"the evening edit" starts right now. ♪. elizabeth: we begin tonight with senator ron johnson. he's the chair of homeland security and multiple other committees. he joined senators at the border last week. senator, we're so glad to see you, to have you on the show. welcome to the show. president biden and his team saying there is no problem at the border. move along. there is no there there. what do you say? >> hello, elizabeth. they're in complete denial. in is the worst crisis i've seen at the border since i took over the chairmanship of homeland governmental affairs. i am no longer chair. because democrats are in charge. what is so sad about this, depressing about this, it didn't

have to happen. after the 2018, 2019 surge president trump got it under control. he put in place the migrant program, the return to mexico policy, ended into agreements with mexico and other central american countries. we pretty well stopped the flow of unaccompanied children and migrant families exploiting our generous asylum laws. then president biden, even though the transition team asked the trump administration what can we do to prevent a border crisis, we said keep the policies in place. first thing that president biden did he dismantled all those programs. this was not only predictable, it is predicted. it is just sad. elizabeth: people are being assaulted. children are getting killed along the way to try to cross illegally. people are being trafficked by the cartels and they're being enslaved by the cartels. we have three out of five americans disapprove of president joe biden's handling of the border crisis. that is according to an ipsos

poll. donald trump plans to go to the border. president biden says he doesn't care what president trump is going to do. what is your reaction to trump going to the border? >> i'm glad he is willing to do it. anybody willing to go to the border, that can bring press with them to highlight the depredations occurring right now is welcome news. the human trafficking element of this has never been fully reported on. it was not reported on in 2014 or 2018 or now currently. i can't even describe some of the things on air that, some of the depredations. it is horrific. a couple of them. for example, when we were in the boats on the rio grande, the people, giving us the tour said one of the traffickers techniques is when they're approached by cpb boats or texas public safety boats, they will literally throw a child overboard into a pretty dangerous river, the rio grande. it has very strong and strange currents. they will throw a child

overboard as diversion so they can complete their mission. the drugs that are flowing through as they are used, using these children and families as a divergence. the sex trafficking, involuntary servitude, it is simply not being recorded properly but, you know, elizabeth, the border is 100% under control on the mexican side. you don't cross without paying traffickers 6 to $10,000 per person. these people don't have the money. how do you think they pay that off? they do it in the sex trade. they do it in the other involuntary servitude. depredations were predicted and predictable and president biden, kamala harris, went forward with the horrible policy anyway. elizabeth: sir, you're giving us information that there seems to be a blockade by the biden administration. they're being much less transparent than the trump administration. it has been blocking the media at the border, doing a gag order. what you're reporting to us is something that the american people are not hearing right

now. illegal crossings generate hundreds if not billions, hundreds of millions, billions of dollars in smuggling revenue for the cartels that control access to the border. so how is it that the biden team can try to get away with trying to do a gag order at the border, including on senators like you? >> the mainstream media is basically in their back pocket. they picked their candidate. did everything they did to suppress the report on hunter biden to make sure job jobe won. the last thing they want to do prove themselves wrong picking the wrong horse. one of the things we revealed in 2018 hearing they actually sell children to people who want to come across so they can come across with a family unit to exploit our laws. we've known this for years this is exactly what president biden is allowing to happen. it is absolutely shameful. but let's face it, they realize a picture is worth a thousand words. why there is so much of an outcry during the 2018-2019

crisis we saw horrific pictures. a two-year-old child drowned in the rio grande. the biden administration is not allowing the press in there so the american people don't see those pictures. 18 u.s. senators, we went down to the donna facility. took pictures. like being in a communist china. i've been there. the communist party has minders with you so you can't take pictures. the same thing we have the vice president or the president biden minders with us, telling us to delete photos. we're a separate branch government. we're doing oversight. the american people need to see this. it was surreal. you felt like you were in communist china. elizabeth: we hear what you're saying. we hear you loud and clear. the biden team keeps sayingth the humane ones. border authority saying no, biden team, you're being inhumane when you have weak border policies as you point out it allows all sorts of depredations, horrific, horrific

