"the evening edit" starts right now. ♪ elizabeth: welcome to the show. you're watching the fox business network. we begin tonight with house republicans at the border today saying biden, the democrats you broke it, you own it. bring in retired i.c.e. acting director ronald vitello. good to see you. democrats say there is no crisis but fema is headed there? fema is in charge of crises. what is going on. >> right. they were emergency managers. they were put the whole government response in 2014 when president obama and biden was the vice president. that problem is much smaller in 2014 than it is today. i saw some reports from the

border they are taking in 500 children who are coming to the border alone and hhs shelters are releasing children at 140, 150 a day. the math does not work. they will need lots and lots of shelter space. obviously the border patrol at the line has to spend a brief period of time to get these people into custody and get them transferred to hhs. so their facilities are strained. i pity the workforce. it's a terrible situation for them to go through but we sent this signal we want children to come to the border and obviously they're being released from the hhs shelters to family in the united states and so, this cycle will continue. every time we had a surge like this the only way we stopped it was with detention. i don't see that in the cards here. building shelters is fine but the kids need the right kind of care. you don't stop the flow if we don't start holding people accountable for crossing the border illegally.

elizabeth: yeah. we've got basically the worst border crisis in 15 years. the biden team is accused of again blocking the media covering biden officials visiting the border this weekend. why the media blackout. we also have the use of the dallas convention center to house teenagers. in in this sure seems like a crisis. are they trying to topspin the conversation, what do you think? >> immigration always figures into the elections. in the last couple years top three or top most important thing. if this chaos continues and it doesn't look like they're going to do anything different than continue to do the same things they have been doing since january 20th it will be a factor when people decide which way to vote in the midterms or whatever happens there. elizabeth: let's watch house minority leader kevin mccarthy at the border today. watch this. >> you know, it is worse than a

crisis. i thought i would see a crisis. this is really a human heart break. we have a brand new facility to care for the children. they built it beyond capacity that they wouldn't reach it. today they set the anniversary of broke the capacity. more than 1000 children. it is growing every day. that means 120 of these border agents doing an extraordinary job in unbelievable times can't be on the bored protecting us. elizabeth: you have kevin mccarthy saying that. you wonder where is the consent of the governed here? what do you think? >> it is frustrating this would be the outcome when they sort of rolled back the tools in place that stopped the surge in 2019. i understand when policies change, when presidents change the policies change but not having sufficient shelter space and not winding it down after you built up some of that space it is very expensive to put that stuff up in a hurry.

you have to find the right staff for it. so they're behind the curve here. it is, he mentioned it, the leader mentioned the workforce has to deal with that not just they're having to deal with this humanitarian crisis but they're being distracted by the job they can do stopping drugs and stopping human trafficking. they're now inundated with these children and families. elizabeth: fema at the border insisting with a breen light for human smugglers. that the human smugglers are armed with weapon. we'll stay on the story. ron vitiello, thank you very much appreciate it. florida attorney general, ashley moody. great to see you again. you're suing the biden administration. why? >> absolutely. the biden administration has implemented reckless policies when it comes to immigration. starting with canceling operation talon which was a targeted operation to go after sex offenders in our country illegally. now they have come out with a policy that they're not going to

arrest all serious criminal offenders and deport them. i have sheriffs around my state calling, we have got to go after this in court. we having to release people back into the communities that are going to wreak havoc. we're not talking about trivial crimes. we're talking about burglars. people breaking into peoples homes. deadly drug traffickers and under the biden and administration, they're jug wanting to us release them back into our states. so we've got to hold them accountable in court. elizabeth: so, the biden team and the the white house press secretary is saying they inherited a broken system at the border and that their policies are more humane than trump's. what do you say to that? >> that is absolutely untrue. you can say all you want for people not to come, trying to ward off a crisis but there are written policies give no ability to law enforcement to do their

jobs. what they're begging for from this administration and this does not just affect border states. this safety, nonexistent policy will trickle down into states across our country. when it comes to the security of our states, you have to have clear, consistent, bold, decisive leadership, not an ostrich that sticks its head in the sand and says there is no crisis. this is unacceptable t puts our states in jeopardy and we have to, i think you will see attorneys general from across the nation reaching out, holding this administration accountable to do its job that is mandated by federal law. elizabeth: okay this is hard for maybe democrats and certain parts of the population to grasp and understand. we see unmarked graves around the border of illegal border-crossers who were trying to cross who were killed by human smugglers and drug

