money for enforcement and jail. that is the argument. the judge agreed with that argument. elizabeth: so it is not immediately clear if the biden administration will appeal judge tipton's latest ruling. the justice department did not seek a stay of his earlier temporary retraining order. so what you're saying is, what this meant was, what the biden administration wanted to do was freeze deportations for those charged with those crimes even if they were known gang members and even if they had prior criminal records, right? was that the story? >> absolutely. but here's what the biden administration is doing to work around it. the memorandum i.c.e. said limited who i.c.e. can arrest now, 90% of those criminals arrested or removed last year, cannot be arrested now under new priorities of i.c.e. the way they worked around, arrest 90% less. we have moratorium on 90% of the people removed. convicted criminals. that is the way the biden administration is working around

it. there is another lawsuit pending. i hope the judge further finds they're working around this decision by ending i.c.e. arrests by at least 90%. elizabeth: all right. so you know i.c.e. arrests tens of thousands of illegal aliens every year who are convicted or pending charges for crimes like drunk driving, assault, drug to possession and fraud. tom, the numbers are staggering. 2019, more than 74,000 convictions for drunk driving. 68 charges or convictions for traffic offenses. 46,000 charges or convictions for assault. we're not talking single-digit numbers. these are in the tens of thousands. >> absolutely. let's not forget there is no prerequisite in the immigration law you have to commit yet another crime other than being here illegally. being here illegally is no longer a reason for i.c.e. to arrest you. here is what i propose the biden administration, go ahead abolish immigration courts too? we're spending billions of

dollars immigration processes putting people in front after court, in front of a judge the a great taxpayer offense. federal judge says you must be deported. now the administration says you can't execute that order. so that means a judge's order is meaningless now. so why do you have immigration court? it doesn't matter anymore because being illegally in the united states isn't no longer illegal at least not an arrest priority of i.c.e. according to the biden administration. elizabeth: so again, this is about crime. it is not about immigration. for decker cade americans have been killed by drunk driving individuals who were not supposed to be here. they're here illegally, i were concluding many were killed after federal and state officials decided not to deport them, tom. so you have spoken to angel moms and dads, angel families. how are they going to feel when this biden administration proposal was floated by, right? >> the country let them down. the biden administration let them down. the biden administration has

immigration actists working in the white house now. i know who they are. have they met with a angel mom or angel dad? absolutely not. the president biden dui is no longer public safety threat, why are we arresting anybody for dui? if it is not a public safety threat, why are people going to jail? 10,000 people die a year from dui. it is a public safety threat. the angel mom and dads they have lost their children forever. they have been separated from their children forever, by somebody wasn't here illegally, they should have been removed. so that crime should never happen. every crime committed by illegal aliens, preventable crime if we had a secure border, i.c.e. could enforce the laws as intended by statute, as intended by what congress wrote in the law. elizabeth: so you know, there is this thinking in washington that this discussion we are having is somehow with a broad brush

painting rather, a broad brush -- people trying to come here -- but this somehow is putting a negative slant towards those who are trying to i am my great here legally? this is a hot potato issue. why, tom? why is an issue about crime so difficult for washington to talk about and edge act policies about? >> you had a millions of people standing in line trying to do things the right way, right? they're going through background checks. they're filing applications. what does it say to them. they want families to be put together. i met a gentleman the other day who recognized me, told me, you know i've been working for eight years with my family. i became a non-immigrant. i became a citizen, working in the family, following the rules, watch people come across the border every day and get released. why do i want to follow the rules anymore. here is somebody who wanted to become a u.s. citizen, became a u.s. citizen, respects the laws of this count through enough to

want to follow the rules. he is put in a back seat by people who knowingly intentionally violate the laws? it's a shame. we're rewarding illegal behavior. all these family groups that, illegal family groups have come in the last five or six years, hundreds of thousands of them, they entered country illegally. they were ordered removed. instead of leaving they hid out. they hid out became a fugitive. ignored a federal judge's order. what happened liz? they will be get rewarded with amnesty. according to biden's plan, people ignored a judge, get amnesty end up with citizenship. elizabeth: a matter of inequity for those who did it the fair and right way who follow the law. tom, thanks for joining us. really appreciate it. thanks for your service to our country. >> thanks for having me. >> sure. coming up retired four-star army general jack keane on this chilling op-ed by former secretary of state mike pompeo. what exactly china has been

op-ed. what was your reaction 14 republicans demanding fbi director chris wray give them a briefing about democrat eric swalwell's an entangle meant with a chinese spy? they want to know everything they know about that and if they were targeting anybody else in congress. your reaction to that? >> what surprises me all about that, certainly the republicans request. they have to make that request. this should have been done a long time ago, frankly i thought it had been done. a member ever congress targeted by a foreign government, the chinese communist party intelligence service. they have a spy make contact with the congressman with the congressman even before he became a congressman, with an attempt to gain obviously what? influence and information. that is a big deal and it is an indicator of the much more comprehensive chinese communist

espionage program that is going on in the united states. it is so massive that it is the largest attempt to penetrate a foreign power in history. nothing that we've ever experienced even with the soviet union compares to what the ccp, the chinese communist party is doing. this should have taken place months ago, in the house and in the senate, to give everybody the benefit of what the fbi has learned and what are the techniques and procedures that this intelligence service is using to manipulate us to, blackmail us, et cetera. elizabeth: yeah. you're absolutely right, general, because china has been accused of trying to get. >> u.s. power grid with the technology, into the 5g telecom network and universities. get to the op-ed by former secretary of state mike pompeo. it details what china has been doing, weaponizing viruses. can you talk to us about that? >> it's a significant op-ed.