was shocking to me because in 2018, 2019, the trump administration was being criticized, taking sometimes seven to 10 days do background checks to try to insure children belonged to those ad h adults before they release them. this administration is bypassing those goals. that cpb to release to family units, or not do dna tests within eight hours. the word came down from the biden administration and cpb, don't issue notices to appear. that takes too much time. now these people are in this country illegally. they're being let into the interior of america. they have no legal obligation to appear before a court to have the asylum claim made this is as close to complete open borders as anybody could possibly imagine. elizabeth: it is out of control. now we have a memo that the biden team is feeling the pressure. it indicates, it is asking for

volunteers from across the government to deploy to the border for up to 120 days. there is that. i want to ask you this how is it republican senators like ted cruz were applied to be blocked by biden staffers to record inside of a migrant facility and indiana mike brown who went to the border friday, one of biden's representatives tried to get them to delete a picture? you are senators. you're allowed oversight. how is that allowed to happen when the biden team officials are allowed to block you guys. >> it felt like you were in communist china. had communist minders trying to bird dog to make sure we do it. we got a lot of pictures out. we didn't listen to them. i asked the minder please stop bothering me. i represent a coequal branch government. i'm down here for oversight. the american people need to see this. go away. senator cruz is smarter, took pictures of the minder. this is totalitarian type of

♪. elizabeth: joining us now fox news contributor jason chaffetz is back with us. he just launched a new podcast. it is called jason in the house. you're in the house tonight. so senator chuck schumer he is pressuring the senate parliamentarian to bend senate rules beyond recognition so democrats can do government spending without any republican votes via budget reconciliation a simple majority. can he get away with that? >> well i don't think so. i will be interested to see how the parliamentarian rules but not to dive too much into the weeds, just so you understand under the normal budget process established back in 1974 you're supposed to have 12 different appropriations bills. they are supposed to be brought up one at a time. any member can offer an amendment. they have only done that once since 1974. so the process is broken and what pelosi and schumer are trying to do is change the rules of how reconciliation works so that they can power through a bill with only 51 votes.

normally you need to break a filibuster at 60. so i don't think they can do that. you can do that but once a year. they're trying to do it now twice in a year. that would be very abnormal. elizabeth: so biden is going to announce his 3 trillion-dollar infrastructure bill this week. transportation secretary pete buttigieg is walking back his plan to tax drivers by the mile. that would have slammed the working poor and the middle class in the trucking industry. it has been flat out called out that one of the stupidest ideas people have ever heard because it would require more government satellite tracking of how you, how long you drive in your car. so you know, but now we've got -- listen, the biden team is acting like they have a mandate. they don't. they don't have a majority, a slim majority in the house. don't have a mart jo in the senate. he won by getting tens of thousands of votes in three states. but they're acting like it is okay to ram through trillions of

dollars in spending with zero republican oversight? here come the tax hikes. you know what? they will have to tax the middle class. you can't do it by taxing the upper brackets. that is complete insanity to think that way. >> they have done everything the opposite what they campaign said they were going to do. the first day they did is cut jobs. now they want to raise taxes. they have gone away from border security and built a wall around the capitol that is now dismantled. that is where they decided walls did work around the capitol but don't work on the southern border. they want to raise taxes, not just on the wealthiest 1%. that is just their talking point. when you have pete buttigieg throwing it out there as a test saying every single in this person country will have a raise in their taxes by having it at the gas pump, that is still a raise in taxes. they also, liz, they talk about spending in washington, d.c. as if we don't already spend $4 trillion as the base budget,