traffickers. we see assault the on the illegal border-crossers. they're going the same routes that the drug traffickers and human traffickers are following. they're victimized. they're targeted. when you do it illegally, you're setting yourself up for crime. 80% of those who cross are paying, are paying human smugglers. if you don't pay up, you become recruited into a drug gang or criminal gang. it is, can you break this down because it's unclear if people understand why this is a humanitarian crisis and why it is so dangerous to try to cross illegally? can you explain it? >> this is a crisis because when you have a leader that will not come out and say we are not going to accept illegal activity, we are going to uphold the law and follow our laws, criminal organizations and that includes trafficking organizations, focusing on deadly drugs like fentanyl, human trafficking organizations are sophisticated. from day one of this

administration they have ramped up activities. they're charging money, astronomical sums to bring people across the border. this increases crime. it is not just at the border. this will flow into our states around this country and that is why we need an administration that will follow the will of congress do do their job. this is not some suggestion they follow immigration laws and deport criminals. this is mandated by federal law. they're thumbing their nose at the law. they're pretending no crisis is existing. that is not good leadership, that is not good policy we deserve better as americans. elizabeth: so you're going to tell us, are more attorneys general going to join you in suing the biden administration? we have about 12 to 14 right now. is this going to increase? >> as attorney general my number one priority is to protect floridians. i know that the other attorneys general feel this way about their states.

♪. elizabeth: okay. back with us now, house oversight ranking member, he is congressman james comer of kentucky. congressman, we always love having you on. can you get the chair of your committee, carolyn maloney to s&p new york governor andrew cuomo? you guys are in the minority. are you going to do it? >> we're trying. steve scalise and myself, we have not let up on this. we've stayed focus on the nursing home abuses, the nursing home coverup with respect to the deaths. i think that with the new allegations with sexual harrassment, you're seeing all the democrats are starting to cave in on governor cuomo. i think they're using the sexual harrassment to cut bait with governor cuomo, now finally calling on his resignation because they are all on record praising governor cuomo's great leadership in handling the pandemic when in reality, he was a disaster. thousands of people lost their lives and he has, without a doubt tried to cover that up.

so i think that the democrats are going to try to avoid the s&p by hoping and praying that governor cuomo resigns before it gets to the point that public pressure causes the democrats to s&p governor cuomo. elizabeth: yeah. it may end up that governor cuomo announces that he is not running for re-election next year, we have don't know but we've got president joe biden, house speaker nancy pelosi stopping short of demanding cuomo resign. house democrat adam schiff joins senator schumer saying he should resign. 126 lawmakers, in washington saying he should step down. your reaction to this, that cuomo deserves due process. a lot of people are saying that but democrats are demanding for cuomo now, when democrats and cuomo said we'll not give due process to justice kavanaugh during his hearings? your reaction to that story? >> everyone deserves due process. governor cuomo deserves due

process. the democrats are exposing their hypocrisy saying he deserves due process but republicans like brett kavanaugh didn't not deserve due process. at the end of the dade he deserves due process. if he is innocent he should come before the house oversight committee and plead his case. he should be transparent with the american people. the more he hides behind the facts with respect to the nursing home scandal, the more he hides behind the facts with these allegations of sexual misconduct the more guilty he will look. elizabeth: "vanity fair" ran a piece by michael who was the buying grafter of governor cuomo. it is pretty hard-hitting. claimed that keri kennedy hit in the closet because she was fearful of andrew cuomo's physical abuse. new york mayor bill de blasio blasted governor cuomo on "face the nation" over the weekend. watch this. >> i think a impeachment proceeding will begin and i think he will impeach and right

before that he will decide to resign. he should resign now, because he is holding up our effort to fight covid. he is literally in the way of us saving lives right now. by the way it was about campaign contributions, the nursing home industry, big hospital systems gave him millions and millions of dollars. he went easy on them and tried to cover up for everyone, not just him but his donors. elizabeth: yeah, we were breaking news on "the evening edit" weeks ago about the political donation angle of this. are you going to look into that? can you guys bet any hearing whatsoever? can you do it under carolyn maloney. >> i don't know if we'll be able to do it under chairwoman maloney. she is getting a lot of pressure from new yorkers to subpoena governor cuomo this is something that i am focused on to be honest with you this is terrible what has happened. the thousands of deaths. the fact he lied about it. he tried to cover it up. the connection with the inappropriate campaign contributions. the mayor of new york city is