i'm delighted that he wrote it. the former secretary has been talking about this, you know, certainly on television but now to bring it all together in one piece i think it's very useful. i mean it is, it is certainly something we all got to be concerned about. let me set the table for you on this issue. the chinese communist party a number of years ago, excess of a decade have made the decision that they wanted to achieve biotechnology dominance. when president xi came in, he put that on fast forward. he wants technology dominance, not only in biotech but as you know, 5g networks, artificial intelligence, quantum computing and the like. here he put it on fast forward. they have got 75 labs. as a result of that, over the last 10 years secretary pompeo mentioned they have discovered 2000 new viruses. that is how aggressive they have been. the article points out it has taken 200 years to get to 2,000.

they did it in less than 10. this is a very, very aggressive program. and what it points to in addition to that the lab in question, the wuhan institute of virology, has in that laboratory somewhere in excess of thousands. he actually said tens of thousands of virus ares associated with bats and there are two scientists who work in that lab, one that said the biosafety issues here are something to be concerned about. it is a double-edged sword. we're trying to help humankind with, understanding pandemics but also it can result in global disaster. and that was a number of years ago. we've seen the results of that. another scientist from the same lab pointed out that there are major safety issues. the state department pointed out there are safety issues. i think the circumstantial evidence which people have seen say it is quite substantial.

we don't have a smoking gun so to speak but i think we can draw some pretty powerful conclusions here that china obviously created this world pandemic out after regional epidemic. elizabeth: yeah. >> spread it, lied about it, and two, their aggressive program without appropriate safety standards put us at risk. will likely this, is something we got to come to grips with, liz. it is likely going to continue to put the world at risk. elizabeth: right. and he says china is making bio weapons at same wuhan china lab where the covid-19 virus is thought to leaked out of. he noted in 2011 the military experts said we're making man-made pathogens with specific genetic markers and targeting drug delivery technology. he said in 2015 that the peoples liberation army treated that

2003-2004 leak of sars virus out of a lab in beijing, quote as a contrary genetic weapon. back in 2003-2004, that virus general, was treated quote as a contemporary genetic weapon. this is about bio weapons. people didn't know the length and breadth of china was doing weaponizing viruses. as the secretary of state is alleging. five dozen gop lawmakers why is the u.s. funding through the nih grants, hundreds of thousands of dollars going to the wuhan lab? your final word on that? >> yeah. first of all we have known that china is making bio weapons just like russia is, and our adversaries are, associating it with the wuhan i think is informative for us. the reality is they have been very aggressive. they had two reasons for being so aggressive.

face. all the time she is such a happy person an everything. but with her mother and father-in-law dying with everything, that that is tragic beyond belief. the governor of new york has himself a real problem now. he absolutely should testify. everybody should get to the bottom of it. transparency what it is about. you have to have the trust of the people. when you get into this it is not good. elizabeth: so his executive order last year, got nursing home patients who were in hospitals, had covid-19, recovering, those patients had to go back into nursing homes. they were not allowed to be tested for covid-19. then the governor cuomo's administration undercounted by not including those who passed away in hospitals in the death toll. 15,000 it turns out did pass away. from nursing home, covid-19 getting infection. and you know, it looks like 40% of, was also the amount of the

undercounting of the number of patients put back in, 9,000. now we see andrew cuomo's approval rating dropping, double, single digits in a bunch of these polls. they want him, democrats, want him, governor to return political donations he got from the nursing home and hospital industry because the democrats like ron kim, governor, say, that's, after he got those donations he gave those executives blanket immunity from lawsuits related to covid-19. your reaction to that? >> well, i don't know how you can react except it is just bad stuff. this gig is not easy, i will promise you that. at least in west virginia we've done, i can go to bed at night i know everything we've done is completely transparent. when it really boils right down to it, you know, liz, the whole thing is just, as simple as this when you start covering stuff

up, when you start changing the number and fudging things in order to write a book, whatever it might be, i'm not being overly critical. the facts are the facts. at the end of the day when you start down that path, you're about to get in real trouble. the one thing, biggest thing i have already said, when you lose trust of the people, you have got a big issue on your hands. we are counted on as governors, that is the one thing we've done in west virginia, this little, you know state that lot of people thought was poor and everything, we've become a diamond in the rough. the reason we've done that because i kept everybody pulling the rope together. i really believe in west virginia, all of us need to be completely transparent. elizabeth: yeah. you know, now, cuomo made a statement in may of last year that he would not put his own mother in a nursing home. that came just two months after his executive order saying patients have to go back into