75% of which roughly is mandatory programmatic spending. they just keep throwing trillions of dollars at this without a single republican vote and yet joe biden and kamala harris said they would unite the country, bring us together. they have note talked to mitch mcconnell since joe biden became president. elizabeth: you know so now the name of game is to try to ram through more spending and taxes by getting rid of the filibuster by trying to call it racist. biden described it as a jim crow relic when biden defended it, used it for four decades. so did senator barack obama. democrats used it more than 300 times last year. republicans only used it once. democrats used it to filibuster senator tim scott police reform bill. somehow they're trying to get the moral high ground trying to convince the media and the country that the filibuster been around for decades is racist. this is shameless, this is

shameless activity on part of democrats and they're fast losing credibility. what do you say? >> i think you're absolutely 110%. they totally flipped when they suddenly, democrats are in charge. chuck schumer has the gavel, guess what? whole another set of rules. rewrite history and put a whole new perspective on it but what they promised, what they said they were going to work with republicans and they have not even done so. literally have not even picked up the phone to even have a simple meeting with them. but to try to use this little process called, overcoming the filibuster, every single time they go, they use this tactic what i call disaster liberalism, what do they do? they try to call you a racist. that is the only card they can play. you're racist if you don't follow our lead. elizabeth: that is pathetic. it is juvenile, immature and pathetic and it is not what the u.s. taxpayer deserves in the way of legislative activity or rhetoric. jason chaffetz. good to see you. thanks for joining us. >> thank you.

elizabeth: sure. next up fox news contributor liz peek on a ninth woman, her name is sherry vill, she stepped forward to accuse governor andrew cuomo of also of sexual harrassment, unwanted touching. the new york state attorney general is subpoenaing dozens of cuomo's aides about the sexual harrassment allegations, whether como team tried to intimidate into silence cuomo's accusers. they wouldn't get away with it in the private sector, why would taxpayers allow them to get away with it in government? >> i think it is long overdue. multiple reports indicate you have a culture of corruption in the governor's office and you have have a staff that very much acts like their boss. getting to the bottom of this is critical. there are two investigations going on at the moment. one from the attorney general's office with respect to the sexual harrassment and assault

liz, we love having you back on the show. a ninth woman has come forward accusing governor andrew cuomo, sherry vill, of sexual harrassment. she has a photo. gloria all red is helping her step forward. this woman has been married for 30 years. what is going on with governor cuomo? >> i don't know. is there magic number, does it have to get to 15, or divviesable by five? how many women have to come forward for the world to gnat governor cuomo is a creep and he behaved badly towards so many people employed by him, aides in his office. this is not accidental. come on, this is ground swell of so many people calling out the governor thuggish behavior. people are trying to silence witnesses and people who might come forward, abusive behavior towards people who work for him. it is pretty horrific. but i would say this, liz, in the midst of all of this, let us

not forget the nursing home scandal because to me me as awful as the sexual harrassment tale is, and the that the the be cuomo administration tried to cover up the number of deaths, we cannot lose sight of that. elizabeth: how is cuomo's team allowed to keep their day jobs? they are accused of what would never be allowed in the corporate world, trying to silence cuomo's accusers. the new york ag is looking into that, the top aide melissa der rosa, and rich aaparte intimidating their accusers as they tried to inintimidate and silence the truth about nursing home deaths. you see the same activity, the same behavior happening here with the sexual harrassment allegations. your word on that, liz? >> he thinks he is so powerful. he has been so powerful in new york state.

state county official as pleas for nursing homes in his county while the governor was allegedly giving his covid tests for his mother, brother, sister, and family members. nursing homes couldn't get tests but como and his top allies could? what is going on here? >> stuebe ben county wanted tests for three different nursing homes. they only got supplies for one in the midst of all of this in april of 2020. you had andrew cuomo's family tested by the state at the direction of the governor. it is an amazing thing. chris cuomo, not that old of a guy. he is a cnn host. definitely not the kind of person who is in the dire range here in terms of impacts from the coronavirus. he was getting exclusive access to test people in the state who were in much different situations desperately needed. the only reason for that, because his brother was the governor. the man, the lengths they went to try to keep this covered up.