exactly right. this is a scandal this is a huge scandal on top of other scandals that como has. with respect to the oversight committee we're focused on the nursing home scandal. this is the one we stayed with. you have done a great job, liz, reporting this from day one. elizabeth: all right. thank you, congressman. we appreciate it. i'm grateful for your kindness there and your generosity. we'll have you on soon. come back soon. let's continue with new york state assemblyman angelo santabarbara. a new scandal? did you hear about it? >> yes. elizabeth: grounds for impeachment. can you break down what is going on cuomo's covid czar what did he do? >> reports indicate what i read, the person in charge of vaccine distribution was reportedly making phone calls to county executives across new york state to try to shore up support. there was a complaint filed with the ag's office. so another, we may see another

investigation over this. essentially weaponizing our vaccine distribution here in new york state to try to get support for the governor who is surrounded by scandals and, as we can see, this is more abuse of power, just on dismay and longer remains in office the more he will do this. elizabeth: if this is true, are you going to put the lives of voters at risk by threatening to withhold vaccine supply in exchange for statements of loyalty to cuomo? i mean, are you going to add this to the impeachment charges along with obstruction of justice and work place retaliation, are you guys going to add all of that? >> there are certainly a number of impeachable offenses here. we have more than enough to move forward. i would, i hope that the legislature moves expeditiously with this impeachment probe to remove the governor from office and not further subject our state to an executive, the whims of an executive that is becoming

more and more desperate each day and quite frankly unhinged with each passing day. we see him doing things that are clearly an abuse of power but it speaks to what he will do if he remains in office, especially during this budget process. we just began budget negotiations, the final budget negotiations as of today. he will almost certainly use budget process, federal dollars, state dollars, to continue to do what he has a pattern of doing. he uses it to manipulate, control, because that is what he has always done. elizabeth: we'll stay on the story for sure. "the washington post" and "the new york times" reporting that story about the covid czar. the allegations are serious. i mean new york is one of the worst-run states in the country and one of the worst hit by covid. if we have time, i don't know if we have time to watch governor cuomo topspin and manipulate the new york state press conferences at the beginning of the pandemic which he won an emmy.

this is insidious stuff when you watch cuomo's rhetoric. take a listen. >> look, whether a person died in the hospital or died in a nursing home, it's, the people died. people died. if you look at new york state we have a lower percentage of deaths in nursing homes than other states. new york state, we're only about 28% only but we're below the national average in number of deaths in nursing homes but who cares? 33, 28, died in a hospital, died in a nursing home, they died. >> okay. this is prima facia evidence of being self-incriminating. at that time he and his team were knocking out-of-state reports nursing home residents who died in hospitals.

who cares? the cdc cares. health scientists care. they needed to track where the virus was going assemblyman. new york was a gateway for virus to other states. that is why you care. your reaction? >> to add to that, these numbers he had available at summer of last year, we just passed an extensive nursing home reform package. had we been able to get the numbers, the data we requested, he repeatedly ignored us,ing no in order any oversight he is trying to explain why it is not important t was important. perhaps the legislative changes and policy changes we made a few weeks ago could have saved lives if we made them eight months ago. that is the part he is not talking about. he just picks and chooses, disconnected from reality. elizabeth: 15,000 people dead in new york state nursing homes this is a tragedy of national proportions. new york state assemblyman, angelo santa barbara we'll have you back on.

network. we're coming into the bottom of the hour. former president trump made an appearance at a campaign event for sarah huckabee sanders over the weekend. sanders intends to run for governor of arkansas, a position her father held in the late 90s, early 2000s. let's welcome back to the show, north dakota senator kevin cramer. senator, so good to see you again. senator, can we get your quick reaction to "the washington post" running a blockbuster correction. basically president trump never said to the georgia state election, officialing, find the fraud. he said there is dishonesty there. this was used at impeachment proceedings statement, against president trump, a georgia state investigation into trump. your reaction on this correction? >> well good for "the washington post" but it is awfully late. avoid the mistakes by doing a little bit of investigative reporting. "the washington post" is famous in this time jumping first

before they do background checks, research, verification. this happened to donald trump multiple times as we know over the course of four years. in fact "the washington post," "new york times," others were largely embarrassed by donald trump getting elected. they seemed to spent four years trying to undo it or delegitimatize it this is one more time they took a leap without checking out the facts. donald trump was proven right again. shame on "the washington post" for doing it in the first place but at least they did print the retraction. elizabeth: seems that the audio recording was found in a georgia state official's trash bin on their desktop. the audio recording, the proof is out there. there will be major fallout on this. let's move on this story. what was your reaction when you heard florida governor desantis biden's threat to reinstate covid-19 lock down restrictions if americans don't follow the ruse, governor desantis said that is insane. what is your reaction to that? >> i agree with governor