nursing homes. so you know, more and more keeps coming out. so your rule of thumb is always be tans parent, just always give the facts. it looks like there were political, there was political gamesmanship behind the scenes in the cuomo administration. your final word on this story? >> well, i don't like any part of it, you know. but at the same time, liz, what we've done is just this. in west virginia, we absolutely looked at all of our nursing homes, you know, we've had problems there as well. but all of our nursing homes, we needed to get them tested first. we needed to get them vaccinated first. we needed to give them second shots right behind that and we've done so. we have listened to our experts guide us through this but every single day, every day that i come before the people, we tell the people the good, and the bad, the ugly. we tell them everything. we keep them all moving together. that is really important this time. people need leaders that do

♪. elizabeth: now to our week-long exclusive series on "the evening edit." it is called your voice, america stands up, america speaks out. joining me is carlos roman. he is the owner of the bread and barley restaurant in covina, california in los angeles county. carlos, thanks so much joining us. there was a video of you confronting a health department officer over lockdowns. it went viral. can you tell us what happened? >> basically i got a call from my manager there saying someone was outside taking pictures of customers and trying to, i don't know, take pictures basically. i asked her to go see what was going on? they said they were with the

health department. they were going to be issuing a citation because people were sitting outside in front of the restaurant. people were waiting for their food. and so, i got angry, we're already, in a situation where we're barely making ends meet. business is tough enough as it is without that kind of harrassment? so i wanted to confront the health inspector find out what we were doing wrong. i pulled up line him and tried to talk to him. elizabeth: it seems so unfair because big box stores like costco and home depot and target and walmart, they're allowed to stay hope but the little guys got shut down. you were sued? where does that lawsuit stand? >> well, basically i had to enter into a stipulated judgment in order to get my health permit back. they had kind of a quick, put together hearing of sorts where it is basically them against me. they say, thank you for your input. we'll let you know what happened. then a week later they say we

decided to revoke your health permit n order to get it back, id that to get through this legal process which they have never ending resources to fight and drag out. i don't. so i had to agree to some terms in order to get that back, pay a bunch of hefty fines and citations. it has been a mess. it has been a real mess. elizabeth: it has been a mess. government data, cdc data, carlos, shows that states did not lock down as severely as, severely as other states, you know the state has did not lock down, florida, nebraska, iowa, utah, arkansas, wyoming, they have lower covid cases, lower hospitalizations, lower deaths per capita versus states that did aggressive lock down. they have lower jobless rates. your word on that? >> i don't understand the lockdown to begin with. seems like it only applied to small businesses like myself. hair salons and restaurants and places that you know, where just

average people are trying to make a living, we're not the huge juggernaut box stores like you mentioned earlier. it is not walmart, costco, not home depot. i don't even understand what the point of the lockdown was in the first place. it only seemed to target small businesses. that is not where the masses are to begin with. that is not where most people are. anyone goes out at night, during the day, goes shopping knows that. elizabeth: yeah. there is a growing number of lawsuits brought by americans like you against lockdowns for being unconstitutional. people know covid is deadly. it is no joke. you have got to be safe but, you know, small business guys are doing the right thing with temperature checks, plexiglass, you know social distancing and masks. the other thing, carlos, what else happened, people are frustrated about during these lockdowns, they saw a cities and their towns and neighborhoods under siege from crime and from things like riots. they were, people were literally

begging for officials to help them. listen to this. watch. >> go to hell. you can go to hell. and excuse my expression but you took something that was precious from me, precious from my son, precious, something precious from his mother. we will never see him, he cannot come back. he cannot wake back up. he was an innocent little baby and he is gone forever. >> the community is getting worse and worse. nobody is doing nothing about it. nobody. nobody is trying to make a change. and it is sad to say that. like, every day is just worse. you don't know if you are going to live to see the next day. >> come here, meet with us. face us. stay here for a weekend. for the love of god just come here, say something to us, the people that are frikin' voting for you and depend on you to take care of us.

where are you? show your face to us. do something. don't just sit there and let your city go down to the ruins. elizabeth: what do you think, carlos? >> enforcement seems to be based on popularity nowadays. i'm speechless. i don't know what to say. there is an army of health inspectors and people out trying to enforce things like small business having a patron sitting out in front and yet, you know, things like that can happen. i don't understand it. i really don't. we tried to fight it. but, these government agencies have deep pockets. they, they're no strangers to litigation. they have armies of attorneys on staff and it almost seems like their true purpose is to really just keep us in check and keep us in place and the mini one of us speak up, they hit you with an iron fist. elizabeth: yeah. it is quite a story.