they used initials. they didn't write full names on the test. they categorized all the people in the cuomo family as specials. they had police escorts, literally gave state troopers the testing supplies, brought them to labs, forced lab workers to work overtime just to get the results for andrew cuomo's family. it is absolutely disgusting a total abdication of the governor's responsibilities to the people of his state who desperately needed his attention and help. elizabeth: yeah. you're right. we're just talking about up state stueben county. they were saying we need tests for nursing homes in our county and they couldn't get the tests. >> yes. elizabeth: we're talking about people exposed to covid-19 because cuomo ordered patients back in. now new york lawmakers tell us all of this will be loaded into the impeachment probe. what is your forecast will happen with the cuomo impeachment probe? >> you know, i'm concerned that it is not, that it doesn't have the fangs.

we heard a story come out a couple weeks ago, yahoo! news obtained a audio of conversation with state legislators. in the conversation they were taking a half measure, launching an impeachment investigation, rather than a full-blown impeachment. what does that mean? the state party, the democrats already signaled cuomo stands accused of all these things, he denied it. time to move on to the people's business. i don't think we're ready to move on. new york shouldn't be ready to move on with a governor so mistreated them. could we survive this? it is possible. governor northam did it in virginia. he is a powerful governor in new york. elizabeth: but nothing liketh. governor northam didn't face, what you know new york governor cuomo is alleged doing. >> that's right. elizabeth: vince, thank you for joining us. we appreciate it. up next, we're excited to have back on former acting director of intelligence ric grenell. republicans slamming the world

available statements that the trump intelligence community leaders were making. we made it perfectly clear that the w.h.o. was not credible. they made incredibly stupid mistakes from the very beginning of covid. and by the way, i spent eight years at the u.n., i can tell you that the chinese are all over u.n. agencies trying to control them, trying to make sure that they are fully ensconessed in the leadership of difficult organizations just in case something happens in, in the world, like with w.h.o. where they can control the message. i'm really surprised that the biden administration is just now realizing this. elizabeth: well the whole world including the u.s. is still at risk with what is going on in china. even a former bill clinton official who served on the national security council told

cbs's "60 minutes" that the investigation in wuhan was flawed. i like your reaction. watch. >> i wouldn't really call what happened now an investigation. it is a essentially, a highly chaperoned, a highly-curated study tour. this group of experts only saw what the chinese government wanted them to see. elizabeth: then you have the lone american scientist, peter dasek, on the w.h.o. saying what were we supposed to do? what you are supposed to do is be an investigator. what do you say to that? >> look, you know philosophically let's drop back for a second. even the u.n. inspectors in iran, they're scientists. they go there to look at open doors and, you know, information that is presented to them. they don't carry guns. i would say, that i tend to agree, what are we thinking when we send doctors into china? the assumption is china is going to be transparent and come forward with information.

that is a really ridiculous assumption. i don't know why we're playing this game. this is the communist party of china. this is what they do when they take technology. they steal data. you know the german intelligence service in europe warns germans before you travel to china you should bring a burner phone because the chinese steal data from you. the whole world understands this. i think that the bigger problem here, liz, is that the biden administration continues to try to look across the table at china and pretend like we've got a partner that has some sort of moral equivalency. look what happened in alaska? the chinese kept insisting on bringing the media in and playing us. this is something that they don't do in their own country but we allowed them to do this in alaska. a couple of days later, after they played us, on our own

american soil, they announced a deal with iran, $400 billion deal because they know that the biden team is weak and not able to stop them. they would have never done this under the trump administration because there would have been immediate penalty. tariffs or something. donald trump knows how to negotiate. what we have right now is that the chinese, the russians, the iranians and others will come. kim jong-un, and others, testing this administration because they know that what he really cares about, what president biden really cares about is some sort of consensus with them or the europeans. the goal is for happy talk. the goal is for everyone to sign off on a statement. the goal is not to make progress or protect the united states people because if it was the goal, then we would have looked across the table in alaska and said, how dare you make these statements? you don't even let your people