desantis. quite honestly i'm plexed by this administration desire to keep this pandemic going. we spent the last year plus trying to get rid of the pandemic. they seem to be elong gating it. they want to spread the misery. there is pent-up anxiety among the american public especially as we head into spring and summer now. people want too get out, do things they do in the summertime. now governor desantis knows far better than anybody in washington, d.c. whether florida is ready to be open, i trust his judgment and i hope people get on airplanes to go to florida. i know i'm going to. elizabeth: okay. maybe we'll see you there. there has been restrictions have either been lifted or dialed back in 40 states. governor desantis basically really tore into biden on this. let's take a listen to governor desantis there. watch. >> biden last night said that they may have to impose more lockdown type policies in the future. i can tell you, that ain't

happening in florida. to even contemplate doing any type of lockdown, honestly it is insane. elizabeth: now we have word that president biden wants to raise corporate and individual taxes, income tax rates to the estate tax is going to go up. he will hit limited liability companies and their tax cuts and more as he is talking about more lockdowns. looking ahead to 2024, how is this going to stack up? >> well, so, it is really easy, frankly, if he want wants to do something good for the economy, get the vaccines out, thank you president trump for getting vaccines out f he does nothing but let governors reopen, he will have a six plus grows domestic product growth over the course of the next year. i don't know why he wants to ruin all of that with higher taxes, more shutdowns. i'm astounded by the notion that

somehow one person in washington, d.c., taking advice from one other person in washington, d.c., knows what is good for the economy state by state. they forgot the united states is 50 sovereign states and the federal government a creation of them, not the other way around. elizabeth: so you're talking biden is taking advice from nancy pelosi is that it? nancy pelosi, maybe a little too much from anthony fauci. i was a little astounded yesterday when fauci, when fauci suggested donald trump should tell all of his supporters to get vaccines because clearly they take orders from donald trump. absolutely zero respect from the fact conservatives are naturally suspect of group think. they are individuals. we think for ourselves f they have want to get a vaccine they get one, if they don't they won't. i'm talking about this lockdown mind-set in washington, d.c., should not be spread throughout the rest of the country. hopefully the rest of the country can have a greater influence on affairs of

♪. elizabeth: let's welcome back to the show former trump deputy national security advisor kt mcfarland. kt is the author of the terrific book revolution, trump, washington and we the people. first, kt this, statement factored big in impeachment and also the georgia state election probe into donald trump. your take on "the washington post" correcting their story that turns out trump never said to that election official in georgia, find the voter fraud, find the fraud. never said it. he said there is dishonesty there. what happens next? >> well i think, here is a curious thing, liz, why did "the washington post" admit and confess that they had made a mistake? my guess is that the file that was found, this is the "washington post" being a boy scout, being boy scouts magnanimous and decent. this is "washington post," somebody had the goods on them, they had to come out ahead of the story, it was honest mistake, don't worry about us.

>> completely expected, excuse me. this is the kind of thing that has been going on in portland for years and years and years, for much of the west coast, especially places like seattle. in portland antifa has been threatening parades, threatening the mayor, threatening the police force for years with little crack down. ones the defund the police movement came around last summer and the city council abandoned any responsibility to the community and followed that, it only got worse. since joe biden has been elected president things seem like they possibly calmed down for just a moment but not for anarchists. they're not satisfied with a democrat in office. last week we saw the mayor had to ask for emergency $2 million to put back in the police budget to crack down on lawlessness. i expect to see reverses in cities across america going forward. elizabeth: do you think the defund the police movement is going to stop under president biden? they even protested against biden on his inauguration day.

have previously or currently have worked for him so making phonecalls like this basically intimidating witnesses in interfering with witnesses is a form of work weighs retaliation and sends a message to people who complain are people whom i complained that they will face retaliation, retribution or public humiliation in their jobs if they pursue this. the law cracks down on us pretty hard. there are sometimes exceptions to these laws but he is acting in a way that would get a ceo a major corporation in america fired if they were doing the same thing in a private setting. this man is out of control. he's not following legal protocols to protect women and workers in general. we aren't even talking about the harassment he is unleashed against lawmakers who questioned him for what he is caused to the vulnerable populations in the state. liz: what we are talking about here is situations that could never take place in the
